The Council elected to handle item No. 6 Assessment District RE 62-A-1
No. 62-A-1) under City Clerk next on the Agenda.
Mayor Bloxham asked whether it would be advisable for the City ASSESSMENT BONDS
to award a construction contract at this time, and whether-or
not the assessment bonds will be marketable.
Mr. H. B. Zelles of Stone & Youngberg stated that everything
was in order; that a letter was on file with Mr. Nordby that
there will be one or more bids for the purchase of bonds
for district No. 62-A-1; that as of December 2, 1963 a check
with the Director of Finance indicated the following:
$237,395.19 payments in cash
2,385.20 payments under $50.00
49,302.22 assessments from public agencies
1,358,782.45 would go to bond
$1,647,865.06 TOTAL
Mr. Zelles stated that there would be a total of 2,478 bonds unless
there were payments of bonds before bonds are delivered to the
buyer. He requested that the Council approve the preparation of
a statement which is to be mailed to the official bidders; he
said that the statement would be much like the one mailed to
the bidders on Assessment District No. 61-A-1 which contains
the assessment diagram, a description of the bonds, redemp-
tion provisions, the economical and fiscal characteristics
of Baldwin Park, etc. plus the official notice of sale; that BIDS TO BE RECEIVEO
bids on the bonds will be received on February 5, 1964 in FEBRUARY 5, 1964

He expdeieed it will be necessary to hire an appraiser for EASEMENTS
thg acquisitions so the contract will not be delayed. The
appraiser who conducted the work for the first district,
Mr. Jack J. O'Brien, who was quite satisfactory, indicated
he could do the job quite quickly and for approximately
the same amount, that he. could not give an exact figure
because he does not yet have the strip maps prepared by
the engineering department to examine. He requested
authorization to obtain title reports and authorization
for overtime for the preparation of strip maps.

Assistant City Engineer Welch explained that the Traffic
Safety Committee consisting of City Engineer Young, Chief
Administrative Officer Nordby, Chief of Police Best and
himself had considered-the request and investigated the
area and recommended that Athol be considered as a through
street and traffic allowed to proceed without stopping
between Bess Avenue and Francisquito Avenue, and that
traffic stop when entering Athol from Cosbey Avenue,
Fairgrove Street, Waco Street and Egi i Avenue.

Discussion followed wherein Councilman Holmes suggested
that the Traffic Safety Committee continue to check the
area to see if this handles the problem and if necessary
that they make further recommendations.
Councilman Bishop said that the committee may want to keep
the sign at Elwin School as this sign had been installed
upon request of the school. It was suggested that the
City Attorney prepare the resolution taking into considera-
tion the Council's comments.

Mayor Bloxham announced that the hour of 8:00 p.m. having
arrived that it was the time and place fixed for the
public hearing on Z-199, an application filed by Ralph C.
Lerge, et al, for a change of zone from A-1 light
agricultural) zone to C-2 neneral commercial) zone or
more restrictive zone fer properties located at 13547
Franci squi to Avenue and 3203, 1213 North. Baldwin Park
Boulevard, in the City of Baldwin Park.,
Mayor Bloxham stated that this public hearing had been
opened previously and at the request of the applicant had
been continued from December 18, 1963.
The oath was administered by City Clerk Balkus to anyone
who wished to testify.
Mayor Bloxham asked for testimony in behalf of the zone
change.,
Mr. Milton Hadley, Attorney, 14304 East Ramona Boulevard,
stated he represented the petitioners for the zone change
and also for Conditional Use Permit Case No. CP-19.
He: indicated that it was the thought of the petitioners
present that they will construct a service station on
this particular site; a factor for consideration was
that there are no service stations in this particular
area; it is a heavily traveled intersection; this area
is adjacent to the freeway; the present dwelling on the
area should be improved; the shopping center will go
in south of the area; traffic will support this type
of business; it will be an improvement to the inter-
section; this wi l l be a buffer between commercial and
residential; there is sufficient area for a service
station; the only service will b`, gasoline, oil and
tube; he considered this the highest and best use
for the property in his opinion; that an apartment would
block the area as there is not sufficient parking; that
the station would furnish employment plus City tax; that
there would be no extra load on schools and he requested
approval of both Z-199 and CP-19. Mr. Hadley presented
aerial photos of th area for Coinci 1 to view.
Further testimony in behalf was given by Eli Petrack,
developer of the property. He stated the property was
selected by Humble Oil Company; that they planned to
expend approximately $60,000 and they felt this was a
good business location.
Further testimony in favor was given by Sidney Down,
a real estate broker, representing Ralph Lerge, et al,
stated Mr. Lerge had paid taxes on the property for
twenty-two 22) years; that Mr. Lerge would like to
purchase other property in the comauni t y; that Mr. Lerge
felt this was no longer safe residential property.
Mr. Evans, 3440 Wilshire Boulevard, representing Eli
Petrack stated that flood lights on the corner would be a
safety factor.
As there was no further testimony either in behalf of or
in opposition to Z-199, Mayor Bloxham declared the public
hearing closed.

