FOR THE PURPOSE OF HAVING A PUBLIC HEARING ON SEWER ASSESS-
MENT DISTRICT 62-A-I. COUNCILMAN HOLMES SECONDED. There
were no objections, the motion carried and was so ordered
by Mayor Bloxham.

At 7:20 P.M. Mayor Bloxham reopened the City Council meet-
ing in the City Auditorium and announced that this was the
time and place fixed for the hearing of protests, objec-
tions or appeals in respect to the assessment and work
under and pursuant to Resolution of Intention, Resolution
No. 63-132, the report of the City Engineer prepared and
filed, and the Municipal Improvement Act of 1913.
City Clerk Balkus presented the affidavits of publication,
mailing and posting of notice of hearing and affidavit of
filing map with the County Clerk, stating that as required
all had been signed and notarized.
Mr. Urban J. Schreiner outlined and gave a brief resume of
the district, explaining that the proceedings the City
Council was undertaking were under the Municipal Improve-
ment Act of 1913. The Act by which the City Council has
designated a certain area of the City which they feel will
benefit and be served by the construction of sewers. The
means by which the sewers would be put in would be to call
for bids, then the contractors submit bids,(which bids
were received and opened on October 30, 1963) then the
contractor sets about to do the work for which he is paid
in cash. The work on this district would commence in
December or the early part of January).

Mr. Schreiner further explained th.it the second aspect of RESUME CONTINUED

assessment over all the parcels in the district that the
City Council has designated as Sewcr District 62-A-I. The
assessments have been spread by a professional assessment
engineer according to-the benefit i ih a i eac'i property de-
rives from the sewers; larger properties receive a larger
assessment and the smaller properfies a sma!ler assessment.
It was explained that the purpose of the Public Hearing
was to take evidence and give the Cit, Council an opportunity
of hearing what the property owners have to say about the
work, about the extent of the assessment district, and
about the assessments themselves. The City Council would
hear read all the written protests and following that
the persons who had submitted written protests would be
given an opportunity to address the City Council orally
and support their written protest. Following that persons
who had not submitted written protests would be given an
opportunity to make an oral protest or ask for some
adjustment or some type of relief. It was stressed that
each property owner, at the time he was given an opportunity
to speak, would be asked to give his name, address, and
description of the property owned.
Further explanation outlined that following the Public
Hearing the City Council would consider all the evidence
received and make the adjustments which they consider were
warranted by the written and oral protests. Then, follow-
ing the carrying out of any changes considered necessary
the assessment would be confirmed, which means that a
lien would be placed on all the lands within the district.
Following a thirty 30) day period, during which property
owners may pay their assessments in cash, assessment bonds
would be issued. These bonds would be sold on the basis
of public bidding in the same manner that a construction
contract is awarded on public bidding. The reason being
that in this way the cost of the financing, the interest
cost on the assessment bond, would be kept to a minimum,
which results in a saving to the property owners in the
district.
Mr. Schreiner explained that in the first district the bonds
were sold to bear interest at 4.45%, so that persons who had
allowed their assessment to go to bond were given an opportunity
of paying their assessments over a ten 10) year period,
paying interest at the rate of 4.450 for the ten year period.
in closing, Mr. Schreiner stated the City Council was present
to hear evidence, take evidence, to devejop a basis for making
any adjustments it deemed necessary.

Ledford; then crossing the Freeway on the Frazier Street
overpass to Westcott,along the power lines to Ramona and
East to the Westerly City Limits.
Mr. Young stated he had checked the plans in detail and found
that the located lines serve, in general, all the properties
lying within the district; and after investigating some
complaints by the property owners some minor changes should
be heard and considered by the City Council.

th;s was the size and extent of the lines.

Councilman Bishop questioned the area north of Olive
Street up to Arrow in the vicinity of Ohio Street.
City Engineer young explained that from Center east to
the property line between!'lalnut and Merced, extended across
Olive, there is an area 1501 north of Olive in District
No. 2, and that a segment of Irwindale could come into
the next district if they so desire.

