The City Council of the City of Baldwin Park met in ad- journed regular session at the above place at 7:00 p.m. Roll Call: Present: COUNCILMEN BISHOP, HOLMES.. AES. NO. 64-23'RE CERTAIN RESOLUTION NO. 64-33 CLAIMS AND DEM4NDS AGAINST SAID CITY A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING RESOLUTION NO. 64-23 RELATING TO CER- TAIN CLAIMS AND DEMANDS AGAINST SAID CITY" City Clerk Balkus explained that this resolution corrected CORRECTING TYPO. the typographical error which was pointed out on February 5, ERROR 1964, when Resolution No. 64-23 was presented. COUNCILMAN BISHOP MOVED THAT RESOLUTION NO. 64-33 BE APPROVED RES. NO. 64-33 AND FURTHER READING BE WAIVED. COUNCILMAN MOREHEAD SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BISHOP, MOREHEAD, HOLMES, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE 00- Councilman. Bishop stated that the lot splits should be RE LOT SPLIT PRO- handled under the old procedure; that the ordinance should CEDURE be amended to accomplish this. U Councilman Holmes stated if the matter was handled in the manner it was intended to be the present ordinance was satisfactory; that if the situation was not clear enough and It was going to be a complicated problem to handle, lot splits should be handled under the original procedure. Chief Administrative Officer Nordby stated he would like to submit a report to the Council at their next regular meet- ing clarifying the lot split ordinance. There was further discussion. Mr. Urban J. Schreiner stated he had looked at the check which was drawn for H,H.F,A.; that it was the proper time to pay it; that he was not aware of any prior payment. Finance Director Duncan verified that this payment had not been made previously. COUNCILMAN BISHOP MOVED THAT RESOLUTION NO. 64-34 BE APPROVED AND FURTHER READING BE WAIVED, COUNCILMAN MOREHEAD SECONDED. The motion carried by the following vote: AYES: COUNCILMEN BISHOP, MOREHEAD, HOLMES, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE 00- City Engineer Young presented Lot Split No. 596, 3251 North Athol, William F. Berritt, applicant. He stated that the curbs and gutters were in and the street was improved with the exception of sidewalks and some driveways. He stated the applicant was installing sidewalks around Parcel 1; that the applicant wanted to put sidewalks in front of the other parcel but wanted to wait until the house was built so as not to tear up the sidewalk. He commented further stating that under the present ordinance the lot splits could not be recorded unless the City Engineer signed them; that under the old procedure lot splits could only be recorded as pieces of ground as they were sold. He stated his recommendation was these people be permitted to build; and install sidewalks at later date) that under the lot split ordinance he could not accept the deposit for the sidewalks that were to be constructed. COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL CONCUR WITH THE CITY ENGINEER AND APPROVE LOT SPLIT NO. 596. City Engineer Young stated,in explanation, that he would accept the deposit; that the applicant would be given a building permit; that after the house was built, sidewalks were in and affidavit signed the map could be recorded as a lot split. Discussion followed regarding the recording of lot splits under the old procedure. City Attorney Flandrick stated what was recorded and what was on the assessment maps was entirely unrelated; that until the lots were sold off the Assessor's Office would not divide the tax bills. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL ADJOURN TO THE CONFERENCE ROOM OF THE CITY HALL, COUNCILMAN BISHOP SECONDED, There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- At 7:30 p.m. Mayor B!oxham reopened the Adjourned Regular Meeting of the Baldwin Park City Council in the Conference Room of the City HaII. City Clerk Ba!kus took the roll call which was identical with the one taken at the commencement of the meeting in the Council Chamber. 