regular session at the above place at 7:30 p.m.
Councilman Holmes led the salute to the flag.

Mr. James Garrow, representing the Baldwin Park Improve-
ment Association, presented a Committee Report on the pro-
posed new library building which suggested that the City
Council make available to Los Angeles County the land
adjacent to the Civic Auditorium for a 10,000 square foot
library building and that the City Yard be moved to
another location.

COUNCILMAN MOREHEAD MOVED THAT THE REPORT PRESENTED BY

SECONDED. There were~no objections, the motion carried

City Clerk Balkus presented a petition signed by merchants
and property owners requesting diagonal parking along
the north curb of Ramona Boulevard.
City Engineer Young stated that his department had been
requested to make a study of this; that they had not
completed their study due to the sewer project; that with
the completion nearing they would commence their study
again.

City Clerk Balkus reviewed the letters from Lyle Dean
Jay, Mrs. Michael Hennessy, and Mrs. Eleanor Lowry,
regarding the night parking lei.
Discussion followed.
City Attorney Flandrick stated there were no provisions
under the existing ordinance to allow parking permits
for overnight parking.

Upon the consent of the Council, City Clerk Balkus brought
on the Agenda a letter from the City of Azusa dated
November 7, 1963, requesting the consent of the City Council
for their Annexations on properties designated as No. 59
and 56.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONSENT
TO THE ANNEXATIONS ANNEXATION NOS. 56 AND 59, CITY OF
AZUSA) AND HAVE NO OBJECTIONS TO THE ANNEXATION PRO-
CEEDINGS. COUNCILMAN MOREHEAD SECONDED. There were
no objections, the motion carried and was so ordered

Discussion followed wherein Councilman Holmes brought out RE NIGHT PARKING
that the problems of permitting overnight parking were
far reaching throughout the City other than the problem
In Mr. Jay's immediate neighborhood.
Mayor Bloxham stated that Mr. Nordby, Chief Administrative
Officer, would be happy to review the problems of night
parking with Mr. Jay.

Councilman Holmes reported that he had attended the
regular quarterly meeting of the Upper San Gabriel Valley
Water Association last week. He stated that one of the
facts brought out was that the water basin in the Upper
San Gabriel Valley had reached the lowest point in
history on the first of November. He stated that action
was taken opposing the Udahi Southwest Water Plan and that
it would be in order for any and all public bodies as
well as individuals to express their opposition to it.

Councilman Bishop stated he had attended the Mayors
meeting with Mayor Bloxham. He stated that the subject
of the new annexation law passed by the State legislature
was brought up; that in his opinion this law caused con-
siderable more time being spent and more red tape; that
the Committee had the power to deny but not to grant; that
it only slowed things up rather than speeding them up.
COUNCILMAN BISHOP MOVED THAT THIS GOVERNING BOARD GO ON
RECORD AND INSTRUCT THE CITY ATTORNEY TO DRAW UP A RESOLU-
TION ASKING THE STATE LEGISLATION TO BRING THIS UP BEFORE
THE LEGISLATURE AGAIN AND SEND ONE COPY TO EACH ONE OF
OUR ASSEMBLYMEN IN THIS DISTRICT, SENATOR REESE, EACH
MUNICIPALITY IN THE EAST SAN GABRIEL VALLEY AND TO THE
LEAGUE OF CALIFORNIA CITIES. MAYOR BLOXHAM SECONDED.

City Attorney Flandrick stated that a problem had arisen CITY ATTY. FLANDRICV

approval he was going to try to obtain State permission

In answer to a question by Mayor Bloxham, City Attorney
Flandrick stated that $5,000.00 was the total cost for
both appraisers. He stated that one appraiser was to act
as a back up for the other appraiser In the case of
legal attack; that he had explained this to both appraisers
and they were both willing to accept the job on that basis.

