regular session at the above place at 7:30 p.m.

City Treasurer Pugh read in full the Investment of City INVESTMENT OF CITY
Funds for November 1963. FUNDS NOVEMBER 196
COUNCILMAN HOLMES MOVED THAT THE CITY TREASURER'S REPORT RECEIVED AND FILED
BE RECEIVED AND FILED. COUNCILMAN MOREHEAD SECONDED.
There were no. objections, the motion carried and was so
ordered by Mayor Bloxham.

Mrs. Marianne Johnson, 3825 North Foster, Baldwin Park, MRS. MARIANNE JOHNSC
presented a check to the City of Baldwin Park in the amount 3825 N. Foster, B. F
of $156.26. She stated that this was the remaining funds
of the Baldwin Park Beautification Group which was no PRESENTED CHECK It
longer in existence; that this was to be used for the AMT. OF $156.26 ON
beautification of the Civic Auditorium; and it was suggested BEHALF OF B.PK,
that it be used for the purchase of ornamental shrubs or BEAUTIFICATION GROUF
trees in cement pots. FOR BEAUTIFICATION
CIVIC AUDITORIUM
Mayor Bloxham thanked Mrs. Johnson on behalf of the City
and commended her for her work accomplished with the
beautification group. Councilwoman Taylor also commended
Mrs. Johnson.
COUNCILMAN MOREHEAD MOVED THAT THE CHECK IN THE AMOUNT
OF $156.26 BE ACCEPTED AND USED TO THE BEST AD VANTAG E
AS RECOMMENDED DY MRS. JOHNSON AND HER GROUP FOR
BEAUTIFICATION OF THE CIVIC) AUDITORIUM. COUNCILMAN
BISHOP SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Bloxham.
City Clerk 3alkus gave the check to Finance Director

Mrs. Marianne Johnson, 3825 North Foster, Baldwin Park,
commented on proposed Resolution No. 63-159 which would
recommend legislation which would force school districts
to pay expenses for school crossing guard protection.

Regular Meeting of the Oaldwin Park City Council
She sta'..ed that the primary responsibility of the agencies
should be considered; that the school district was re-
sponsibie for the education of the childrei.-that the
Police Department wtas responsible for the safety and wel-
fare of the citizens. She stated that the School District
would be asked to provide a service for which it was not
set up and not qualified to provide; that the only place
the money could come from would be out of the Educational
Fund; that the only way they could provide the service
was if the legislature provided them with the power to
tax additionally for this; that this would be double
taxation for the same service.

As Pastor Glen Goffar was in the audience, City Clerk REQUEST OF SEVENTH
Ralkus presented the request of the Seventh-Day Adventist DAY ADVENTIST CHURCI.
Church for operation of a Sound Truck from 6:30 to 9:00 FOR OPERATION OF
p.m. November 30, 1963 to December 31, 1963 for the pur- SOUND TRUCK FOR
pose of Christmas Caroling; that according to Section 4248.6 CHRISTMAS CAROLING
of the Baldwin Park Municipal Code these hours would not be
permitted.
City Attorney Flandrick stated that the only way. this
could be permitted would be to amend the ordinance;
that it could be handled on an emergency basis if the
Council so desired.
In answer to a question by Councilman Holmes, City Attorney
Flandrick stated that the ordinance could stipulate. that the
Christmas Carol activity be for regularly constituted churches.
Councilman Bishop stated that the ordinance should remain
as it was and make a provision for, the Yuletide period.

Councilman Morehead suggested that it not be restricted to
church organizations; that there would be undoubtedly other
groups making this request.
Discussion fo l lowed.
City Attorney Flandrick stated the phrasing could be so that
the Council would have before them any application that proposed
to vary from the hours stated in the ordinance such as for
churches, Salvation Army or any other group. tie suggested
that wording be to the effect that the City Council may,
grant permits for use for this kind of operation-.during
hours other than those set and that the City Council shall
pass on each case and shall set the hours.
Councilman Holmes stated with the consent of the second SUGGESTION FOR

Councilman Bishop stated in his opinion these applications
should not have to come before the City Council.

