regular session at the above place at 7:30 p.m.

Regarding the minutes of September 4, 1963, City Clerk 9alkus CORRECTIONS TO
explained that on Page It, the third paragraph from the SEPT. 4 AND

1962"; that the minutes of September 6, 1963, on Page 2, MINUTES
the vote with regard to Resolution No. 63-122 should
indicate that Councilman Morehead was absent.

California Cities dated September 5, 1963, regarding the
special session on International Municipal Cooperation to
be held on October 20, 1963.

City Attorney Flandrick explained that at the direction of PROPOSED LOT SPLIT
the City Council at their last meeting, a lot split ordinance ORDINANCE
had been prepared and submitted to the Council; that it had
been examined by Planning Director and Building Superintendent
Kalbfleisch, City Engineer Young and Assistant City Engineer
Welch; that basically the procedure under this ordinance would
be that the City Engineer would be delegated the authority to
approve certain lot splits, that is, those lot splits where
there is no dedication of any street opening, street widening,
no improvement such as curbs, gutters, etc., no relocatidn of
buildings or utility lines; that If the conditions as set

forth in Section 9303 are not found to be present by the
City Engineer, then the matter is denied by him and auto-
matically referred to the Planning Commission which then
will consider it and make a recommendation to the Council;
that the ordinance was set up for the Planning Commission
and the City Council to hold a public hearing not a formal
public hearing as in a zone change).
Councilman Holmes asked if there was any legal advertising
involved.
City Attorney Flandrick stated that the Council need not NOTIFICATION REQUIRE
hold any public hearing or notify anyone except the TO APPLICANT ONLY
applicant.
Councilman Bishop stated in his opinion it was not necessary
to notify persons within a three hundred 1300) foot radius
on lot splits and this portion of the ordinance should be
deleted.
City Attorney Flandrick stated that was not a recommenda-
tion; that It was merely put In as something the Council
might wish to consider; the only purpose Involved would
be to let people in the area know that a development was
going on; that this was not a requirement.
Councilman Morehead stated it was his opinion that this
lot split ordinance was being revised to save time and
that he agreed that the notices within three hundred 300)
feet were not necessary.
At 7:45 p.m. City Engineer Young arrived. 7:45 P.M. CITY
ENGR. YOUNG ARRIVED
City Attorney Flandrick stated if the Council wished to delete CHANGES IN PROPOSED
the three hundred 300) feet provision that Section 9306 ORD.
should be amended in the last full sentence on page 2 by SECTION 9306
striking out the phrase and all property owners within
300 feet of the subject property.", and in the line just
preceding that after the phrase hearing to the applicant,"
insert the word and"; that the same changes would be made
in the last sentence of the first paragraph of proposed
Section 9307.

Councilman Morehead asked If the new lot split ordinance RE CIRCUMVENTION

City Attorney Flandrick stated this ordinance would not
prohibit that; the manner of prohibiting such a circum-
vention would be denial of the tot split map on
the grounds that It is an obvious attempt to circumvent
the provisions of the State Map; that it Is provided that
the Council may approve, disapprove or condition the
approval of any map.
City Clerk Balkus pointed out that according to Section 9308
the City Clerk's office would record the City Council resolu-
tion approving or conditionally approving any map at the
expense of the applicant.
City Attorney Flandrick stated that the purpose of this
was that the resolution would have attached to it as an
exhibit the actual map; this would then be recorded and
you would have a public record which would be picked up
by the title searchers; that in his opinion this would
eliminate confusion in descriptions contained In deeds
of future conveyances; that the recorders office has a
policy of not accepting for filing that which is not a
record of survey or a subdivision map; that they wil,i

City Engineer Young explained that on Lot Split No. 4 EXPLANATION OF

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on CP-8, an applica-
tion submitted by Rosehaven Rest Home requesting Condi-
tional Use Permit for a 150 Bed Convalescent Home for
30 years in the A-I light agriculture) zone at 3562 Vine-
land Avenue.
Mayor Bloxham stated he had received a memorandum stating
the applicant requested a continuance to October 2, 1963.

