The motion died for lack of a second. City Clerk Ba]kus administered the oath to those in the audience desiring to be heard during the meeting. We James Q. Gi1eon, 13268 East Francisgaito, stated he had attended a Council meeting s rox±mately one month ago and at that time the City Attorney, Mr. Flaadrick, advised that if the Council were to consider any testimony regarding Z-125 at that time after the public hearing bad been closed in the event that the Council should choose to reverse their original decision a court could rule that testimony had been considered outside of a public hearing and this reversal could be very well contested in court; that on the strength of this advice from the City Attorney he deliberately refrained that night from speaking and giving testimony that he was prepared to give in opposition to Z-125; that he did so because at that time he still bad hopes that the Council might reconsider and reverse their original decision; h&*-ever that night the Council did not see fit to do so and by a three to two-vote as he recalled instructed the City Attorney to draw up an ordinance; that at the last meeting approximately two weeks ago the ordinance passed its first reading by a three to two vote with Taylor and Morehead dissenting; that tonight he had requested to be under Oral Communica- tions because it was his nature not to throw down his irons and concede victory until the last shot was fired; that he was prepared tonight to cover the arguments that he thought were reasonable against Z-125; that he had availed himself of all possible infornstion on both sides of this question and was still of the same opinion, opposed to it; that he wancted-togo on record as not giving up or laying down ikons until the last shot was fired; that in his opinion, if the ordinance passed second reading the last shot will have been fired but it could very well ricochet. 00- City Clerk Balkus administered the Oath of;Office•to Patrolman James Crawford. 00- City Clerk Balkus presented a petition for a stop sign to be installed at the corner of Nubia and La Rica Streets. Acting City Engineer Welch stated that the Traffic Committee had considered this problem at their meeting on Monday; that the situation at this intersection had been studied by the Police Department; that the Traffic Committee unanimously recommended that a atop sign be placed at this intersection on Nubia Street making a two way stop on Nubia, an east and vest street. Councilman Holmes stated in his opinion, a four way stop should have been recommended; that Is Rica was an exceptionally long street without any through streets until Nubia and had a number of intersections that were only one way coming onto La Rica south of this intersection. may 1, 1963 Page 2 MOTION MADE MOTION DIED OATH A-1=1127 1111121 JAMS Q. Councilman Holmes stated that the southeast corner was an exceptionally blind eorrier. COUNCILMAN HOLD MOVED THAT STOP SIGNS BE INSTALLED ON ALL FOUR 4) WAYS OF TIE INTERSECTION OF NUBIA AND LA RICA COUNCILWOMAN TAY1/ R SECONDED. Discussion followed wherein Councilman Holmes also brought out that there was a new tract being moved into and the children would be crossing this intersection going to the Margaret Heath School. COUNCILMAN MOREHEAD MOVED THAT THE MAIN MOTION BE AMENDED TO I +'LETE THE STOP SIGNS ON LA RICA AND THE CITY COUNCIL CONCUR WITH THE RECOMM.ONDATION OF THE CITY ENGINEER AND THE SAFETY CO} 4ITTEE, UNTIL SUCH TIME AS THE STOP SIGNS ARE WARRANTED. COUNCILMAN BISHOP SECONDED. COUNCILMAN BISHOP MOVED THAT THE REQUEST BY THE AMERICAN LITTLE LEAGUE TO HOLD A BREAKFAST IN THE FOOD GIANT PARKING LOT BE BROUGHT ON THE AGENDA. COUNCILWOMAN TAYLOR SECONDED. There were no objections, the motion carried end was so ordered by Mayor Bloxham. City Attorney Flandrick stated that technically this would constitute a violation of the Zoning Ordinance; that it would appear to him that,a charitable and religious type activity on a one or two day basis was not a full use of land in violation of the Zoning Ordinance and he could see no problem in permitting it; that it was a matter of practice and up to the Council. COUNCILMAN BISHOP MOVED THAT THE AMERICAN LITTLE IEAGUE BE PERMITTED TO HOLD A B16WAST IN TIM FOOD GIANT PARKING LOT ON MAY 25, 1963. COUNCILMAN MOLD SECONIED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus announced that it was the time and place fixed for a public hearing on Z-160, an application sub- mitted by Leon Wynkoop requesting a change of zone from A-1 light agricultural) to R-1 single family residential) for property situated at 4023 Center Street. City Clerk Balkus stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission recommended approval of the zone change. As there was no one in the audience desiring to speak either in behalf of or in opposition to Z-160, Mayor Bloxham declared the public hearing closed. A. Watt Construction Company request- ing a change of zone from A-1 light agricultural) to R-1 single family residential) for property situated at the intersection of Stichman Avenue and Durness Street running length of the existing Stichman Avenue and buffered by the Big Dalton Wash. City Clerk Balkus stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission recommended approval of the zone change. As there was no one in the audience desiring to speak either in behalf of or in opposition to Z-261, Mayor Bloxham declared the public hearing closed. Planning Director Kalbfleisch read Section 9121.9 Sub- section 2 of the Zoning Ordinance wherein City Attorney Flandrick stated if this area was not immediately adjacent to a high density area under the definition read a Master