CLAUSEN, ZONE CASE Z-212 BE SET FOR PUBLIC HEARING ON FEBRUARY 20, 1964. COUNCILMAN HOLMES SECONDED. Chief Administrative Officer Nordby stated he had ex- plained the Short Form 1911 Act to Mrs. Esquivel both by means of telephone conversation and by letter when the issue had come before the Council previously August 21, 1963). The Council Instructed that the Chief Administrative Officer contact Mrs. Esquivel or write her, again and refresh her memory as to what she could do along the lines of the 1911 Act in putting in sidewalks or curbs and gutters. Councilman Morehead stated that comments should be made on her postscript; that the.City did not condone persons traveling sixty 60) miles per hour in the City. 00- Minute Clerk Langseth asked if the Council wished to consider a letter from S. W. Ferguson, Owner, regarding Lot Split No. 593 and a letter from Frank Perricone, Owner, regarding Lot Split No. 594 both requesting that ten 11t0) day riptide to the applicant from the City Clerk be waived and that the tot splits be brought on the agenda. Mayor Bloxham asked the reason for the waiver request. Mr. Tracy Bousman, 212 South First Avenue, Arcadia, stated the waiver was asked because the lot splits were filed with the engineer on December 10, 963 and did not get to the Planning Commission until January 22, 1964; that in the meantime loans were running and Interest was being paid on approximately $65,000.00; that noramily it did not take sixty 60) days to get to the Planning Commission. COUNCILMAN HOLMES MOVED THAT THEY L.S. NO. 593 AND 594) BE BROUGHT ON THE AGENDA TONIGHT AT THE PROPER PLACE TO BE CONSIDERED. COUNCILWOMAN TAYLOR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- Councilman Holmes stated that Thursday, February 13, 1964, there would be a quarterly meeting of the Upper San Gabriel Valley Water Association at Eaton's at 6:00 p.m.; that the current status of the water problems would be discussed; that he would be happy to see that reservations were made for any of the Council who wished to attend. 00- Councilwoman Taylor stated she had attended a Library Committee Meeting at Mt. San Antonio; that their new library was beautiful. 00- Mayor Bloxham stated that he had received notice from the Police Department that part of the staff had had car trouble and would be present shortly. 00- The City Attorney's portion of the Agenda was deferred until later in the meeting. TREASURER City Treasurer Pugh said she wanted to know who was responsible for the Deputy City Treasurer. City Attorney Flandrick stated the Deputy was responsible to the City Treasurer in so far as the duties of the City Treasurer were concerned. City Treasurer Pugh stated the budget called for a full time Deputy City Treasurer; that a full time Deputy was needed. Discussion followed regarding the duties of the Finance Director as far as State Statutes were concerned and duties that were delegated by the Council. City Attorney Flandrick explained that one of the provisions of the Personnel Rules and Regulations was that the Council would establish a job classification plan which would include JOB CLASSIFICATION each position in the City other than elective or appointive PLAN BEING PREPARED position; that the necessary Information was now being prepared and would be submitted to the Council at a later date. 00- At this time Mayor Bloxham asked Mr. Urban J. Schreiner of O'Melveny and Myers to proceed with the opening of the bids. This being the time and place fixed for the opening of bids for $1,358,782.45 of bonds to be issued to represent unpaid assessments levied upon lands within Assessment District No. 62-A-1, the following bids received pursuant to the notice inviting bids were publicly opened, examined and read: 8:00 P.M. Mr. Kalbfleisch further stated that this was last large major portion of the A-I to R-) zoning within the City; that approximately ninety 90) per cent of the City would be changed from A-1 to R-I with the completion of this zone change. He stated one of the conditions of approval as stated in the resolution of approval was that the applicant shall construct and install a six 6) foot block wall on each side lot line and rear lot line of the subject property". He stated that the question was, was Mrs. Ronneberg going to be required to construct the wall surrounding the entire parcel or merely surround- Ing the area in which the dog kennels themselves would be located. Discussion followed that the Council had not required sidewniks or curbs. Planning Director Kalbfleisch placed a plot plan later marked City Council Exhibit A")on the wall. It was pointed out that the area described as being used for the dog kennels was approximately forty 40) feet by seventy 70) feet. Planning Director Kalbfleisch pointed out that the Planning Commission had recommended a block wall along both side lot lines and the rear lot line; that the conditional use permit had been requested on the entire property. COUNCILMAN BISHOP MOVED THAT RESOLUTION NO. 64-12 BE AMENDED TO READ TO ENCLOSE THE IMMEDIATE AREA BEING USED FOR THE KENNEL AS THE CITY ATTORNEY POINTED OUT. City Attorney Flandrick pointed out the area to be enclosed on the plot plan and marked it. Mrs. Lois Ronneberg stated that she understood if she wanted to enlarge the kennel all she had to do was put up more wall. Mayor