Í«Adjourned Regular Meeting of the Baldwin Park City Council
Mr. Patrick Rossetti, representing L. J. Thompson, Assess-
ment Engineer, stated there were 3500 parcels in the dis-
trict; that it was their job to spread $1,648,557.46, which
was a revised estimate of the total cost of the job over
the 3500 parcels; that the benefits accrued to each parcel
of land were judged on the benefits of the property owner.
Regarding the payments Mr. Rossetti stated when the project
was confirmed by the City Council and recorded the property
owners had thirty 30) days in which to pay in cash; that
the billing was from the City Treasurer; that the assess-
ments not paid within the thirty 30) day period would go
to a ten 10) year bond; that the bond would be at six
percent 6%) or less; that the billing would be twice a
year, twice for the interest and once for the principal;
that a payoff required a five percent 5%) premium on the
unpaid principal.
Mr. Urban J. Schreiner stated the notice received in the
mail by the property owners which stated the estimated
assessment on the property was based on the original
estimated cost of this work; that the estimate was made
before the construction bids were received on October 30,
1963; that the construction bids were substantially below
the Engineer's estimate; that the special consultants to
the City and the City staff held a meeting two 2) days
previous to review the bids and to review the estimate of
cost of this job; that it was their recommendation to the
City Council-to lower everyone's assessment by slightly
over twenty percent 20%).
Mayor Bloxham asked if any person who had filed a written
protest, or his representative, desired to be heard in
support of such protests.
Mrs. T. E. Johnson, 3825 North Foster, Baldwin Park,
stated she wrote requesting to be included in the district;
that her property faced the County Trunk Line; that at
one time the City Engineer did assure her than an eight
8) inch line could feasibly be put down in the street
over the existing trunk line at a much shallower depth
which would be much more economical to the people; that
she would be willing to contact other people facing that
street if the Council would be willing to consider this
to see if they felt the same as she did.
Mr. William E. Stamper, 3367 North Nolina Street, Baldwin
Park, asked if sewers were going to go through whether the
people wanted them or not.
Mr. Schreiner stated that the procedure that the law
required did not require a vote; that the people were
given an opportunity to file their protests and objec-
tions; that the City Council had the right to make the
decision to go forward or to abandon the proceedings,
Mr. Robert T. Solton, Attorney, spoke regarding the par-
cels of land being taken for school purposes. He stated
that the complaint for eminent domain was filed on September
24, 1963; that there were eighteen 18) parcels under
condemnation; that seven 7) of these property owners had
apparently come to terms; that the escrow should close
very shortly; that as far as the rest of the properties,
the property owners were not protesting the validity of
the proceedings; that they had a quarrel as to the evalua-
tion of the assessment;that the homes would be taken out;
that they were asking that this area be eliminated from
the assessment district.