00- Chief Administrative Officer Nordby stated that there were three main Items concerning the next sewer district to be discussed this evening: the size of the district, the procedure or the thinking of the Council in the selec- tion of Consulting Engineer, and whether or not the City is going to H.H.F.A. for financing. Councilman Holmes stated he was still of the opinion that better time could be made by doing District No. 3 and combining District Nos. 4 and 5. He asked the Chief Administrative Officer for a report on his trip to San Francisco to see Mr. Emmert. Chief Administrative Officer Nordby stated that Mr. Emmert reported to him that the Regional Office in San Francisco could approve an advance planning loan in any amount; that the big problem in larger loans was the availability of funds; that they have one 1) million dollars in their budget revolving fund) for loans; that it took the repayment of loans from projects to keep the loan fund alive; that Mr. Emmert had applica- tions which had been tentatively approved but the funds were not yet available; that priorities were established on the tentative approval date. Mr. Nordby stated that the tentative approval took from two 2) weeks to five 5) weeks and approximately another sixty 60) days to get the money. Chief Administrative Officer Nordby stated he had talked with three 3) firms that stated a signed agreement between the engineering firm and the City would be sufficient basis to go to a lending institution and get enough funds to proceed with the design. Councilman Holmes commented that a private engineer would have to be paid in full whereas H.H.F.A. funds would not be repaid if the district fell through. Mr. Urban J. Schreiner, O'Melveny & Myers, stated if the proceedings were abandoned for a time and the engineering plans were on hand and later the district was started, the cost of engineering could be recovered at that time. City Engineer Young stated that the plans could be ready for review within sixty 60) days on District No. 3. Mayor Bloxham stated that there had already been a unanimous vote to do the remaining districts in one district; that the agreement with the contractor could specify the work schedule; that he had been told that WORK SCHEDULE the prints would be in in approximately one hundred 100) to one hundred ten ilO) days; that by taking the dis- tricts altogether the public hearing could be early in the fall. Discussion followed wherein City Engineer Young stated CONSTRUCTION COULD BE that construction could be started about November 1964 if STARTED ABOUT NOV. all three districts were taken together). 1964 Discussion followed concerning possible litigation pro- blems. Mr. Urban Schreiner stated as far as the time schedule of construction was concerned even though if the districts were to be combined, the proceedings would be started at same time, one way to expedite construction would be to let two,possibly three separate contracts; that way if RE POSSIBILITY OF the Council received low bids from three different bidders LETTING THREE CON'-. they would have the same time schedule, working simultaneously TRACTS on all three; that the construction in each area could be done at the same time. City Engineer Young stated that schedules could be set up to carry on work in all three districts; that the Engineer of Works would set up starting diagrams for certain areas; that the diagrams would depend upon when they start; that this would allow the Engineer of Work to have the bidders to submit the amount of equipment they had and would propose to use in the district and set the minimum amount of equipment deemed necessary; BIDDERS TO SUBMIT that it was his opinion, in scheduling this out, the AMOUNT OF EQUIP- scheduling would be such that the work would not be done MENT THEY HAD AND in the downtown district during the holiday season. PROPOSE TO USE Regarding the contracts Mr. Schreiner stated the district was assessed on the basis of benefit; that you aggregate all of the estimated construction costs and spread that evenly over the entire district. Discussion followed concerning soil conditions. Mr. Schreiner further stated that in his opinion it would MR. Councilman Holmes stated he was for getting this City severed as soon as possible. Discussion followed. Councilman Holmes stated he felt the motion was premature; that even though the Council might be satisfied with the various consultants this motion employ,-?d them without terms or conditions. Mr. Schreiner stated he could not agree wholeheartedly MR. SCHREINER'S with the motion; that it should be subject to acceptable OPINION RE MOTION contract provided to the Council; that in his opinion about as far as the Council could go