Discussion followed wherein it was the consensus that the
area should be considered all at once by precise planning;
that there could be traffic problems, etc.
COUNCILMAN BISHOP MOVED THX THE CITY COUNCIL CONCUR WITH

THE ATTORNEY BE INSTRUCTED TO PREPARE A RESOLUTION TO THAT

City Attorney Flandrick stated that in view of Council's
action on Z-199 they would be denying CP-19 also, other-
wise it would be improperly zoned.
Mayor Bloxham declared the public hearing closed on CP-19.

RESOLUTION OF DENIAL ON CP-19. COUNCILMAN BISHOP SECONDED.
There were no objections, the motion carried and was so
ordered by Mayor Bloxham.

Mr. Larry Sade, applicant for Zone Change No. Z-208 stated
he was ill and had been and requested that Z-208 be con-
sidered as the next order of business. The Council
acceded to the request and Mayor Bloxham announced that
it was now the time and place fixed for a public hearing
on Z-208, an application submitted by Larry Sade request-
ing a change of zone from A-i light agricultural) zone
to R-3 multiple family residential) zone and C-M
commercial manufacturing; zone or more restrictive use
on the hereafter described real properties: Parcel A:
A change of zone from A-1 light agricultural zone to
R-3 multiple family residential) zone or more restrictive
use for properties located in the 15201 and 15301 block
of Badillo Street. Parcel B: A change of zone from A-1
light agricultural) zone to C-1`4 commercial manufacturing)
zone or more restrictive use for properties located in the
15200 and 15300 block of Ramona Blvd. Parcels A and B
contain 14.142 acres.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and pointad.-out the ru.bject property a proxiriately

Mr. Larry Sade, developer, 8362 West Third Street, Los
Angeles 48, stated the Planning Commission recommended
approval on the zone change, that he had developed other
property in the City, that he intended to make this a
good development and requested the Council's approval.
Councilman Holmes questioned whether Mr. Sade had re-
quested C-M zoning on approximately two 2) acres on
Ramona included in the area.

Mr. Sade explained that this C-M is presently in effect
on Ramona and under the Master. Plan fit is C-M; that they
have no plans for this paace i; that this would create a
buffer Pone between R-3 and the Commercial; that they have
only three acres; that everything in this section on Ramona
is strip zoning and is all C zoned; that this does not; look
well and that he does not want to build out to Ramona; that
the proper development of R-3 is what they plan, now.
Councilman Holmes asked Mr. Sade if he would object to C-1
or C-2 zoning and what the five foot easement on the west
boundary was intended for.
Mr. Sade said he had no objection to C-1 or C-2 and that the
easement was a drainage easement for West Covina for drain
age to Badillo.
As there was no further testimony Mayor Bloxham declared
the public hearing closed.
City Attorney F l andri ck explained that C- H can be changed
to C-2 but the request would have to go back to the Plan-
ning Commission for a report, but would not have to be
readverti sed.

He stated the area contains approximately 63,000 square
feet; that possibly 16 to 17 duplexes could be put on the
property; that they planned 18 duplexes 9 duplexes single
story) with shake roofs, all two bedroom units; that
recreation area would be included.

commented upon the number of runs and walks required 1341 Virginii!d Ave,
and stated that she would put them in. She objected to
the installation of sidewalks and referred to Mr. Nemeth's
application for a kennel, saying she had used the same
plot plan as Mr. Nemeth and did not feel it was fair that
she be expected to install rock walls and sidewalks and
curbs and gutters when he had made the same type of applica-
tion and these Installations were not required of him,
and she asked that the Council give her consideration.
Mrs.Mer'ien Lillyett, Virginia Avenue, stated she desired IYARtAN LILLYETT,
to have a conditional use permit for the same use, and Virginia Ave.
would apply for one later.

Discussion followed wherein City Attorney Flandrick
explained that curbs and gutters were required in an
M-1 zone but not sidewalks.
Planning Director Kalbfleisch said the conditions in
the two cases were almost identical, but the need was
not discovered at the time the Nemeth case was handled;
also there had been a change in the ordinance in November,
1963.
The Council commented it was unjust. to require sidewalks
on one like-application and not on another.
The Council reopened the public hearing. PUBLIC HEARING
REOPENED CP-21
Mrs. Ronneberg stated she had more buildings and improve-
ments in than Mr. Nemeth.
Mrs. Lillyett questioned whether anything besides a block
wall could be installed any other type fence that would
be six 6) feet high wherein Mr. Kaibfleisch explained that
a six 6) foot block wall was required.
At 9:45 p.m. there were certain sections of the Municipal RECESS 9:45 P.M.

January 2, 1964; that they were anxious to begin construc-
tion.

