BY CITY CLERK 00- Mr. Jim Smiles, 4343 Alderson, Baldwin Park, asked why JIM SMILES, 4343 it was necessary to go to San Gabriel to get a lost dog Alderson, B.Pk. when there was a County Pound in Baldwin Park. RE POUND SERVICES Chief Administrative Officer Nordby stated there had been several calls and questions concerning the change over from the Los Angeles County Pound to the San Gabriel Valley Humane Society; that the City received $.80 from each dog license fee collected; that this would amount to approximat,o$y $4,000.00 a year; that under the contract with the San Gabriel Valley Humane Society the expense of maintaining control of animals was placed on those who voluntarily acquire pets; that the statement most fre- quently heard that the County performed this or that service at no cost" was wholly without basis in fact; that the charge for extra services was hidden In the county general tax which was levied against all taxpayers whether they were pet owners or not. 00- BIB] 39561-U01 1963-U02 08-U02 21-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO115492-U03 DO116776-U03 C4-U03 MINUTES1-U03 4/22/2008-U04 ROBIN-U04 CITY-U06 COUNCIL-U06 1963 08 21 CC MINHÄ—@¸—+‘ Í«1326 Regular Meeting of the Baldwin Rark`Q-ity Council At 7:40 p.m. City Engineer Young arrived. 00- City Clerk Balkus read a letter from Mr. and Mrs. A. L. Reigler, 3410 North Vineland, Baldwin Park, dated August 3, 1963; and presented a letter from Frank and Delno Gilmore, 3405 North Vineland, Baldwin Park, dated August 8, 1963, both regarding the drainage problem at Vineland and Merced. City Engineer Young reported that the problem'could be alleviated by regrading Vineland and by taking out approxi- mately twelve hundred 1200) feet of curb and gutter at a cost of about $7,000.00; that this was also on the supplemental storm drain program of the 1958 Bond Issue. Councilman Bishop stated this should have immediate attention; that the City Engineer should be authorized to draw up specifications, go to bid'and get the job done before the rainy season. There was further discussion. COUNCILWOMAN TAYLOR MOVED THAT THE CITY ENGINEER BE DIRECTED TO COME BALK WITH A PROPOSAL AND AN ESTIMATE AS TO THE COST. COUNCILMAN BISHOP SECONDED. The motion carried by the following vote: AYES; COUNCILMEN TAYLOR, BISHOP, MOREHEAD AND MAYOR BLOXHAM NOES: NONE ABSENT: COUNCILMAN HOLMES 00- City Clerk Backus read a letter from the Business Men's Association dated August 15, 1963, regarding a. Back to School Jamboree to be held September 5, 6 and 7, 1963. Councilman Bishop asked for an opinion from the City Attorney regarding this matter. City Attorney Flandrick stated that Section 6751 of the Baldwin Park Municipal Code permits this type of activity pursuant to the Temporary Use Permit Section; if the Council wished to accept the letter as an application it could be granted at this time. Mayor Bioxham stated that the letter should be accepted as an.application due to the time element. COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL APPROVE THE APPLICATION LETTER) FOR THIS SPECIAL EVENT. COUNCILMAN MOREHEAD SECONDED. Chief Administrative Officer Nordby stated that he had written three 3) explanatory memorandums to the Council concerning the subject request; that the first one was dated August 6, 1963, as a result of a telephone call to the Regional Planning Commission requesting any documents that permitted Rosehaven to exist under a Special Permit; that the documents were received and the August 16, 1963 memorandum set forth the information contained in the documents; that there were two Special Permits granted by the Regional Planning Commission, the first one in 1950, the second 1952 effective 1953; that it appeared from his reading and interpretation that the second Special Permit which was effective January 1953, Permit No. 812, that Rosehaven was granted the capacity of thirty 30) patients total; that approximately one year later in 1954 the third request was made to the Regional Planning Commission, this request which was to increase the capacity was denied by the Commission; again in 1955 a second request was made to the Regional Planning Commission to enlarge Rosehaven, this again was denied, and as a result of this denial Rosehaven made an appeal to the Board of Supervisors; the Board of Supervisors reversed the denial of the Regional Planning Commission and granted permission to house six 6) to thirty 30) patients at 3556 North Vineland; that he also received from the operators of Rosehaven their current license issued by the State copy in C.A,0. files); that this was called a License to conduct an institution for Aged Persons; that in his brief investigation of the operation he found all of the people housed in Rosehaven were not aged persons; that one of the conditions imposed by the permits granted by the County and again by the Board of Supervisors restricted the use to aged persons excepting mental cases; that he found, In his layman's opinion, there were several patients in Rosehaven that were mental cases, sub-normal, retarded which seemed to be in violation of the