City Clerk Balkus announced that the hour of 8:00 P.M.
having arrived that it was the time and place fixed for
a public hearing on Z-198, an application submitted by
Ralph E. Newman, et at requesting a change of zone from
R-I light agricultural) zone to R-3 multiple family
residential) zone or more restrictive use for property
located at 13444, 13448, 13502, 13512, 13520, 13522
and 13526 Tracy Street.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
a resolution of denial on September 25, 1963, P.C. No.
63-138.
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR
BLOXHAM.
Mr. Ralph E. Newnan, 13448 Tracy Street, Baldwin Park,
stated he appealed the decl;sion of the Planning Commission
because in his opinion the Planning Commission did not
voice the general opinion of the neighbors in that particular
locale; that with the exception of Mr. Via, all on Waco
Street and almost all on Tracy Street even up to Robinette
have all indicated their approval of this R-3 zoning; that
the area fronting on Tracy from Francisquito and Baldwin Park
down 570 ft. was rezoned C-2 some months ago; that three of
the six properties involved in this application face that
C-2 area; that Mr. Lake on the corner of Tracy and Baldwin
Park faced against R-3 zone; that as he understood it
Robinette eventually because of the school would be cut
through; that that would mean there would only be approxi-
mately three more houses in that block; that it would be a
short block; that at the time Mr. Snyder made his applica-
tion for the C-2 zoning) the Planning Department had a
map that indicated the general area would be R-3; that Mr.
Via on Waco and Tracy already had a variance and was not
particularly interested in a change of zone at this time.
Mr. Edward L. Perritt, 13502 East Tracy, Baldwin Park,
stood up and stated that he had planned to testify but
that Mr. Newman had covered things pretty thoroughly.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to Z-198,
Mayor Bloxham declared the public hearing closed.

In answer to a question by Mayor Bloxham, Planning
Director Kalbfleisch stated that the school would be
located on Frazier Street; that It would cover approxi-
mately nine 9) acres; that directly across the street
from R-3 was the proposed commercial center.
Councilman Holmes stated that no plan for immediate
development had been mentioned; that the total amount
of R-3 in Baldwin Park was 10 to I of R-2; that much of
it was not being developed and much of it that was being
developed was developed on a limited scale because of the
financing problems In making a first class structure
that would become self-supporting.
One of the gentlemen who had testified In favor of this
request indicated he would like to speak again, however,
it was the consensus of the Council not to reopen the
public hearing.
In answer to a question by Councilman Morehead, Planning
Director Kalbfleisch stated he did not recommend this
change; that he worded his memorandum so that the Plan-
ning Commission would consider all possible aspects.

jections, the motion carried and was so ordered by Mayor
Bloxham.

a rezoning from A-I light agricultural) zone to R-I
single family residential) zone for all properties
presently in the A-1 light agricultural) zone located
within the following described boundaries: Olive Street
on the north; Los Angeles Street on the south; Maine
Avenue on the west; and the Baldwin Park City boundary
on the east.
City Clerk Balku's stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had
adopted a resolution recommending approval on October
23, 1963, P.C. Res. No. 63-153.

place fixed for a public hearing regarding the Intention
of the Baldwin Park Planning Commission to amend the Baldwin
Park Zoning Code by adding Section 9119.72 re: Area and
Yard Requirements and Exceptions.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
proposed amendment. and. stated that the Planning Corrmission
had adopted a resolution recommending approval on October
23, 1963, P.C. Res. No. 63-156.

place fixed for a public hearing on CP-20, an application
submitted by Signal Oil & Gas Co., W. E. Walkup, Vice
President, to establish a gasoline service station use
in the C-I neighborhood commercial) zone situated
southerly of the San Bernardino Freeway at the southeast
corner of Puente Avenue and Garvey Avenue.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of me
case and stated that the Planning Commission had adopted
a resolution recommending approval on October 23, 1963,
P.C. Res. No, 63-152.
Mr. Warren Lefevre, 10600 Katelia, Anaheim, stated that
the Harbor Development Corporation was buying this
property from Signal Oil & Gas Company and leasing it
to Shell Oil Company; that It would be a ranch design
service station; that the use would not injure property
owners in the area; that it was in the C-I zone; that the
property was ideally situated for a service station located
on a major highway; that the area was surrounded by
commercially zoned property on three sides.

