The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Bloxham led the salute to the flag. Roll Call: Present: COUNCILMEN BLOXHAM, HOLMES, MOREHEAD, TAYLOR AND MAYOR BISHOP Absent: NONE Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, CITY TREASURER PUGH, ACTING CITY ENGINEER WELCH, PLANNING DIRECTOR AND BUILDING SUPERIN- TENDENT KALBFLEISCH, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- Mayor Bishop announced that the first Item would be the reorganization of the Council which he requested. He stated that he was withdrawing his name as Mayor or Mayor pro tern; that he had been Mayor for two years and Mayor pro tem for two years. He thanked his colleagues on the Council for their continued cooperation and stated he appreciated the support of Baldwin Park citizens, who in his opinion had been loyal to the Council as a whole. Mayor Bishop reported on a bill that was before the legis- lature in Sacramento for consideration, AB 2112. He stated that he along with Mr. Nordby and the City Attorney had made several trips to Sacramento to negotiate with Committees and were very fortunate to get the bill through In twelve days without a dissenting vote; that the bill was now on the Governor's desk for his signature; that this bill related to the labor increase on the 1913 Act which had been held up in litigation and that when the bill was signed the City could sign the construction contract for Sewer Dis- trict 61-A-1. In order to proceed with the reorganization of the City Council, Mayor Bishop turned the meeting over to City Clerk Balkus. City Clerk Balkus announced that at this time all of the Council members were on an equal basis, to nominate and I elect, and that voting could be accomplished by roll call or secret ballot. Voting was handled by secret ballot, with Hub H. Bloxham becoming Mayor by a unanimous vote. Mayor Bloxham asked that City Clerk Balkus handle the election of Mayor pro tem. City Clerk Balkus distributed ballots for the election of Mayor pro tem, and the results proved that Donald V. Holmes was elected by a vote of 4-I. Councilman More- head received one vote. COUNCILMAN MOREHEAD MOVED THAT BY UNANIMOUS VOTE COUNCIL- MAN HOLMES IS ELECTED MAYOR PRO TEM. MAYOR BLOXHAM SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. He stated that in his opinion Councilman Bishop did an outstanding job as Mayor. Councilman Holmes added his comments to that of Mayor Bloxham and congratualted Councilman Bishop on the stewardship of his Mayor's job and the amount of work he had accomplished. He mentioned the hard work Council- man Bishop did on getting the sower line extended up Ramona Boulevard two or three years ahead of any consi- dered schedule and congratulated him on a job well done and the support and loyalty he had shown to the Council. Councilwoman Taylor stated she had enjoyed working with Councilman Bishop during his term of office as Mayor and congratulated him on the work accomplished for the Council and the citizens of Baldwin Park. Councilman Morehead stated in his opinion Councilman Bishop had served the City well and it had been a pleasure to be a member of the Council during his term of office. Councilman Bishop expressed his thanks again for the confi- dence and support of the Council members during his term as Mayor and-stated that we" should all support the Mayor, who must be the spokesman for the Council, and get behind the projects to be completed. Newly-elected Mayor Bloxham expressed his thanks for the confidence that the Council had shown in electing him Mayor. Mayor pro tem Holmes thanked the Council for reelecting him Mayor pro tem and stated he would continue to help and cooperate. Mayor Bloxham indicated he would like to turn his appoint- ment as Alternate to the County Sanitation District and Alternate to the League of California Cities over to Councilman Bishop; that all other appointments would re- main as they were. BY CITY CLERK City Clerk Balkus administered the oath to those in the Mr. C. E. Burke, 4080 North Bresee Avenue, Baldwin Park, requested permission to drive his two ton truck to and from work not on truck route) and also to park at the Hancock Service Station at Bresee and Los Angeles. He stated that he had lived in Baldwin Park since 1954; that he had been drivio,g the truck before and'since the streets had been posted; that he had recently been sited by the Police Department for driving on a posted street. I At the request of Councilman Bishop, City Attorney Flandrick explained the truck ordinance to Mr. Burke and stated that the City Council could not make an exception to the ordinance; that they could amend the ordinance. Councilman Morehead stated that In his opinion an amend- ment to the ordinance should be taken under consideration whereby truck owners as of a certain date would be per- mitted to drive their trucks on the posted streets. Bresee Ave., B.Pk, REQUEST TO DRIVE TWO TON' TRUCK TO AND FROM WORK AND TO PARK AT HANCOCK SERVICE STATION AT BRESEE AND LOS ANGELF COUNCILMAN MOREHEAD MOVED THAT THE CITY ATTORNEY BE DIRECTED MOTION MADE TO LOOK INTO THIS ORDINANCE AND SEE WHAT HE CAN COME UP WITH THAT COULD POSSIBLY ALLEVIATE SOME OF THIS HARDSHIP WHICH AT THE PRESENT TIME MR. BURKE IS UNDER. City Attorney Flandrick stated he knew of no reason why the City could not, if they so desired establish an exception in the ordinance permitting individuals who reside within the City to go off the truck routes to go to a place of storage or overnight parking. Discussion followed wherein it was brought out that the zoning ordinance prohibited the parking of trucks over 6,000 pounds except on M" property. Councilman Bishop stated in his opinion the truck ordinance was very good and that no changes should be made. Chief Administrative Officer Nordby stated that he had REPORT BY C.A.O. discussed this problem with Mr. Andrews who operated the NORDBY station at Bresee and Los Angeles; that Mr. Andrews stated he had three customers who could not get to his station because there were no truck routes leading to his station; that there was an amendment to the truck route ordinance in 1962 which provided if the restric- tions placed on certain streets created an undue hard- ship on a trucker he may apply to the City for a permit or an exception, this permit must designate the exact route he could take and only for the purpose indicated on the permit, not as a regular route for hauling merchan- dise; that he suggested to Mr. Andrews that he contact his customers and have them show any undue hardship to the City Engineer; that the City Engineer would take this under advisement and issue or deny a permit; that if the permit were denied the person would have a chance of appeal to the Council. Mr. Burke stated that he had talked with the City Engineer; that the City Engineer stated he would be only allowed to gas up and go back out again which would not help him. Councilman Morehead withdrew his motion. In answer to a question by Councilman Bishop, Mr. Burke stated that he bought gasoline at the station at Bresee and Los Angeles and parked there; that that was as close as he could get to his home with the truck. Discussion followed. Councilman Holmes stated the matter should be taken under consideration and given due consideration; that the sta- tion was established under the County regulations before the City incorporated, as a neighborhood station; that the County regulations also had the same weight limit on Los Angeles Street at that time. Mayor Bloxham stated that this matter would be taken under consideration. 00- Mayor Bloxham announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on a Short Form 1911 Act on Ohio Street. City Clerk Balkus stated that the required postings had been accomplished. As there was no one in the audience desiring to speak either in behalf of or in opposition to the Short Form 1911 Act on Ohio Street, Mayor Bioxham declared the public hearing closed. Howard requesting a change of zone from A-I, P and C-2 to R-3 for property situated at 13310 and 13312 Ramona Boulevard, legally described as Lot 18, Tract 8805, except the easterly 400 feet thereof, the westerly 21 feet of Lot 23 and all of Lot 24, Tract No. 8805. City Clerk Balkus stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission recommended approval of the zone change. As there was no one in the audience desiring to speak in behalf of the request TESTIMONY IN OPPOSITION TO THE RE- QUEST WAS CALLED FOR BY MAYOR BLOXHAM. Mr. Charles H. Brown, 13238 East Ramona Boulevard, Baldwin Park, stated he thought the zoning should remain C-2; that he had talked with property owners in the area and most of them were very much against the proposed zone change; that he had improved his property and Intended to improve it to a greater extent; that he knew of one property owner that wanted to open a cafe. In answer to a question by Councilman Bishop Mr. Brown stated that he thought the front 100 feet should remain C-2. Mrs. Marianne Johnson, 3825 North Foster Avenue, Baldwin Park, stated her property was 75 feet by 400 feet; that in area there was approximately 7 acres of A-i empty land that if all develped at one time it could make a very fine development but spot development would shut off the area for future development of a good type; that there was a street proposed on the Master Plan which would run through I Mr. Stone's property on Earl and cul-de-sac at this property; that if this zone change were granted she could visualize what she called poor development for her property, 10 foot driveway and many houses scattered close together back on a long piece of property; that from Foster to Earl to her knowledge was the largest back piece of property In Baldwin Park and she thought it should be developed as a whole, not in spots. Mrs. John Buchanan, 13244 East Ramona Boulevard, Baldwin Park, stated she felt the zone change would ruin most of the property in this area; that she had developed the back one-half of the property and was keeping the front half for future development; that her property was lo- cated in the center of the block. Mrs. Charles H. Brown, 13238 East Ramona Boulevard, Baldwin Park stated that in four years their business, Brown and Mendosa Realty, had tripled; that she wanted the zoning to remain C-2. RES. NO. 63-44 ADOPTED PUBLIC HEARING Z-158, REQUESTING CHANGE OF ZONE FROM A-I,P AND C-2 TO R-3, AT 13310 AND 13312 RAMONA BLVD., BILL D. HOWARD, APPLICANT TESTIMONY IN OPPOSITION MRS. CHARLES H. Pinnick, 13334 East Ramona Boulevard, Baldwin Park, stated he was protesting because there. were at least four people to his knowledge that did not receive notices; that he understood notices were required to be mailed to property owners within 500 feet of the property. Planning