tonight without having an agreement presented for consideration would be to approve the employment of the consulting firms that were dealt with befc.e provided that their cervices again arpeared to be reasonable; that p;-Irhaps the Council would iKe to limit the hG;is for compensation to be no greater than that for Sewer District No. 2 or something similar; that Councilman Holmes raise( a viiid point that tha motion shoL'!d not be so restriz:tive that any contract could be torc,ed on the City without the Counci! iaving had an opportunity to approve it. Mr. Schreiner further stated O'Melveny & Myers' fee schedule had been revised and their fee would be lower than it was for Districts I and 2. In answer to Coutnei4 s questions Mr. Schreiner stated in his opinion if t4e motion on the floor was adopted it should be considered by the members of the Council as an expression of intent; that it would represent a satisfaction with the services that had been provided in District Nos. I and 2; that when special consultants were retained in these fields perhaps a few dollars one way or another eras. not the sole criterion of which proposal should be accepted- that as Mr. Holmes pointed out various work could be accomplished by one that another would not offer to do; that by asking Ivor A. Lyons for a proposal the Council was expressing satisfaction with the work.he-had pertosmed; that for the protection of the City, the proposal of Ivor Lyons should then be examined by the City Engineer, the reasonableness of it should be verified with other independent engineers, the scope of duties that he would undertake to perform should be set forth to the satisfaction of the City Engineer, City Attorney and other legal counsel. Further discussion followed wherein an addition to the motion was suggested by Mr. Schreiner and agreed upon by the maker of the motion and the second which was as follows: AND REQUEST THIS GROUP OF CONSULTANTS TO SUBMIT PROPOSALS AS WELL AS OTHER FIRMS DOING THE SAME TYPE OF WORK. There was considerable discussion wherein the motion was withdrawn. COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE OFFICER AND CITY ENGINEER BE INSTRUCTED TO PREPARE SPECIFICATIONS AND GET WRITTEN PROPOSALS IN ON ALL THE CONSULTING FIRMS PERTAINING TO THIS SEWER DISTRICT), FOUR OF THEM ENGINEERING, FINANCIAL), ASSESSMENT.SPREAD, LEGAL) AND HAVE THEM BACK INHERE BY NEXT WEDNESDAY,, COUNCILMAN HOLMES SECONDED. It was clarified that the proposals were to be written; that the. consultants need not be present at the meeting. Mr. Schreiner stated the Council was not calling for the type of services which required a contract to be awarded. He stated the Planning Commission had adopted a resolution this evening recommending approval, PC 64-15. He suggested that Page 2, Paragraph g" be amended to provide that a grading plan shall be submitted by the applicant if required by the City Engineer to be approved by him prior to the issuance of a building permit"; that the applicant had indicated that he did not intend to make any change in the grade. City Engineer Young stated there was a 1% grade required toward the street. The Council agreed on the change suggested by the City Attorney. City Clerk Balkus read Resolution No. 64-35 by title as follows: RESOLUTION NO. 64-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A LOT SPLIT APPLICANT: CALIFORNIA PROPERTY BROKERS, 4049 MERCED AVE., L.S. 602)" COUNCILMAN HOLMES MOVED THAT RESOLUTION NO. 64-35 BE APPROVED AS AMENDED AND FURTHER READING BE WAIVED. COUNCILMAN BISHOP SECONDED. The motion carried by the following vote: AYES: COUNCILMEN HOLMES, BISHOP, MOREHEAD, TAYLOR AND MAYOR BLOXHAM NOES: NONE ABSENT: NONE There was further discussion regarding the cash deposit and who was to accept it wherein City Attorney Flandrick stated Resolution No. 64-35 provided for a cash deposit. MAYOR BLOXHAM MOVED THAT THE CITY COUNCIL AUTHORIZE THE CITY ENGINEER TO ACCEPT THE NECESSARY CASH DEPOSIT FOR THE IMPROVEMENTS. U.S. 602). COUNCILMAN HOLMES SECONDED. COUNCILMAN HOLMES MOVED TO AUTHORIZE THE CITY ENGINEER IN ALL FUTURE CASES WHERE LOT SPLITS ARE PRESENTED TO HIM AND THERE IS NO DEDICATION REQUIRED AND ALL OTHER REQUIREMENTS OF SECTION 9303 OF THE BALDWIN PARK MUNICIPAL CODE) ARE MET TO ACCEPT CASH DEPOSITS FOR IMPROVEMENTS AND TO AUTHOR- IZE THE DIRECTOR OF FINANCE TO ACCEPT THE MONEY.
