in reguiur session at the above place at 7:30 p.m.
Councilman Bishop led the salute to the flag. FLAG SALUTE

Councilman Morehead questioned Item 2 of the report and asked QUESTIONS BY COUN-
why both $50,000.00 deposits one from Bank of America CILMAN MOREHEAD
and one from Citizens National Bank) were called for and both
redeposited at Bank of America.
Finance Director Duncan explained that they were needed in
the active account and the only active account was at Bank
of America.

Councilman Morehead asked if the deposits between the
two banks were balanced; that it appeared to him that
there were more deposits at Bank.of America.
City Treasurer Pugh stated that the total amount was
fairly equal.
COUNCILMAN BISHOP MOVED THAT THE CITY TREASURER'S
REPORT BE RECEIVED AND FILED. COUNCILMAN MOREHEAD
SECONDED. There were no objections, the motion carried
and was so ordered by Mayor pro tem Holmes.

Mayor pro tem Holmes stated that there had been some
work done on the speaker system in the Council Chamber
and asked for comments from the audience.

Mr. James Q. Gibson, 13268 East Francisquito Boulevard,
Baldwin Park, stated that you could hear better from
the audience than before. He stated that he wished to
talk on double taxation; that he understood that the
agreement with the San Gabriel Valley Humane Society
was that they would perform the duties that had pre-
viously been performed by the Los Angeles County Pound;
that the City was to receive an $.80 rebate on each
license collected in Baldwin Park; that previously it
was possible to take a live or dead animal any time during
the night or day to the Baldwin Park County Pound and it
would be received free of charge; that a friend trying
to dispose of two cats was told that the San Gabriel
Valley Humane Society charged $3.50 each whether they were
picked up or taken to the pound; that a call was made to
the pound approximately 7:00 p.m. one evening telling of
a dying dog and wanting to dispose of it and the caller was
told that the pound was closed until 8:00 a.m. the next
morning and nothing could be done to receive the animal
and suggested that the caller see a veterinarian. He
further stated that it was his opinion that the license
money collected should be used to avail the animal
owners of the City of the privileges that have been
enjoyed with the County Pound; that the people of Baldwin
Park were paying for something they were not receiving;
that they were being taxed double, through no intention
of the City Council.
Mrs. James Q. Gibson commented the audience could not hear
the person at the speaker's microphone.
Councilman Morehead stated that he had met with Mrs. Joan
Coleman, Poundmaster, and Chief Administrative Officer
Nordby in Mr. Nordby's office last Thursday to discuss
the contract; that the contract did not read that there
would be any other charge; that it was explained by
Mrs. Coleman that the San Gabriel Valley Humane Society
had a program where they go into the schools to explain
the care for various types of pets and that this service
was not offered by the County; that the answering service
the pound retained was being replaced by a twenty-four
24) hour dispatcher; that for taking in one dog or one
cat there was a $2.00 charge; two or more $3.00. He
further stated that it was the understanding at the time
the contract was approved that the San Gabriel Valley
Humane Society's service would be as good or better than
the County.
The Council referred this matter to the City Attorney to
review the contract and to the Chief Administrative Officer
to get in touch with the San Gabriel Valley Humane Society
to be sure the contract was being lived up to.

to him by the City Clerk stating that Mr. Douglas Asquith NOT IN AUDIENCE
had requested time under the oral portion of the agenda.
There were no objections by the Council, however.Mr.
Asquith was not in the audience.

COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL ACCEPT EVAN
L. MILLS RESIGNATION AND THAT A RESOLUTION AND ALSO A
LETTER OF COMMENDATION BE PREPARED COMMENDING HIM FOR HIS
EXTRAORDINARY WORK ON THE PLANNING COMMISSION. COUNCIL-

City Attorney Flandrick suggested that the letter from
G. H. Pritchard dated July 30, 1963 regarding AGP-15
be deferred as far as consideration and action until
AGP-15 came before the Council as a public hearing)
and that copies be sent to the Planning Commission for
their consideration.
Mr. Pritchard asked if the public hearing would be before
the Planning Commission or the City Council.
City Attorney Flandrick stated that the public hearing had
been closed before the Planning Commission; that the Plan-
ning Commission action would now be to adopt a resolution
making a recommendation to the City Council and the case
would be set for public hearing before the City Council.
He suggested that the City Council direct the City Clerk
to direct a letter to Mr. Pritchard advising him of the
time and place of that hearing.
COUNCILI'JOMAN TAYLOR MOVED THAT THE CITY CLERK BE DIRECTED
TO SEND A LETTER TO MR. PRITCHARD ADVISING HIM OF THE TIME
AND PLACE OF THE PUBLIC HEARING BEFORE THE CITY COUNCIL.
COUNCILMAN MOREHEAD SECONDED. There were no objections,
the motion carried and was so ordered by Mayor pro tem

City Clerk read in full a letter from Mr. and Mrs. John
Kubier, 3413 North Vineland, Baldwin Park, dated August 1,
1963, regarding the water drainage at the corner of Vine-
land and Merced. letter in official file)
Mayor pro tem Holmes stated that there was a similar letter
presented at the last Council meeting; that the City Engineer
had been instructed to make studies of this area and come
back to the City Council with a recommendation which would
be within the financial limits of the City to try to
alleviate the situation.

Regular Meeting of the Baldwin Park City Council
Mrs. Levi Hyfield, 14243 East Merced, Baldwin Park, stated
that the water runs curb to curb during rains and the
children from Jones School cannot cross the street; that
children play In the water with boats; that since the curbs
were put in the land was twenty 20) Inches lower than
before; that the water backs up to Maine; that her property
was the last one to get the water; that her neighbor did
not have curbs; that there were approximately six 6)
schools on Merced. She was very anxious for this matter
to be corrected.
Mayor pro tem Holmes assured Mrs. Hyfield that the situation
was being investigated and would be resolved as much as
possible. 00-
Mayor pro tem Holmes announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on CP-8, an applica-
tion submitted by Rosehaven Rest Home requesting Conditional
Use Permit for a 150 Bed Convalescent Home for 30 years
in the A-I light agriculture) zone at 3562 Vineland
Avenue.
City Clerk Balkus stated that the City Council had received
a communication from Chief Administrative Officer Nordby re-
garding this matter; that it was requested that the matter
be continued as there was more information to be acquired.
Mayor pro tem Holmes declared the hearing opened and asked
for testimony in favor of the request.
Mr. Fred W. Raab Jr., 4025 North Maine, Baldwin Park,
representing the applicant, stated that he had been led
to believe that there would not be any hearing this even-
ing; that he did not have present the witnesses that he
would have had if h9 had nut received this information
and asked that the hearing be continued to August 21, 1963.
Mayor pro tem Holmes stated that since Mr. Raab indicated
he did not wish to take the oath prior to his speaking
this statement would not be considered as testimony.
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR PRO TEM HOLMES.
Mr. Beech, 1150 San Dimas Avenue, San Dimas, stated he
was a contractor and working with Rosehaven Homes; that
there would be a concrete wall around the entire project;
that most of the old buildings would be removed in the new
building program; that there were four 4) electric meters
presently and under the new program there would be only one
and the submeters would be underground.
In answer to a question by Mr. James Q. Gibson, 13268 East
Francisquito, Baldwin Park, Mayor pro tem Holmes stated
that it had not been established by the Council whether the
hearing would be continued or not.
Comments by Council as to further study.