Counci lman Morehead asked the City Attorney to word the
motion which read:

THIS KIND OF PERMIT FOR SOUND TRUCKS DURING THE MONTH OF
DECEMBER.
COUNCILMAN MOREHEAD MOVED THAT THE ORDINANCE BE PREPARED
TO PERMIT THE CITY CLERK TO ISSUE PERMITS TO CHURCH GROUPS
AND DULY RECOGNIZED ORGANIZATIONS DURINC THE MONTH OF
DECEMBER FOR NONCOMMERCIAL USE OF SOUND TRUCKS BETWEEN
THE HOURS OF 6:00 P.M. AND 10:00 P.M. WITHOUT REGARD TO
THE OTHER PROVISIONS OF SECTION 4248.6.
Discussion followed wherein City Attorney Flandrick
stated that according to the other provisions of
the existing ordinance groups other than church groups
would apply.

City Clerk Balkus reviewed the letter from Mrs. Lois
Chapman regarding an exchange teacher from Argentina.
Discussion followed that many of the families in Baldwin
Park had extended entertainment to her and would be during
her stay.

Councilman Bishop reported that he had attended a League
of California Cities Meeting in Montebello; that the topic
was Rapid Transit; that Senator Reese spoke before the
group and he interpreted his recommendation as being for a
seven fl mber'conmission, three. from Los Angeles, three from,
the Board,of SSupiirvisors and one representing the other
seventy-three 73) cities. He stated that this matter
would be before the State Legislature again this..coming
session; that the resolution that was previously adopted
should be sent again with a letter to the State Senator
and representatives from the 49th, 50th and 58th District
stating that the City was in opposition to giving any
power that would permit any firm to levy tazes for this
purpose. 1.

COUNCILMAN HOLMES SECONDED. There were no objections,
the motion carried and was so ordered by Mayor Bloxham.
Mayor Bloxham instructed the Chief Administrative Officer
to write this letter.

City Clerk Balkus announced that the hour of 8:00 p' m.
having arrived that it was the time and place fixed for the'
public hearing on Z-201, an application initiated by the
Baldwin Park Planning Commission for a rezoning from A-1
light agricultural) zone to R-1 single fami ly*residential)
zone or more restrictive use for all properties presently
in A-1 light agricultural) zone on certain real properties
within the hereafter described boundaries: Parcel A
San Bernardino Freeway on the north and the Baldwin Park
City boundary on the east, west and south; Parcel 3
That area included within Annexation No. 13 to the City
of Baldwin Park; Parcel C That area included within
Annexation No. 14 to the City of Baldwin Park; Parcel D
That area included within Annexation No. 15 to the City
of Baldwin Park.
City Clerk Balkus stated the required publication had
been accompli shed.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
a resolution recommending approval on October,23, 1963,
P.C. Res. No. 63-154.
As there was no one in the audience desiring to speak

Discussion followed concerning the exact boundaries of
the zone change.
City Clerk 3alkus had received a letter from Mrs. M. Pierce
33900 North Cheseboro Road, Palmdale, in opposition to this
zone change; however it was not considered as the City
Attorney explained that testimony had to be given in person
on a zone change.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to Z-203, Mayor
Bloxham declared the public hearing closed.
In answer to a question by Councilman Morehead, Planning
Director Kalbfleisch stated that Via's Zoo and Turkey
Ranch and the Jones Dairy was in the area included in this
zone charge. There was comment that the zoo would remai n
nonconforming as it now was.
Planning Director Kalbfleisch stated that the suggestion
was that Mr. Via request a variance; that there was no
zone at the present time that would permit a zoo..
City Attorney Flandrick confirmed that this zone change
would have no effect on Via's Zoo and Turkey Ranch; that
it could continue to operate as a nonconforming use.

in behalf of or in opposition to Z-204, Mayor Bloxham

Discussion followed concerning the fire station property
and the property changed to zone R-3 under Zone Change
Case No. Z-191.
Councilman Bishop stated he did not concur with the
recommendation of changing the fifty 50) foot to the
west of the fire station to R-3; that this lot would be
used as parking facilities for an R-3 development.
Planning Director Kalbfleisch stated that the fire station
property had one hundred fifty-six 156) feet of frontage;
that the fire station was to be built on the westerly one
hundred 100) feet of the property and the easterly portion
of the property would be used for parking.
Councilman Bishop stated at the present time there was no
R-3 property on Los Angeles Street that would be used as
R-3.
Councilman Holmes stated he did not think the lot west of
the fire station should remain R-1.
There was further discussion.