Mr. Bruce Martin, 1085 North Harbor Boulevard, Anaheim,
stated he worked for Sheri Oil Company in the real estate
department. He stated the service station would not be the
standard steel building; that it would be of used brick;
that they had just completed a ranch type design service
station at the northeast corner of Santa Anita and Duarte
by the Santa Anita Race Track. He passed a large colored
picture of their ranch design service station at the north-
west corner of Whittier and Cypress in La Habra for the
City Council to view. He stated that Shell did have a
service station at Puente Avenue one-half mile south of
the requested location; that this was now a Mobile service
station and this was one of the reasons that they did want
to offset their representation and acquire this site on a
lease basis.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to CP-20,
Mayor Bloxham declared the public hearing closed.
Discussion regarding the drainage problem; that permanent
relief was one of the supplemental projects under the
1958 Storm Drain Bond Issue; that the Council had recently
approved a variance for a service station across the free-
way on Merced and Puente; that there were four service
stations on the corner of Pacific and Puente, one on the
corner of Puente and Merced, three on the corner of
Francisquito and Puente; that they were all closer than
one mile apart; that It would be detrimental to cut the
alley off.
With the consent of the Council, Mayor Bloxham reopened
the public hearing on CP-20 for further testimony.
Mr. Lefevre reiterated that the Harbor Development
Corporation was buying the property from Signal 01i
& Gas Corporation and leasing it to Shell OiI Company;
that the City ordinances required that the present
owner sign the application; that actually Signal
Oil & Gas Corporation had nothing to do with this
application; that a condition of escrow was that a
conditional use permit be granted; that regarding the
engineering and alley questions they had discussed
this with City Engineer Young and were willing to put
in anything in the way of an alley or putting in
permanent storm drain or any other improvements the
City would want.
City Attorney Flandrick suggested that the application
be amended to include as a co-owner Harbor Development
Corporation.
The Council and Mr. Lefevre consented to this amendment.
City Engineer Young stated there has been a drainage
problem at the corner of Puente and Garvey for a number
of years; that this was part of a supplemental program
by the County Flood Control under the 1958 Bond Issue;
that the City had been working with the State with the
hope of raising part of the street and putting In the
necessary drainage facilities using the supplemental
program so that the proper curbs and gutters and inlets
could be made; that it appeared that some time between
now and the first of the year there would be some
answer as to the amount of money available on the
supplemental Flood Control Program Project 607) that
he had suggested to Mr. Stout Harbor Development
Corporation Engineer) that the City would probably
recommend putting In temporary control flood structures to
handle part of the flood waters coming out from under
the street based on a three year program rather than a
ten or twenty year program; that the Master Plan as pre-

Chief Administrative Officer Nordby stated that approxi-
mately three months ago he received a letter from Assembly-
man Soto regarding a project which would widen and improve
Puente Avenue from Francisquito to County territory and into
the City of Industry.
There was further discussion regarding the Supplemental
Flood Control Projects.
City Engineer Young stated that Mr. Wade of the State
Highway Department had come out to the City of Baldwin
Park in June) wanting to know if he would recommend
to the Council that the City take this portion of the
State Highway over when the State relinquishes; that he
had since 1958 withheld any recommendations of this nature
contending that the drainage problem at this particular
point was partially created by State construction.
Mayor Bloxham declared the public hearing closed.
Councilman Bishop asked the City Attorney if the City
Council could hold this up and ask the applicant to come
back with some assurance regarding Improving the drainage
to the specifications of the County Flood Control plus
continuing the alley in back of the property onto Garvey.
City Attorney Flandrick stated yes; that he suggested
continuing the public hearing for perhaps thirty 30)
days to permit the applicant time to obtain the necessary
information from the City Engineering Department as to
what their recommendations were.
There being no objections, Mayor Bloxham reopened the
public hearing on CP-20.
COUNCILMAN BISHOP MOVED THAT THE PUBLIC HEARING BE HELD
OPEN FCR THIRTY 30) DAYS AND BE BROUGHT BACK BEFORE THE

City Clerk Balkus announced that it was the time and place
fixed for a public hearing on ZV-87, an application sub-
mitted by Signal Oil & Gas Company, R. C. Wedemeyer,
Real Estate Department, to allow an encroachment for
signs and light columns into the required ten 10)
foot setback and eliminate the required landscaping;
and to allow the placement of an illuminated, slowly
rotating sign 65 square foot sign area, per face, with-
in the required ten 10) foot setback In lieu of the
required fifty 50) square foot of sign area per face
non rotating sign, in the C-i neighborhood commercial)
zone situated southerly of the San Bernardino Freeway
at the southeast corner of Puente Avenue and Garvey
Avenue.
Mayor Bloxham stated that this public hearing would be
continued with CP-20 to December 18,',1963.

