COUNCILMAN BISHOP SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. City Clerk Balkus presented an application for a Temporary Use Permit submitted by Glenn L. Goffar, Chairman, for the Baldwin Park Union School of Seventh-Day Adventist. The request was for Big John Strong's Trained Animal Program to be held on the school playground at 2554 N. Maine, May 24, 1964, from 12:00 Noon to 9:00 P.M. Mrs. Balkus stated that the Planning Department could see no problem since it was to be one day only; that the Police Depart- ment anticipated a possible parking problem; that there would be no rides, just animals. Discussion followed. COUNCILMAN HOLMES MOVED THAT THE ANIMAL CIRCUS THAT IS BEING SPONSORED BY THE ADVENTIST SCHOOL BE APPROVED. COUNCILMEN BISHOP SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. COUNCILMAN HOMES MOVED THAT IT BE SPECIFIED THAT THERE BE NO RIDES. COUNCILMAN BISHOP SECONDED. The motion carried by the following vote: YES: COUNCILMEN HOLMES, BISHOP, MOREHEAD AND MAYOR BLOXHAM NOES: NONE ABSENT: COUNC I LV!OM AN TAYLOR Discussion regarding fees wherein City Clerk Balkus stated the Council might wish to waive the processing fee for the church but the circus would have to apply for their business license and permit. COUNCILMAN BISHOP MOVED THAT THE CHURCH FEES BE WAIVED AS FAR AS THEY ARE CONCERNED. COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered by Mayor Bloxham. 00- City Clerk Balkus stated she had received calls from several property owners on Cavette Place concerning the high charges of California Sewer Construction Company, Montebello, to fill septic tanks; that one party had been charged $67.27 to fill their septic tank. COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL INSTRUCT MOTION MADE THE VARIOUS DEPARTMENTS, THE CHIEF ADMINISTRATIVE OFFICER, CITY ENGINEER AND BUILDING DEPARTMENT, TO FOLLO'! UP iiITH THESE PEOPLE, DETERMINE 1'IHETHER THEY ARE OPERATING A LEGITIMATE SET UP AND HAVE UNIFORM PRICES FOR THEIR RESPECTIVE UNIT JOBS SUCH AS SO MUCH FOR A FOOT OF LINE AND FOR BACK FILLING ETC. Discussion followed. The motion died for lack of a second. MOTION DIED FOR LACK OF SECOND City Clerk Balkus brought out that under the 1961 Uniform Plumbing Code, which had been adopted by the City of Baldwin Park, Section 1119 requkredthat all septic tanks be filled. Mayor Bloxham instructed that the Chief Administrative COUNCIL INSTRUCTION Officer and City Engineer get together and check this TO CHECK THIS OUT thing out to see whether or not the people are getting a fair play. 00- Concerning the Rosehaven Rest Home at 3562 North Vineland COUNCILMAN BISHOP Avenue CP-8), Councilman Bishop stated Mr. Carter had RE COMPLAINTS called him several times and that the people across from ROSEHAVEN REST HOME the rest home say this situation is a nuisance; that it CP-8 was reported that people were not using the restrooms; that in his opinion the Chief Administrative Officer should make an investigation; that Mr. Carter's tenant was going to move; that it was reported there were people there who were mentally incompetent. Councilman Holmes stated it had been reported to him that COUNCILMAN HOLMES the people from this resthome came to people's homes wanting to use their telephone and they get somewhat abusive if they were refused; that in his opinion a check should be made and maintained periodically to see that they were living up to the terms of the permit; that the newer places were required to have block walls. Mayor Bloxham stated he had talked with Mr. Carter; that MAYOR BLOXHAM the Police Department had been called to return these people to the rest home; that Mr. Carter did not feel the situation was very much better than it was before; that Mr. Carter's tenant was about to leave; that this would be the second tenant he had lost over the rest home situation. Discussion followed. COUNCILMAN HOLMES MOVED THAT THE CHIEF ADMINISTRATIVE OFFICER MOTION MADE AND TAKE THE NECESSARY STEPS TO SEE THAT THESE COMPLAINTS ARE CARRIED THAT C.A.O. He stated he and Mr. Kalbfleisch both agreed on this plan; that the cupboards were presently being removed. He stated that a quotation had been received from Parker Plumbing, 14617 East Ramona Boulevard, Baldwin Park, to install the necessary closets, wash basins, hook