The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Councilman Morehead led the salute to the flag. FLAG SALUTE
The Invocation was given by Reverend Elmer Seger of The INVOCATION
Bible Church.

City Treasurer Pugh read in full the Investment of City TREASURER'S REPORT
Funds for February 1964. AS OF FEB., 1964
COUNCILMAN MOREHEAD MOVED THAT THE CITY TREASURER'S
REPORT BE RECEIVED AND FILED.
Councilman Holmes brought out that the maturing date on the
Los Angeles Street Improvement monies shown as January 17,
1964, should probably be April 17, 1964, instead.
Ccuncllmen Morehead withdrew his motion.
COUNCILMAN MOREHEAD MOVED THAT THE CITY TREASURER'S REPORT
BE RECEIVED AND FILED WITH THE EXCEPTION OF THE LAST ITEM,
LOS ANGELES STREET IMPROVEMENT, TO BE HELD UNTIL THE DATE
OF MATURITY IS CORRECTED.
Discussion followed that the report should be held over;
that the entire report should be approved at the same time.
The motion died for lack of a second.

Discussion followed that the Building Department had been
requiring curbs and gutters on private streets.
COUNCILMAN BISHOP MOVED THAT THE REQUEST OF MR. WALLACE
K. FARMER BE DENIED. COUNCILMAN MOREHEAD SECONDED. The
motion carried by the following vote:

Minute Clerk Langseth presented a claim against the City
submitted by Thomas J. Greenleaf with regard to an
accident with a Police Car on February 29, 1964, on
Ramona Boulevard near Maine.
COUNCILMAN BISHOP MOVED THAT THIS CLAIM'BE DENIED AND
TURNED OVER TO THE I NSURANCE COMPANY. COUNC I LMAN MOREHEAD
SECONDED. There were no objections, the motion carried
and was so ordered by Mayor Bloxham.

City Attorney Flandrick presented a proposed agreement
between the City of'Baldwin Park and Charles E. and Dorothy
A..Berthel regarding the demolition of existing structures
in connection with Lot Split No. 586.
Planning Director Kalbfleisch brought out that the build-
ing setting on the northerly side of the property had
been condemned.
City Attorney Flandrick stated he understood that this
building was to be demolished immediately.
COUNCILMAN HOLMES MOVED THAT THE AGREEMENT AS PRESENTED BY
THE CITY ATTORNEY BETWEEN THE CITY AND MR. BERTHEL BE
APPROVED AND THE NECESSARY OFFICIALS AUTHORIZED TO SIGN.

City Attorney Flandrick stated that at the last meeting
the Council approved the recommendation of the City Engineer
concerning grade crossings; that a letter had been received
from Pacific Electric accepting the general proposal; that
there would have to be budgetary adjustments,approved by
the Council before the agreement could be signed.

THE CITY ATTORNEY AND THE CITY ENGINEER TO PREPARE THE
NECESSARY AGREEMENT AND OTHER DATA TO BE BROUGHT BACK
AT THE NEXT REGULAR MEETING CONCERNING THE PACIFIC
ELECTRIC AND THE CITY'S TENTATIVE AGREEMENT ON SIGNALS.

Regular Meeting of the Baldwin Park City Council
Chief Administrative Officer Nordby,stated at the last
Council meeting the Council had requ,ested a clarification
of the firearms pay; that this had apparently started by
being included in the 1962 budget and was carried over to
the 1963-64 budget; that the Council had before them the
material submitted in the budget with regard to this matter.
Discussion followed that the minutes of the Council
meetings did not relect any policy actually made by
the Council regarding this matter.
Chief of Police Best stated that the incentive pay was
adopted by the 1962-63 budget; that the $10.00 amount was
first paid in September of 1962; that this amount had not
been changed.
In answer to a question by Councilman Holmes, Finance
Director Duncan stated up to this point the amount paid
did not exceed the budgetary amount.
There was NO ACTION TAKEN.