Mayor Bloxham announced that Item Numbers 4 and 5 under
the City Clerk's portion of the Agenda would be considered
at this time.
Mr, Urban J. Schreiner, O'Melveny & Myers, 433 South Spring
Street, Los Angeles 13, California, Legal Counsel for
District 62-A-I, stated that since the public hearing on
November 7, 1963, the staff and special consultants had
examined all of the protests and requests for changes
that were made by the owners of property within the Assess-
ment District; that recommendations had been assimilated
and were ready.
He reviewed the report from the City Engineer to the
Chief Administrative Officer dated November 20, 1963,
entitled Sewer District 62-A-I Recommended changes"
stating that he had discussed this with the City Engineer;
that it was his understanding that the City Engineer
desired to withdraw Item No. I as a recommendation at this
time and would prefer to have it taken up by the Council
at a later date; that Item No. 2, a request by a property
owner on Olive Street to delete that portion of line No. 2
and to remove that parcel of Assessment No. 44 from the
district on Olive Street tying northerly of the center
line from Center Street easterly to the Assessment dis-
trict boundary, had been reviewed and it was the recom-
mendation of the City Engineer that the line be brought
in as shown on Sheet No. 8 on the contractors plans and
that the parcel of land under Assessment No. 44 be left
in the district; that Item No. 3 deals with line 2-Al
across private property to the dead end of Harlan at its
junction with Benbow, a private street; that one of the
factors interfering with the proper development of this
parcel was the location of an existing house on Assess-
ment No. 63; that also several proposed subdivisions of
the adjacent property Assessment No, 64 have been turned
down in the past; that recently this area was involved
in a proposed zone change referendum which stopped all
subdividing of this area until approximately August 1964;
that the recommendation was the deletion of the line
2-Al across private property from the southerly end of
Dunia to the northerly enc of Harlan and that the sewer
line from the southerly end of Dunla be reversed in flow
and flow on Dunia to Center Street as shown on a recently
prepared Sheet No. 33.
Mr. Schreiner read and reviewed Section 2 of Resolution
No. 63-151. copy•In officrel.f!Ies.)
Councilman Holmes asked about the people that were
excluded from the district that wanted in.
Mr. Schreiner stated that these properties abutted the
County Trunk Line; that they were actually within the
boundaries of the Assessment District but were not
assessed because in the opinion of the Assessment
Engineer they were not benefited by the sewers being
constructed since they have the opportunity of service
from the County Trunk Line.
Mr. Pat Rossetti, from Laurence J. Thompson's Office,
1141 Highland Avenue, Manhattan Beach, California,
Assessment Engineer, stated that in his opinion these
people could not be legally assessed because people
could only be charged for what was actually being con-
structed in the assessment district.
Mr. Schreiner stated that in his opinion the district
would be subject to legal attack if the Council brought
into the district only those people who requested to
be brought in or everyone.

Mr. Schreiner stated regarding the property now under
condemnation proceedings by the School District that
the laterals had been deleted but to remain consistent
with the City Council's policy that the school district
property be assessed there was no mechanism by which
the assessment on this property could be deferred until
the school had title; that the property owners could
add the assessment as a capital cost to their lot cost
and perhaps recover this in condemnation proceedings from
the School District.

In answer to a question by Councilman Bishop, Mr. Schreiner RE SCHOOL DISTRICT
stated that the School District could be required to pay ASSESSMENTS
the assessment immed?ately and for that purpose the Educa-
tion Code provided that the School District would have the
power to levy an extra tax In the first year) to pay its
full assessment; that the School District and Cities
jointly were given the power to enter into an agreement
whereby the School District would pay its assessment over
a five year period paying 1/5 of the amount each year;
that the balance of the amount would carry interest at
the rate of the bonds sold; however no bonds would be
sold against the School property.
There was discussion as to why assessment 3137 was RE DELETION OF
deleted wherein Mr. Thompson stated that the rear house ASSESSMENT NO.
was connected to the County Trunk line; that when a 3137
home was built on the front of the property the property
would at that time be subject to the assessment which
was deleted, $804.001.