Mr. J. Gordon McNulty, attorney, stated his clients were
unable to be present at this time and requested a
continuance of the hearing to October 2, 1963.
The Council agreed to the continuance and Mayor Bloxham

Councilwoman Taylor commented that long lots were involved
and asked how they could be developed.

mitted by Wesley W. Shriver to construct an addition and
improve a dwelling in the C-I neighborhood commercial)
zone for property located at 13930 Merced Avenue.
City Clerk Balkus stated that the required publication,
mailings and postings had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission recommended
approval of the request on the four grounds required for
a variance by the Municipal Code.

flight would travel over seven hundred 700) feet or more
of property owned by the applicant crossing a small portion
of Auction Avenue and Ramona Boulevard, property used for
egg produce and truck maintenance will also be crossed;
that in landing the helicopter would approach the landing
area from the northeasterly direction flying over uninhabited
property; that the landing pad was paved area. He stated
that the Planning Commission recommended eleven conditions
of approval and that he believed two 2) more should be TWO ADDITIONAL CONDI-

Councilman Morehead asked if the applicant was in complete
agreement with the Planning Commission restrictions and
requirements and also the two that the Planning Director
suggested.
Planning Director Kalbfleisch stated the applicant was
agreeable with the conditions with the exception of the
one concerning the Fire Prevention Bureau.
As there was no one in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to CP-15, Mayor DECLARED CLOSED
Bloxham declared the public hearing closed. CP-15
Discussion followed regarding the three 3) foot block wall RE BLOCK WALL
wherein Mayor Bloxham Indicated this was not sufficient.
In answer to a question by Councilman Bishop, Planning
Director Kalbfleisch stated this would be a private heli-
port for use of the W. E. McKnight Construction Company
only.
Councilman Bishop stated that if this were approved anyone OPINION BY COUNCIL-
in the M-I zone would be qualified to ask for the same thing; MAN BISHOP
that he felt if there were a heliport in the City it should
be for the general public's use i.e. to take people to and
from the Los Angeles International Airport).

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Nordby passed out to the
Council and reviewed a report concerning the revised. assess-
ment estimate on Sewer District 62-A-I. He stated that the
unit cost estimate had been reduced substantially; that
the estimate of the assessment engineer reflects a 9.3%
increase over that of Sewer District 61-A-1; that in his
opinion the district should be created as soon as possible;
that Mr. Rosetti had stated he could have the brochure ready
for the Council to review prior to September 25 or 26, If
the Council wished to meet at that time.
City Attorney Flandrick stated if he recalled correctly
the public hearing date could be set not less than forty-
five 45) days nor more than sixty 60) days from the
date the Resolution of Intention was adopted.
Mr. James Q. Gibson, 13268 East Francisquito, Baldwin Park,
commented that September 26, 1963, was Baldwin Park's day
at the Los Angeles County Fair and asked that a hearing
or discussion regarding the district not be held on that
date.
Mrs. Frost, 13600 East Frazier, Baldwin Park, stated she
had been held up In selling her property; that F. H. A.
was waiting for an answer from tonight's meeting as to
whether or not the district was established.
City Attorney Flandrick stated that the lien situation
came about by reason of a complete error on the part of
Title Insurance and Trust Company; that he suggested every
individual who had a problem like that contact either
the Director of Finance or himself; that a letter would
be obtained from Title Insurance and Trust Company Indica-
ting it was their mistake; that there were no liens on
property in Sewer District 62-A-I.
Mrs. Frost stated that such a letter had been sent to the
F. H. A. and they would not accept this; that they were
waiting to determine whether or not there was to be an
assessment.
An unidentified woman stated that there were figures on
the assessment list. She asked how the people would pay
this assessment.
City Attorney Flandrick stated that the figures picked up
by Title Insurance and Trust Company were completely. In
error; that if there were an assessment the people could
pay their assessments by cash or over a period of time
as set by the Council.
Mayor Bloxham asked the City Attorney, with regard to the
lien problem, If there was anything the City could do to
help people in Sewer District No. 62-A-I sell their houses.
City Attorney Flandrick stated Title Insurance and Trust
Company was aware of the situation and indicated they
had written letters to all of the escrow holders who
were involved in transactions where this has been a
problem and that they would not Issue any other title
searches or reports indicating the second sewer district
was in existence, which of course it was not; that as
far as F. H. A. was concerned perhaps a letter from Mr.
Nordby would solve Mrs. Frost's- problem.
City Engineer Young stated he had written letters for Mr.
and Mrs. Frost; that one letter was written prior to his
employ with the City by Mr. Welch; that In that letter It
did have the wrong house number; that he sent out the
correct house number and pointed out to the real estate
people and to F, H. A. that there was no lien against the
property; that two days ago he had had a call from F. H. A.
in Anaheim and he explained the entire thing to them;

that it was his feel-ing they were going to go ahead with
it; that he assured them that as far as he could detetSnine
there was no lien against the property nor would there be
one in the immedi:ate future, that the Council had to form
the district, it had to go to bid, had to go to bond and
be completely cleared before there'was any lien; that he
had also had several inquires in his office and written
letters on this subject.
Mr. Michael V. Dargus, 13260 Francisquito, Baldwin Park,
stated that on July 27th he wanted-to obtain a loan on his
property; that the only way the escrow could be cleared
was for him to sign intentions of assuming the debt of
the pending lien of $1,056.00.
Councilman Holmes stated..that the responsible officials
of Title Insurance and Trust Company should come to a
Council Meeting and explain why this happened, explain
the problems and loss of sales etc. and how they are
going to get the problem straightened out.

