REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL

The City Council of the City of Baldwin Park met in
regular session at the above, place at 7:30 p.m.
Councilman Morehead led the salute to the flag.
The Invocation was given by Reverend Harold Hiveley of
the First Christian Church.

Mayor Bloxham presented five year and one year service
pins to City employees.

City Clerk Balkus stated that the Council had copies of
a letter from the Baldwin Park Improvement Association
and that Mr. James Garrow wished to speak.
Mr. James Garrow, representing the Baldwin Park Improve-
ment Association, stated that the Improvement Associa-
tion had asked him to Speak to the Council regarding
the State Highway Department Roadside Rest Program.
He briefly reviewed this program stating that there
were two hundred rests proposed and that the Baldwin
Park Improvement Association suggested that the City
Council communicate with the proper authorities in the
State for the establishment of two roadside rests, one
on each side of the freeway in Baldwin Park; that the
State already owned a desirable location south of the
freeway between Leorita and Baldwin Park Boulevard; that
their suggested location on the north side of the freeway
was at the new interchange located adjacent to Barnes
Park. He urged that the Council send appropriate letters
to Mr. John Urica, State Director of Public WIlorks,and to
Assemblyman Harvey Johnson and any other bodies of the
State that would be helpful in this program.
Mr. James Garrow read a letter from the Baldwin Park
Improvement Association expressing their concern for the
expenditure of a vault at this time and asking the Council
to consider ideas mentioned such as renting a vault until
some future time as plans for a civic center could be
realized or microfilming.
In answer to a question by Mayor Bloxham, Mr. Garrow
stated that the roadside rests were put in by the Federal
Government ninety percent 90%) and the State ten percent
10%) and the State Highway maintains them; that the City
had no expense in this matter.

OFFICER CONTACT THE PROPER AUTHORITIES AND CHECK INTO THE
STOPS ON THE FREEWAY. COUNCILMAN HOLMES SECONDED. There
were no objections, the motion carried and was so ordered
by Mayor Bloxham.

City Clerk Balkus presented written letters of appeal
gn Z-222 from Esther Gura and on Z-217 from A. CJ. Cole,
Jr. and T. A. Colwick.
Discussion followed wherein it was stated that these
matters would be set for public hearing on April 15,
1964.
City Attorney Flandrick suggested that both of these
matters being matters involving public hearings be set
at some meeting subsequent to April 15, 1964, bearing in
mind the City Council election on April 14, 1964, or as
an alternate if there were new members of the Council
that the hearings could be set for April 15,. 1964, opened
and carried over.

City Clerk Balkus read in full a letter from W. E. McKnight
Construction Company, 14913 East Ramona Boulevard, dated
March 10, 1964, requesting waiver of improvements.
Councilman Morehead commented that he was not objecting
to the curb and gutter improvement; that ingress and
egress would be difficult with his heavy equipment if
they were.-put in; that Mr. McKnight was willing to
sign an agreement to install the improvements when
Ramona Boulevard was improved with curbs and gutters
on both sides.
Di scusg_ion fd-l lowed that the curb return as- shown on
the map would be across the driveway; that possibly a
roll over curb would solve the problem.
City Attorney Flandrick suggested that the Council consider
this problem in terms of two alternatives; first being
that Mr. McKnight being required to deposit with the
City a cash deposit to insure the construction of curbs
and gutters or in the alternative that he be required
to construct and install the roll type curb; that the
Council had the authority to do this under Section 8107 a).
COUNCILMAN HOLMES MOVED THAT ROLL OVER CURBS AND GUTTERS
BE INSTALLED IN THE AREA.
Mr. J. J. Mooney, 14913 Ramona Boulevard, Baldwin Park,
stated whenever a gutter of either type was installed
it would form a flat spot in this area and instead of
helping. the flow of water at this time it was their
opinion: that it would restrict the flow of water and
cause a puddling condition within the entire frontage
of their property. He stated that they were willing
to put up a cash bond or cash or whatever the City
requires to improve the property at the time that all of
the engineering could be worked out.
Discussion followed that there was a puddling problem now;
that McKnight wished to proceed with the construction of
their office and complete it.

City Treasurer Pugh presented the corrected Investment
of City Funds report for February 1964.
Councilman Holmes questioned Item No. 5, the City's por-
tion of the $.01 gas tax matching funds. He stated he
understood there was a limitation of time on how long
the City could keep the money if it was not used.

were no objections, the motion carried and was so ordered
by Mayor Bloxham.
City Treasurer Pugh read in full the City Treasurer's
Report as of February 29, 1964.
COUNCILMAN HOLMES MOVED THAT THE CITY TREASURER'S REPORTS
OF FEBRUARY 1964, AS CORRECTED, AND FEBRUARY 29, 1964,
BE RECEIVED AND FILED. COUNCILMAN MOREHEAD SECONDED.
There were no objections, the motion carried and was so
ordered by Mayor Bloxham.
Councilman Holmes stated that the Council had not re-
ceived a report on the sewer bond accounts.
Discussion followed.
City Attorney Flandrick stated that City Treasurer
Pugh, Finance Director Duncan and he would submit to
the Council at the next regular meeting a report on the
sewer bond accounts.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
a public hearing on Z-218, an application submitted by
Helmut D. Rosendahl and Manuel G. Ortega for a change of
zone from R-I single family residential zone) to R-3
lheavy multiple family residential zone) or more restric-
tive use at 13148 and 13154 Fairgrove Street.
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.