Mr. Urban Schreiner reviewed the report from the City
Engineer to the Chief Administrative Officer,; regarding
the request for approval of a supplemental agreement on
Sewer District 61-A-I for the relocation of a sewer line
In Ramona Boulevard. He stated that this agreement was
necessitated by line i-C having-to be realigned; that
originally this line was shown in the parkway adjacent
to Ramona Boulevard; that due to the fact that there
were many utility facilities under the planned location
for the line it was found necessary to relocate the
line back out onto the pavement where the concrete was
approximately eight 8) inches thick; that the Contractor
agreed to absorb all additional concrete cutting and
hauling costs and agreed'-to replace the concrete for
the total additional cost of $3,600.00. He stated that
the additional payment could be authorized.

Chief Administrative Officer Nordby reviewed his report
regarding the Civil Defense request for landing a helicopter
at the Athletic Field of Baldwin Park High School. He
stated that originally It was arranged that two military
helicopters from March Air Force Base would take part
in the exercise subject to Council approval; however the
helicopters had been given a military assignment and
would not be available; that Mr. Pierce had informed
him that Mr. McKnight of McKnight Construction Company
had offered to put his helicopter on display at the
football field.
Discussion that Mr. Mcknight's helicopter would not be
equipped the same as a military helicopter and would not
fit in with the Civil Defense exercise.

Chief Administrative Officer Nordby reviewed his report
regarding the letter from N. H. Templin concerning the
speed limit on Vineland from Nelson to the southerly
border of Baldwin Park. He stated the segment of Vine-
land from the southerly city limits Walnut Creek) to
Francisquito Avenue, a distance of approximately 1250
feet, should be upgraded to the limit of 35 miles per
hour now in effect in the county segment; that in addi-
tion consideration should be given to increasing the
speed limits on Pacific Avenue, Puente Avenue, and
certain segments on the south side of Ramona Boulevard.
He recommended that the Council authorize the Engineering
Department to proceed with appropriate studies of the
above named streets with the objective of bringing a
recommendation to the Council for adjusted speed limits;
that the study would employ the use of radar units which
were available from the County; that Mr. Bandy estimated
the cost of such studies would be approximately $100.00
for each street.
Councilman Holmes stated he could go along with the
recommendation with regard to Vineland but that he
did not concur with the recommendation on the other
streets.
Councilwoman Taylor indicated she agreed with Councilman
Holmes.
Councilman Bishop agreed with the Vineland recommendation.
He stated that the money that would be spent on the studies
should be used for work on the streets.

City Engineer Young reviewed his report on the Los Angeles REPORT BY CITY ENGR

District and the City of Baldwin Park he found that the money
they would contribute toward the permanent paving could not
be used for any type of temporary resurfacing.
City Attorney Flandrick stated that assuming the City could
get cooperation from the State on approval of the appraisals,
the action should be able to be filed and have right of imme-
diate possession by January 15th, 1964.
City Engineer Young stated that the plans had been completed;
that specifications have to be written and then approved by
the State; that they should be ready~to go by the time the
condemnation proceedings were completed; that they should
be able to go to bid by February 1-15, 1964.
There was further discussion wherein City Engineer Young
stated that they would do patchwork on the worst of the
existing holes.