City Attorney Flandrick gave a report as follows:
Item No. 1. Mr. Flandrick met with Mr. Chambley, the head RE LOS ANGELES
of the division wno Will have the power to approve the ST. PROJECT
appraisal so the City can expend gas tax funds. This was
in connection with the Los Angeles Street project; that
formerly it had been proposed to the Council that the
appraisers, Mr. J. A. Mann and Mr. Jack O'Brien, be employed
for Los Angeles Street; that the cost of a brief appraisal
would be $5,000.00; that a detailed appraisal as required
by the Mate in the past would cost $15,000,00. Mr. Chambley
indicated that the state would accept the lesser type STATE WILL ACCEPT
appraisal report. Mr. Flandrick stated the City would soon LESSER TYPE APPRAISAL
be in a position to have the properties on Los Angeles REPORT
Street for the widening.
Item No. H. Lot Split No. 584. Planning Director Kalbfleisch L.S. NO, 584
indicated on a map the area being considered for street right RE STREET RIGHT
of way as a condition of approval for the lot split. Mr. OF WAY
Flandrick explained that an entire parcel could not be re-
quired as a condition of approval as the required parcel
had to have some relation to the lot split itself. In
this case the acquisition would do nothing for the remain-
ing two lots but would benefit other properties. He
suggested the City acquire the lot either by purchase or
condemnation from the present owner.
Discussion followed as to acquiring the lot now or at a
future time.

Chief Administrative Officer Nordby explained that Mr.
and Mrs. Taylor, 4242 North La Rica had offered to donate
a German Shepherd dog to be used in police work. He said
Mr. Albert Messerschmidt, West Covina, had indicated the
dog was ideally suited to police work, and Officer Baker
of the Police Department had volunteered to house, feed
and handle the dog on his own time and expense should
the City accept the offer. Mr. Nordby explained that the
City might wish to accept the offer on a trial basis to
evaluate the service.
Discussion followed with Councilman Holmes questioning who
would train the dog.

Officer Baker said the dog was already trained; that
training is 80f the man and 2O the dock; that a dog should
work with one owner only.
Mr. Nordby stated Mr. Messerschmidt would train the dog
and in answer to Councilman Morehead's question indicated
that being a free offer the City could accept.
Councilman Morehead indicated the City should accept the
free offer on a trial basis; that this would be a wonderful
asset and then the City would know how this one dog would
work.
Councilmen Bishop, Holmes, Taylor and Mayor Bloxham dis-
cussed the matter at length as to insurance, problems
involved, use of the dog with only one man, and that the
dogs were fine but should be considered at budget time.
COUNCILMAN MOREHEAD MOVED THAT THIS ONE POLICE DOG IN
QUESTION BE ACCEPTED FROM MRS. TAYLOR AND THAT THE CITY
PAY ONE DOLLAR FOR THIS DOG SO THEY CAN DEFINITELY CLAIM
LEGAL TITLE AND THE NECESSARY RAMIFICATIONS TO LEGALLY
O'IN THIS DOG AND TURN IT OVER TO OFFICER BAKER AND WHEN
THIS DOG, IS IN THE OPINION OF MR. MESSERSCHMIDT, AND

this would produce better development. The Planning

Discussion followed as to requirements of the building
code which would require a change in the ordinance.
COUNCILMAN MOREHEAD MOVED THAT ALL PROPERTY IN THE CITY

Discussion followed regarding property that has been
zoned prior to the change in the ordinance.
City Attorney Flandrick stated he would have to review
the code to clarify this problem.

how they would be effected by a change in the code.

50% written examination and 50% oral examination should
be clarified.
City Attorney Flandrick suggested this be inserted at the
end of Section 155, which would read as follows: The
final score in any examination shall be based 50% on the
written portion and 50% upon the oral portion.'
Mr. Nordby said the City Attorney suggested adding a
Section No. 182 on Page 9 as follows: ACTING CAPACITY,"'

City Attorney Flandrick stated that if the Council wished
to leave the additional information that Mr. Kalbfleisch
had indicated for the plot plan to Mr. Kalbfleisch's
approval as to location in compliance with the code, this
could be accomplished; and if there is an urgency, a
resolution of approval could be prepared immediately
should this be the desire of the Council.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to CP-22, Mayor
Bloxham declared the public hearing closed.
Discussion followed with Councilman Bishop calling
attention to an old trailer, also trash accumulated on Lot
27 being a fire hazard, and questioning ingress and egress
to the lot, he further questioned whether the house would
be removed.
The Council reopened the public hearing.
Mr. David DeVall, Principal of the school, who resides
at 1231 1,1ardena, Viest Covina, came forward and stated the
house was fenced off, that there was a tractor, a tree
and a In power mower on the back of the property. He
stated the property would be completely cleaned up and
the parking area black topped.
Further discussion followed as to parking spaces necessary,
with Mr. DeVall stating they would abide by all City re-
quirements.
City Attorney Flandrick questioned the number of off street
parking spaces which would be required by the Planning
Director.
Discussion followed wherein the applicant proposed a
parking lot 701 x 100' minus the ingress and egress
and the Council indicated this would be adequate.
Reverend Glen Goffar indicated the layout on the map
on the wall and mapped in the parking area showing a
twenty-five 25') foot wide ingress and egress.
City Attorney Ftandrick said this would suffice as a
plot plan.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to CP-22, Mayor
i3loxham again declared the public hearing closed.
City Attorney Ftandrick read Resolution No. 64-7 by
title as follows:
