The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Morehead led the salute to the flag. FLAG SALUTE Roll Call: Present: COUNCILMEN BLOXHAM, HOLMES, ROLL CALL MOREHEAD, TAYLOR AND MAYOR BISHOP Absent: NONE Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, CITY TREASURER PUGH, ACTING CITY ENGINEER WELCH, PLANNING DIRECTOR AND BUILDING SUPERIN- TENDENT KALBFLEISCH, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- Mr. Wayne Robertson, Manager of the Chamber of Commerce, on CHAMBER OF COMMERCE behalf of the Chairman of the Chamber of Commerce,presented AWARD TO POLICE to Lieutenant Jack Luoma, representing the Police Department, DEPT. FOR MERITORIUS an award for meritorius service performed by the Baldwin SERVICE PERFORMED Park Police Department resulting in the success of Lucky LUCKY BALDWIN PARK Baldwin Park Days." DAYS Lieutenant Jack Luoma expressed thanks on behalf of the Police Department. 00- City Clerk Balkus presented to Mayor Bishop his five year SERVICE PIN AWARDS service pin and he in turn presented service pins to the FIVE YEARS AND employees with five years and one year of service. ONE YEAR 00- Councilman Morehead stated it was his understanding that RE ORAL COMMUNICATION persons listed under Oral Communications wished to talk ON Z-125 AND AGP-9 on Z-125 and AGP-9 and that Z-125 and AGP-9 could not be discussed by the public at this meeting. He asked for an explanation. City Attorney Flandrick stated that if the people intend CITY ATTORNEY'S to discuss or argue in favor of or against this particular OPINION measure it would in the nature of evidence; that it was his belief that if the Council heard these people not having set the matter for an additional public hearing and the relative merits and disadvantages of the particular zone change were discussed and the Council thereafter adopted the ordinance granting the zone change, and if the ordinance were attacked in a court of law there was a possibility that the court might declare the ordinance invalid on the grounds that the Council did not follow the procedure set forth In the City's Code and the State law in that they were taking evidence which was not pre- sented to Council at a public hearing; that if the Coun- cil heard these people any action Council took with reference to the zone change case, whether it was granted or denied, would be placed in jeopardy. Mr. James Q. Gibson, 13268 East Francisquito, Baldwin Park, asked if the evidence heard by the Council tonight could be considered just reason for reopening the public hearing rather than to act as evidence. He asked if there were enough presentation and evidence didn't the City Attorney think that it would be entirely within the Council's rights and jurisdiction to reopen the public hearing. Mayor Bishop stated and the City Attorney concurred that the public hearing could be reopened by vote of the Council. Discussion of dates when the additional public hearing could be held wherein City Clerk Balkus stated that May I, 1963 would be the earliest date possible. COUNCILMAN MOREHEAD MOVED THAT THE CITY CLERK BE INSTRUCTED MOTION MADE TO TO PREPARE NECESSARY PUBLICATION FOR PUBLIC HEARING ON REOPEN Z-125 MAY I, 1963 IN REGARD TO ZONE CASE NO. Z-125. Councilman Morehead stated his reason for making a motion to have an additional hearing was that he had evidence that had direct bearing on the subject zone case that had not been presented. The motion died for lack of a second. MOTION DIED FOR LACK OF SECOND Councilman Holmes stated that the matter had been before the Planning Commission and City Council several times in the past several months; that any person desiring to be heard had had an opportunity to be heard. He brought out the length of time and publication costs involved for public hearings. City Attorney Flandrick stated that in the Council's COMMENT BY CITY deliberation any Council member would have an opportunity ATTY. FLANDRICK to make comments for or against the proposed change. COUNCILMAN MOREHEAD MOVED THAT A PUBLIC HEARING BE ORDERED MOTION MADE FOR A CERTAIN DATE, SAY MAY 1, 1963 FOR Z-I25. The motion died for lack of a second. MOTION DIED FOR LACK OF SECOND 00- 1' 4 4e City Clerk Balkus administered the oath to those in the OATH ADMINISTERED audience desiring to be heard during the meeting. BY CITY CLERK 00- Mr. Douglas 1N. Asquith, 13138 Judith, Baldwin Park, asked DOUGLAS W. ASQUITH, whether he could talk on the subject of good government; 13138 Judith, B.Pk. that it would border possibly on Z-125 with other subjects mixed in. City Attorney Flandrick stated yes as long as it was not evidence on Z-125. Mayor Bishop asked the City Attorney to interrupt the oral communication at any time any statement was out of order. Mr. Asquith stated he found it better to circle around the business district because of the traffic light system. He discussed storm drain and street improvement work that had been done in various parts of the City, the expense of the repair work to the auditorium and Master Plan designations. City Clerk Balkus stated that the required publication had been accomplished. At the request of Mayor Bishop, City Clerk Balkus read Ordinance No. 261 by title as follows: ORDINANCE NO. 261 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMEND- ING SEC's 1 ON 5!09 OF THE BALDN IN PARK MUNICIPAL CODE, ADOPTING THE PUBLIC HEALTH CODE OF THE COUNTY OF LOS ANGELES" BEING ORDINANCE NO. 7583 OF SAID COUNTY, ENTITLED AN ORDINANCE ADOPTING A HEALTH CODE" As there was no one in the audience desiring to speak either in behalf of or in opposition to the proposal, Mayor Bishop declared the public hearing closed. Mayor Bishop announced also that the public hearing on Z-150 would be held at this time which was an applica- tion submitted by Fred L. White requesting a change of zone from A-I light agricultural) to C-2 General Commercial) for the southwest corner of Ohio Street and Maine Avenue, legally described as all of Lot 17 of the Revised Map of Vineland of Azusa, in the City of Baldwin Park. Planning Director Kalbfleisch presented a resume of the cases and stated that the Planning Commission recommended approval of AGP-10 and Z-150. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN MAYOR BISHOP. BEHALF Mr. Fred L. White, 3820 East Colorado Boulevard, Pasadena, FRED L. WHITE, stated in his opinion this type of commercial development 3820 E. Colorado was needed in northern Baldwin Park; that he was aware of Blvd., Pasadena the proposed shopping center in the area of Olive and Maine. He showed a map of the proposed shopping center pointing out the parking area and separated delivery area in the back which he stated would be walled in. He stated the development had approximately 94,000 square feet of building area, approximately seven acres of land and that they estimated the anticipated volume of business to be approximately three and one-half to five million dollars each year; that there would be a considerable income from sales tax for the City; that this planned improvement would provide a new type of facility that would be addi- tional strength to the City as far as attracting people who were now going outside of the City to do their shopping. He stated he had secured from the Survey Department statistics showing the average family income per family in Baldwin Park was $6,285.00 a year; that out of that amount approximately 22% was spent in markets each year; that Baldwin Park had a potential food market sale of approximately twelve million dollars, and approximately six to eight million dollars of food business was going outside the City now. He further stated in this size of development the market was the key to the development because it was the market that would attract the shoppers; that he anticipated the market would do approximately two and one-half to three million dollars a year; that the center would not be detrimental to the people living in the area; that the buildings would face into the area. Mr. Jack Cole, 15027 East Howellhurst Drive, Baldwin Park, JACK COLE, stated that he was not physically or financially interested 15027 E. Howellhursf in the zone change; that in his opinion the shopping center Dr., B.Pk. would be good for the City and if it was good for the City it was going to be good for him; that he could see taxable wealth and no children to educate in this seven acres. Mr. Tom Colwick, 3438 North Maine Avenue, Baldwin Park, TOM COLWICK, stated he would like to speak in favor of the zone change; 3438 N. Maine Ave., that he was of the opinion that the community of Baldwin B.Pk. Park as well as themselves should welcome a man that wanted to spend two million dollars in our community and asked that the Council grant the zone change. TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY TESTIMONY IN MAYOR EW SHOP. OPPOSITION As there was no one else in the audience desiring to speak PUBLIC HEARING either in behalf of or in opposition to AGP-10 or Z-150, DECLARED CLOSED Mayor Bishop declared the public hearings cooed. AGP-10 AND Z-150 Discussion regarding the zoning In the surrounding area. Councilman Holmes stated he would like to have time to review and study the facts and figures; that there had not been a precise plan presented; that previously this area had been studied and the surveys made at that time in- dicated that it would not be self-supporting for a large investment shopping center but it did appear that a hospi- tal was needed. The hospital plan did not materialize be- cause the sewers were not forthcoming fast enough. Discussion of the location of the eight shopping centers in Azusa. Councilman Holmes asked 1f Mr. White was fully are of the magnitude of the development going in less than one- half mile south of there; that it appeared to him these developers might be talking about the same amount of potential money; that this area would not be convenient for the people in the southwest part of town. At the request of Mayor Bishop, City Clerk Balkus read RES. NO. 63-40 Resolution No. 63-40 by title as follows: AMENDING GENERAL PLAN OF SAID CITY RESOLUTION NO. 63-40 AGP-10) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDNIN PARK AMENDING THE GENERAL PLAN OF SAID CITY AGP-10)" COUNCILMAN MOREHEAD MOVED THAT THE PUBLIC HEARING ON AGP-JO MOTION MADE AND BE REOPENED. COUNCILMAN BLOXHAM SECONDED. There were no CARRIED THAT PUB. objections, the motion carried and was so ordered by Mayor HEARING ON AGP-10 Bishop. BE REOPENED Councilman Morehead asked Mr. White if it was possible that the area from the proposed area south to Scott and the area in the rear to the next street could be developed later. Mr. White stated he had no options on the area Councilman Morehead mentioned; that the project excluded the Scott property; that they had thought of including the Scott property but this Increased their investment cost too much land cost). He stated that he did not have any firm committments on the proposed shopping center at this time; that they had a program of possibly having all the stores under one roof. Mr. White said no; that, in his opinion, he could not deter- mine the final plan of building until the triple A" teases were secured; that he felt the market should be in the corner to draw the people all the way past the stores; that some of the market chains might not want to be in the back or they might want a change in the size of the stores, In answer to questioning by Councilman Holmes Mr. White stated he was very much aware of the shopping center going In approximately one-half mile to the south; that in past experience when a market was built across