journed regujar session at the above pace at 11:00 am.

planned to bring the line in and tie it in at Lark Ellen
and Cypress; that in the interest of public relations Mr.
Glen Taylor of Southern California Edison called him and
asked him to bring this to the attention of the Council;
that he and Mr. Welch had toured the proposed route along
Olive) shown in dark blue on the sketch; that he and
Mr. Welch suggested the possibility of two alternate
routes shown in red on the sketch; that they were ready
to finalize their plans for the lines and wished the con-
currence of the Council.
Discussion followed.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ASK THE
SOUTHERN CALIFORNIA EDISON TO MEET WITH US AGAIN AND PUR-
SUE THIS FURTHER TO COME UP WITH A BETTER ROUTING THAT
THEY CAN LIVE WITH AND WE CAN TOO.
The motion was withdrawn. MOTION WITHDRAWN
Mr. Henry Littlejohn, 4225 North Jerry, Baldwin Park, HENRY LITTLEJOHN,
stated that the ground under these lines would be lost 4225 N. JERRY, B.PK
other than for possible parking or grazing of cattle;
that the City should consider what these lines would do
to useful land; that possibly the lines could be run
along with the Bureau of Power and Light lines.

Mayor Bloxham commented that perhaps this meeting could be
adjourned to meet with a representative of the Southern
California Edison Company.

Chief Administrative Officer Nordby stated that the City RE PROBLEMS \IITH

Mr. A. J. Gilbert, Counsel for Title Insurance and Trust A. J. GILBERT,

he was at the meeting at the informal request of Mr.
Nordby to probe or answer certain inquiries affecting
the premature notice of possible assessments; that with
him was Mr. John Tompkins, Vice President of Title
insurance and Trust and the Manager of the entire tax and
assessment program of Realty Tax and Service Company;
and also Mr. Frank Hansen, Supervisor of the entire
operation of the assessment. He stated that they pledged
their cooperation with the Council in resolving any
problems that may have arisen as a consequence of this
particular act. He stated he would like for the record
to reflect a little more detail respecting the nature
of the complaints and the reason for asking them to
appear.
Councilman Holmes stated that the people in this district
not yet created) who had tried to sell their property
had been faced with an assessment which in some cases had
to be paid off before the sale could be consummated; that
the premature flagging of properties by T.I. & T. had
prevented the consummating of loans; that the lending
agencies for the sale of new homes in the area were
asking for more money for down payments; that how this
had happened was not the problem; but how this coul(I be
cleared up was the matter to be considered.
Mr. John Tompkins, Vice President of Title Insurance JOHN TOMPKINS, VICE
and Trust Company explained the numerous assessments in PRESIDENT OF TITLE
the County daily. He stated that once they establish INS. AND TRUST CO.
the hearing date it was their normal procedure, about
ten 10) days prior to the hearing to notify the escrow
where they had open orders of the existence of a possible
assessment and the fact that the hearing date was a
given day; that the loan institutions were vitally
interested in proposed assessments; that in order to
notify and to know what was involved they must have
an assessment spread; that they checked the assessment
spreads for description and advise of any errors
found; that they could not pin point why or how but
they came up with a hearing date of July 17th on this
sewer district; that they learned of their error on
August 21 and immediately put out a bulletin; that they
would examine the records every other day to make sure
that such a mistake did not occur again; that they did
not know their source of information; that all they could
say was that it was in their files and they used their
usual procedure; that it was a clerical error made by
someone in their office; that they reexamined all of the
minutes of the Council meetings, there was no such date;
that they were very apologetic.
Councilman Holmes stated that the Council was still receiv-
ing complaints.