Mayor Bloxham announced that the hour of 8:00 p.m. having
arrived that it was the time and place fixed for a public
hearing-onrZ-216, an application submitted by Frank J.
Gambina requesting a change of zone from A-I light
agricultural zone) to R-3 iheavy multiple family residen-
tial zone) or more restrictive use on certain real property
located at 3120 Frazier Street.
Minute Clerk Langseth administered the oath to those in
the audience desiring to be heard during the meeting.
Minute Clerk Langseth stated that the required publication,
and mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No. PC 63-17 recommending approval on February
12, I964,,

February 12, 1965. A plot plan was shown.

proposals from three engineering firms for the Design 64-A-I
Work for'Sewer District 64-A-I.
Discussion followed wherein it was decided to discuss TO BE DISCUSSED

Chief Administrative Officer Nordby stated that the RE GROUP INS. FOR
group insurance policy for the employees would expire EMPLOYEES TO EXPIRE
March 3i, 1964; that rather than ask the Council to MARCH 31, 1964

day extension of the plan with Aetna and at the next
regular meeting he would present his recommendation.

City Engineer Young passed copies of the vault plans VAULT PLANS
and the technical part of the specifications. He stated
that the Planning Director and he had not gone over the
details; that he had handed the City Attorney the
General Conditions for him to check; that the plans did
not include the vault doors; that he was proposing the Mosier
Safe four hour door for the upper floor and a one hour door
for the Police Department; that he felt it could be built
for the budgeted amount; that the four hour door cost
$980.00 plus $100.00 installation and the one hour door

Police had agreed that a one hour door would be`satis-
factory that, in his opinion, this vault would be
satisfactory for fifteen 15) years; that he suggested
that the bids be received by the first meeting in April.

Regular Meeting of the Baldwin Park City Council
City Attorney Flandrick stated there were three tracts
to be considered; that he suggested that the Council
consider an adjourned meeting within the next ten days
as there was a time limitation under the State Map
Act and they would be deemed approved If the Council
took no action.

Councilman Holmes stated there was a lot split project
that just went in off of Torrey and Foster; that there
were grading fills to where the back end of the lots were
up to four to six feet; that there was not that much of
a drainage problem on the lots in Baldwin Park.
Extensive discussion followed wherein the Council
Instructed the City Engineer and the Planning Director
to check into this matter.

Councilman Holmes stated the drainage problem had been
taken care of but there was now a hazardous dip on
Badillo at Depot.
The Council instructed the City Engineer to come back
with a recommendation as to a solution.

stated that the City could acquire prescriptive rights

that most of the private streets were established
by deed restrictions where all of the property owners
have an equal right to use the streets.
As there were no objections, Mayor Bloxham Instructed
City Engineer Young to come back with a recommendation
and costs for the public streets and, how to eliminate
the barricades.

Chief Administrative Officer Nordby to contact the Chamber
of Commerce to see if they had plans for a cleanup week.

preparation of a suitable strip map.. to show, easements
to be acquired; placement of sewer laterals and how
this should be done; Engineer will have to name loca-
tion of existing utilities..

Discussion followed concerning what the City would
furnish, Section 4. wherein City Attorney Flandrick
stated the City would furnish what they have and if
the Engineer wanted more up to date materiel or any
additional material he would have to furnish his own.
Regarding bonds, Chief Administrative Officer Nordby
stated that a Faithful Performance Bond would be
necessary.
Councilman Holmes stated he was concerned with a
Labor and Materials Bond.
City Attorney Flandrick stated he did not see the
necessity of a Labor and Materials Bond under a
consultant contract; that he certainly agreed one
was needed on the project.
Councilman Holmes stated he did see a need when the
Engineer would be hiring subcontractors, surveying
crews and stakeout crews.
City Attorney Flandrick stated this would come under
the Faithful Performance Bond and that one should be
required in the full amount of the contract.;..however,
he would check with several insurance companies
to see if a Labor and Materials Bond could be acquired.
Councilman Holmes asked what would happen if after
approximately six months or one year the sewer system
did not work because of poor grades or improper
grades.
City Attorney Flandrick stated this would be covered by
the Faithful Performance Bond.
City Engineer Young stated any wrong design should be
caught when plans were checked by the Engineering
Department, however, the Engineer of Work was still
responsible as it was his design.
Councilman Bishop stated he thought the City Attorney,
City Engineer and Chief Administrative Officer should
be instructed to get together and prepare the con-
tract with all additional items included.
Chief Administrative Officer Nordby stated that the
proposed agreement had been mailed to Ivor Lyons and
Associates, Walsh-Forkert Engineering and Harold L.
Johnson Engineering; that he had mentioned the
possible changes additions) and they had all said
these changes would make no appreciable difference
in their percentages costs).
City Attorney Flandrick stated he suggested under
Section 3, subparagraph a, that preliminary field
surveys as necessary be added.
Councilman Holmes brought out that Section 2, sub-
paragraph a, gave a choice of ink on linen or
cronaflex for the original plans, designs and draw-
ings stating there had been problems with this matter
before and asked the difference between the two.

