City Clerk Balkus presented a letter from the Assembly LETTER FROM ASSEMBLY
Judiciary Committee dated August 28, 1963 regarding JUDICIARY COMMITTEE

Discussion followed wherein Mayor Bloxham indicated he
would attend this meeting if possible and if not an
alternate would be appointed.

City Attorney Flandrick presented Resolution No. 63-114 RES. NO. 63-I14
and stated it had been prepared at the Council's direction;
that the owner of the property in connection with Z-158 filed
an affidavit with the City Clerk stating he wished the
matter dismissed and revoking the authority given to the
actual applicant, Bill Howard.
COUNCILMAN MOREHEAD MOVED THAT RESOLUTION NO. 63-114 BE
APPROVED AND FURTHER READING BE WAIVED. The motion was
withdrawn.

City Attorney Flandrick commented that as directed by the
City Council at the last regular meeting the staff was
now preparing an ordinance for lot split regulations and
it would be presented. at the next meeting; that the staff
had discussed recommending to the City Council that the
City Engineer approve lot splits that did not require
policy decision no street dedication, no curb and gutter
improvement, lots minimum size). All other Lot Splits
would require Planning Commission and City Council action.
Discussion regarding evasion of the subdivision map act,
elimination of interior lots, that this ordinance might
curtail lot splits in order to get the proper development,
that lot splits now were not recorded until they were sold
off, that many lots were now being divided and sold off with-
out a formal lot split application.
City Attorney Flandrick stated that it was proposed that
the ordinance would contain an appeal provision so that
if the City Engineer disapproved a map the applicant
could appeal to the Planning Commission and then to the
City Council.
Councilman Holmes stated that the lot splits now under
process should not become involved in the new policy.
The Council agreed that the lot splits that were now
filed should be processed and not held up; that the lot
splits that were held at the last regular meeting would
be considered September 18, 1963.

Mayor Bloxham announced that the hour of 8:00 p.m. having
arrived that it was the time and place fixed for a public
hearing on Z-184, application submitted by Ignacio P.
Mancillas, et al requesting a change of zone from A-I
light agriculture zone) to zone R-1 single family
residential zone) or more restrictive use for properties
located at 3734, 3740, 3748 and 4750 North Foster Avenue,
Baldwin Park, California.
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission recommended
approval of the subject request.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to Z-184, Mayor
Bloxham declared the public hearing closed.

Councilman Holmes commented that this property was in the

Regarding reservations for the Independent Cities meeting on
Santa Catalina Island September 21,22, 1963, mayor Bloxham
and Councilman Bishop indicated they planned to attend.
Councilman Holmes stated he would advise the City Clerk
tomorrow, September 5, 1963.

Mr. Gilbert Pritchard, 3735 Monterey Avenue, Baldwin Park,
stated that he had received a letter stating there would
be a public hearing on AGP-15 this evening.
City Attorney Flandrick stated that urgency Ordinance No.
294 adopted August 27, 1963, deleted the two provisions
of the Zoning Ordinance which provided for this kind of
procedure on an Amendment to the Master Plan public hear-
ings before the Planning Commission and City Council).
City Attorney Flandrick stated the City Council could either
conduct a hearing on the Master Plan Amendment testimony
concerning street would not be relevant because street not
on Master Plan); or hear the people and consider whether
the Planning Director should be directed to consider the
existence of such a street In future lot splits.
COUNCILMAN HOLMES MOVED THAT THE MATTER BE BROUGHT ON THE
AGENDA AND THAT THESE PEOPLE BE HEARD. COUNCILMAN MORE-
HEAD SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Bloxham.
City Clerk Balkus stated that publication for AGP-15 was
made on August 24, 1963, stating that a public hearing
was to be held before the City Council on September 4, 1963,
and that proper mailings were also made; that on August 27,
1963, the City Council adopted urgency Ordinance No. 294
which eliminated the provisions for a Master Plan Amendment
public hearing before the City Council.

Planning Director Kalbfleisch stated that the Planning
Commission had conducted a public hearing on AGP-15;
that they recommended approval to the City Council
that this area be designated as a low density residential
use in lieu of existing low density with the proposal
that this be a neighborhood park site; that there were
no requirements for a street at that time; since that

time for the development of these deep lots there had been
a proposal of a future street'within this general area
to form a better tract development; that there were
existing cul-de-sac dedications and also street dedications
already started within the genera! area, but as for the
map presented this was a proposal at one time but since
that time the map had been revised for a cul-de-sac adjacent
to Ramona Boulevard and then there would be an out let formed
at some other location or.-, ouriet only) running onto
Monterey or Grace Street; that th-:e was no designation
at the present time.
Mr. Pritchard stated that the proposed street was not an
asset, that it would no; help the people in the area;
that the City would be asking the property owners to give
up sixty 60) by three hundred 300) feet from Grace in
on the west side between Frazier and Ramona Boulevard);
that from Monterey east the City would be asking two
property owners to give up thirty 30) by three hundred
300) feet between Frazier and Ramona Boulevard). He
stated that the street proposal had been changed again
and asked how the property owners could properly develop
their property and make maximum use of their property when
they do not know where the-street was going to go. He
commented on the public hearing of AGP-15 before the
Planning Commission and stated that on July 24, 1963
AGP-15 was shown under Old Business which is closed to
public" and was not shown on the Agenda as a Public Hear-
ing; that they had been told at a previous meeting that
the public hearing would be continued and they would be
informed of the continued hearing date.
City Attorney Flandrick stated that as he recalled the
decision of the Planning Commission was to eliminate
the park site; that the street was not a part of the Master
Plan; that this was one of many areas where the Planning
Commission proposed there should be a street and when a
lot split was applied for the staff recommended to the
Planning Commission and the Planning Commission to the
Council that the area be dedicated or not dedicated;
that if the Council was convinced that Mr. Pritchard's
argument was sound and the street was not at a desirable
location as proposed, a direction could be sent to the
Planning Commission that this street was not to be
considered.
Mr. Pritchard stated his alternate suggestion for this
area was R-2 zoning; that he believed under R-2 the
street would not be required or elimination of the
street and leave it R-l.
Mrs. D. G. Heser, 3820 North Grace Avenue, Baldwin'Park,
stated she was not in favor of the street going in.
Mr, Leo W. King, 3830 Grace Avenue, Baldwin Park, stated
he was in full agreement that this street should not be
put through.
Mrs. Anna Brown, 3840 Monterey, Baldwin Park, stated she
did not want the street under the present conditions and
that she wanted to go on record saying that this property
was her security and she could not afford to dedicate
thirty 30) feet to the City for a street.
Mr. Harris, 3714 North Grace, Baldwin Park, stated that
thirty 30) feet had been taken from the back and sixty
60) feet frontage was wanted at this time; that his lot
was 300 x 160; that he did not see any reason for the
street.

