The City Council of the City of Baldwin Park met in ad- journed regular session at the above place at 7:00 p.m, Roll Call: Present: COUNCiLMEN BISHOP, HOLMES, ROLL CALL MOREHEAD, TAYLOR AND MAYOR BLOXHAM Absent: CITY ATTORNEY FLANDRICK, CITY TREASURER PUGH, PLANNING DIRECTOR AND BUILDING SUPER- INTENDENT KALBFLEISCH AND CHIEF OF POLICE BEST Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ENGINEER YOUNG, ASSISTANT CITY ENGINEER WELCH, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALKUS 00- As there was to be discussion of Sewer District 62-A-I at ALSO PRESENT the meeting the following were also present: Laurence Thompson, Assessment Engineer Patrick Rosetta, Associate Assessment Engineer James Sims,representing Ivor Lyons and Associates, Construction Engineers Urban J. Schreiner,representing O'Melveny & Myers, Legal Consultants W. R. Kolberg, representing Stone & Youngberg, Financial Consultants 00- Councilman Holmes mentioned that some changes had been made RE MICROPHONES on the speakers in the Council Chamber; that he hoped there COUNCIL CHAMBER would be an improvement and if not that the matter be pur- sued until the job was accomplished. Assistant City Engineer Welch stated that the goose neck swivels on the microphones had been removed; that there were other problems to be checked out. 00- City Clerk Balkus read Resolution No. 63-104 by t4tte as RES. NO. 63-104 follows: AMENDING BUDGET FOR FISCAL YR. RESOLUTION NO. 63-104 1962-63, AS ADOPTED BY RES. NO. 63-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BUDGET FOR THE FISCAL YEAR 1962-63, AS ADOPTED BY RESOLUTION NO. 63-37" Finance Director Duncan explained this was the final amend- ment to the 1962-63 budget; that the auditors had agreed that these adjustments were proper. COUNCILWOMAN TAYLOR MOVED THAT RESOLUTION NO. 63-!04 BE RES. NO. 63-104 APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN HOLMES ADOPTED SECONDED. At this time Mayor Bloxham asked for a report from the REPORT RE 62-A-I legal advisor for Sewer District 62-A-1, Mr. Urban J. Schreiner of O'Melveny & Myers. Mr. Schreiner stated that during the second week of June MR. URBAN J. a meeting was held among the technical advisors, Mr. SCHREINER, O'MELVENY Rosetti, City Attorney Flandrick, Mr. Young and himself; & MYERS that the plans, diagram and assessment roll had been gone over to make sure that the documents were consistent with one another; that the quotation of the easements which would have to be obtained were definitely shown on the plans and would be in such a position on the plans that they could be easily condemned if condemnation were necessary; that at that time It was felt that the Council wanted to have an opportunity to examine the plans and specifications and the other documents that make up the Engineer's Report; that following this examination a further final meeting would have to be held among the technical advisors before the Resolution of Intention could be adopted; that he understood that the Council had had an opportunity individually to go over the plans, diagram and roll to Its own satisfaction; that this being the case they were now in a position to make a final analysis and examination of the materials necessary to adopt the Resolution of Intention and set this matter for hearing. He further stated that he believed that the final meeting could be held within the next two weeks and that the scheduling of these proceedings could take place in approximately three weeks. Councilman Holmes asked for a report from the City Engineer as to what progress had been made on the suggestions and recommendations and various items that were discussed that should be corrected and if these could be accomplished in approximately two weeks. City Engineer Young stated yes; that Mr. Sims of Ivor CITY ENGR. YOUNG Lyons and Associates was ready to come out to the City Hall tomorrow morning to get started on the changes that had been gone over; that it would not take Ivor Lyons very long to make the changes necessary in the specifications. Councilman Holmes brought out that the Council Instructed that there be no loose ends on the language of the agree- ments, contracts, and specifications, for instance as to who was going to do the staking of the grades and inspec- tion; that the Council was to see all specifications, all agreements and all documents before any final action was taken. 