Special Permit issued by the County and the reversal of the third request granted by Board of Supervisors; that the license issued by the State Department of Social Welfare, the number is 52 of which six are housed at 3556 Vineland; that he could not justify the 52 from the permits and the granting by the Board of Supervisors; that he was'still awaiting the letter which was written to Rosehaven in 1955 by the Clerk of the Board of Supervisors to find out if there were any additional conditions imposed by the Board of Supervisors; that he requested this from Dr. Dietz, the former owner, who had said he would supply the permissive letter, however, a few hours later Dr.Dietz called and stated that on the advise of his attorney he would not supply this information, therefore, I had to make the request by telephone and the information had not yet reached his office; that until he received that document he could not make recommendations or draw any conclusions. Mr. Gordon McNulty, 4025 North-Maine Baldwin Park, stated GORDON MICNULTY, 4025 he was the attorney for W. Bernard Wald and Mr. Goodman N. Maine, B.Pk. Gertler, present owners of Rosehaven; that he did not ATTY. FOR OWNERS represent Mr. Dietz, the mortgage holder. He stated OF ROSEHAVEN concerning the six 6) retarded patients who were presently there the present owners had agreed to remove them, two were leaving tomorrow and four were leaving this week; that this should eliminate this objection although he thought there was some testimony previously as to whether they were actually mental in the strict sense of the word; that an inspection had been made and some of the electrical work did not meet the specifications of the Building Code; that the owners were willing to make the repairs as soon as they were informed as to the specific work to be done; that the owners advised him that they had purchased the property not from Dr. Dietz, but from an intermediate owner on the basis of the licenses displayed in the build- ing or handed to them showing the total capacity of fifty- two 52); that he believed there were two buildings, one with thirty 30) and one with twenty-two 22); that concerning the Conditional Use Permit, his clients under Section 2 of the proposal have no objections to complying with Sections a) and b); that their only objection should the permit be granted was c) requirement to post a cash deposit or a letter of credit; that there had been no indication as to what amount the cash deposit would be, and secondly it would possibly be discriminatory against them since there was no indication that this had been applied to owners or users of land In similar circumstances; that they had no objections to carrying the matter over and in the meantime they would cooperate. * C. G. Kolts, of the law firm of Kolts and Kolts, C. G. KOLTS, OF 417 South Hill Street, Los Angeles, stated his firm KOLTS AND KOLTS, represented approximately twenty 20) property owners 417 S. Hill St., and taxpayers immediately surrounding this establish- L. A. ment; that they were ready to proceed; that they had no objections to continuance of the hearing but they did want to go on record at this time as opposing the issuance of the permit and to offer the testimony of the people present and who would be present at the con- tinuance. The Council agreed to hear those present wishing to be heard. City Clerk Balkus again administered the oath. OATH READMINISTERED City Attorney Flandrick, before anyone testified, stressed RE DOCUMENTS the fact that each one of the Councilmen had before them a copy of the Planning Commission Resolution No. 63-51, copies of the staff reports from the Chief Administrative Officer dated August 6, 1963, August 16, 1963 and August 21, 1963; that Mr. McNulty, attorney for the applicants, has a copy of these documents, and he was now handing a copy of the same documents to Mr. C. G. Kolts. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHALF MAYOR BLOXHAM. Mr. Gordon McNutt stated thdt the owners had advised him that a license ha been issued in 1963 signed by Mr. Nordby indicating the capacity of fifty-two 52) people. Mrs. Rothiand Brockway, Manager of Rosehaven Rest Home, 3562 North Vineland, Baldwin Park cited an instance of an elderly woman leaving the grounds and knocking on a neighbor's door. She stated that the things that the young boys had been accused of was terrible; that she seldom left the grccun"s and knew what they were doing every minute of the day and night. She stated that the place would beautify Baldwin Park; that the people there were well taken care of. TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY MAYOR BLOXHAM, Mr. Kolts proceeded to call his clients to the microphone and questioned them. Mr. E. B. Carter, 3548 Vineland Avenue, Baldwin Park, stated that since the application had been filed the pre- mises had been cleaned up and looked better. Mrs. Mina Gifford, 3553 North Vineland Avenue, Baldwin Park, stated that approximately two weeks ago on Sunday she and her husband were in the kitchen doing dishes approxirr.tely 7:30 p.m.; that they were watching the