Roll Call: Present: COUNCILMEN BISHOP, HOLMES, MOREHEAD, TAYLOR AND MAYOR BLOXHAM Absent: NONE Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, CITY TREASURER PUGH, ASSISTANT CITY ENGINEER WELCH, PLANNING DIRECTOR AND BUILDING SUPERIN- TENDENT KALBFLEISCH, ASSISTANT PLANNING DIRECTOR NELSON, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- COUNCILMAN BISHOP MOVED THAT THE MINUTES OF APRIL 17, 1963, AND MAY 28, 1963, BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN HOLMES SECONDED. There were no objec- tions, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus presented and read in full a letter from the Baldwin Park Improvement Association, Incorporated, dated June 10, 1963, regarding their interest in the completion of curbs and gutters to align City streets. There was NO ACTION REQUIRED. 00- City Clerk Balkus read in full a letter from C. S. Lovett, Pastor, Personal Christianity Chapel, dated June 14, 1963, regarding an extension of time concerning CP-II. City Attorney Flandrick stated under Section 9120.41 of the Municipal Code this matter should be referred to the Planning Commission; that the Planning Commission could grant an extension if they felt there was just cause. COUNCILMAN HOLMES MOVED THAT THE REQUEST OF MR. C. S. LOVETT BE REFERRED TO THE PLANNING COMMISSION FOR PROPER PROCESSING. COUNCILWOMAN TAYLOR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus presented a letter from J. Gordon McNulty dated June 14, 1963 regarding CP-8. City Attorney Flandrick stated this matter was an appeal from the decision of the Planning Commission and should be set for public hearing before the Council. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, MOREHEAD, BISHOP, TAYLOR AND MAYOR BLOXHAM NOES NONE ABSENT: NONE 00- City Attorney Flandrick reviewed his memorandum regarding Superior Court Case entitled Igna vs. City of Baldwin Park and State of California, Department of Industrial Relations, Division of Public Housing; that the proposed action was to authorize the City Attorney to appear and defend on behalf of the City the above-captioned action. COUNCILMAN MOREHEAD MOVED THAT THE CITY ATTORNEY BE AUTHORIZED TO APPEAR AND DEFEND ON BEHALF OF THE CITY THE ABOVE-MENTIONED ACTION. COUNCILMAN BISHOP SECONDED. The motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus presented proposed Resolution Nos. 63-76 63-77. Discussion followed wherein the Council instructed that the date of the election be changed in the Resolution to read August 20, 1963, and that the word Pickering" be deleted from the ballot wording and from this resolution in the places as outlined by the City Attorney. Discussion followed wherein it was brought out by Councilman Holmes that a provision should be made for them to pick up dead animals; that the manager had indicated this would be part of the services. City Attorney Flandrick stated that this third agreement incorporated the provisions of the agreement the City now had along with the provisions of the amended agreement that the Council had approved; that he suggested if the Council wished that the Mayor and City Clerk be authorized to execute this agreement with the thirty 30) day termination clause as the Council had previously requested. COUNCILMAN BISHOP MOVED THAT THIS MATTER BE HELD OVER. COUNCILMAN HOLMES SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. Chief Administrative Officer Nordby reviewed his report concerning the Actuarial Study Requisition Police Retirement Program) which stated that the approximate cost was $35.00 for having a precise survey and report conducted which would establish the cost of entering the State Retirement System; that such a study did not, of course, commit the City in any way except to provide the necessary basic information; that he recommended that the Council consider and approve this requisition.