00- Councilman Morehead asked if there was any tightening in the specifications for temporary paving in 62-A-I; that the temporary paving on the west side of Maine Avenue in 61-A-I was very poor. August I, 1963 Page 3 CAST IRON PIPE FOR SPEED RING SEAL RE LANGUAGE OF DOCU- MENTS COUNCIL TO SEE ALL DOCUMENTS BEFORE FINAL ACTION TEMPORARY PAVING 61-A-I AND 62-A-I I Councilman Holmes concurred with Mr. Morehead that the temporary paving on Maine Avenue left much to be desired; that temporary jobs could be made so that they were reasonably good until the permanent repair; that it might be well to stipulate this if needed; that this could probably be taken care of in the existing specifications. City Engineer Young stated that he had contacted the con- tractor; that the temporary paving was 3/4 inch from the surface so that when the main surface was put on there would be a better tie in; that tomorrow they were going to start filling them in 61-A-I) with a little finer material in order to take out the bump; that the other three utility trenches Los Angeles and Maine) would be taken care of by the construction company. Discussion followed concerning an agreement. between the utility companies and the contractor concerning the back- fill on trenches. 00- Mr. Schreiner stated with regard to the interpretation of the specifications that Mr. Fiandrick, before he went on vacation, indicated that he wanted to meet with Mr. Young and himself and go over the agreement between the City and Ivor Lyons, the agreement between the City and O'Melveny & Myers and the specifications to make sure that there were no loose ends. He stated that in his opinion August 21, 1963, would be the date on which the Council could adopt the Resolution of Intention and set a time for public hearing; that the hearing would be six 6) weeks later; that Mr. Rosetti and Mr. Thompson had completed their work; that it was a matter of one more meeting among the technical consultants. Councilman Holmes asked that it be made very clear that the estimated assessment that was sent out was only an estimate and based on the estimated costs of the project to give the property owners an idea of what their assess- ments might be. Mr. Laurence Thompson, Assessment Engineer, stated that the notices were required by law; that it had been dis- cussed that on any subsequent projects an information brochure which described the project should be mailed to every property owner within the district telling the details involved in the district and including something about the size of the district, its boundaries, that there would be a public hearing for the people to express themselves, how the assessment could be paid, where it could be paid and what could happen If not paid for. He mentioned gnat he had assembled such a brochure for Costa Mesa and Fountain Valley. The Council asked that two or three of the brochures used in Costa Mesa and Fountain Valley be mailed to the Chief Administrative Officer. Mr. Rosetti, of Laurence Thompson's office, suggested that callers to the City Hall asking questions be informed that there would be someone from the Laurence Thompson's office in the City Hall on scheduled days to answer any questions. 00- Councilman Holmes stated that particular attention should be paid in lining up the assessment and the layout of the laterals; that this should be coordinated between the De- sign Engineer and the Assessment Engineer. City Engineer Young suggested sending out cards to all of the property owners with a diagram asking where they would want latera;s,or walking up and down the streets finding out where the property owners wanted their laterals as was being done in District 61-A-I. Mr. Thompson suggested concentrating the cards on the twenty- five foot lots. Mr. Young stated that to his knowledge there were no twenty- five foot lots in 62-A-I; that there would be in District No. 3. Councilman Holmes stated it was simple enough to get rid of the extra laterals if it was done at the proper-time; that this would require a combination of things, knowledge of the Council, Engineers, of the areas by looking at the maps and at the property physically and by sending out postcards. Mr. Rosetti stated that there had been discussion regarding the postcards; that everyone would have their own idea about how it should be done and there would be delay and administra- tive costs; that the aterals could be deleted if the property owners brought the matter before the Council at the hearing or even just prior to construction. Mr. Schreiner stated in his opinion the easiest and the fairest way would be to include the lateral problem as part of the brochure and explain that it was encumbant upon the property owner to look at the plans and make sure that there were not too many laterals on their piece of property, that it should be explained that it was too time consuming for City forces to contact each owner and have it brought out in the paper that Mr. Thompson and Mr. Rosetti would be at City Hall for people to come in and look at the plans and discuss laterals so that by the time of the hearing there would be a list of laterals that were questionable or should be deleted. Mr. Sims of Ivor Lyons & Associates mentioned that during the design of District No. 2 they had the aerial drawings to assist them in locating the laterals. Discussion followed the procedure for change order wherein Mr. Schreiner brought ou that it was encumbant upon the property owners to come in and notify the