Bloxham stated to enlarge the kennel would take another conditional use permit application. Mrs. Ronneberg stated she understood that she would not have to put a wall back of the kennel house. Mayor Bloxham stated there would have to be a wall around the entire kennel area; that a house would not constitute a wall. 00- Chief Administrative Officer Nordby reviewed his report regarding the purchase of the westerly fifty 50) feet of Lots 98 and 99 of Tract 7701. He stated that the owner Mr. Horace E. Long had been contacted pursuant to the City Council's instruction; that Mr. Long submitted his price of $3,000.00 net in writing; that the City Engineer had agreed the price of $3,000.00 net was acceptable and the City should proceed to purchase the property for street purposes; that in addition to the stated price the City would absorb its proportionate share of sewer bond No. 682 in the amount of $428.72; that the lot size was 50 by 125.85 feet; that in as much as the City had sold property at Los Angeles and Stewart approximately two months ago for $3,826.00 there would be no problem in budget adjustment to acquire this property. Baldwin Park for advance planning for sewer district RE SEWER DISTRICT No. 3, whatever area it would encompass; that Mr. Emmert NO, 3 had no thoughts as to the size of the district and stated this was a practical matter that the H.H.F.A. or C.F.A. has no concern over; that it would have to be determined locally on the advise of the engineering staff or consult- ing engineer; that regarding the amount of loan the City could apply for and have approved on the regional level, he said there was no maximum; that in regard to the time element of approval he said the application may be approved in as short a period of time as two weeks and a maximum of five weeks; that delays occur not in the screening of the application but in the availability of funds; that the availability of the funds could conceivably take another two months after the loan was approved. In answer to a question by Councilwoman Taylor, City OPINION BY CITY ATTY Attorney Flandrick stated that Section 9303 was the section RE SECTION 9303 that permitted the City Engineer to approve lot splits under certain circumstances; that if the lot split was on a private street he had no alternative but to disapprove that lot spl-t and refer the matter to the Planning Commis- sion; that i•f there was an indication that there was a requirement or would be a requirement for widening of a street or-the creation of a new street he must disapprove the lot sp•Jit map unless under Section 9305, the City SECTION 9305 Council stated that was the area they desired for a new street or X" street must be widened so many feet and therefore direct the City Clerk to accept the proper deed granting that dedication to the City and the Finance Department to accept the cash bond or whatever it might be for the improvement; that the purpose of Section 9305 was to place the burden of creating new streets and determining the width of streets where it belonged, on the City Council. Councilmo Holes stated then the lot splits presented did not comply with the intent of the ordinance. City Attorney Flandrick stated no; that as they presently stood they, coijd not be approved by the City Engineer; that they ofd only be approved by the City Engineer with- out Pjanningcomnission and City Council formal action if the City C9uf)cil stated that the proposed design as sub- mitted y,03 peceptable in terms of the street pattern and direct the City Clerk to accept the grant for the areas of these streets. Councilman Holmes stated the ordinance stated that all of the improvements shall be in before lot splits can be approved by the City Council. City Attorney Flandrick stated this was correct, or bonded for. Discussion followed regarding the application fee wherein RE APPLICATION Planning Director Kalbfleisch stated the original lot split FEE LOT SPLITS ordinance required approximately $55.00 for a lot split, $10.00 filing fee, $5.00 for engineering fee, and $10.00 for each lot. Considerable discussion followed regarding proper procedure. City Attorney Flandrick stated if the Council was satisfied with the lot splits as submitted in other words if they felt on all three of the lot splits that the street pattern was satisfactory) then the motion would be to direct the City Clerk to accept the necessary deeds conveying to the City the easements and the one 1) foot outlots and further in so far as the improvements were concerned curb, gutter, sidewalk, street improvements if necessary, street trees etc.) direct the City. Councilman Holmes explained that this lot split should have gone to the Planning Commission for study and reaomnendation; that undoubtedly there was in the overall planning an access from Merced Street or from Walnut 1o the Interior street. Discussion followed regarding the waiver of the ten 10) day notice to the applicant wherein City Attorney Flandrick stated that the waiver must be in letter form filed with the City Clerk. Mayor Bloxham handed a copy of the lot split section of the Municipal Code to the City Clerk to give to the applicant. The applicant indicated he had a copy of this section of the Code). He further stated that the tract would not be formally accepted until the correction to the street curb was made; that most of the $400.00 would be used in correcting the street grade when the next tract adjacent to this was improved; that the tract had been presented to the Planning Commission as No. 29528. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BISHOP, MOREHEAD, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE 00- City Engineer Young reviewed his report requesting permission to install a small section of sewer line extending from Tract 26449 on Stichman across a vacant parcel to a portion of a street that was previously dedicated under Lot Split No. 387; that this would enable a house being built on this lot to tie into the existing sewer in lieu of running an adverse grade and extending out to Vineland; that this would also get this sewer in the proper location for the extension of any future development onto the east of this particular project. Councilman Holmes stated in his opinion this would be using the sewer revolving fund to build a private sewer for an individual who has requested a lot split and approve making installation across another property owners lots. City Engineer Young stated he assumed that the revolving fund for sewers was to extend the sewer through; that the money would come back by the development of the other properties; that a hook up fee would have to be charged to the developer; that it would be up to the City to acquire an easement for that purpose. Discussion of the street dedication that would have to be acquired at some time". City Attorney Flandrick stated this could be done if the City acquired an easement and if this was a main line sewer and not a private sewer; that he understood from Mr. Young's letter that this was a main line sewer, not a house lateral. He asked if it could be set up that the four 4) parcels would pay the total cost. City Attorney F!andrick stated this would require a change in the ordinance and when,as and if they apply for a hook up to that sewe-, charge them the fee. Councilman Morehead asked f the person could tie into Vineland wherein City Engineer Young stated he could. Councilman Holmes stated this was not as good a set up as getting the Stichman Avenu,~ line extended so that the people on down the line can proceed and not require a lateral from Vineland for some 400+ feet. City Engineer Young stated that sewers were available on Vineland and it might not be possible to extend this sewer on up through under the assessment act. Councilman Holmes stated if this was extended the people should pay their proportionate share, the revolving fund picks up the distribution part of this for the area and that is where the proration comes in but the easement should be obtained first before the Council approves the request. COUNCILMAN HOLMES MOVED THAT THIS BE RETURNED TO THE CITY ENGINEER AND THAT HE AND THE CHIEF ADMINISTRATIVE OFFICER COME UP WITH MORE DETAILS ON THE MATTER OF THE EASEMENT AND PRORATING THE COSTS BETWEEN THE TRUNK LINE EXTENSION AND THE INDIVIDUAL USAGE. Mr. Bousman stated if six 6) feet out of the twenty 20) feet was maintained for curbs and sidewalks they could give the City a three 3) foot easement back of the sidewalk for utilities; that they would have to retain the footage in order to comply with the zoning area require- ments. The Council agreed with this suggestion, a six 6) foot area, four 4) foot would be the easement for the sidewalk and the two 2) foot area for the utility use would be part of the street; that the poles would be located back of the sidewalk. City Attorney Flandrick stated that the bond situation was in a different category and the City could not make a charge for this type of question. It was clarified that the Council wished a recommendation to be brought back for approval on these charges. COUNCILMAN MOREHEAD SECONDED. The motion carried by the following vote: February 5, 1964 Page 12 REQUESTS CONCERNING BONDS CITY ATTY. STATED CITY COULD NOT MAKE CHARGE FOR THIS TYPE OF QUESTION RECOMMENDATION TO BE BROUGHT BACK FOR APPROVAL ON THESE CHARGES MOTION SECONDED MOTION CARRIED AYES: COUNCILMEN BISHOP, MOREHEAD, HOLMES, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE 00- City Engineer Young reviewed his report on the damage REPORT BY CITY ENGR. to the brush chipper. He stated that the damage was ON DAMAGE TO BRUSH accidental; that the cost for repair was $1,319.00; that CHIPPER the only apparent place in the budget that the money could come from was from Engineering Department salary savings; that there should be more money in the budget for accidental repair to machinery; that he recommended that the machine be repaired. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONCUR WITH MOTION MADE AND THE REC'-~;.".MENDATION OF THE CITY ENGINEER ON THIS AND THAT CARRIED THAT CITY THE CHIPPER BE REPAIRED FOR THE SUM OF $1,319.00 AND THAT COUNCIL CONCUR WITH IT COME OUT OF THE FUNDS AS RECOMMENDED BY THE CITY ENGINEER. RECOMMENDATION OF COUNCILMAN MOREHEAD SECONDED. The motion carried by the CITY ENGR. TO USE to be installed on Ohio Street and on Merced Avenue. SHORT FORM 1911 ACT ON OHIO ST. AND MERCED AVE. MAYOR BLOXHAM MOVED THAT THE CITY ATTORNEY BE DIRECTED TO MOTION MADE AND PREPARE THE NECESSARY RESOLUTION TO INSTITUTE THIS AND CARRIED THAT CITY BRING THEM BACK AT THE NEXT MEETING. COUNCILMAN MOREHEAD ATTY. BE DIRECTED TO SECONDED.
