There were no objections, the motion carried and was so ordered by Mayor Bloxham. Chief Administrative Officer Nordby reviewed the request of Mr. James A. Samuelson, Publisher, to circulate a newspaper in the City of Baldwin Park to be called the Baldwin Park Sentinel. He pointed out to the Council Section 4250.1, Section 8), Subparagraph 3 of the Baldwin Park Municipal Code and stated that his opinion in reading this section was that they would need a sub- scription list; that the City Attorney indicated he would review the pertinent Municipal Code Sections and give his opinion to the Council. Mr. James A. Samuelson, 216 North San Jose Avenue, Covina, stated he was the General Partner and Publisher of the Covina Sentinel which to date was printed and published In the City of Covina at 118 West Badillo Street and was distributed in the cities of Covina and West Covina and the community of Charter Oak. He stated that the reason he was here tonight was a possible misinterpretation of information of last week in which they were under the impression that they had to do three or four basic things to be qualified to distribute the Sentinel in Baldwin Park; Continued) UOUNC I L CHAMBER JULY 22, 1963 U$$ 7:00 P.M. SAN JOSE AVE., COVINA, GENERAL PARTNER AND PUBLISHER OF COVtNA SENTINEL BIB] 39561-U01 1963-U02 07-U02 22-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115492-U03 DO116772-U03 C4-U03 MINUTES1-U03 4/22/2008-U04 ROBIN-U04 ADJOURNED-U05 CITY-U06 COUNCIL-U06 1963 07 22 CC MINHÄ—@¸—+d Í«1289 Adjourned Regular Meeting of the Baldwin Park City Council that it seemed now with the general Interpretation of the Anti-Litter Ordinance that apparently an interpretation by the City Council, City Attorney and possibly an amend- ment to the ordinance was needed; that before the Council was a letter which he handed out to the Council letter in official files) that had. been mailed to the merchants of Baldwin Park and there was a petition form that had not been circulated; that they were under the impression they had to obtain a number of names for a subscription list; that this could be anywhere from 300-600 signatures of people who desired delivery of the newspaper to their homes; that as of today they understood they might have to get the home owners signatures; that he and Mr. Sisson, Manager, were at the Council meeting to receive an interpretation of the ordinance; that they had somewhat committed them- selves to an August 1st distribution of the Sentinel; that to date they had fourteen 14) pages of advertising sold. Councilman Holmes asked if he actually maintained sub- scriptions to the newspaper. Mr. Samuelson stated yes, that they started one and one- half years ago with no subscriptions; that to date they had 2,000 subscriptions In Covina and had never had an organized subscription, campaign; that the cost of the news- paper was $4.50 per year for fifty-two 52) publications; that it was distributed once a week on Thursday. Mayor Bioxham asked Mr. Samuelson if he had any subscrip- tions in Baldwin Park. Mr. Samuelson stated yes, probably thirty.'(30) to fifty 50) in Baldwin Park; that the highest number of subscrip- tions of any weekly in the San Gabriel Valley was 4400 paid subscriptions; that the Sentinel had over 2,000 voluntary subscriptions in one year; that the paper would be conducted as a separate unit and not a replate or pickup from the Covina paper; that as he stated In his letter the only pickup would be standing features of the Sentinel; that they would not have Charter Oak and Covina news; that they intended to give Baldwin Park a true Baldwin Park newspaper. Councilman Holmes asked how the newspaper would be distributed. Mr. Samuelson answered that they intended to come in with a professional distributor, Dependable Distributors, to begin with; that Mickey Trainer, owner of Dependable Distirbutors, used basically the same crew each week. Councilman Holmes asked If he maintained wire service. Mr. Samuelson stated no that they had a telephone contact with CNS. COUNCILMAN HOLMES MOVED THAT THIS MATTER BE REFERRED TO THE CITY ATTORNEY AND THE CHIEF ADMINISTRATIVE OFFICER TO COME UP WITH A REPORT AND RECOMMENDATION FORTHWITH; THAT THIS COUNCIL CAN, IF NECESSARY, MEET IN A SHORT SPECIAL MEETING OR AN ADJOURNED MEETING AND WOULD THEN BE IN A POSITION TO GIVE THESE GENTLEMEN A GOOD CLEAR CUT POLICY SO THAT THEY WILL NOT BE WORRYING WHERE THEY STAND, COUNCILMAN BISHOP SECONDED. JULY 24, 1963 00- City Clerk Balkus stated that she hoped to be able to CITY CLERK BALKUS take the rest of the week off; that she would be at home TO BE OUT OF OFFICE and available if required. BUT AT HOME AND AVAILABLE IF REQUIREI The Council indicated they had no objection. 