The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman Holmes led the salute to the flag. TROPHY Park for the year 1963. He stated that Baldwin Park had reached 129% of the quota. 00- COUNCILMAN HOLMES MOVED THAT THE MINUTES OF DECEMBER 17, MINUTES OF DEC. 17, 1962, OCTOBER 10, 1963, AND NOVEMBER 20, 1963, BE APPROVED 1962, OCT. 10, 1963 AND FURTHER READING BE WAIVED. COUNCILMAN MOREHOD SECONDED, The motion cawed by the following vote: AYES COUNC I LME I BISHOP, MORE 4fAD, HOLMES, TAYLOR AND MAYOR BLOIKHAM NOES: NONE ABSENT: NONE 00-- Mayor Bloxham complimented the Road Department for their fine work on Los Angeles Street stating that he realized the work was not completed. 00- Councilmen Morehead reported that last week he had attended the 50th anniversary meeting of the Southern California Planning Congress in Santa Fe Springs. 00- Councilman Bishop reported that he had attended a League of California Cities meeting; that motel and hotel bed tax was discussed. 00- City Attorney Flandrick stated his memorandum concerning status of pending matters In litigation was for informa- tion only. 00- City Attorney Flandrick presented a proposed agreement between the City of Baldwin Park and A. Elizabeth and Gene Mathewson and explained that this agreement was concerned with acquisition of rights-of-my on Baldwin Park Boulevard for street widening. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ACCEPT THE CITY ATTORNEY'S RECOMMMAT ION AND APPROVE THE MATHENSON At3REEMENT AND THE PFEJPER OFF ICIALS BE AUTHORIZED TO SIGN, COUNCIUVOINAN TAYLOR SECONDED. COUNCILMAN BISHOP MOVED THAT ITEM NO. 2 BE APPROVED AS PRESENTED AND THAT THE PROPER OFFICIALS BE AUTHORIZED TO SIGN. COUNCILMAN MOREHEAD SECONDED. Chief Administrative Officer Nordby pointed out that there were some blank spaces on page 2 to be filled in. With the approval of the second, Councilman Bishop withdrew the motion. COUNCILMAN BISHOP MOVED THAT THE BEAUTIFICATION LEASE, ITEM 2, BE APPROVED AS PRESENTED WITH THE STIPULATION THAT IT BEGINS JANUARY 1, 1964, FOR A PERICD OF FIVE YEARS AT $5.00 A YEAR ON A LEASE BASIS. COUNCILMAN MOREHEAD SECONDED. City Attorney Flandrick stated then the second date to be inserted in Section 3 would be December 31, 1969 and in Section 4) the payments to be made on or before the first day of February. City Attorney Flandrick commented that this lease had been submitted to the railroad company but they had not given their consent; that if there were any changes they requested the agreement would be brought to the Council for concurrence. E. Walkup, Vice President, to establish a gasoline service station use in the C-1 neighborhood commercial) zone situated southerly of the San Bernardino Freeway at the southeast corner of Puente Ave. and Garvey Ave. Planning Director Kalbfieisch presented a resume of the case and stated that this case had been held over for a solution on the drainage problem. City Engineer Young reviewed his report and stated that the plans had been presented; that the drainage problem had been O.K.'d and temporary permits had been issued and O.K.'d by the State Highway Division; that the City of West Covina had given their. consent to this type of development.. Discussion followed regarding the drainage. City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR BLOXHAM. Mr. Warren C. Lefebre, 10600 Katella, Anaheim, stated that approximately three 3) weeks ago the Assistant City Engineer, Mr. Glenn Welch, and he and his engineer had a conference with the Division of Highways in the State Building in Los Angeles; that the problem as far as the State was concerned was that the water came through the double box culvert under Garvey into an open ditch; went through the open ditch until it got to a culvert which was under the alley which was off their property, just south of it and served the whole shopping center; that presented the problem of a major restriction;'that the culvert was of a temporary. nature; that if they brought the box all the'way across their frontage and stopped there was no way to tie the water into that culvert and make the connection; that it would have the effect of reducing substantially the capacity of the box under Garvey Avenue; that he wanted it understood that they were not quarreling with the City or the State; that they were willing to do anything from an engineering standpoint that could be done but this was all the State would buy so they did not have any choice on the matter. In response to Councilman Holmes, Mr. Lefebre stated that this would be a substantially improved situation from the way it was now; that it would all be covered; that the concrete curb would be in on the radius; that the first driveway would be in and permanent improvements; that if the State would go along they would be very happy to put in the entire structure; that he would like to point out that this was not the permanent structure; that the ultimate would be a pipe down the center of Puente to serve catch basins on both sides of Puente coming into this pipe and would go on some several hundred feet south to the open flood control channel; that they were posting with the City cash in an amount necessary to put in the permanent paveout; permanent curb, gutters, sidewalks and concrete driveway. Discussion followed that Puente Avenue from the San Bernardino Freeway to Valley Boulevard was to be improved and widened in the future. City Engineer Young stated he had been in contact with the Flood Control office regarding the allocation of the Project 604 Funds; that Baldwin Park was rated among the first four at the present time and that probably late in January, the City would be asked to start on design for the