Mr. Frank Hansen, Supervisor of the entire operation of the
assessment, explained how the rescinding order was handled,
He stated they would try to rectify the loopholes in their
machinery regarding the proposed assessments reported since
the shut down,
In answer to a question by Councilman Holmes, Mr. Hansen
stated they started their processing approximately ten 10)
days prior to the hearing date; that in larger improvements
such as this one It was a little sooner.
In answer to a question by Councilman Morehead, Mr. Thompkins
stated that should the assessment district not go through
to completion they would report to the title company on
all of their open orders that the assessment district no
longer existed and they in turn would report to the banks
and escrow companies. He stated the rescission would only
be in the event the assessment district was entirely voided;
that there would not be a rescission because of postpone-
ments or delays.
Mr. Pat Rossetti of Laurence Thompson's office stated they
usually supply the rolls to Title Insurance and Trust
Company for checking; that there was no charge for this.
Mr. A. J. Gilbert, Counsel for Title Insurance and Trust
Company and Realty Tax and Service Corporation; stated that
he was going to suggest to the operations that the word
proposed" assessment be used more often; that if the
City had further complaints and the City felt this was not
their fault and the City had nothing to do with it they
would be delighted to have the City refer those com-
plainants to them; that these people could be referred to
Mr. Thompkins, Mr. Hansen, Chairman of the Board or
himself at Realty Tax and Service Company.
Mr. Thompkins suggested that these people could call
Mr. Hansen, Mr. McCall or Mr. McDougal; that the people
could call through Title Insurance and Trust Company or
Realty Tax and Service Corporation.
At 12:00 P.M. City Engineer Young arrived.
In answer to a question by City Engineer Young concerning
properties in the proposed assessment district where
escrow was being held up, Mr. Hansen stated if City Engineer
Young could give them the Assessment Number they would
trace through the plant and have the Title Officer in-
struct the escrow that this was a proposed assessment
which they showed prematurely.
Mr. Urban J. Schreiner stated that if everything went
as planned the hearing date would be November 6, 1963,
for Assessment District No. 62-A-I).
The City Council instructed that City Clerk Balkus send
Mr. Thompkins the resolution declaring the intent to order
the construction of sewers in Sewer District No. 62-A-I.

City Engineer Young handed to the City Council a diagram
of the Frazier Street overpass. He stated in his opinion
the best place for walks would be on the west side of
the overpass; that they proposed to put an asphalt walk
and a chain link fence on the side; that his estimate
including materials and labor was approximately $1500.00;
that to completely insure that the children did not get
into the streets would take a fence on both sides.

Councilman Morehead stated the resolution designated two

Mr. Nordby stated in the past years the Chief Administrative

the attached map. During the course of this investigation, 481 house-to-
house or business establishment calls were made. Of this number, 164 occu-
pants were not at home or did not answer the door. Of the 317 property
owners or tenants actually contacted, 166 or 52.30 reported having experienced
trouble with their individual subsurface sewage disposal systems. They
complained of the seepage pits or cesspools filling up causing raw sewage
to back up into the plumbing fixtures or to overflow onto the surface of the
ground. Also that frequent pumping and cleaning out of the seepage pits and
cesspools or the installation of new pits or leaching line systems was
necessary.
The majority of the homes within the area of this proposed Sewer Assessment
District were erected from 10 to 40 years ago. At the time, many of them
were constructed single cesspools, without septic tanks, were installed as the
method of sewage disposal. The effective sidewail leaching areas of these
cesspools are now becoming sealed with a natural accumulation of sludge and
grease due to their long period of service. When this condition occurs, they
cease to function properly and soon fill up and become inoperative.
In view of our survey, the undersigned Health Officer of the County of Los
Angeles, having been officially designated by the City Council of the City of
Baldwin Park to perform public health services for the City of Baldwin Park,
do hereby recommend that sanitary sewers be installed in Sewer Assessment District
No. 62-A-1. This recommendation is made as an improvement necessary to the pro-
tection of public health and pursuant to the provisions of Section 2808 of the
Streets and Highways Code.

Mayor Bloxham announced that the City Council now had RE POSTING OF NOTIC
jurisdiction to call for construction bids for the work CALLING FOR CONSTRU
and that it would be in order for the Council to adopt its TION BIDS
resolution ordering the posting of notice inviting bids
for improvements.
Mr. Schreiner stated that posting of the notice on the
bulletin board suffices for the legal notice; that
the Green Sheet would also carry the notice.

Mr. Schreiner stated this concluded the action that could
be taken on Sewer District No. 62-A-I at this time.

City Engineer Young brought out that in Sewer District
No. 61-A-1 there were manholes on the plans that were
not spelled out as dropped manholes; but should have
been in his opinion; that six 6) manholes had been
withheld for payment.
Mk. Schreiner stated he would review the specifica-
tions and make a determination of how many there were
in this district.

City,Attorney Flandrick reported that recently the
Tribune, had filed a suit to adjudicate the Baldwin
Park Bulletin as a newspaper of general circulation
within the City; that this could mean that the City
would be required to publish all future ordinances;
that he had received a copy of the petition and several
other documents from the attorney representing the
Tribune; that there was some doubt as to whether they
were to be so adjudicated due to the fact that there was
some discrepancy as to whether they were in circula-
tion or in business, as such prior to 1923; that at
the next meeting on Wednesday he would advise the Council
in writing as to the status.

Councilwoman Taylor stated that a piano was still needed
for the reopening of the Civic Auditorium.
The Council instructed that Councilwoman Taylor and City
Clerk Balkus be appointed to select a piano; that advertis-
ing be authorized if necessary; that $10.00 to $15.00 be
authorized to have an expert check out the piano chosen.