younger men across the street at the rest home; that one of them was carrying something heavy. Mr. McNulty objected to this testimony since his clients had agreed to remove these men. City Attorney Flandrick stated that there was no line of objection in this matter; that it was a matter of the Council hearing all of the evidence. Mrs. Gifford stated the object was thrown over the fence into Mr. Carter's back yard; that they turned the rain- bird on next to the fence and the water flooded Mr. Carter's back yard and had gone into the house; that the object was a large rock with a face painted on it. She stated she had seen silhouettes as late as midnight in the yard back of the house; that last Friday she had seen three of them at the M and I Liquor Store. She cited an in- stance of one of the boys talking to young children on their way to Vineland School girl 8-9, boy 6--7); that the school was approximately five or six houses from Rosehaven. Mrs. Roy Craig, 3535 North Vineland Avenue, Baldwin Park, address located across the street approximately two houses away), stated she had lived there approximately two years; that she was in sympathy with these retarded people; that she felt they should be put in a place where they were not excited, where they were treated kindly and where they had guidance, She stated that the neighborhood should be protected; that they were too close to the town; that this should be a refit home for elderly people. M. Hagen, 3557 North Vineland Avenue, Baldwin Park; MRS. V. M. HAGEN, stated that she had lived across from the rest home for 3557 N. Vineland seven 7) years; that it had always been for elderly citizens; Ave., B.Pk. that she had no objections to elderly citizens, even if they put in 150 more beds, but she did object to he mentally retarded men. She stated that g:-ant9ng of tha permit would depreciate the value of her property; that her tenant was so frightened of the mentally retarded men that she would not come out to the driveway or to the mailbox. She stated that on Memorial Day an elderly woman called to her and complained about the mentally retarded men; that this woman stated she did not feel these men should be in with the elderly people. Mr. F. C. Hubner, 3585 North Vineland Avenue, Baldwin Park, F. C. HUBNER, 3585 stated that the people had been put upon" by not having N. Vineland Ave., been informed about the increase of elderly people; that B.Pk. the permit originally called for 26-30 people; that they had wheel chair cases and mentally retarded people; that he was one of the original signers in favor of the permit; that at that time it was to be a place for ambulatory people; that he had seen fighting among the mentally retarded people and that was not a good spectacle for the neighborhood; that in the middle of night loud noises have been heard, some calling for help; that they usually go to bed very late; that he had helped four 4) elderly people get out because they were not satisfied, that there was one man he tried to help get out but could not; that if this place was enlarged with all kinds of people coming in this would lower the property values. Mr. August Scheiffele, 3539 North Vineland, Baldwin Park, AUGUST SCHEIFFELE, stated he had lived at this address for thirty-one 31) 3539 N. Vineland years; that he was one of the original signers for the Ave., B. Pk. permit; that this was to be for old people and not over 30-35 in number; that he had seen young mentally retarded people there; that he had seen them talking to young children as they walk by. He cited some obscene acts that he lad seen. He stated that granting of the permit would crease the properly value; that he had seen trash being hauled out since the application had been filed; that he was disgusted with the way the place was run; that there was no supervision; that the mentally retarded people could leave at any time; that he had seen them at the root beer stand. Mr. Ko;ts stated that City Clerk Balkus told him that she would see that each of the Council members would receive a copy of the letter sent in by Mr. and Mrs. Frye. Mr. Harold E. Roland, 1319 Elliott Avenue, El Monte, HAROLD E. ROLAND, stated he owned the property directly across from the 1319 Elliott Ave., rest home; that he did not sign the original petition El Monte for a rest home for the reason that his understanding was that it was two or three cottages or homes and they came up with a large building; that his daughter had lived at this location for six 6) years; that he had no objection to elderly people but the other people he did object to; that his daughter had two small children; that the granting of this permit would decrease the property value. Mr. Paul V. Engel, 3563 North Vineland Avenue, Baldwin Park, PAUL V. ENGEL, 3563 stated he had lived at this address for six 6) years; that N. Vineland Ave., many times the retarded men in the eesthome had called his B.Pk. children ages 7 and 14) across the street and gave-them candy; that on three occasions these men had been in his yard; that he objected to retarded people being in this home. IN REBUTTAL Mr. Gertler