flood control portion of this particular area; that it would probably be approximately one year before the plans and everything would be completed; that it was-his opinion that the present drainage plan'would be adequate. Councilman Morehead asked City Engineer Young if it was his recommendation that CP-20 as far as the flood control problems were concerned be accepted as presented. City Engineer Young stated yes; that he was in favor of the plans as the encroachment permit given by the State and recommend that this was satisfactory for temporary drainage as it was on the set of- plans. COUNCILMAN MOREHEAD MOVED THAT THE TEMPORARY CALIFORNIA STATE ENCROACHMENT PLAN PERMIT THAT HAS BEEN GRANTED BE ACCEPTED BY THIS COUCNC I L AND CP-20 BE APPROVED AND THAT THE CITY ATTORNEY BE INSTRUCTED TO PREPARE THE NECESSARY RESOLUTION. COUNCILMAN BISHOP SECONDED. Councilman Holmes stated there were other conditions that had been discussed. Planning Director Kalbfleisch reviewed the conditions as set forth in Planning Commission Resolution No. PC 63-152. With the approval of the second,Councilman Morehead withdrew his motion. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE PLANNING COMMISSION AND APPROVE PLANNING COMMISSION RESOLUTION NO. PC 63-152 INCLUD- ING THE LATEST RECOMMENDATION OF THE CITY ENGINEER IN REGARD TO THE FLOOD CONTROL AGREEMENT AND THAT THE CITY ATTORNEY BE INSTRUCTED TO PREPARE THE NECESSARY RESOLUTION. COUNCILMAN BISHOP SECONDED. Mr. Warren Lefebre, 10600 Katella, Anaheim, stated they were asking for a variance to contract a service station with a normal layout; that the sign on the corner would be a standard Shell sign with 65 square feet; that it would rotate very slowly and would not flash; that land- scaping in service stations had not worked out very well; that this would be a Shell ranch type service station. As there was no one else in the audience desiring to speak either in behalf of or in opposition to ZV-87, Mayor Crites declared the public hearing closed. Planning Director Kalbfleisch stated the recommendation of the Planning Commission was for approval and read the conditions suggested by the Planning Commission. Discussion followed concerning the conditions wherein Councilman Holmes stated that the conditions should specify that the sign be 50 ft. sign area, per face, and that it would be non rotating. There were no changes made in the conditions of the Planning Commission since the conditions as stated by Councilman Holmes were part of the request. There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus stated the City Council had a memorandum concerning Z-198, that this matter had been inadvertently left off the agenda, however there was a written request to continue this matter to January 15, 1964. As there were no objections, Mayor Bloxham stated no action was required; that tis matter would be automatically continued to January 15, 1964. 00- City Engineer Young reviewed his report regarding the installation of stop signs which recommended that stop signs be authorized for installation on Bogart at South Ramona and on Depot, Virginia and Vineland at Badillo as shown on the sketch presented). COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION OF THE CITY ENGINEER AND THE TRAFFIC COMMITTEE AND I N ADDITION ADD TWO MORE STOP SIGNS ON THE EASTERLY AND WESTERLY SIDE OF BAD ILLO AND RAMONA BLVD. MAKING THAT INTERSECTION A 44WAY STOP. COUNCILMAN BISHOP SECONDED. Councilman Morehead asked if City Engineer Young concurred with this. City Engineer Young stated that eventually this was going to have to be signalized Badillo and Ramona); that the feeling was if four-way stops were put in it was difficult to take them out, that this intersection was a problem at certain times of the day arid a. portable signal would solve the problem, however portable signals were expensive and this was not practical; that he would go along with the 4-way stop. The report stated that Lot Split No. 584 approved by the Planning Commission by Resolution PC 63-164 was requested held over by the Council for further study; that Lot Split No. 584 was a portion of a former Lot Split, No. 337; that Parcel B of Lot Split No. 584 at one time was to be a street portion entering Nubia as indicated by the master plan; that the master plan of this portion of the lot had apparently been studied by the Planning Commission in connection with this lot split and the feeling of the Planning Commission was that they could develop the land below Nubia by entering either from Lante or Fortin Street and having a cul-de-sac along the back property lines; that, in his opinion, if this lot split was held up due to requiring a street entering on Nubia that the City purchase Parcel 8 of Lot Split No. 584; that the reason that he had requested Lot Split No. 584 be reconsidered was for the purpose of asking that the sewer bond be required paid off in full on Assessment No. 682; that in his letter of October 23, 1963, to the Planning Department he had requested that the bond be paid off in full because at that time the bond interest payment was five months over due; that the property had been sold off illegally without a lot split" but was then again re- purchased by the former owner and presented to the Plann- ing Department for a lot split; that at the present time the first payment on Assessment No. 682, Bond No. 545 was seven months over due and the next payment of interest plus the bond principal was now one month over due with penalty; that the bond amount could not be split until there was a legal lot split and O'Melveny and Myers had termed this an illegal lot split and therefore the bond amount could not be split at this time.