City Clerk Balkus administered the oath.
Mr. Leonard Puglisi, 7915 North Maple, Fontana, stated
he was a builder and worked around this area; that he
had lived In Baldwin Park since 1948 and had recently
moved to Fontana. 1961 directory indicates Covina address
not Baldwin Park) He stated he was In the process of
getting a lot split on Grace Street; that he did not see
any progress being made by not going R-2 or permitting lot
splits using driveway back for access).
In answer to a question by Councilman Holmes, Planning
Director Kalbfleisch stated the present zoning was A-1;
that there was a public hearing set before the Planning
Commission to rezone from Ramona Boulevard to Frazier,
east to Merced and west to Foster from A-I to R-I; that
the public hearing would be on Septftber 25, 1963.

In answer to a question by Councilman Morehead, Planning
Director Kalbfleisch stated there would be thirty 30)
feet taken from either side; that there was a possibility
of taking twenty.-eight 28) with a fifty-six 56) foot street; that
on the Burrows property there, had been a dedication of
thirty 30) feet along the entire back south of the church).
He stated that the preliminary dssign had been reworked;
that this could possibly be Improved under the 1903 or
1911 Act; that the property owners in the general area
would pay for the access onto the other right-of-way
not any one individual).
City Attorney Flandrick suggested that the matter could be WAYS MATTER COULD BE
handled in one of two ways; that to formalize it if the HANDLED SUGGESTED
Planning Director had specific plans for this area in BY CITY ATTY.
so far as streets are concerned he could recommend to
the Planning Commission that they consider specifically
certain streets in adding them as such to the Master Plan
or the Council could direct the Planning Director to pre-
pare a block study for this particular block and go
into all of the aspects Including where a street should be,
what is the most desirable location, what areas had the
City already acquired by way of dedication as a result of
lot splits and then set the matter for consideration before
the City Council In the future and advise the people concerned
so that they would have an opportunity to be heard.
There was further discussion.

at Houston in October.

Chief Administrative Officer Nordby reviewed a report
from City Engineer Young, copies of which had been
passed out at the beginning of the Council meeting,
concerning the Relocation of a Sewer Line in Sewer
District 61-A-1, Station 1300 to 3700 + or on
Ramona Boulevard. Mr. Nordby and City Attorney Fiand-
rick recommended that before the Council took any action
that opinion of legal counsel for the district be obtained.
Discussion followed concerning location of the property
line and records not showing actual location of water and
gas lines.
The Council asked about using the Miscellaneous Sewer
Fund for this expense.
COUNCILMAN HOLMES MOVED THAT THIS MATTER BE HELD UP
AND ACTED ON AT AN ADJOURNED MEETING WHEN THE CITY
COUNCIL HEARS FROM MR. URBAN J. SCHREINER LEGAL

There was a discussion of a possible adjournment date

City Engineer Young presented his report regarding the
drainage at Merced and Vineland and recommended the
Installation of a seepage well French drain" at the
opening in the curb which is located on the northeast
corner of the intersection; that $250.00 would cover
the cost of installation.
Discussion followed regarding the curb grades throughout
the City.

City Attorney Flandrick suggested if the Council desired to
require the standard sewer installation they could put it
in as an alternative and let the decision ride with the
subdivider as to whether he wished to go through the lots
by way of an easement or doom the streets.
The Council agreed with this suggestion.
Councilman Bishop stated that policy on subdivisions should
be determined; that subdivisions within certain districts
should have to hook Into the sewer line.

COUNCILMAN BISHOP STATED THAT WOULD BE HIS MOTION. MOTION MADE
Discussion followed as to reaffirming the Council's DISCUSSION
previous action on October II, 1962; the effect of any
council action on persons involved; the impression that
the Council entertained regarding the action on October It,
1962, that Rule it of Section 5 of the proposed Resolution
No. 62-209 had established a policy; the necessity for taking
action at the present time; the intent of the policy of the
City Council; the possibility of the Chief's violation of
the wishes of the governing body not any'action of employee
Morehead; the possibility that the Chief had forgotten
about the policy; that Chief Administrative Officer Nordby
was not aware of the policy; that regardless of vote on any
measure, that once a policy was established by majority vote
then the policy should be carried out.

of the City Council which is in violation of the City
Council Policy, and clearly state the reason of this