City Clerk Balkus announced that it was the time and PUBLIC HEARING
place fixed for a public hearing on Z-178, consideration
of amendments to the Baldwin Park Municipal Code Zoning Z-178, CONSIDERA-
Ordinance) to provide: That final action on Zone Variance TION OF AMENDMENTS
and Conditional Use Permit cases shall be taken by the City TO B.PK. MUN. CODE
Council upon recommendation of the Planning Commission and ZONING ORDINANCE)
Clarification of the procedure necessary for Master Plan
Amendments.
City Attorney Flandrick stated that the Council initiated
a proposed amendment to the Zoning Ordinance approximately
one month ago to clarify the procedure necessary for the
amendment of master plan development and to provide for
a recommendation by the Planning Commission on Zone Variances
and Conditional Use Permit cases so that the Planning Commis-
sion action would merely be recommendation as such to the
Council for final action. He stated that the ordinance had
been presented to the Planning Commission for their con-
sideration; that the effect would be to eliminate the final
authority of the Planning Commission to grant any zone
variance or conditional use permit and it would delete
several sections of the Code which now provide for a cumber-
some and in his opinion unnecessary proceeding in connection
with master plan amendments; that the Planning Commission
had considered these matters and a letter was before the
City Council from Planning Director Kalbfleisch indicating
the action of the Planning Commission; that the Planning
Commission, in addition to these recommendations, recom-
mended that the City Council delete the two sections of
the code 9121.9 and 9121.91) relating to master plan
amendments as such and that this matter be set for a
Joint public hearing, all three matters to be considered
by the City Council at the same time, the changing in the
regulations relating to the granting of variances,
conditional use permits and the procedure necessary for
master plan amendments.
City Clerk Backus stated that the required publication had PUBLICATION
been accomplished.
Councilman Bishop stated in his opinion that there should
be only one public hearing on zone variances and conditional
use permits before the City Council); that the ten days
appeal period should be deleted and the zone variances and
conditional use permits automatically come before the
Council for a final decision.
Councilwoman Taylor stated she agreed concerning the ten
day appeal period and that in her opinion the Planning
Commission Public Hearing should not be eliminated.
Councilman Morehead stated in his opinion the Planning
Commission should hold a public hearing on all zone
variances and conditional use permits as they now did;
that the ambiguity of the ordinance should be corrected.
Councilman Holmes asked if the ordinance as presented
eliminated any study or recommendation by the Planning
Commission on the zone variances and conditional use permits.
City Attorney Flandrick stated that that was the Planning
Commission's recommendation but that was not the way the
ordinance was presented.

Discussion followed regarding the publication and fees
involved for a public hearing.
At 8:35 p.m. City Treasurer Pugh left the Council Chamber.
COUNCILMAN BISHOP MOVED THAT THE SECTION DELETING THE
TEN DAYS APPEAL TO THE CITY COUNCIL BE DELETED COMPLETELY
AND THE PLANNING COMMISSION HOLD A PUBLIC HEARING AND
ALL ZONE EXCEPTIONS AND CONDITIONAL USE PERMITS COME BE-
FORE THE CITY COUNCIL AUTOMATICALLY FOR A PUBLIC HEARING;
AND THAT THE PLANNING DIRECTOR MAKE A PROFESSIONAL RE-
COMMENDATION AND THAT THE MATTERS COME TO THE CITY COUNCIL
FOR A FINAL DECISION.
Discussion followed wherein the Council Indicated they
wished to have the final authority on revocation of zone
variances and conditional use permits.
COUNCILWOMAN TAYLOR SECONDED.
Mayor pro tem Holmes declared the public hearing closed.
With the consent of the second Councilman Bishop withdrew
his motion and asked the City Attorney to word the motion.
COUNCILMAN BISHOP MOVED TO AMEND THE APPLICABLE SECTIONS
OF THE CODE TO PROVIDE THAT IN CONNECTION WITH THE
APPLICATION FOR CONDITIONAL USE PERMITS AND ZONE
VARIANCES THAT THEY BE SUBMITTED TO THE PLANNING COMMIS-
SION; THAT THE PLANNING COMMISSION HOLD PUBLIC HEARINGS
ON THEM; THAT THEY MAKE RECOMMENDATIONS AS TO THE DISPOSI-
TION OF EACH INDIVIDUAL CASE; THAT THOSE RECOMMENDATIONS BE
TRANSMITTED TO THE COUNCIL WHICH WILL THEN HOLD A PUBLIC
HEARING ON EACH INDIVIDUAL CASE AND WILL PASS ACCORDINGLY
ON WHATEVER IT HAPPENS TO BE;AND IN ADDITION AS TO THE
REVOCATION OF CONDITIONAL USE PERMITS AND VARIANCES THAT
THE SAME PROCEDURE WILL APPLY THERE; THAT THE PLANNING
DIRECTOR, ADVISED OF COMPLAINTS OR WHAT HAVE YOU, WILL
INITIATE REVOCATION PROCEEDINGS BEFORE THE PLANNING
COMMISSION WHICH BODY WILL HOLD A PUBLIC HEARING, MAKE
ITS RECOMMENDATION, THEN SUBMIT IT TO THE COUNCIL AND THE
COUNCIL WILL THEREAFTER HOLD A PUBLIC HEARING TO DETERMINE
WHETHER THE PERMIT OR VARIANCE SHOULD BE REVOKED; DELETE
TWO SECTIONS OF THE CODE 9121.9 AND 9121.91 RELATING TO
THE AMENDMENT OF THE MASTER PLAN AS SUCH; THAT THIS IN
ADDITION WILL GO BACK TO THE PLANNING COMMISSION FOR RE-
PORT AT THE NEXT MEETING; THE FOLLOWING MEETING THE ORDI-
NANCE k14ILL BE PRESENTED TO THE CITY COUNCIL. COUNCIL-