Mr. Schreiner stated that it would be his recommendation
that the assessments be treated in such a way that pay-
ment was not required of persons who were not going
to remain owners of the property for more than four 4)
or five 5) months.
Mr. Howard Sutterfield, Assistant Superintendent, Baldwin HOIJARD SUTTERF)ELD,
Park Unified School District, stated he wanted the Council Asst. Supt., B.Pk.
to take into consideration even though the school was Unified School Dis-
acquiring the property they would also need sewers; that trict
it was hoped that the Council would see fit to exclude
this at this time because the school would be built and
was hoped to be in operation within one 1) year; that
the primary concern was that the escrows not be delayed
and a way be found to assess the school district after it
became the owner of these properties and to later assess
the other properties as they become district property.
Mr. Earl Strawn, 13360 Tracy, Baldwin Park, stated the EARL STRAWN, 13360
title company had told him tomorrow November 8, 1963, the Tracy, B.Pk.
assessments would be on the properties; that he was one
of the seven people in escrow to be school property);
that his property went in escrow on September 4, 1963;
and didn't think an assessment to him was fair; that he
owned two parcels in this district but only received notice
on one. He asked if it was going to be mandate that the
people connect to the sewers right away; that in his
opinion there had not been a fair survey taken; that
he objected to the City Engineer's report being approved
the same day it was asked for; that he would like the
people of the City to express themselves by voting in
this matter.
Mr. Schreiner stated the fact that an assessment was
levied on property in escrow did not mean that the
current owner would pay the assessment; that the assess-
ment was on the land itself; that when an assessment
was levied on property in escrow and the escrow was
closed this did not change the fact that the assess-
ment remained on the property and must be paid by the
new owner; that the documents in the City Engineer's
report were a mat ter of,puib t i c record.
Mr. Strawn asked if the Council had the authority to
set this assessment aside, say for forty-five 45)
days.
Mr. Schreiner stated the Council was guided by legal URBAN J. 3CHRE)NER
principles; that it did have the discretion to have
the assessment spread in accordance with the benefits;
that it had the discretion to determine what property
in the assessment district was benefited; that the Council
did have the discretion to have the hearing continued
for a re.sonable time and to set aside the proceedings;
that in he avent the proceedings were continued for a
substan+ici period of ime it would not be possible for
the Council to make an award of the construction contract
whose bid was the low bid. He also stated that there
were approximately one hundred ten 110) written pro- APPROXIMATELY 110
tests 3 % of land less than one-half of the land WRITTEN PROTESTS
within the district).
Mr. Joseph Balkus, 4625 North Harlan Avenue, Baldwin Park, JOSEPH BALKUS, 4625
stated he was sure it was not the original intent of the N. Harlan Ave., B.Pk
original design to bring the main trunk line within ten
10) feet of the front door when economically and engineer-
ing wise it was feasible to do otherwise; that normally
sewers increase property values. He asked how much time there
was for one to-take further steps if opinions differed.
Mr. Schreiner stated there would be thirty 30) days.

Mr. Jackson Baker, 13433 Benbow Street, Baldwin Park, stated JACKSON BAKER, 13433
he was charged for seven hundred fifteen 715) fo' of eenbow St., B.Pk.
sewer; that his property did not touch any street; that
although three 3) attempts had been made in the last five
5) years he had not been able to subdivide his property.
Mr. Rossetti stated the City Engineer had a suggestion
to eliminate that line and redirect the line from Dunia
Street and instead of flowing west to flow east; that if
this was done it would eliminate two hundred forty 240)
feet of assessment against the Baker property and would
modify the assessmentagainst the Balkus property; that
this was at the discretion of the City Council; that as
far as the opinion of the Assessment Engineer the current
assessment was a logical way of spreading the assessment;
that if there were problems involved in subdivision this
was another matter.
Mr. Baker stated if he was assessed for Dunia, sixty 60)
feet, that in his opinion he should be able to build a
house there.
Mayor Bloxham instructed that the Engineers further study COUNCIL INSTRUCTION
this matter.
Mrs. H. H. Steedley, 3428 San Gabriel River Parkway, Baldwin MRS. H. H. STEEDLEY,
Park, protested the cost of the sewers. 3428 San Gab. River
Parkway, B.Pk.
Mr. Wayne M. Collum, 13511 Lubicon, Baldwin Park, stated WAYNE M. COLLUM,
his notice was mailed to Kin lock. He asked when the 13511 Lubicon, B.Pk.
property owners would be notified of any action that
would be taken on the appeals or objections.
Mr. Schreiner stated there was no requirement that any
further notice be given as to when the City staff reports
back to the City Council; that all formal action legally
had to be taken at an open Council meeting; that the pro-
tests and objections given tonight would be studied by the
City staff and the City staff will then make a further
recommendation just as it did on the financial aspect of
the job and the City Council would then place it on the
Agenda for a regular meeting; that this would take approxi-
mately two 2) weeks to get these thing ironed out.
Mr. Collum stated that he had not been able to obtain a
formula for the assessment; that he did not feel persons
on a cul-de-sac should be assessed in that manner"; that
when there was three 3) pieces of property on one
side of the cul-de-sac that were all different sizes and
shapes and all assessed the same there should be some
adjustment.

