ADJOURNED REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL SEPTEMBER 6, 1963

The City Council of the City of Baldwin Park met in
adjourned regular session at the above place at 11:30 a.m.
Roll Call: Present: COUNCILMEN HOLMES, BISHOP, ROLL CALL
TAYLOR AND MAYOR BLOXHAM
Absent: COUNCILMAN MOREHEAD, CITY

Mayor Bloxham stated that the City Council of the City of
Baldwin Park was now in session at a regular adjourned
meeting.
Chief Administrative Officer Nordby stated that at the C.A.O. NORDBY
last meeting the City Engineer had delivered a memorandum EXPLANATION RE
to the Council which concerned the necessity for reloca- MEMO RE RELOCATION
ting the Sewer Line Main on the North Side of Ramona, SEWER LINE
and because of undetermined locations of water and gas
lines it is necessary to relocate the sewer line. Due
to having to replace approximately 2400 feet of 8" con-
crete to a width of 30", the additional cost amounts to
approximately $3600, not to exceed $4000, which would be
the Cities share.
Mr. Schreiner, Legal Counsel, O'Melveny and Myers, in a MR. SCHREINER,
phone conversation with Mr. Nordby stated that a field O'MELVENY & MYERS
change of this kind, which is based on the original, would INFORMATION
be permissible; it is possible to make a supplemental
agreement with the contractor; if the contingency in the
bond fund were not sufficient to cover the cost it would
be permissible to take money from another fund, the
general fund, and this would be charged back to the dis-
trict. There is at the present time approximately $13,000
in the contingency fund.
A written opinion will be forthcoming from Mr. Schreiner.
Mr. Nordby further commented a written supplemental agree-
ment should be prepared with the contractor subject to the
approval of O'Melvemy and Myers and the City Council. He
suggested that the City Engineer work out a unit cost and
a limitation be placed on the entire cost so that if the
contractor runs into additional problems the City will only
be obligated up to a certain amount.
Mr. Nordby suggested that the City Council instruct the
Chief Administrative Officer and the City Engineer to
effect a supplemental agreement with the contractor sub-
ject to the approval of the legal counsel and the agree-
ment to come back to the Council for final approval.
Discussion followed regarding use of the general fund, DISCUSSION
of which the City Council did not approve as all costs
should remain within the district. Further discussion
followed regarding the use of the sewer revolving fund
and then when the district is completed the amount might
possibly be reimbursed from the contingency fund.

COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE
OFFICER BE INSTRUCTED TO PROCEED WITH THIS MATTER AND BRING
BACK THE INFORMATION TO THE CITY COUNCIL. COUNCILWOMAN
TAYLOR SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Bloxham.

City Clerk Balkus read Resolution No. 63-122 by title
as follows:
RESOLUTION NO. 63-122
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK ALLOWING
CLAIMS AND DEMANDS AGAINST THE CITY
OF BALDWIN PARK"
COUNCILMAN HOLMES MOVED THAT RESOLUTION NO. 63-122 BE
APPROVED AND FURTHER READINB BE WAIVED. COUNCILMAN BISHOP
SECONDED. The motion carried by the following vote:
AYES: COUNCILMEN HOLMES, BISHOP,
TAYLOR AND MAYOR BLOXHAM
NOES: NONE
ABSENT: NONE

Chief Administrative Officer Nordby informed the Council
that he had received a revised brochure of Sewer District
No. 2 from Laurence Thompson, Assessment Engineer, how-
ever there was no revision nor reduction alteration made
in the estimated cost.
Mayor Bloxham commented that he would not be interested
in the brochure until the consultants could come up with
a cost in dollars and cents as this is what interests
the people.
Councilman Bishop also commented there is nothing in the
proposed brochure that substantiates what the people will
have to pay; there was discussion as to reducing the dis-
count on bonds from 5% to 2%.
Chief Administrative Officer Nordby suggested that another
meeting be held with the consultants and insist that they
come up with the necessary information.
There was discussion as to eliminating the contingency,
however some contingency should be allowed for, the re-
duction should be applied to the estimated cost and leave
the contingency as a contingency.
The Council indicated they would meet with the consultants
at any time.

With the approval of Mayor Bloxham Councilman Bishop ex-
plained to Councilman Holmes that prior to the meeting
the members of the Council present had made a statement
to the paper regarding an article appearing in the San
Gabriel Valley Daily Tribune. zoning and development
of a proposed 23 acre shopping center in the area of
Francisquito and Baldwin Park Boulevard) The Council had
instigated the action on this area and had asked that
the whole area be studied with specific instruction to the
Planning Commission to do so and also had requested that

they come up with a proper type of ordinance to make it
so that when zoning was completed there would be no spot
zoning. The City Council recommended that the Planning
Commission make such a study and establish boundaries
however, the newspaper article was completely erroneous and
diametrically opposed to the City Council Intent.
Rene Dictor, reporter for the Tribune explained, that
the story was not released entirely as it had been written;
that editing sometimes changed an article.

Chief Administrative Officer Nordby Informed the Council C.A.O. NOROBY
that he would be leaving Friday night to take his daughter
to college at Berkeley, however the responsibility would
be left with the City Clerk and the City Engineer.
Mayor Bloxham asked that Mr. Nordby explain further.
Chief Administrative Officer Nordby explained as follows:

years of work at the University of Aloska the next two

National Institute of Mental Health. This will lead to a
graduate degree as Master of Science.