the street from an existing market the existing market did more business than previously and both markets did more business. Councilwoman Taylor asked If there was a possibility of a large department store in this center. Mr White stated no. Discussion concerning a shopping center in Fontana that went in one-half mile from another one and every store was vacant. Discussion followed regarding the parking area if the store was under one roof. Councilman Holmes stated his reason for abstention was that he had not been able to give as much thought to the proposal as he would like to; that he thought it was a good idea but he was not ready to make a final decision. Waco St., shown on the Master Plan as manufacturing; that there was B.Pk. very little manufacturing property left in the City; that there would be grave danger for children to live in this area high tension wires); that there would be an immediate need for additional schools; that the City needed that land to bring tax money; that as soon as sewers were installed manufacturers would be enticed to this area. 00- Mr. James Q. Gibson, 13268 Francisquito Avenue, Baldwin JAMES Q. GIBSON, Park stated that his subject was to have been the Pickering 13268 Francisquito development, however in view of the advice of the City Ave., B.Pk. Attorney, although he was not relinquishing his right to speak on any subject, he was declining to speak on this subject because he did not want to, in any way, jeopardize any future ruling or decision by the Council by presenting evidence at this time. He stated it was not only his hope but his sincere belief that the Council would defer final judgment on this thing" until they had weighed all evidence that was available on the subject; that he felt it was the Council's duty as well as all of the people in Baldwin Park to avail themselves of all information on both sides before arriving at a conclusion; that he had talked with the Council members and since there was no urgency in this natter he thought the matter should be studied more rather than to be decided hastily. 00- City Clerk Balkus presented and read a letter in full from the LETTER FROM R. Watt Construction Company, 16901 SouthWestern WATT CONSTRUCTION Avenue, Gardena, California, dated March 26, 1963, CO., 16901 S. appealing to reverse the City Engineer's decision to Western Ave., Garden repave entire Stichman Avenue because of necessary Calif. connections of sewer, water and gas to service Tract No. 27866 from existing mains located in the paved area APPEAL TO REVERSE of said Stichman Avenue. He stated if patchwork were permitted there would be three cuts for every fifty-two feet of frontage, and that with that many cuts some of the backfills would be bound to fail within approximately one year; that this would ruin the appearance of practically a new street; and that he recommended that they replace the entire street. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE ACTING CITY ENGINEER AND REQUIRE R. A. WATT CONSTRUCTION COMPANY TO COMPLY ITH HIS RECOMMENDATION. COUNCILWOMAN TAYLOR SECONDED. He further stated his figuring indicated the City would have a $9.86 tax rate this year; that taxes on a $14,000.00 home would be approximately $380.00; that the school would receive $186.00 of that; that the cost to educate one child was $400.00; that the difference between $186.00 and $400.00 would come from State Aid; that he had been informed by an official of Pomona that any citizen that came to their town costs them" $31.00; that the Walnut Street School would open approximately January 1964 and according to plans it was already filled as soon as it was opened; that If this tract went in Immediately the school would have to go on double sessions; that another school would be necessary to absorb the children from this proposed tract and an additional site of ten acres would be required for which no vacant land was available; that these proposed homes would completely upset the school planning. Councilman Holmes asked why the sewer existing in Badillo could not be used. Mr. Sade stated that it was part of the same parcel and that it was not going to be developed until the sewers were in; that the storm drain was in the center of the street fourteen 14) feet deep and twelve 12) feet high; that there was only about two and one-half 2#) to three 3) feet between the top of the storm drain and the top of the pavement. Councilman Holmes asked If the flood control district would permit a sewer line to go through the storm drain. Mr. Sade stated, no. Discussion followed. Discussion regarding draining swimming pools wherein it was brought out by Mayor Bishop that there was an Ordinance that permitted drainage of swimming pools. Mr. Sade stated that the project was going to cost approximately 13/4 million dollars; that they did not want to jeopardize the project by installing a system which would not suffice; that Harold Johnson, their engineer, the Nottingham Company, Mr. Welch and Mr. Kalbfleisch had made these recommendations. City Attorney Flandrick stated that this Council sitting as the Administrative Authority had the power to reduce the size of the septic tanks or to eliminate septic tanks should they make the finding that within two years sewers will be installed; that the Council did not have the power to reduce the size and area of the cess pools. Building Superintendent Kalbfleisch stated that one more 5 foot in diameter by 25 foot cess pool would bring the capacity up to 1520 square feet; that the requirement was 1510 square foot. Councilman Bloxham asked for Mr. Kalbfleisch's recommenda- tion. Building Superintendent Kalbfleisch recommended, an addi- tional cess pool and allow the septic tank go in at 5,000 gallons if the Council determined the sewers would go in in two years.