this had been and was a matter of being completed; that the BEING COMPLETED
original owner and operator had operated in a manner which
was not a credit to anyone; that Mr. Irving took over a
few years back and little by little, not with an expedious
speed, in good faith and with a considerable amount of
expense and effort had to a degree, a substantial degree,
attempted to comply with the requirements of the City;
that at the time they appeared in 1961 when the conditions
were set forth and shortly thereafter when the conditions
were gone over in detail, the Council had been most
courteous, cooperative and understanding; that he had
explained to the Council the position of Mr. Irving in re-
gard to economic factors that were involved in the type
of development that was required by the Council and the
City of Baldwin Park; that Mr. Irving up to the present WORK COMPLETED
time had completed approximately ten hundred and seventy 1070 FT. OF BLOCK
1070) feet of an eight foot high block wall fence for WALL
which he had already expended a sum of $4,300.00; that there
still remained approximately one thousand 1000) feet to
complete; that the corrugated fence had been completed which WORK COMPLETED

that the tire removal had been taken care of at the expense of

had been installed at an expense of seven hundred and twelve
dollars $712.00); that this was far removed to what it would
cost fir. Irving to complete and comply with what they be-
lieved was a reasonable request by the City; that as of today
the JJJ Company had entered into a contract with Mr. Irving RE CONTRACT WITH
which had been signed by all of the parties concerned; that JJJ COMPANY
financing would be secured; that within ten 10) days after
the financing was secured and they figured not later than
January 15th, approximately forty-five 45) days for comple-
tion of financing). within ten days from that time the con-
tractor must start construction; that the contractor had a
period of one hundred 100) working days to complete all the
items; that there would be possibly some delay in the event
of weather conditions preventing work to be done; that the

connections and for the streets and curbs); that a
reputable engineering concern was working on this now and
he understood that there had been some contact or some
indication to the Council or representatives of the City
in connection with the-existing situation; that the
things that had to be done in accordance with the contract
were: grading to be in concurrence with plans of the City
Road Department, excess dirt to be spread on future develop-
ment site; sewers and manholes to be installed according
to plans and City requirements; water to be installed in
accordance to 3aldWin Park Water District requirements;
culverts and headwalls to be installed according to plans
and specifications and approved by City requirements; roads
to be installed according to plans and specifications and
approved by City requirements; curbs and approaches to be
installed according to plans and specifications and approved
by City requirements; block wall to match existing block
wall, boundaries shown on plans; water sewers, lateral ties
and streets for the new structure; rough and finish grading
for new building site to be in accordance with plans and
specifications; building eighty 80) by forty 40) block wall
construction, first floor twenty 20) by forty 40), second
floor according to plans and specifications; paving and striping
of employees and customer parking; and chain link fence on two
sides according to plans and specifications.
Mr. Altagen stated that Mr. Irving had made as many,loans as
he possibly could to complete portions of the particular
project but now his property was in a condition where the
equity was large enough that lending institutions were
desirous of making the proper type of loan. He.further
stated that Mr. Irving had promised in good faith before
and had attempted in good faith to comply with the require-
ments;that he was now in a position to go ahead and was.,,
going to go ahead to do those things that were required'
by the Use Permit and the various directives set forth by
the Use Permit; that taking into consideration weather and
other conditions they had an approximate date of completidn, APPROXIMATE DATE OF
April 15, 1964, either substantially complete or entirely COMPLETION APRIL 15,
complete. He handed the contract to the City Clerk for the 1964
C ty Attorney to examine. He asked that the City Council
take into consideration what had been done and what would
be done and that the Use Permit not be revoked. He stated
that he had come before City Councils again and again on Use
Permits; that dismantlers, had found it a problem to always
comply sometimes even substantially with reasonable requests
of City Councils o~ Zoning Commissions; that it had been an
economic problem in every instance that he knew of.

if they so desired, concerning what it is about and how INDUSTRY
it can be conducted in a proper manner. He stated that
the representative of the contractor's firm was present;
that part of the engineering plans were drawn; that Mr.
Irving was involved to the extent of $600.00 on the plans
and by Monday he would have $850.00 paid; that the full
cost was approximately $1,000.00. He urged the Council to
consider the fact that this business benefits the community;
that to his knowledge-it had not created any police problem;
that they did want to stay here in Baldwin Park); that they
did want to operate here; and they did want to comply with
the requirements which they thought were reasonable.