City Engineer Young presented a report on Final Tract FINAL TRACT MAP NO.
Map No. 28929 located at Vineland and Garvey Condominium 28929
Development). He recommended that both the tentative map REQUESTED TENTATIVE
and the final map be approved; that a cash deposit of $300.00 AND FINAL APPROVAL
was on file to assure completion of grading; that a cash
deposit of $492.00 had been made to cover cost of street
lights on Vineland.
Discussion followed regarding the draining problem and
the acquisition of property for recreational facilities.
City Engineer Young stated that the grading plan was not
submitted until after the slabs had been poured.
Mr. William Norris, 10217 Lower Azusa Road, Temple City, WM. NORRIS, 10217
Roseglen Construction, stated it was the first time he Lower Azusa Rd.,
had been aware of the grading plan situation; that he Temple City, ROSE-
was not involved in the direct construction; that with GLEN CONSTRUCTION
regard to the drainage they had worked with the City
Engineer and had posted a cash bond with the City;
that with regard to the original zoning, they applied
for a zone change and were advised by the Planning
Director to apply for a variance and at his request
did change to a variance; that he could document this;
that they stilt had pending a zone change to the R-3;
that from a legal standpoint he thought it was immaterial
whether it was passed or dropped; that with regard to
acquiring the Flood Control Property they had worked
with Mr. Flandrick and had reached an agreement on the

exact conditions under which they would be permitted
to acquire the land; that it would be for recreational
use;.that the addition of this property would be a great
help to the property; that they had a deposit on the
property. He passed a sketch indicating what the proposed
use would.. be.
Councilman Holmes stated that the Fire District would
like to have the street or driveway named.
City Engineer Young stated he had asked City Attorney
Flandrick and Chief Administrative Officer Nordby the
advisibility of having them dedicate the driveways as
alleys on a continuing offer to the City and the City
not accept them.
Mr. Norris stated they would be willing to offer them
in dedication if the City wished. He stated that the
City could be of great assistance to them by adopting
a resolution to be sent to the Board of Supervisors to
the extent that the acquiring of this property by the
condominium rather than by some disinterested third party
for possible building was preferable.
Mr. Norris affirmed that he had consented to the Council
holding the tentative tract map for this project under
submission until November 20, 1963.
City Attorney. Flandrick reviewed the agreement stating
that a cqpy of the sketch passed to the Council would be
attached as Exhibit B" of the Agreement.
There was further discussion regarding the drainage
problem wherein Mr. Norris stated he could personally
assure the Council that this problem would be taken
care of.
The Council instructed that the subdivider deposit a
total of $1,000.00 to assure completion of grading.
City Attorney Flandrick stated a condition of the Tentative
Tract Resolution would read as follows: That the sub-
divider shall deposit the sum of $1492.00 to assure the
completion and construction of all drainage facilities
and street lights as shown on the tract map and grading
plan as submitted".

City Engineer Young reviewed his report regarding the
proposed relinquishment of certain areas adjacent to the
San Bernardino Freeway which recommended that the City
Council decide whether or not they desire the State to
provide landscaping on the Bess-Frazier overpass and
on Baldwin Park Boulevard south of the Freeway, keeping
In mind that if they expend funds to provide this land-
scaping and sprinkler systems the City must accept
maintenance responsibility; that after relinquishment
the City would be required to maintain the landscaping
on Puente Avenue so it was also recommended that sufficient
funds be authorized for personnel and equipment to.main-
tain the amount of landscaping which would be relinquished
to the City; that it was further recommended that the
City indicate their approval of accepting the relinquish-
ment of the areas adjacent to the Freeway with the excep-
tion of Francisquito Avenue between Walnut Creek wash and
the Freeway; that the relinquishment of this portion of
Francisquito should not be voluntarily accepted until
the City was satisfied with provisions taken to alleviate
the drainage problems.
COUNCILMAN MOREHEAD MOVED THAT THIS REPORT BE TURNED OVER
TO THE CITY ATTORNEY AND LET HIM RESEARCH IT AND SEE WHAT
HE CAN COME UP WITH. COUNCILMAN BISHOP SECONDED. There

Councilman Holmes Instructed the City Attorney to see
what would happen if the City did not accept.

City Engineer Young reviewed his report regarding the
replacement of curb and gutter on Palm and La Rica in
order to properly correct the drainage problem; that
some of the curb was put in by the County and some put
In in the last year or so; that the Engineering Depart-
ment was presently obtaining bids.