City staff of the laterals they did not want. Mr, Thompson stated it could be emphasized in bold type that the mailing was an estimated assessment. Chief Administrative Officer Nordby asked if the publica- tion and distribution of the brochure and informative information was a permissible charge against the district. Councilman Holmes stated that the easement would be part of the distribution system as such; that it was not a part of an individual property line and as such the cost of installing the line was part of the entire district cost. There was further discussion regarding how the property would be assessed wherein Mr. Thompson stated the property would be assessed by front footage on Benbow and BENSON ASSESSED BY an acreage assessment on the back property; that when FRONT FOOTAGE Mr. Baker developed the property he would build his own ACREAGE ASSESSMENT sewer. ON BACK PROPERTY City Engineer Young stated where there were deep lots they would be assessed for about 80% of the area since there was an allowance for street for future develop- ment; that there were three houses on the Baker property; THREE HOUSE LATERALS that each one would get a lateral and there would be an acreage charge on the rest of the property. 00- Council asked about securing a loan on property in 62-A-1. RE LOAN ON PROPERTY 62-A-I Mr. Schreiner stated in the course of preparing property descriptions and making sure they conform to the existing breakdown of property by subdivision the engineer customarily goes to the Title Company to have the descrip- tion checked and at that time the Title Company flags the property as a matter of course showing that they were expected to have alien placed against them in the relatively near future; that it was up to the lender if he wished to reduce the maximum loan amount by the amount of the tentative assessment. 00- UP TO LENDER IF WISH ED TO REDUCE MAXI- MUM LOAN AMT. Assistant City Engineer Welch stated there were existing curbs and gutters at this area; that it was impossible to drain the intersection by surface flow unless several hundred feet of curb and gutter were replaced on Vineland; that the only real soaution was to put in catch basins at Vineland and Merced taking the water to the wash; that an estimated cost of this construction was a little over $10,000.00; that the Intersection could be reworked and keep the water from being more than about three 3) Inches; that the nuisance water now stands about one 1) to two 2) Inches deep and backs up for approximately two hundred 200) feet; that the grade coming down Merced is less than 2/10% slope in that area. In answer to a question by Councilwoman Taylor, Assistant City Engineer Welch stated that a grade something less than 2/10%) was put In coming from Ahern down to this inter- section in order to drain Ahern; that it was delivered to this intersection as high as possible; that it was impossible to drain Ahern and not create the existing condition. Councilman Holmes stated that the Intersection drained before the curbs and gutters were installed; that the deepest part of the water that was now standing was between Ahern and Vineland; that the curb was put in some five to six months ago. In answer to a question by Councilman Holmes, Assistant City Engineer Welch stated that this area would probably never get involved with a bond issue. Councilman Holmes suggested taking up a few inches diagonally across Vineland and Merced and turning the flow into the east side of Vineiand(where there is no curb and gutter. City EhgineerYoung suggested that a more complete study be made. With the consent of the second Councilman Holmes with- drew his motion. He stated that he had received six to eight requests for the use of the auditorium; that he had tentatively set an opening date for the 21st of September, 1963 and that a piano was needed. Assistant City Engineer Welch reviewed his report in detail. He stated that at his recommended rates the auditorium would probably break even and might even lose a little; that he recommended that civic organizations Baldwin Park) should be giv a reduced rate. Mayor Bloxham stated that there should be a bond or an agreement of some kind with all of the organizations renting the auditorium. Assistant City Engineer Welch stated this matter was being discussed with the City Attorney and a recommendation would be brought to the Council. He said that there were several contributing factors; that the speakers were the wrong type; that the microphones were excellent but were the opposite type that should be used in this particular setup; that the Mayor's microphone was bad as far as pickup was concerned and should be replaced. He stated that the recommendation of Mr. Stephens and also himself) was that two new sound column speakers be installed the type that were installed in the auditorium) one on each side facing the the audience, and that the acoustical tile be continued across the room.