and stafod that he recommended no change regarding this

and maybe a reassessment.
Mr. Preston Matthew, representing the Church of Christ, PRESTON IAATTHEt'!,
3510 Baldwin Park Boulevard, Baldwin Park, stated the Church of Christ,
property reached from Baldwin Park Boulevard to Maine 3510 B.Pk. Blvd.,
Street, 22721 feet on each street; that they were being B.Pk.
assessed for 455 feet; that due to the City of Baldwin
Park regulations they were forced to purchase this
property for a parking lot; that they requested that
this assessment be reconsidered and reevaluated.
Mr. Rossetti explained that the property could be divided
and developed and that he found nothing wrong with the
assessment.

Mr. Rossetti stated those changes could be made. He further
stated that the present use of the property did not
affect the assessment spread.
Mr. Schreiner also explained that the fact that property
may be zoned for a particular use did not mean that the
property could not be assessed x" number of dollars even
though under the current use it may be under a restricted
form of use; that the assessment was spread on the land
underneath that parking lot just as though the parking
lot was not there.
Mrs. Raelene N. Morton, 13030 East Farnell, Baldwin Park, MRS. RAELENE N.
stated that every property owner in Tract No. 26383 had MORTON, 13030 E.
signed a petition that they did not want sewers; that no Parnell, B.Pk.
one would benefit from the sewers.
Mr. Schreiner stated this was up to the discretion of the
City Council to look upon this and adopt a policy of
sewering all of the streets in the City or severing
all but the streets where everyone protests or take
whatever action it feels appropriate.
Mrs. Morton stated that the homes were only eighteen 18)
months old and had septic tanks which cost $500.00;
that in her opinion she did not feel that because
one hundred sixty-six people requested sewers that the
owners in the tract should have to put in sewers; that
this property was located south of the freeway off of
Frazier Street; that Farnell was a cul-de-sac.
Mrs. Enrico Chastek, 13024 Ledford, Baldwin Park, stated MRS. ENRICO CHASTEK,
she had a corner lot on a half circle and asked if $557.78 13024 Ledford, B.Pk.
would be her total assessment; that this assessment was
going to make a financial hardship on some of the properties
in this area.
Mr. Rossetti stated this was the total assessment.
Mr. Schreiner stated with the recommended twenty percent
20%) decrease the assessment would be approximately
$440.00 and explained the bond payments if this was not
paid in cash.
M.. T. E. Roberge, 13050 Farnell, Baldwin Park, stated T. E. ROBERGE, 1305C
he had called the City Hall before he bought this Farnell, B.Pk.
property, about nine 9) weeks ago, and had been told
they had no idea of any sewers at all"; that he could
not afford sewers.
Mr. Ray Schweitzer, 2655 North Beverly Glen, Los Angeles, RAY SChWEITZER, 2655

Mr. Schreiner stated the work, if the sewer district
proceeded, would commence almost immediately; that
there was a seven 7) month construction period for
the entire job.

Adjourned Regular Meeting of the Baldwin Park City Council
Mayor Bloxham left the meeting for approximately five 5)
minutes at 10:36 p.m.
Mayor pro tem Holmes asked if any person wished to make an
oral protest.
Mr. Jack Thomas, 13151 Shaver, Baldwin Park, asked why he
did not receive a notice in the mail.
Mr. Rossetti explained that the names were taken from the
last equalized assessment roll on file with the County and
that there had been approximately four hundred fifty 450)
notices returned; that an effort was being made to obtain
the correct addresses.
Mr. Thomas stated that he could not afford the sewers and
did not need them; that he wanted to know if this community,
behind the Edgewood Drive-in Theatre had any appeal; that
there were thirty-one 31) homes in this tract.
Mayor Bloxham stated the protest would be accepted and taken
into consi.deration.
Mr. Richard Genovese, 4603 Walnut Street, Baldwin Park,
stated that in his opinion Baldwin Park should be cleaned
up and not worry about sewers and septic tanks; that there
was trash in town and across the street from him; that he
thought he was being charged too much.
Mr. Rossetti stated the assessment was in keeping with the
area to all of the other property owners.
Mr. Genovese asked if the property owners had to hook up
to the sewers.
Mayor Bloxham stated they were not compelled to hook up.
Mr. Thomas asked if he could have the figure of his assess-
ment since he did not get a written notice.
Mr. Rossetti stated it was $557.78, minus the twenty percent