City Attorney Flandrick stated that Section 4
on page 14 would be rewritten.
Discussion followed regarding subparagraph g) of
Section t and that a Certificate of Insurance or
a deposit should be obtained to cover these
particular documents.
City Attorney Flandrick stated that subparagraph'
b) of Section 5 would be rewritten.
Regarding payment by monthly Invoice, Councilman
Holmes stated It was not very clear regarding
payment on some of the items.
Councilman Holmes brought out that subparagraph
c) of Section 5 did not tie down the amount of
the inspectors salary.
City Engineer Young stated regarding subparagraph c)
and d) that, in his opinion, the Consulting Engineer
should furnish the Chief inspector plus whatever
Inspection was needed and that the Cons•i ting Engineer
should be paid a certain percentage in addition to their
salaries; that the limitation would be in'the approval
of the inspector by the City Engineer; that he did
not agree in setting a maximum fee; that the Engineer
would have to pay probably $800.00 to $900,.00 for a
good Chief Engineer.
Discussion followed wherein City Attorney Flandrick
stated subparagrapb'(d) of Section 5 tied the Field
Staking and Inspect-ion down to a maximum. percentage.
Councilman Holmes stated in subparagraph e) of
Section 5 he did not agree to actual payroll
costs plus one hundred percent 100%)thereof";
that this figure should be negotiated.
Councilman Holmes asked that the City Attorney and
the City Engineer consider the last part of the
first sentence of Section 7 a) and the final
estimate for the work not completed". stating that
the City, as he understood it, would be paying
l 5% whatever It would be on all of the work
not completed. He also asked if the contract was
assigned for the entire job and for some reason the
job was terminated what would happen as far as City
liability for payment.
City Attorney Flandrick stated that the City would
only be responsible for the amount owing to the
Consulting Engineer.
City Attorney Flandrick suggested that Section 9
be deleted and substitute bonding and insurance
In this Section.
Councilman Holmes suggested that the words and itemized"
be added to Section 7, subparagraph b) the next to the
last line after shall submit a verified".
Regarding Section 10 a), prints, City Attorney Flandrick
suggested that It read such copies as are necessary for
all utilities and for the purpose of bidding".
The Council indicated they did not want plans for their

were furnished to the utility companies; that the
County Sanitation District required two 2) full.
sets; that, in his opinion, approximately 15 copies
would be needed.
Councilman Holmes pointed out that the number of
copies would have to be amended in subparagraph b)
of Section 10 and to strbpetagraph c) c $ecfion 10
the County Sanitation District should ge included.
Regarding Section 11, the fourth line, Councilman
Holmes stated It should read Any such inspector
or Inspectors" because there would be more than
one, and that Section 13 would have to be rewritten
to tie it down more.
City Attorney Flandrick stated that Section 15 could
be deleted or would be revised.
Discussion followed that the City would be notified
of any assignment of the contract.
Discussion followed that there were no major changes
which would considerably change the price charged by
the Consulting Engineer wherein Councilman Holmes
did not agree; that for one item the number of prints
being changed from 3 to 15 would Increase the cost.
COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE
OFFICER GIVE THE CITY COUNCIL THE BIDS THE THREE
QUOTATIONS) AND THE CHIEF ADMINISTRATIVE OFFICER AND
THE CITY ENGINEER MAKE THEIR RECOMMENDATION. COUNCIL-
MAN MOREHEAD SECONDED.
Councilman Holmes stated he could"not understand the
members of the Council making a determination of who
was going to do a job before the Council had the
terms of the work to be performed completed; that
quotations had been submitted; that the Council' had
made substantial changes and if this made any sub-
stantial change in their-thinking they would not
like the Idea of not being notified of the changes.
Mayor Bloxham asked the City Attorney if this motion
would affect the signing of the agreement in any way.
City Attorney Flandrick stated, no, that copies of
the agreement as changed would be submitted to the
engineers in question.

