There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- Mr. James Garrow, representing the Baldwin Park Improve- ment Association, presented a Committee Report on the pro- posed new library building which suggested that the City Council make available to Los Angeles County the land adjacent to the Civic Auditorium for a 10,000 square foot library building and that the City Yard be moved to another location. JAMES GARRON BE RECEIVED AND TURNED OVER TO THE CHIEF ADMINISTRATIVE OFFICER FOR STUDY. COUNCILMAN HOLMES SECONDED. There were~no objections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus presented a petition signed by merchants and property owners requesting diagonal parking along the north curb of Ramona Boulevard. City Engineer Young stated that his department had been requested to make a study of this; that they had not completed their study due to the sewer project; that with the completion nearing they would commence their study again. 00- City Clerk Balkus reviewed the letters from Lyle Dean Jay, Mrs. Michael Hennessy, and Mrs. Eleanor Lowry, regarding the night parking lei. Discussion followed. City Attorney Flandrick stated there were no provisions under the existing ordinance to allow parking permits for overnight parking. 00- Upon the consent of the Council, City Clerk Balkus brought on the Agenda a letter from the City of Azusa dated November 7, 1963, requesting the consent of the City Council for their Annexations on properties designated as No. 59 and 56. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONSENT TO THE ANNEXATIONS ANNEXATION NOS. 56 AND 59, CITY OF AZUSA) AND HAVE NO OBJECTIONS TO THE ANNEXATION PRO- CEEDINGS. COUNCILMAN MOREHEAD SECONDED. Discussion followed wherein Councilman Holmes brought out RE NIGHT PARKING that the problems of permitting overnight parking were far reaching throughout the City other than the problem In Mr. Jay's immediate neighborhood. Mayor Bloxham stated that Mr. Nordby, Chief Administrative Officer, would be happy to review the problems of night parking with Mr. Jay. He stated that one of the facts brought out was that the water basin in the Upper San Gabriel Valley had reached the lowest point in history on the first of November. He stated that action was taken opposing the Udahi Southwest Water Plan and that it would be in order for any and all public bodies as well as individuals to express their opposition to it. RE UDAHL SOUTHWEST WATER PLAN 00- Councilman Bishop stated he had attended the Mayors meeting with Mayor Bloxham. He stated that the subject of the new annexation law passed by the State legislature was brought up; that in his opinion this law caused con- siderable more time being spent and more red tape; that the Committee had the power to deny but not to grant; that it only slowed things up rather than speeding them up. COUNCILMAN BISHOP MOVED THAT THIS GOVERNING BOARD GO ON RECORD AND INSTRUCT THE CITY ATTORNEY TO DRAW UP A RESOLU- TION ASKING THE STATE LEGISLATION TO BRING THIS UP BEFORE THE LEGISLATURE AGAIN AND SEND ONE COPY TO EACH ONE OF OUR ASSEMBLYMEN IN THIS DISTRICT, SENATOR REESE, EACH MUNICIPALITY IN THE EAST SAN GABRIEL VALLEY AND TO THE LEAGUE OF CALIFORNIA CITIES. He stated that one appraiser was to act as a back up for the other appraiser In the case of legal attack; that he had explained this to both appraisers and they were both willing to accept the job on that basis. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BISHOP, MORE- HEAD, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE 00- City Clerk Balkus announced that the hour of 8:00 P.M. having arrived that it was the time and place fixed for a public hearing on Z-198, an application submitted by Ralph E. Newman, et at requesting a change of zone from R-I light agricultural) zone to R-3 multiple family residential) zone or more restrictive use for property located at 13444, 13448, 13502, 13512, 13520, 13522 and 13526 Tracy Street. City Clerk Balkus stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission had adopted a resolution of denial on September 25, 1963, P.C. No. 63-138. City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR BLOXHAM. Mr. Ralph E. Newnan, 13448 Tracy Street, Baldwin Park, stated he appealed the decl;sion of the Planning Commission because in his opinion the Planning Commission did not voice the general opinion of the neighbors in that particular locale; that with the exception of Mr. Via, all on Waco Street and almost all on Tracy Street even up to Robinette have all indicated their approval of this R-3 zoning; that the area fronting on Tracy from Francisquito and Baldwin Park down 570 ft. was rezoned C-2 some months ago; that three of the six properties involved in this application face that C-2 area; that Mr. Lake on the corner of Tracy and Baldwin Park faced against R-3 zone; that as he understood it Robinette eventually because of the school would be cut through; that that would mean there would only be approxi- mately three more houses in that block; that it would be a short block; that at the time Mr. Snyder made his applica- tion for the C-2 zoning) the Planning Department had a map that indicated the general area would be R-3; that Mr. Via on Waco and Tracy already had a variance and was not particularly interested in a change of zone at this time. Mr. Edward L. Perritt, 13502 East Tracy, Baldwin Park, stood up and stated that he had planned to testify but that Mr. Newman had covered things pretty thoroughly. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-198, Mayor Bloxham declared the public hearing closed. Councilman Holmes stated that no plan for immediate development had been mentioned; that the total amount of R-3 in Baldwin Park was 10 to I of R-2; that much of it was not being developed and much of it that was being developed was developed on a limited scale because of the financing problems In making a first class structure that would become self-supporting. One of the gentlemen who had testified In favor of this request indicated he would like to speak again, however, it was the consensus of the Council not to reopen the public hearing. In answer to a question by Councilman Morehead, Planning Director Kalbfleisch stated he did not recommend this change; that he worded his memorandum so that the Plan- ning Commission would consider all possible aspects. There were no ob- jections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus announced that it was the time and place for a public hearing on Z-200, an application Initiated by the Baldwin Park Planning Commission for a rezoning from A-I light agricultural) zone to R-I single family residential) zone for all properties presently in the A-1 light agricultural) zone located within the following described boundaries: Olive Street on the north; Los Angeles Street on the south; Maine Avenue on the west; and the Baldwin Park City boundary on the east. City Clerk Balku's stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission had adopted a resolution recommending approval on October 23, 1963, P.C. Res. No. 63-153. COUNCILMAN BISHOP MOVED THAT THE CITY CODICIL APPROVE THIS AMENDED TO BALDWIN PARK ZONING CODE ADDING SECTION 9119.72 RE AREA AND YARD REQUIREMENTS AND EXCEPTIONS) AND INSTRUCT THE CITY ATTORNEY TO PREPARE AN ORDINANCE TO THIS EFFECT. E. Walkup, Vice President, to establish a gasoline service station use in the C-I neighborhood commercial) zone situated southerly of the San Bernardino Freeway at the southeast corner of Puente Avenue and Garvey Avenue. City Clerk Balkus stated that the required publication had been accomplished. Planning Director Kalbfleisch presented a resume of me case and stated that the Planning Commission had adopted a resolution recommending approval on October 23, 1963, P.C. Res. No, 63-152. Mr. Warren Lefevre, 10600 Katelia, Anaheim, stated that the Harbor Development Corporation was buying this property from Signal Oil & Gas Company and leasing it to Shell Oil Company; that It would be a ranch design service station; that the use would not injure property owners in the area; that it was in the C-I zone; that the property was ideally situated for a service station located on a major highway; that the area was surrounded by commercially zoned property on three sides. He stated the service station would not be the standard steel building; that it would be of used brick; that they had just completed a ranch type design service station at the northeast corner of Santa Anita and Duarte by the Santa Anita Race Track. He passed a large colored picture of their ranch design service station at the north- west corner of Whittier and Cypress in La Habra for the City Council to view. He stated that Shell did have a service station at Puente Avenue one-half mile south of the requested location; that this was now a Mobile service station and this was one of the reasons that they did want to offset their representation and acquire this site on a lease basis. As there was no one else in the audience desiring to speak either in behalf of or in opposition to CP-20, Mayor Bloxham declared the public hearing closed. Discussion regarding the drainage problem; that permanent relief was one of the supplemental projects under the 1958 Storm Drain Bond Issue; that the Council had recently approved a variance for a service station across the free- way on Merced and Puente; that there were four service stations on the corner of Pacific and Puente, one on the corner of Puente and Merced, three on the corner of Francisquito and Puente; that they were all closer than one mile apart; that It would be detrimental to cut the alley off. With the consent of the Council, Mayor Bloxham reopened the public hearing on CP-20 for further testimony. Mr. Lefevre reiterated that the Harbor Development Corporation was buying the property from Signal 01i & Gas Corporation and leasing it to Shell OiI Company; that the City ordinances required that the present owner sign the application; that actually Signal Oil & Gas Corporation had nothing to do with this application; that a condition of escrow was that a conditional use permit be granted; that regarding the engineering and alley questions they had discussed this with City Engineer Young and were willing to put in anything in the way of an alley or putting in permanent storm drain or any other improvements the City would want. City Attorney Flandrick suggested that the application be amended to include as a co-owner Harbor Development Corporation. The Council and Mr. Lefevre consented to this amendment. He recommended that the Council authorize the Engineering Department to proceed with appropriate studies of the above named streets with the objective of bringing a recommendation to the Council for adjusted speed limits; that the study would employ the use of radar units which were available from the County; that Mr. Bandy estimated the cost of such studies would be approximately $100.00 for each street. Discussion