Mayor Bloxham requested a roll call which was the same as above. 00- City Attorney Flandrick reviewed proposed Ordinance No. 322 relating to the Chief Administrative Officer's duties and functions which, he stated, was recommended by Chief Administrative Officer Nordby. He stated that the first three sections of the present section of the Municipal Code had been consolidated; that the substantial change was in proposed Section 2903; that this section would require the City Council to appoint the seven positions indicated in that Section; that there would be an addi- tional section which should be added to the draft of the ordinance, present Section 2905, that it was suggested that Section 2105 be removed from the Municipal Code and the subject of appeals be covered by the Personnel Ruses and Regulations; that it was suggested that a Continued) 7:10 P.M. Councilman Morehead asked why Chief Administrative Officer Nordby wanted the present ordinance changed. Chief Administrative Officer Nordby stated that actually there would be no change in the powers and duties because in effect it was the Council who made appointments under the present system; that this would only confirm the practice that has been followed; that in either case the Chief Administrative Officer had the privilege of recommending. Councilman Morehead stated that in his opinion this pro- posed ordinance would be taking away some of the recom- mending powers from the Chief Administrative Officer's Office; that as he understood it the Council would be completely submerging themselves in the administrative duties of this City; that he did not agree with changing the present ordinance. Councilman Holmes stated the present ordinance was basically pretty good; that it did not need a complete overhaul; that the point Mr. Nordby brought out should be considered; that in his opinion the administrative ordinance should not be changed for.the time being and any subsequent amendment to effect what Mr. Nordby talked about be given thought and the ordinance amended to that extent and no more. Councilman Bishop stated that in his opinion the changes outlined were necessary to accomplish what the Council desired concerning the Personnel Rules and Regulations. City Attorney Flandrick stated that the point of conten- tion was subparagraph a) of Section 2904 which among other things provided that the Chief Administrative Officer had the authority to appoint with the permission of the City Council Department Heads and Assistant De- partment Heads; that the second full paragraph of that Section gave the Chief Administrative Officer the authority to appoint and when necessary for the good of the service to suspend and remove all other officers and employees of the City. He stated that the Council's decision on this point would have a direct bearing on the Personnel ides and Regulations; that if the power was to remain with the Chief Administrative Officer the Personnel Rules and Regulations as they now were would have to amended to fit them in with this concept. Councilman Holmes stated he could not see any direct conflict. City Attorney Flandrick stated it would in connection with the question of removal and explained that it was the suggestion that the Department Heads have the authority to remove and the Chief Administrative Officer would act as the reviewing authority. Councilwoman Taylor stated that every employee should have the right to an appeal. There was further discussion regarding proposed Ordinance No. 322. Councilman Holmes stated that in his opinion the employees should have an appeal to the City Council wherein it was brought out by City Attorney Flandrick that the hearing. could be held in executive session unless the employee objected; that if he objected it must be held in public. He also welcomed the City Employees present. 00- A gentleman came forward stating his name was Brown; that he was an attorney and had been engaged by the City Employees Association; that his office was in West Covina; that his experience had been with the District Attorney's office; that he had been a prosecutor for three years. He requested a copy of the Ordinance now under discussion. After discussion with Mayor Bloxham, Mr. Brown stated that it was a copy of the employees Personnel Rules and Regula- tions he was requesting. There were no corrected copies available; however Council- man Morehead handed Mr. Brown his work copy from a previous meeting. 