Chief Administrative Officer Nordby stated that he had had
handed to him just prior to the meeting a request from the
Pasadena Star News to occupy a room In City Hall as a
press room; that they wish to place a phone in the room at
their expense and would pay rental for the space; that he
withheld any recommendation at, this time in that he had
not had an opportunity to study the matter; that he would
report on this, if possible, at the next regular meeting.

Chief Administrative Officer Nordby presented to the
Council a report from City Engineer Young regarding a
deficiency report on flood control and a copy of a letter
from Mr. M. E. Salsbury, Chief Engineer of the Los
Angeles County Flood Control District, dated June 3, 1963,
requesting a deficiency report.
City Engineer Young stated that there would possibly be
money left over from the 1958 Bond Issue to do supple-
mental projects reported in the original 1958 Bond Issue
report; that the Flood Control District was trying to
establish a priority list for the supplemental projects
and also to plan for the future; that his recommendation
was that the City Council approved his report as submitted
and authorize its transmittal to the Los Angeles County
Flood Control District.
COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL CONCUR WITH
THE RECOMMENDATION OF. THE CITY ENGINEER AND THAT THIS

City Engineer Young reviewed his report on the seepage pit
at Merced and Vineland. He stated that the pit was working;
that there was a little scuffing around the lawn, however
the City forces would take care of. this.
Councilman Holmes stated that the Council had specifically
asked for the grade elevation differences and the possi-
bility of a standard cross gutter.
City Engineer Young stated he had not obtained this inform-.,
ation yet. He commented that Mr. Welch would return to work
next Monday, September 23, 1963, and that Mr. Hugh Cox
would be going into the army on September 25, 1963.
Mr. Michael V. Dargus, 13260 Francisquito, Baldwin Park,
asked the City Engineer when something would be done about
Francisquito and Frazier; that the School District put
in the curbs and gutters about two months ago, that there
had been no pavement hookup and the boulevard stop signs
were in the right of way.
City Engineer Young stated this matter would be checked into.

Planning Director Kalbfleisch handed to the Council maps
of a block study on the area bounded by Ramona, Frazier,
Monterey and Grace which had been requested by the Council
at their last regular meeting. Mr. Pritchard and another
gentleman in the audience received a copy of this map also)
Planning Director Kalbfleisch stated that in studying this
area thoroughly he arrived at a fifty 50) foot right of
way between two dwellings on Monterey leaving a ten 10)
foot side yard on either side; that the property to the
rear of the church was for parking and could be developed
into a right of way future street); that the cul-de-sac
encroaching into the R-2 property was eliminated; that
the parcels were split similar to what could be developed
as an R-I development; that the dark colors on the map
show where the properties have been dedicated.
Councilman Holmes commented that he would like to meet with
Mr. Pritchard and other property owners and go over this plan.
Mr. Gilbert Pritchard, 3735 Monterey Avenue, Baldwin Park,
stated they had petitioned for R-2 in that area; that they
do not want a street.
Councilman Holmes stated as he recalled from the communica-
tions the first choice was to leave It R-I without a street
as outlined or any street, period; that the second choice

Mr. Pritchard commented that there was not access to the
cul-de-sac; that the street was originally designed to go
through to Ramona, that building permits had been issued,
that there was R-3 on Ramona right now, and that they
were currently building; that in his opinion R-2 was a
logical back up; that R-2 almost encompasses the next
block down to Athol; that they front on a high speed
highway; that there was a school and child day care center
on Monterey; that they ware within five blocks of a
parochial school and church, and there was a church In the
immediate block; that there was all the facilities for a
medium density development; that in a few years, possible
tow, or three there would be a San Gabriel River Parkway
which would tie into Ramona and Los Angeles from Olive
Street; that there would be sewers there in approximately
one 1) year; that they want R-2 and the street eliminated.
Councilman Bishop stated if the property owners wanted
a zone change to R-2 the proper procedure would be to
file a zone change application with the Planning Depart-
ment.
Councilman Holmes stated the study presented would not
have any merit as R-2 but as R-l It might have. He asked
Mr. Pritchard if he had any ideas of how this land could
be developed R-2 with access.
Mr. Pritchard stated there was already property that had
a lot split with access; that there would be a problem
now as the new lot split ordinance required that the lots
face a street.
Discussion followed concerning the rental and selling
potential of R-2 and R-l.
Mr. Pritchard stated. he would like to ask the City Attorney
why the Council could not consider the R-2 zoning request.
City Attorney Flandrick stated that the zone change case
could be initiated upon the filing of an application by
any property owner or by action of this Council to initiate
studies to that end or by the Planning Commission.
Mayor Bloxham stated that If the property owners wished R-2
zoning to be considered that an application for the zone
change be filed.