Plan Amendment would be required. Further discussion followed wherein City Attorney Flandrick stated if the Council wished to consider nonconforming R-3 as being an existing R-3 zone then an Amendment to the Master Plan would not be required. COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL SEND THIS BACK TO THE PLANNING COMMISSION WITH IIBT1JCTIONE FOR THEM TO HOLD A PUBLIC HEARING ON THE AGP THAT THE PUBLIC HEARING ON Z-162 BE HELD IN ABEYANCE). COUNCIL- MAN HOLMES SECONDED. Further discussion followed as to whether this zone change could be approved at this time wherein City Attorney Flandrick stated the Council could make the finding that the phrase existing R-3 zone" means either a lawful R-3 zone or an existing nonconforming R-3 zone and then this zone change could be approved without a public hearing for the amendment to the Master Plan for this particular case. Planning Director Kalbfleisch stated that the adjacent area was zoned R-3 but it was nonconforming as per Master Plan. City Attorney Flandrick stated in this case there was no problem. K. Agajanian requesting a change of zone from A-1 to C-1 for property-iitu ted at 14487 Merced Avenue. City Clerk Balkus stated that the required publication had been accomplished; that this case had been published A-1 to C-3 in accordance with the original request but C-1 being a more restrictive use the publication was legal. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission recommended approval of the zone change from A-1 to C-i. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR BLOXHAM. Mr. Art Agajanian, 1234 Loara Street, Anaheim, stated his original request was for C-3; that the reason for this was that the normal zoning for a service station which was the proposed use was C-3; that at the time the service station across the street was constructed C-1 was permitted at this time; that the only reason C-3 was requested was because of the City's require- ments. As there was no one else in the audience desiring to either in behalf of or in opposition to Z-164, Mayor Bloxham declared the public bearing closed. speak Councilman Bishop stated that the City Attorney should be instructed to prepare an amendment to the Zoning Ordinance deleting the responsibility of.the use permits from the Planning Commission and return it to the govern- ing body. City Attorney Flandrick stated this was being worked on at the present time. City Clerk Balkus brought out that Page 17 of the April 3, 1963 minutes instructed the Planning Commission and the City Attorney to study the sections and eliminate the ambiguity and come up with their recommendations for a proper amendment that all variances come before the City Council for a public hearing to make a final deci- sion. Discussion followed that this should not be hold up because of the Zoning Ordinance amgndment being pro- cessed; that this matter had been before the Council on previous occasions; that no new evidence had been introduced. Mr. Robertson, Manager of the Chamber of ComIDerce, stated there were two possible sites; one that bad been used formerly next to Littlejohn's Dairy, but the liability was greater there in view of the fact that there was mobility to get in and out and also hazard of live stock within two hundred fifty feet of where you would be dumping and burning and two haystacks; that the other alternative was Mr. Sweitserss property and that it was proposed that the dumping of only combustibles at the westerly most border of Baldwin Park which would be the center of where Center Street would intersect that property if it did; that this location would be 1320 feet from the nearest home. Discussion followed regarding the area north of the power line just below Live Oak and westerly of the power line on out towards Rivergrade extension of Olive). Mr. Robertson stated that tentatively the dates bad been set for May 11-12 and May 25-26; that W. Schweitzer bad given his permission to have this dumping and burning on any part of the sixty acres be owned; that the charge had been set es $.25 per trailer load and $.50 for a larger load. Mr. Robertson explained that the Associated Student Body of the Sierra Vista Junior High School had come up with volunteers-workers to hang a door sign on'overy house in Baldwin Park; and that they would spend $100 to get the door hangers printed. Further discussion followed concerning the location, and the City liability and possible expense. Mr. Robertson stated that the Kay Club of Sierra Vista bad asked permission to be used in a project which the Department of Public Works would do; that they wanted to repaint every curb now painted red, green, yellow and white under the supervision of the Depart- ment of Public Works; that he bad consulted the Chamber's insurance broker and they could obtain coverage for this at a minimum, the same coverage they received on the Christmas Decorations. Councilman Holmes reviewed the present policy stating that in order to expedite the improvement of streets that in the R-1 zone and A-i zone since the property owners were paying for the curbs and sidewalks and in some cases a dedication was necessary it had been determined that it would be fair and equitable for the City to make the necessary pavement hookup; that in the commercial and R-3 type of development it would not be fair and equitable for the City to do this; that the developers would pay for it because they were the prime benefactors for this in relation to R-3 and commercial development; that in a majority of cases of that type there was not a great deal of dedication involved; that the City Council would take action on any exceptions.