Regular Meeting of the Baldwin Park City Council
Mayor pro tem Holmes announced that It was the time and
place fixed for a public hearing on Z-180, an application
submitted by James E, Tracy, at al requesting a change of
zone from R-I single family residential zone) to R-3
heavy multiple family residential zone) or more restric-
tive use for property located at 4964, 4958, 4952 North
Maine Avenue, Baldwin Park, California.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of
the case and stated that the Planning Commission recommended
approval of the zone change.
TESTIMONY IN BEHALF OF THE PROPOSED ZONE CHANGE WAS
CALLED FOR BY MAYOR PRO TEM HOLMES.
Mr. James F. Tracy, 868 South Kingsley Drive, Los Angeles,
stated that the lots were too large for single family
dwellings; that they were adjacent to apartment houses.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-180, Mayor pro
tem Holmes declared the public hearing closed.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONCUR
WITH THE RECOMMENDATION OF THE PLANNING COMMISSION.
Councilman Morehead withdrew his motion.
Councilman Bishop asked If this property extended back
to Elizabeth Street which was an undedicated street.
Mr. Tracy stated that In back of 4964 that the street
was improved; that there was a 49.5 ft. strip in rear
facing Elizabeth Street that he did not own, and also
a lot which he sold approximately one year ago.
City Clerk Backus read ordinance No. 295 by title as
follows:

Councilman Bishop stated that he did feel that applicants
should not be required to take a polygraph examination;
that in his opinion this was infringing upon their rights.
Chief of Police Best stated that in his opinion it would
be infringing upon the rights of the community of Baldwin
Park If the City failed to do this; that the City was
interested solely in selecting the most appropriate appli-
cants fo fill a very responsible position In the City;
that the polygraph examination was more effective than MORE EFFECTIVE THAN
psychological testing and would be required of all candidates. PSYCHOLOGICAL TEST-
ING
Councilwoman Taylor stated if this type of testing would
be of greater help than the psychological testing she was
in favor of It.
In answer to a question by Councilwoman Taylor, Chief of
Police Best stated that the testing would be done by an
outside agency. He stated that the present cost for
psychological testing was $18.00 for each applicant; that
the polygraph examination would be $25.00 for each appli- COST $25.00 FOR
cant; that In his opinion the money budgeted under EACH APPLICANT
psychological testing would be sufficient.
In response to a remark by Councilman Bishop, Chief of
Police Best stated that there was more probability of
an incorrect evaluation on a psychological test than on
a polygraph examination; that the psychological tests
were subjective In nature and the psychologist must
interpret them whereas the polygraph examination was
based to affirm previous activities.
COUNCILWOMAN TAYLOR MOVED THAT THE PRESENT MONEY BUDGETED
FOR PSYCHOLOGICAL TESTING BE AUTHORIZED FOR POLYGRAPH
EXAMINATIONS. COUNCILMAN MOREHEAD SECONDED.
City Attorney Flandrick indicated if the motion carried

refused to take the polygraph examination this should not
disqualify him.
in answer to a question by Councilman Morehead, City
Attorney Flandrick stated that there was bill introduced
in the Assembly that.would prohibit the use of polygraph
testing for any public agency; that all of the bills that
were passed had not yet been printed but that his informa-
tion was that this bill was defeated.

Councilman Bishop stated he voted no for the simple reason
that he did not believe in it.

City Clerk Backus stated that Chief of Police Best re-
quested that he be permitted to consider an overage
applicant for the position of pa)-ro!man; that the
applicant was 37 or 38; and should the applicant otherwise
qualify Chief Best would like permission to hire him.
Councilman Bishop stated that the City Council should change
the policy of the age limi+ if they so desired and it should
be adhered to; that there should not be exceptions to the
policy.
Mayor pro tem Holmes stated in his opinion twenty-five 25)
to forty 40) years of age would be a more practical age
limit.
In answer to a question by Mayor pro tem Holmes, City Attorney
Flandrick stated in his opinion if there was no resolution
regarding this matter that the Council could establish a
new policy at this time if they so desired.
Councilman Bishop stated that in his opinion the matter
of making a new policy should be held over for a full
Council.

that the application was submitted by Bill D. Howard, who
had executed a contract to purchase the property; that in-
asmuch as the terms of the escrow and sale agreement were
not complied with he was required to serve a Notice of
Rescission and Cancellation of the purported contract for
sale; that he was not interested at this time in rezoning
the property and as he was not, to his knowledge,
a party to the zoning application, he was not interested
in any further action on his part; that inasmuch as he
would not convey to Mr. Howard as a purchaser the case should
be dropped.

Mr. Bill Howard, 4317 North Maine Avenue, Baldwin Park,
commented that the escrow had not been cancelled; that he
had turned the matter over to an attorney to see whether
he could hold the escrow.

the City; that the weeds were quite bad on City property and
parkways; that Ramona Boulevard and Baldwin Park Boulevard
were two examples.
Assistant City Engineer Welch t ted if the weeds were in the
parkway this was the responsibility of the adjacent property
owners; that if the weeds were around a building the Fire
Department would take definite action and have the weeds

Regular Meeting of the Baldwin Park City Council
Discussion followed that In every City as well as County
territory the property owners were expected to maintain
the parkways in front of their property.
City Attorney Flandrick stated that the City could initiate
a weed abatement program whereby proper notification would
be given to the property owners and if the property owner
failed to remove the trash and or weeds within a given time
limit the City would then be authorized to proceed with the
abatement and the cost to the individual parcel would be
described in the same manner as a special assessment dis-
trict and would be charged on the tax bill.
Discussion followed wherein Councilman Holmes stated In his
opinion the program should be started in April rather than
In March.
COUNCILMAN BISHOP MOVED THAT THE EINGINEERING DEPARTMENT
BE INSTRUCTED TO CHECK INTO THE SITUATION OF WEED ABATE-
MENT AND THE CITY ATTORNEY CHECK THE LEGAL RAMIFICATIONS
OF THE SITUATION AND CHIEF ADMINISTRATIVE OFFICER TO GIVE
ALL ASSISTANCE POSSIBLE IN ORDER TO ARRIVE AT SOME
RECOMMENDATION TO BRING BACK TO THE GOVERNING BOARD.