the water up and put a stub out outside the building so that the City could then run a connection out to the sewer) for a total cost of $980.00. He stated this did not in- clude tile; that with help Tom Miller could put in the partition and then it would be insulated; that he did not have an estimate for this at this time. He recommended that this proposal be accepted. Discussion followed. COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL CONCUR WITH THE CITY ENGINEER AND THAT PARKER PLUMBING BE GIVEN THE CONTRACT FOR $980.00 TO INSTALL ALL PLUMBING AND STUB OUTS TO THE OUTSIDE OF THE BUILDING. COUNCILMAN MOREHEAD SECONDED. City Engineer Young stated Parker Plumbing indicated they could start immediately. NOES: NONE ABSENT: COUNC I L1'!OMAN TAYLOR 00- Chief Administrative Officer Nordby reviewed the tabulation of Engineering Proposals for Sewer District No. 3 which had been submitted to the City Council on November 20, 1964. He stated that No. I on the list had been eliminated due to inexperience; that No. 5 withdrew his proposal in favor of No. 3. He stated he felt the City needed someone who was not too large and could give personal service; that the location factor was considered; that unless the fee was completely out of reason he did not feel this should be a factor; that the quality of service was the important thing; that he listed three firms that in his opinion from all standpoints were the best qualified for the Cities particular work: Harold L. Johnson, Engineering, Ivor Lyons and Associates and 1'Ja l sh--Forkert; that when a i l factors were taken into consideration it was his opinion that Ivor Lyons and Associates should be granted an agreement; that they had gained a great deal of experience with Sewer Districts No. I and No. 2, not only with the terrain and subsoil conditions and other problems that were involved but also with the human element involved which was very important. Councilman Holmes stated before he was ready to take action to approve the agreement he wanted to see a very definite agreement which listed the services as outlined by the Chief Administrative Officer and Council; that the agree- ment should stipulate a figure percentage of construction cost); that the payment provision should state that pay- ment would not be made until the bonds were sold; that a statement should be on file with the City stating that the firm selected was in a position to finance the work until the bonds were sold; that there should be a per- formance bond assuring that the work would be completed within a reasonable length of time; that the City should have a certificate of insurance which had iron clad clauses holding the City harmless from any damages and claims. Chief Administrative Officer Nordby stated he had assurance from each of the firms interviewed that they had no pro- blems in financing. Councilman Holmes stated in his opinion the Council should have a separate contract for each consultant. Discussion followed, There was considerable discussion regarding inspection. Councilman Holmes was of the opinion that the inspector should be an employee of the City; however the consensus of the Council was that this should be optional; that the Engineer of \'lork would proceed with the inspection until or unless the Council felt the work should be done by the City. The Council agreed to negotiate nlonn the same lines as No. 2; that the payment to the Engineer- of Work would be a percentage of the construction cost. COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE OFFICER AND THE CITY ENGINEER NEGOTIATE 1'IITH THE CON- TRACTORS AND BRING BACK THEIR RECOhWENDATION TO THE CITY COUNCIL FOR APPROVAL ON THE SAME BASIS AS NO. 2 IN- CLUDING THE EXTRA SERVICES THAT IJE EXPECT; THAT THE COUNCIL BE SUBMITTED A COPY OF THE AGREEMENT PRIOR TO THE MEETING. It was later clarified that this motion referred to the Larks; that the Chief Administrative Officer see that one of them is made available for use of the Enforcement Officer or other people in the City Hall when required. COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL CONCUR 1'JITH THE RECOMMENDATION OF THE CHIEF ADI,IINISTRATIVE OFFICER, AND AUTHORIZE THE PURCHASE OF THE DODGE DART FROM V!EGGE MOTORS, INCLUDING THE HEATER, FOR A TOTAL OF $1,775.88.