Mr. Thomas asked if anything could be done about the entrance
and exit traffic and the amount of debris thrown along the
entrance street.
Mayor 3loxham stated he would make a note of this; that it
was off the subject of tonight's meeting.
Mr. Elliott Denison, 4072 North Harlan, Baldwin Park,
protested the high cost.
An unidentified woman asked if the people would have to
hook up.
Mayor Bloxham stated his answer was that the people did
not have to hook up.
City Engineer Young stated the people were not obligated
to hook up at the time the sewers go by; however it had
been the policy of the City that as the sewers were
available and the septic tanks went bad then owners must
hook up.
Mr. Verne Rosevear, 3921 Hornbrook Avenue, Baldwin Park,
asked what guarantee the people had that the streets
would be put back in their original condition.

Mayor Bloxham stated that it was included in the contract

Mr. Leonard Dougherty, 13554 East Corak, Baldwin Park, LEONARD DOUGHERTY,
stated he protested the excessive amount and asked how 13551+ E. Corak,
the figure was arrived at. He asked why the interest was B.Pk.
paid every six 6) months.
Mr. Schreiner stated if the interest were six percent 6%)
payable twice a year three percent 3%) would be paid in
July and, three percent 3) in January; that for the year
period you would be paying six percent 6%).
Mr. Dougherty asked how soon after the work was completed
the streets would be put back in their original condition
and was this a bonded bid.
Mr. Simms stated it would be approximately six 6) weeks
and that this was a bonded bid.
Mayor Bloxham asked Mr. Dougherty to come on the stage
for an explanation by Mr. Rossetti on his assessment.
Mr. Thomas Knight, 13615 Rexwood, Baldwin Park, stated THOMAS KNIGHT,
in his opinion the City Council was not truly interested 13615 Rexwood, B.Pk.
in the feeling of the property owners when only four
hundred eighty-one 481) persons were contacted and not
all of them property owners; that he had no objections to
sewers. He asked why in surrounding cities sewers were
being put in at $5.00 a running foot and it was about
$11.00 in Baldwin Park. He also asked if the contract
was open to the public.
Mayor Bloxham stated that any of the records were open to
the public.
Mr. D. W. Asquith, 13138 Judith, Baldwin Park, asked the D. W. ASQUITH, 13138
assessment engineer how the assessments were figured. Judith, B.Pk.
Mayor Bloxham asked Mr. Asquith to step up on the stage
for an explanation by Mr. Rossetti.
Mr. Bill Nixon, 3235 Cosbey Avenue, Baldwin Park, stated BILL NIXON, 3235
he wished the amount of his assessment; that he did not Cosbey Ave., B.Pk.
receive a notice.
Mayor Bloxham asked him to see Mr. Rossetti on-the stage.
Mrs. John Kotonski, 3836 North Grace Avenue, Baldwin Park, MRS. JOHN KOTONSKI,
asked if the sewers would be hooked up right to the house 3836 N. Grace Ave.,
and stated that the assessment was too high. B.Pk.
Councilman Bishop explained that the sewers could not be
hooked up until they were in and checked out.
Mrs. Judith Asquith, 13138 Judith, Baldwin Park, asked MRS. JUDITH ASQUITH,
where there were no sidewalks how far in was the parkway 13138 Judith, B.Pk.
from the curb line.
City Engineer Young stated it was twelve 12) feet from the
curb line to the property line on Judith; that the sewer
line would go twelve 12) feet past the back of the curb.
Mr. Lloyd Holmes, 3W441 Robinette, Baldwin Park, asked if LLOYD HOLMES, 34441

City Engineer young stated that a buiiding permit would
have to be taken out and the work would have to be inspected
by the Building Department.