00- City Clerk Balkus reminded the Council that there had been two other newspapers that had tried to come to Baldwin Park and they had been required to bring In a subscription list; that one was the El Monte Herald and she believed the other one was the Covina Argus. a check, reveals the name to be Good News Publications, of Covina T.L.B.) Discussion followed. 00- At this time the Council proceeded with their discussion DISC. RE 62-A-I on Sewer District 62-A-1. City Engineer Young stated there were a few ticklish pro- AREA OF VINELAND blems as far as private streets were concerned; that in the BELOW WHITESELL area of Vineland below Whitesell on Virginia it could not ON VIRGINIA be drained back to Whitesell; that part would drain back to Whitesell and the other part would have to be taken down an easement across the Baker property; that he was in the pro- cess of trying to contact Mrs. Baker concerning the property. Discussion followed that Walnut Mutual 17 had the area bounded by Vineland, Whitesell no services on Whitesell) and serviced both sides of Virginia; that from Whitesell to the wash and between Vineland and the freeway the fall could not be reversed on Virginia back to Whitesell; that Mr. Young had tried going down around the wash and coming back up to the wash right of way but there were problems involved; that 1/3 or 1/4 of District No. 2 was sandy. It was decided by the Council that this matter would be held in abeyance until it could be determined if the right of way could be acquired within reason; that if the right of way could not be acquired it would have to be considered for exclusion from the district if building was not possible in any other manner. 00- City Engineer Young discussed the area south of the free- DISC. RE AREA SOUTH way bounded by the railroad track on the east, by the Wash OF FREEWAY BOUNDED on the south, by the City limits Rivergrade) on the west. BY RAILROAD TRACK He stated that the area on the knoll near the theater was ON EAST, WASH ON the approximate area that wanted to withdraw from the SOUTH, CITY LIMITS district; that there were approximately 110-115 homes ON WEST on the knoll; that the lines were quite deep on Frazier, eighteen 18) to nineteen 19) feet; that he was attempting to set up a meeting with the people that wished to with- draw from the district. Councilman Holmes stated if the area basically of Judith, Leorita,and maybe a little portion of Bess,withdrew that would exclude some other people to the east of this area from getting into a sewer district. It was brought out that the subdivision just off by Baldwin Park Boulevard near Bess Avenue would be served by the Bess Avenue line. 00- City Engineer Young stated that he was going to recommend that the district across Westcott include the properties fronting on the west side of Westcott and Garvey; that this presented another problem; that an easement would have to be obtained; that the only way to get the main trunk line down there was to have a ten. 10') foot easement from the power company diagonal across to Westcott; that he had not checked out the ownership of the required easement as yet. 00- Page 4 POSSIBLE EXTENSION OF DISTRICT ACROSS WESTCOTT TO INCLUDE PROPERTIES FRONT- ING ON WEST SIDE OF WESTCOTT AND GARVEY At 8:05 p.m. Councilman Morehead arrived. 8:05 P.M. COUNCILMAN MOREHEAD ARRIVED 00- There was discussion of the location and number of RE LOCATION AND laterals. The Council instructed the Engineer of Work, NUMBER OF LATERALS City Engineer and Assessment Engineer that on this district and any subsequent districts to pay attention to the actual use of the land; not rely entirely on the lots as recorded In determining how many laterals were needed and where they should be; avoid any excess laterals. Councilman Bishop stated he thought there should be an established rule set that any standard lot should have a lateral as long as it was a separate lot. 00- COUNCIL INSTRUCTION Regarding Sheet Nos. I and 2 of the Assessment Map, Council- RE BENBGW, HARLAN, man Holmes asked If there were lines on Benbow and Harlan CENTER and if the area northwest was included in the district now to the City limits. City Engineer Young stated that the back property would only have an acreage charge; that they would and could) be served from Benbow or Harlan with reservations; that the area westerly of LittleJohn's Dairy should be revamped; that to make It usable It should be filled; Benbow would have to come into Center or Harlan. 00- Regarding Sheet No. 8 of the Assessment Map, Councilman RE SHEET NO. 8 Holmes asked concerning Lot 7.ifthe depth of that line OF ASSESSMENT MAP was sufficient to beckflow into Center. City Engineer Young stated he did not think it was; that it was made to drain toward Harlan. 