Director Kalbfleisch presented a map showing persons that were mailed notices. He stated that notices were mailed to property owners within 500 feet; that the list of names and addresses were taken from the current County Assessor's Roll. City Clerk Balkus stated that notices were published and required to be mailed to property owners within 300 feet for the Planning Commission hearing; that a public notice in the newspaper and a notice mailed to the applicant was required for the City Council hearing. City Attorney Flandrick stated that he could see no basis for objection; that the Planning Director had certified that mailings were made. April 17, 1963 Page 6 JOSEPH A. PINNICK, 13334 E. Ramona Blvd, B.Pk. RE LEGAL NOTICES Mrs. Robert Hills, 13266 East Ramona Boulevard, Baldwin Park, MRS. ROBT. HILLS, stated she thought the property owners had a right to know 13266 E. Ramona Blvd what would be going in" and asked how the Master Plan B,Pk. was determined. Mayor Bloxham explained the details concerning the process- ing of a zone change and Councilman Holmes explained how the Master Plan came Into being and stated that it was a guide only and did not change the zone. Mr. Robert Hills, 13266 East Ramona Boulevard, Baldwin ROBERT HILLS, Park, stated the zone change would not help his invest- 13266 E. Ramona Blvd ment in the property; that Ramona Boulevard was a truck B.Pk, route which would lend more to commercial development, especially if an off ramp to the proposed freeway was approved for Ramona Boulevard. TESTIMONY IN FAVOR OF THE REQUEST WAS AGAIN CALLED FOR TESTIMONY IN FAVOR BY MAYOR BLOXHAM. Mr. Bill Howard, 4960 Cutler, Baldwin Park, stated that BILL HONARD, he did not believe apartments would hurt the real estate 4960 Cutler, B.Pk. business; that it would not be affecting anyone with commercial property; that apartments would not hurt small businesses; that someone had said there was a street coming in from Earl; that he had built two houses on Earl and there had been no dedication required; that there would be thirty-four 34) units with a twenty-one foot driveway down the side; that some of the property in this area was being used for R-3 even though zoned for commer- cial use. Councilman Bishop stated that he would abstain from voting on this zone change; that in his opinion this would be detrimental to the community as a whole; that this was as much a business district as any location in Baldwin Park as there was one-half mile of continuous C-2 property. As there was no one else In the audience desiring to speak PUBLIC HEARING either in behalf of or in opposition to Z-158, Mayor DECLARED CLOSED Bloxham declared the public hearing closed. Z-158 Councilman Holmes recommended that the matter be continued so that the property owners, developers and the Planning Commission could work on the project; that the zone change application should be held or continued in such a manner so that additional properties could be added and no additional filing fees would be required; that studies should be made on the enighborhood as a whole. COUNCILWOMAN TAYLOR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. Mr. Bob Lloyd, 820 Maryland Way, Covina, stated he was with Baldwin Park Realty and represented both buyer and seller on this property; that It was in escrow and would not be fair to the seller to hold this matter over; that this would have been a much larger development for multiple units if additional properties could have been put together; that the property to the west was being used a great deal for multiple units at this time. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-158, Mayor Bloxham declared the public hearing closed. Councilman Holmes commented that the property owners ndi- catedthat they want to develop; that there had to be cooperation so that good developments would materialize. COUNCILMAN HOLMES MOVED THAT THIS CASE BE HELD AND THAT THE PLANNING COMMISSION BE INSTRUCTED TO INSTIGATE ON ITS OWN MOTION THE ADJOINING AREA TO COME UP FOR A RECOMMENDED ZONING AND THAT THIS MATTER BE EXPEDITED AS RAPIDLY AS POSSIBLE SO AS NOT TO KEEP THIS CASE PENDING FOR THE NEXT NUMBER OF MONTHS. COUNCILMAN MOREHEAD SECONDED. Councilman Bishop stated, In his opinion, the proper development would be to have this all considered at one time with the street In the back and leave the front C-2. Councilman Holmes stated he was sure proper development recortmendations could be worked out Including the street. Mr. Pat Pagent, 4926 Jerry Avenue, Baldwin Park, stated he believed Mr. Pickering had something to do with the Americana Homes; that unless these homes were built better than the Americana Homes, that in five years when the freeway went through they could be torn down and Industry could go in. There was further discussion on the motion made by Council- man Morehead that died for lack of a second. Planning Director Katbfleisch had obtained a map from the Planning Department and at this time went through in detail the zone changes to be accomplished. There were no objections to his explanation. City Attorney Flandrick reported that according to Section 1118 of the Uniform Plumbing Code each case had to be approved-by the Administrative Authority; that the Council was the Administrative Authority; that the Council could consider each case as it came up or designate Mr. Kalb- fleisch as the Administrative Authority.