00- City Attorney Flandrick proceeded with his comments on proposed Ordinance No. 322. Councilman Bishop stated that Administrative Aide should be listed as No. 8 under Section 2903. City Attorney Flandrick reviewed the corrections agreed upon by the Council namely: Adding an 8th office under Section 2903, Administrative Aide; Deleting second full sentence contained in the paragraph immediately following the listing of officers and adding to that section a provision that the Department Heads have the power of appointment, suspen- sion and removal as to the employees supervised by them with the approval of the Chief Administrative Officer and that such employees have the right of appeal to the City Council in the manner provided in the rules. With the Council's approval he stated he would make the corrections and resubmit the ordinance to the City Council. Councilman Holmes stated that it was his understanding that the ambiguity in the administrative ordinance would be corrected by the changes indicated and any procedures brought up by these appeals would be spelled out in the personnel rules and regulations. City Attorney Flandrick stated that was correct. 00- City Clerk Balkus pointed out that the changes. made by the Council at the last meeting on the proposed Personnel Rules and Regulations were typed in red on the copies passed out at this meeting. iS4. Document not in official files) He explained that this document sets up-a..personnel board and would leave the entire personnel administration in the hands of the personnel board. He stated he thought that one of the most important commissions or boards of-a city was a Personnel Board. COUNC-ILMN MOREHEAD MOVED THAT THE CURRENT PERSONNEL MOTION MADE RULES AND REGULATIONS STUDIES BE SUSPENDED UNTIL THIS DOCUMENT CAN BE CONSIDERED AND APPROVED OR DISAPPROVED BY THE CITY COUNCIL. Councilman-Ho4mes stated the personnel rules and regula- tions had been held up previously by various groups, legal ramifications and change of administration; that the suggestion of-Councilman Morehead virtually removed the entire authority and responsibility of the City Council wLthregard to personnel administration. Councilwoman Taylor indicated that the City Council should retain the personnel-administration. May, &Ioxham commented that hard-work and many hours had been spent on the document-Councilman Morehead presented; that, in his opinion, the personnel rules and regulations- the CounciI was now working on were more fitting; that the problems of the City employees were not great enough for a Personnel. Board. Councilman 13ishop. stated, in his opinion, it would be impossible for a City to operate under this type of Personnel rules and regu at tons which Included a. REGULATIONS PRO- CEEDED The CounciI decided that the- first paragraph of Section SECTION 178 J78 would read: SECTION 178. APPOINTMENT: After inter- view and such investigation as may be desired, the depart- ment head concerned shall make such- appointment with the approval of the Chief Administrative Officer.". The last sentence of Section 136 was deleted at the SECTION 136 recommendation of the City Attorney which read The City Council shall approve all new or added positions.". LACK OF SECOND At the suggestion of-City Attorney Flandrick the Council agreed in Section 158 that County Civil Service and so forth not be abbreviated. At the suggestion of City Attorney Flandrick, the Council agreed to change the seventh line of Section 159 to read: The Chief Administrative Officer shall determine the max- imum number of names to be placed on an employment list to meet the needs of the City." SECTION 158 COUNCILMAN MOREHEAD MOVED THAT THE LAST TWO SENTENCES OF MOTION MADE SECTION 159 BE OMITTED. MAYOR BLOXHAM SECONDED. City Attorney Flandrick stated this had been covered on Page 7, under Section 170. Discussion followed regarding Section 193. COUNCILMAN MOREHEAD MOVED THAT SECTION 193 BE DELETED. MOTION MADE AND COUNCILWOMAN TAYLOR SECONDED. CARRIED THAT SECTIOI 193 BE DELETED Discussion followed. The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, TAYLOR, BISHOP AND MAYOR BLOXHAM NOES: COUNCILMAN HOLMES ABSENT: NONE Discussion followed regarding Section 207 wherein the LAST SENTENCE OF Council instructed that the language of the last sentence SECTION 207 be revised. LANGUAGE TO BE RE- VISED The Council changed Section 222, Subparagraph g) to SECTION 222 read: That the employee has been convicted of any criminal offense; excepting occasional traffic viola- t ions.". Section 229, which had been deleted, was amended and SECTION 229 RESTORED restored at the suggestion of City Attorney Flandrick AND AMENDED to read: SECTION 229. APPEALS: Permanent Employees shall have the right of appeal from any decision of a Department Head to the Council in matters of disciplinary action, dismissal or suspension. All appeals shall be written, and in the form prescribed by the C.A.O., and shall be filed with the City Clerk.". COUNCILMAN MOREHEAD MOVED THAT SECTION 231, SUBPARAGRAPH MOTION MADE AND a) BE DELETED. COUNCILMAN BISHOP SECONDED. COUNCILMAN MOREHEAD MOVED THAT THE WORDS FAILURE TO MOTION MADE ADVISE" IN THE LAST SENTENCE OF SECTION 235 BE TAKEN OUT AND THE WORDS WITHOUT THE APPROVAL OF THE C.A.O." BE ADDED. The motion was withdrawn. MOTION WITHDRAWN City Attorney Flandrick suggested that Section 235 could SECTION 235 read as follows: SECTION 235. OUTSIDE EMPLOYMENT OR ACTIVITIES.