00- In regard to Sheet No. 6 of the Assessment Map, Councilman SHEET NO. 6, ASSESS- Holmes asked how the area west and north was to be served MENT MAP and what was being done about the adjoining Irwindale ADJOINING IRWINDALE property south of Los Angeles Street. He asked if ASSESSMENT MAP it was planned a bring all lot splits out on this; that there were no siubouts shown. Ciiy Engineer Young stated that before construction started they would try to obtain by condemnation) a ten 10) foot construction easement with a five 5) foot permanent easement below Palm connecting to Valley Vista. 00- Regarding Sheet No. 37 of the Assessment Map, Councilman RE IRWINDALE AREA Holmes asked what provisions were made for the Irwindale BALL PARK area where the ball park was. City Engineer Young stated that he had talked with Consolidated Rock and the County and they did not particularly care whether there was any provision to hookup or not; that if they wanted to hookup they could come down and go across underneath the railroad down at Rhodes Lane. 00- Regarding Sheet No. 41 of the Assessment Map, Councilman RE SHEET NO. 41, Holmes asked if the four hundred 400) foot lots could ASSESSMENT MAP be served by Foster with a 2% grade. City Engineer Young answered yes; that there was a County Trunk Line on Foster thirteen 13) feet deep. It was brought out that a sewer line nine 9) feet deep could serve a lot of a depth between 400 and 500 feet. City Engineer Young stated he thought there should be six 6) inch line stubouts to the property line; four 4) inches from the property line back to the house single house); six 6) Inches from the property line back for two houses or more. Assistant City Engineer Welch indicated he would also prefer six 6) Inch laterals on at least a 2% slope to the property line. 00- It was brought out that there were approximately four or PRIVATE STREETS five private streets in 62-A-I. AND ANYONE ELSE THAT IS NEEDED BE IN- STRUCTED TO CON- TACT THE PEOPLE ON PRIVATE STREETS IN DISTRICT NO. 2 62-A-1) AND DETER- MINE IF THEY WISH TO BE INCLUDED AND IF SO THAT THEY GIVE WRITTEN LETTER TO CITY EXPRESSING SUCH DESIRE AND ALSO THAT WITH THAT THEY N- CLUDE NECESSARY EASE- MENTS TO CONSTRUCT SEWER LINE Councilman Holmes stated there was some ground near Ramona and Walnut that was not included in the district RE RAMONA & WALNUT and ask how they were going to get service north of Ramona). Assistant City Engineer Welch stated that they all had frontage on West Ramona Boulevard and there was a trunk line there. Discussion followed regarding reimbursement agreements;' ghat they were marked nil and the individual property affected was the one that was making the reimbursement as they connect up. 00- City Engineer Young stated that he had been notified 1911 ACT LINE IN today that the 1911 Act line in Mac Devitt in West MAC DEVITT IN WEST Covina was now ready for hookup. COVINA NON READY FOR HOOKUP 00- Discussion followed regarding the dedication of undeveloped land for streets and whether the owner would have to pay for the thirty 30) foot to be dedicated for street. For clarification where there is thirty 30) feet dedicated on the back, the area is charged the acreage charge for the entire cost. If there is a large tract of ground, or a deep lot where there is possible dedication in the future, there is an allowance of twenty 20) per cent made in the assessment spread which does allow for future streets, thus eliminating any future reimbursement. 00- Further discussion followed wherein It was brought out BOUNDARY LINES OF that?th'e boundary lines of the district do not in any case DISTRICT DO NOT fall in the center of a street. Avila, 4237 North Center, stated he had a lot on M. AVILA, 4237 N. Center that had a six Inch line and asked if this would Center, B.Pk. be sufficient to take care of seven houses, The area was on the end of a cul-de-sac. City Engineer Young stated that an eight inch line would be put in; that the City had a one foot out lot; that if the street were dedicated Shadylawn) then the lateral could be built up to the property line; that it if were not dedicated the stubout cost would have to be paid by Mr. Avila to the contractor; that where they were consider- ing putting in Y's, there was to be a Y charge as such. Mr. Young indicated he would discuss Mr. Avila's problem with him. Mr. Young further explained that the Assessment Engineer, Laurence Thompson,had established assessments on the basis of so much a running foot, plus laterals, plus acreage. 00- Mayor Bloxham asked If there had been anything found out RE REPORT ON about representation in Sanitation District No. 22. REPRESENTATION IN SANITATION DISTRICT NO. 22 Chief Administrative Officer Nordby stated that Mr. Young had obtained records from the City Clerk's office regard- rg this matter and was going to prepare a map for the City Council on District No. 22. 00- in discussing a possible adjournment date Chief Administra- tive Officer Nordby stated that the City Attorney had stated he would have an amendment to Ordinance No. 198 Anti-Litter Ordinance) by tomorrow afternoon. 00- AT 9:30 P.M.