Chief Administrative Officer Nordby stated he would report REPORT BY C.A.O,
on the entire Flood Control Property in addition to the area NORDBY RE FLOOD
which interested Mr. U. B. Anderson, He stated that his files CONTROL PROPERTY
went back to November 2, 1962, when the Flood Control wrote a'
letter to the City requesting a decision on whether or not the
City was interested in acquiring excess Flood Control Property;
that again in May they requested a decision; that subsequent
to this City Attorney Flandrick and he visited the office
of Mr. Bonelli and submitted to him a map which was prepared
by Mr. 1'!elch on a proposed subdivision along this land and
also a completed sketch of Stichman Avenue; that Mr. Dines
ask that the proposal be submitted in wetting which con-
sisted of the letter he Mr. Nordby) wrote on July 16, 1963
and this proposed that the County acquire with its funds
the strip of land.($70,000.00) and an additional $100,000.00
for financing the proposed Stichman Avenue; that in August
he received an acknowledgment from Mr. Bonelli stating the
information had been turned over to Flood Control and the
Road Commissioner for recommendation; that Mr. Templin gave
an adverse recommendation to Mr. Bonelli•s office while the
Flood Control seemed to go along with our proposal; that
later he received in addition to copies of the recommendations,
a letter from Mr. Bonelli with a very polite no" but that
funds would be available possibly under the Collier Bill
Senate Bill No. 344); that these funds have never material-
ized. He stated that it would have to be decided which was
most important- developing the land or its acquisition. He
stated when he submitted the proposal to the County he had
not been contacted by any private developers; that the purpose
was to get the land developed and broaden the tax base which
would benefit both the County and the City; that since then
he had had developers express by telephone, letter and in
person their interest in developing this land. He stated
that it was his personal opTnic;n; that he did not feel any
governmental agency could perform a job as efficiently as
private enterprise could where it was normally private
enterprise's responsibility; that he could see two or
three years go by and still be waiting for funds under Senate
Bill No. 344; that meanwhile there were 8-10 private
developers who cou!d accomoiish the same thing with their
own money; that the City could not make any money on this
except from tax revenue; that it was his recommendation that C.A.O. RECOMMENDED
the City withdraw from any development there. THAT CITY WITHDRAW
FROM ANY DEVELOPMENT

City Engineer Young stated he had sent a communication to
the Planning Commission regarding Lot Split No. 584 asking
that they deny the lot split request unless the assessment
sewer Assessment District No. 61-A-I) was paid off.
Councilman Holmes stated he would like to know if this
lot split involved one of t.-.e lots that was held up that
was applied for by Dick Sco:-t about one year ago that was
blocking the opening of a srreet.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL RECONSIDER
LOT SPLIT NO. 584 AND HOLD THE MATTER OVER UNTIL THE
MATTER IS CLARIFIED ON THE SEWER ASSESSMENT AND ALSO

City Clerk Balkus stated that the City Council had re-
ferred Z-182 to the Planning Commission for a report on
October 16, 1963; that the Council had before them a
Resolution from the Planning Conmission,Res. No. 63-168
reversing their position on Change of Zone Case No. Z-182,
a copy of a letter from Peter F. Schabarum dated November5,
and a copy of a letter from Peter F,.Schabarum dated
November 7, 1963. She read a letter from Peter F. Schabarum
dated November 14, 1963.

Planning Director Kalbfleisch outlined the location
of the area.
City Attorney Flandrick reviewed the case and stated
that the matter was now before the City Council for

I4839 East Pacific Avenue, Baldwin Park, California, dated
November 18, 1963, regarding a Conditional Use Permit,
Resolution No. P.C. 63-27 adopted March 7, 1963. The
letter reqeusted an extension of time"to commence construc-
tion.
City Attorney Flandrick stated that under Section 9120.41
of the Zoning Ordinance she had lost her conditional use
permit and would have to reapply.
COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE
OFFICER BE INSTRUCTED TO INFORM MRS. GLADYS L. CHASE
THAT LEGALLY THE CITY COUNCIL CAN NOT EXTEND HER CONDI-

Chief Administrative Officer Nordby reviewed his report
regarding the consideration of Refuse Collection Licenses.
He stated based on the current population of 40,350 an
additional license could now be granted in addition to
the sixteen licenses now in effect; that the Council would
have to determine I) shall the existing license holders
be granted renewals and 2) to whom shall the additional
license be granted, assuming the Council determines that
another license shall be issued. He stated he had re-
ceived a letter from Webster$$ Refuse Disposal, La Puente,
requesting the additional license.