Mrs. Gilbert Pritchard, 3735 Monterey Avenue, Baldwin Park, MRS. GILBERT PRITCHARD,
stated that in her husband's opinion that in the over-all 3735 Monterey Ave.,
blanket zoning that was being done for the area there should B.Pk.
be a R-2 buffer zone.
Planning Director Kalbfleisch explained that In rezoning
from A-I to R-1 mailed notices to the property owners
were not required; that notices were required if rezoning
to R-2; that the Planning Department was not sufficiently
staffed to handle blanket zoning of this type.
Mrs. Pritchard stated that Planning Director Kalbfleisch
stated at one of the meetings that the street might even
go through from Frazier to Ramona, cutting the block in
half; that at approximately the same time the City gave
a permit to Mr. Howard to build highrise" where the
street might go. She stated the original petition was
to eliminate the street. She commented that the church
had the rear property to build a private school.
Planning Director Kalbfleisch commented that one hundred

Councilwoman Taylor stated concerning the church property,
if the street went through It would split the property so
that some of the buildings would be across the street from
the church.
Mr. B. W. Izell commented that if he was correct there
were some houses in this area built with the Intention
that they would some day face this future street.
Discussion followed wherein it was determined that the
houses were built at 3730 which were on the opposite
side, not in the area under discussion.
There was further discussion.
City Attorney Flandrick stated that Planning Director
Kalbfleisch advised him that the area dedicated closest
to Frazier street now had existing structures facing on
the proposed street frontage.
Mr. Leo King, 3830 Grace, Baldwin Park, stated he was
for anything workable; that the plan submitted by the
Planning Director did not seem to be a working proposal;
that they would like to eliminate the street; meaning
residents In the area) that In their opinion the plan
would hold them up In the development of their property
for quite a number of years. He asked that the Council
make a proposal concerning R-i, elimination of the street,
and allow the property owners to build without requirements
of the street.
There was further discussion.
COUNCILMAN MOREHEAD MOVED THAT THIS PROPOSED PLAN DEVISED
AND RECOMMENDED BY THE PLANNING DIRECTOR BE FILED IN HIS
OFFICE AND SINCE AGP-15 HAS NOT COME BEFORE THIS COUNCIL
AS OF YET TO GO AHEAD WITH THE STUDY FROM A-1 TO R-1 AND
SEE WHAT HAPPENS NEXT OR NEXT YEAR WHEN THEY START
DEVELOPING THIS PROPERTY FORGET ABOUT THIS STREET FOR
THE TIME BEING AND GO AHEAD WITH,THE PROPOSED A-1 TO R-l
ACCORDING TO THE MASTER PLAN).,
Planning Director Kalbfieisch stated that under the
urgency ordinance processed an AGP was not required;
that AGP-15 was cancelled out; that there was a zone
change case pending that would be before the Planning
Commission next week A-I to R-1 In this entire district.
Councilman Bishop ceMriented that this motion did not say
that the street would not go in or it would go in; that
when a lot split application was submitted it would then
be taken under consideration.
COUNCILMAN BISHOP SECONDED.

City Engineer Young stated that the traffic stUdy was
supposed to have been completed at Vineland atid.Pacif$c
today; that he had not received the figures from the
study; that the speed limit sign was not In existence
on Pacific anywhere from the City limits west between
West Covina and Baldwin Park down to this side of the
bridge; that there had been instructions to install a
twenty-five 25) mile per hour sign.

City Engineer Young reported that on August 14, 1963,
Assistant City Engineer Welch and he had attended an
American Right of Way Association Luncheon at the Biltmore;
that this was a lialson meeting; that Rudolph Hess from the
State Highway Division and several others spoke on the
Importance of tiai9an between the right of way engineers,
the people obtaining the right of way, and the people
purchasing the right of way, explaining for what reason
the right of way was needed and stressing sincere honesty
in appraisal of the land.

City Engineer Young reported that he attended on August 23,
1963, the Southern Chapters Municipal Water District Meet-
ing at Los Virgines; that the purpose of the meeting was
to show what was being done to help the area in the future;
that the area comprised 117 square miles including Los
Angeles County up to the Catilegus Water District including
Malibu Lake; that an eight 8) million steel tank reservoir
was under construction in the Los Virgines area; that they
were taking metropolitan water from a thirty 30) inch line;
that they had five booster stations, two of which were in
operation, that take twenty-one thousand gallons per minute;
that they were using just under nine thousand gallons'per
minute.