followed regarding the draining problem and the acquisition of property for recreational facilities. City Engineer Young stated that the grading plan was not submitted until after the slabs had been poured. Mr. William Norris, 10217 Lower Azusa Road, Temple City, WM. He passed a sketch indicating what the proposed use would.. be. Councilman Holmes stated that the Fire District would like to have the street or driveway named. City Engineer Young stated he had asked City Attorney Flandrick and Chief Administrative Officer Nordby the advisibility of having them dedicate the driveways as alleys on a continuing offer to the City and the City not accept them. Mr. Norris stated they would be willing to offer them in dedication if the City wished. He stated that the City could be of great assistance to them by adopting a resolution to be sent to the Board of Supervisors to the extent that the acquiring of this property by the condominium rather than by some disinterested third party for possible building was preferable. Mr. Norris affirmed that he had consented to the Council holding the tentative tract map for this project under submission until November 20, 1963. City Attorney. Flandrick reviewed the agreement stating that a cqpy of the sketch passed to the Council would be attached as Exhibit B" of the Agreement. There was further discussion regarding the drainage problem wherein Mr. Norris stated he could personally assure the Council that this problem would be taken care of. The Council instructed that the subdivider deposit a total of $1,000.00 to assure completion of grading. City Attorney Flandrick stated a condition of the Tentative Tract Resolution would read as follows: That the sub- divider shall deposit the sum of $1492.00 to assure the completion and construction of all drainage facilities and street lights as shown on the tract map and grading plan as submitted". Councilwoman Taylor withdrew the motion. 00- City Engineer Young reviewed his report regarding the proposed relinquishment of certain areas adjacent to the San Bernardino Freeway which recommended that the City Council decide whether or not they desire the State to provide landscaping on the Bess-Frazier overpass and on Baldwin Park Boulevard south of the Freeway, keeping In mind that if they expend funds to provide this land- scaping and sprinkler systems the City must accept maintenance responsibility; that after relinquishment the City would be required to maintain the landscaping on Puente Avenue so it was also recommended that sufficient funds be authorized for personnel and equipment to.main- tain the amount of landscaping which would be relinquished to the City; that it was further recommended that the City indicate their approval of accepting the relinquish- ment of the areas adjacent to the Freeway with the excep- tion of Francisquito Avenue between Walnut Creek wash and the Freeway; that the relinquishment of this portion of Francisquito should not be voluntarily accepted until the City was satisfied with provisions taken to alleviate the drainage problems. Anderson, He stated that his files CONTROL PROPERTY went back to November 2, 1962, when the Flood Control wrote a' letter to the City requesting a decision on whether or not the City was interested in acquiring excess Flood Control Property; that again in May they requested a decision; that subsequent to this City Attorney Flandrick and he visited the office of Mr. Bonelli and submitted to him a map which was prepared by Mr. 1'!elch on a proposed subdivision along this land and also a completed sketch of Stichman Avenue; that Mr. Dines ask that the proposal be submitted in wetting which con- sisted of the letter he Mr. Nordby) wrote on July 16, 1963 and this proposed that the County acquire with its funds the strip of land.($70,000.00) and an additional $100,000.00 for financing the proposed Stichman Avenue; that in August he received an acknowledgment from Mr. Bonelli stating the information had been turned over to Flood Control and the Road Commissioner for recommendation; that Mr. Templin gave an adverse recommendation to Mr. Bonelli•s office while the Flood Control seemed to go along with our proposal; that later he received in addition to copies of the recommendations, a letter from Mr. Bonelli with a very polite no" but that funds would be available possibly under the Collier Bill Senate Bill No. 344); that these funds have never material- ized. He stated that it would have to be decided which was most important- developing the land or its acquisition. He stated when he submitted the proposal to the County he had not been contacted by any private developers; that the purpose was to get the land developed and broaden the tax base which would benefit both the County and the City; that since then he had had developers express by telephone, letter and in person their interest in developing this land. He stated that it was his personal opTnic;n; that he did not feel any governmental agency could perform a job as efficiently as private enterprise could where it was normally private enterprise's responsibility; that he could see two or three years go by and still be waiting for funds under Senate Bill No. 344; that meanwhile there were 8-10 private developers who cou!d accomoiish the same thing with their own money; that the City could not make any money on this except from tax revenue; that it was his recommendation that C.A.O. RECOMMENDED the City withdraw from any development there.