stated that the Fire Department and other Departments of the City had reported to the State that they had been keeping up the grounds; that they had a building for wheelchair patients; that the mental patients were placed in this home by the State; that there was a dispute between the Mental Hygiene and Social Welfare; that the social workers have stated the mental patients had been receiving proper supervision; that he went out with them to the store; that he had not seen one of the events mentioned by persons giving testi- mony. In answer to a question by Councilman Bishop, Mr. Gertler stated they were paid $125.00 to $150.00 per month for elderly people. in answer to a question by Mayor Bioxharn, Mr. Gertler stated he took over this rest home ten 10) months ago. Mrs. Brockway, Manager, explained in her opinion, what a mentally retarded patient was; that regarding the hose incident this was an accident and she had placed the hose in this location herself; that the mentally retarded people were not permitted to leave the grounds. after dark. Mr. McNulty stated that two of the mentally retarded people would be leaving tomorrow and the other four would be leaving at the beginning of next week. Mr. D. W. Asquith, 13138 Judith, Baldwin Park, stated in his opinion this case should be continued and checked out further; that the matter was very confused. COUNCILMAN MOREHEAD MOVED THAT THIS CP-8) BE CONTINUED UNTIL SUCH DATE THAT MR. NORDBY CAN COME FORTH WITH THE COMPLETE INFORMATION THAT HE IS NON SEEKING. The motion was reworded to read: COUNCILMAN MOREHEAD MOVED THAT CP-8 BE CONTINUED UNTIL SEPTEMBER 4, 1963. Mayor Bloxham commented that there would not be a full Council at that time. City Clerk Balkus stated the required publications had PUBLICATION been accomplished on Z-182 and AGP-16. Planning Director Kalbfleisch presented a resume of the RESUME cases and stated that the Planning Commission recommended approval of both cases. Discussion followed. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHALF MAYOR BLOXHAM. Mr. George Voigt, 617 South Olive Street, Los Angeles, GEO. VOIGT, 617 S. stated he represented Petro Development Company; that Olive St., L.A. this request started April of last year; that they had the misfortune of being the first case to come before the Planning Commission and City Council under the new Zoning Ordinance; that the City Council suggested that the Planning Staff come in with a study and recommendation for how large an area should be rezoned commercial; that they believed in their arguments before they had shown that the trend was to commercial; that the widening of Baldwin Park Boulevard seriously depreciates the value of the property as residential; that it took the setback off of many of the houses; that this street would run through the front porch and the front rooms of some of the houses; that the traffic Itself would depreciate the value as R-I property. At 9:15 p.m. Councilman Bishop stated he had just received COUNCILMAN BISHOP notice that his niece had been involved in a serious EXCUSED accident and asked to be excused. Mr. Voigt continued stating that the traffic patterns indicated commercial zoning; that as far as Ramona being a commercial street, conpideration should be given to the fact that comnerc al investment Inds its own neighborhood; that they were now asking for the two corners even though they understood that the Planning Staff had just about completed their study and recommendation for the area; that the Petro Development Company was very interested in building a shopping center much larger than the area being asked for commercial zoning now if he could put together the amount of property necessary; that the indications he and Mr. Schabarum have had from the nieghbors were that they were willing to go along with it and make their properties available for such development. Mr. Peter Schabarum, 109 West College, West Covina, PETER SCHABARU'A, IC applicant, reviewed his previous application, Z-lll; W. College, W. Cov. that his long range plan was to have four or five acres for installation of a neighborhood shopping center; that it was his opinion that the area would warrant a super market; a variety store etc. In answer to a question by Michael V. Mr. Schabarum stated that he concurred this would be considered a spot zoning; however he hoped by making this application and it were approved the City would perhaps initiate a larger area for commercial zoning; that the Planning studies showed the trend in this area toward commercial zoning. Voigt stated he did not see how under the circumstances this would be considered spot zoning; that in view of the studies of the Planning Commission this would not stand out as a spot by itself. Mrs. Dargus asked how many square feet this would involve. Mr. Schabarum stated that one parcel corner) was 140 x AREA INVOLVED 160 feet and the northeast parcel was gross 135 x 110, taking in three parcels; that he was initiating this application with the hope, that there would be Council action to commercial or activity on the part of other owners in this area.