Councilman Morehead brought out that Mr. Irving had had
years to comply with the requirements.
Councilman Holmes stated that the Council was aware of the
type of dismantling that Mr. Irving did and the need it
filled; however those were the reasons that the Council had
attempted to cooperate with Mr. Irving since 1960; that
the amount of effort and money spent on actual compliance
with the conditions was not much; that he had looked at the
work accomplished; that the contract did not mean that the
work would be done now or within the period shown-on that,
the financing was forthcoming.
Mr. Altagen stated there was a thirty thousand dollar
$30,000.00) trust deed on the property; that Mr. Gutierres
had told him that it was only a question of presenting to
the lending institution or to the lend the perfected plan
and the granting of permits.
Mayor Bloxham stated that the public hearing could be
left open and action taken at a later date if they did
not comply with the conditions.

bound vies were not the same; that in Baldwin Park approxi-

school district was out of the City.
Councilman Holmes stated it had merit provided it was a
proper type of legislation; that perhaps it could be
a cooperative project as it was now with the-school
district paying the expenses and designating where the
crossing guards would be and their hours and be under the
jurisdiction of the police departments of the various
agencies;-that he did not think the money was. the prime
problefi.
Discussion followed that the cost for the City of Baldwin
Park was approximately four thousand dollars $4,000.00)
per year; that many school districts use students as cross-
ing guards under certain conditions.
Councilman Morehead stated in his opinion this was a
pedestrian traffic problem within the City; that this
was a problem that the City should retain.

Police Department Retirement System. He recommended that

this time inasmuch as no appropriation has been made in

Council should consider whether or not retirement benefits
should apply to a single department or should encompass
all City employees.
There was discussion wherein it was brought out by
Councilman Holmes that the Council had not received a
copy of the Actuarial Report submitted by the State.

approval of Special Holiday Remuneration. He stated that
as a Result of the national tragedy which occurred on
Friday, November 22, 1963, the Council ordered City
offices to close for that afternoon. He stated in the
interest of equal treatment for all employees considera-
tion should be given to those employees of Public Works
and the Police Department who worked by granting them
a half-day leave credit.

Chief Administrative Officer Nordby stated that he and the RECOMMENDATION BY
City Attorney jointly recommended that the City Council C.A.O. AND CITY ATTY
adjourn this meeting to discuss the Personnel Rules and TO ADJ. MTG. TO
Regulations; that the City Attorney would present to the DISCUSS PERSONNEL
Council an Ordinance which would not make the Rules and RULES AND REG.
Regulations conflict with the City Code.
City Attorney Flandrick suggested that the City Council
treat their action with respect to these rules as being
tentative as there were a number of areas where these
rules now conflict.with the existing Code Sections;
that both items could be taken care of at the same time.
COUNCILWOMAN TAYLOR MOVED THAT THE CITY COUNCIL ADJOURN MOTION MADE
THIS MEETING TO A SUITABLE DATE TO DISCUSS THE PERSONNEL

Chief Administrative Officer Nordby stated that a proposal
had been received from Pyle, Lance, Schlinger and Soil to
perform the audit required on the current sewer contract
61-A-1) relating to wage differential created by the
litigation delay and recommended that an agreement be
entered into between the City and Pyle, Lance, Schlinger
and Soil to perform this audit, subject to the review by
our legal counsel.

City Engineer Young reviewed his report concerning
Lighting District Petition No. 88-63, Resolution No.
63-140. He recommended that Resolution No. 63-140
adopted on November 6, 1963, be rescinded and the entire
resolution including Parcel A should be adopted; that
lighting in tracts were usually planned in advance and
were often approved prior to the actual adoption or even
development of the tract area where new tracts were to
be developed.
The City Attorney stated he would review the original
resolution at this time.
The Council proceeded with the next item on the Agenda.

Discussion followed wherein City Attorney Flandrick stated
Mr. Norris told him the Flood Control personnel indicated
they would accept $.18 a square foot for the excess property
next to the Roseg l en condominium project.
Councilman Bishop stated in his opinion they should have to
continue to operate under a nonconforming condition; that
in his opinion this would be giving big business special
privilege and encouraged a no vote" on this zone change;
that he would like to see in writing the law that permits
them to have this use under the conditions there.
City Attorney Ftandrick stated Senate Bill No. 600
covered this use.
There was further discussion wherein Planning Director
Kalbfleisch stated the building was ready to final out
that they had been required to replaster the garage areas.