Discussion followed wherein Councilman Bishop stated
he would like the recommendation of the Chief Admin-
istraltiveOfficer and the City Engineer.
Chief Administrative Officer Nordby stated that some
time ago he had made a recommendation and he had put
it in writing; that although there had been problems
with Ivor Lyons he thought they could be corrected and
he recommended that the City engage Ivor Lyons for
this district.
City Engineer Young stated that the figures were not
influencing his decision at all;, that he had recom-
mended Ivor Lyons the other evening based upon his
knowledge of the City, having crews In the City, was
well acquainted with the aerial photographs; that
from a time element he felt that the others could not
compete; that there would not;be.much difference in
the quality of the work of the three firms, they were
all good; that both Harold Johnson and Walsh-Forkert
were close and had helped the valley grow; that while
Ivor Lyons' office was in Beverly Hills he had helped
the valley grow also; that he did not condone bidding
but he did not consider this bidding since each
engineering firm was sent an agreement.
Council discussion followed.
City Attorney Flandrick stated if Ivor Lyons was the
selection the agreement could be prepared and sub-
mitted to him and If the Council adjourned to
Wednesday night he could indicate at that time whether
or not he would accept.
Further discussion followed wherein Councilman Bishop
stated that the taxpayers would be saved money in
engineering incidentals.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ADJOURN
TO WEDNESDAY MARCH II, 1964, AT 7:00 P.M. The motion

Councilman Holmes stated he abstained for the reason that
he'thought the Council was premature In this action; that
he had nothing against any of the Engineers; that. he did
not feel that this was the proper time to vote on this
matter.
City Attorney Flandrick stated that the revised agreement
would be presented at the adjourned Council meeting on
Wednesday, March 11, 19611.

The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Councilman Morehead led the salute to the flag. FLAG SALUTE
The invocation was given by Pastor Elmer Seger of the INVOCATION
Bible Church.

City Engineer Young stated that cronaflex was a plastic
process and as far as he was concerned more durable and
was also slightly cheaper than linen; that the originals
could be done in pencil on paper and from these Van
Dykes could be made which would cost approximately
$6.00 a piece.
Councilman Holmes stated that Van Dykes had been made
before and they were not satisfactory; that paper
brown lines were not too durable. He asked about
tracing cloth that could be changed and corrected
if necessary and prints made.
City Engineer Young stated that tracing cloth was the
same as linen; that personally he liked the white
navy linen.
The Council instructed City Engineer Young to bring
back prices on the various processes.
Councilman Holmes asked about the last sentence of
subparagraph b) of Section 3.
City Engineer Young stated that the Los Angeles County
Sanitation District had to check and approve all sewer
lines so that they would know what is going in; that
they often had suggestions concerning whether it was
connecting into their lines or not; that they were sent
preliminary plans just as the City was; that before
the plans went to the contractor for bidding purposes
they must be signed by the County Sanitation District;
that at the present time they had the maintenance
agreement for the sewers and they would not maintain
the sewers unless they did check the design.
Discussion followed regarding subparagraphs h) and
1) of Section 3 wherein City Attorney,.Flandrick asked
if the Council wished to have the Engineer of Work per-
form the inspection services for this job.
Councilman Holmes stated he did not think so but the
rest of the Council did and as it stood now he was
expected to do so.
The Council instructed that subparagraphs h) and i)
of Section 3 be strengthened to tie the items down.
At 11:30 p.m. Finance Director Duncan left the Council
Chamber.
Councilman Holmes brought out, and the City Attorney
agreed, that change orders had not been covered and
would have to be added.
Councilman Holmes brought out that the word vellums"
in subparagraph q) of Section 3 should be changed;
that this was a loop hole and the loose meaning of
vellum was paper.
City Engineer Young suggested using original
reproducibles".
Councilman Morehead stated that it had been mentioned
previously that in the event there was more than one
crew working in any district there would be an
inspector and asked if this would be covered in the
agreement.