Planning Director Kalbfleisch presented a resume of
the case and stated that the Planning Commission had
adopted Resolution PC 64-21 recommending approval on
March 3, 1964.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to Z-218, Mayor
Bloxham declared the public hearing closed.
Discussion followed regarding the street widening;
that there was a need for a ten 10) foot dedication.
City Attorney Flandrick suggested that the City Council
entertain the ordinance for introduction if they felt it
should be R-3 and advise the Planning Director to inform
the applicant that the City Council was willing to at least
favorably consider rezoning of the property if the street
was so widened ten 10) ft. dedication); that this was
not a conditional zone change; that the Council's action
in introducing an ordinance merely formally brings it
before the Council for consideration; that the Council's
final action was at the time the Council considered the
ordinance for adoption; that prior to that time circumstances
may occur which indicate to the Council that the property
should be rezoned, if the public interest so required;
that in this case it apparently would be based upon the
question of was it a sufficiently wide street.

tion submitted by Covina Irrigating Company for a
Conditional Use Permit to allow construction and installa-
tion of a roof structure to cover an existing water
reservoir for a water supply for both domestic and
irrigating purposes, in A-I light agricultural zone),
on certain real property located at 15342 Ramona Boule-
vard.

the case and stated that the Planning Commission had
adopted Resolution PC 64-23 recommending approval on
March 3, 1964.
City Attorney Flandrick stated this conditional use permit
application was also involved in Tract No. 29496, one of
the tracts before the Council this evening; that it was
involved in a lot split problem; that he thought that
the problem would be solved and suggested that it would
be by Council resolution of approval of one of the tracts;

that the company had sold off the balance of that property
marked A-I for subdivision purposes to Mr. Larry Sade;
that he thought the problem was solved as far as the lot
split violation was concerned with the tract map.
As there was no one in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to CP-27, Mayor DECLARED CLOSED

City Clerk Balkus announced that it was the time and place
fixed for a public hearing on CP-29, an application sub-
mitted by Bernard Perlin for a Conditional Use Permit to
allow the construction and operation of an automobile service
station in C-2 general commercial zone) on certain property
located on the northwesterly corner of Garvey Avenue and
Bess Avenue.
City Clerk Balkus stated the required publication, post-
ings and mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of
the case and stated that the Planning Commission had
adopted Resolution PC 64-24 recommending approval on
March 3, 1964.
TESTIMONY I N BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR BLOXHAM.
Mr. Bernard Perlin, 1044 Montego Drive, Los Angeles
49, showed a colored rendering of the proposed station
Exhibit A).
Mr. Bruce Martin, 1085 North Harbor Boulevard, Anaheim,
showed a colored photograph of their ranch style
service station Exhibit B); he also showed a photograph
of the station at Santa Anita and Duarte Exhibit C).
Discussion followed wherein City Attorney Flandrick stated
any approval of CP-29 would mean that it would be approved
subject to the existing provisions of the Code; that if
they desired to vary, which he understood they did, from
one or two matters they would have to apply for a zone
variance which he thought they had applied for; that the
Council, if they so desired, could approve the matter to-
night subject to the compliance of all provisions of the
Code or hold the matter over until the Council had the
zone variance matter before them.

City Attorney Flandrick suggested that the Council, in
view of subparagraph b, hold this matter in abeyance
until such time as they had the zone variance before them
and judge the two together; that he thoughtthe applicant
wanted to request that one or two of the exhibits that
were submitted this evening be returned to him.
Mr. Martin stated this was correct; that the zone variance
for the sign would go before the Planning Commission on
April 1, 1964; that the lot split matter was on page 3
of this evening's agenda.
Mr. Perlin respectfully requested that the conditional
use permit and the zone variance applications were two
separate applications and not dependent on each other
and would appreciate consideration of the conditional
use permit this evening.
Mr. James Q. Gibson, 13268 Francisquito, Baldwin Park, JAMES Q. GIBSON,
stated he was very much in favor of this project; that 13268 Francisquito,
the property at the present time was an eyesore to B.Pk.
Baldwin Park; that this station would be an improvement
to the area; that he could think of no better use for
this land.
As there was no one else in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to CP-29, Mayor DECLARED CLOSED
Bloxham declared the public hearing closed. CP-29
Councilman Holmes stated, in his opinion, the matter of
the sign was a separate item; that item b, Section 2,
definitely states that the applicant shall submit an
application for a variance.
Councilman Bishop stated he thought the matter should be
held in abeyance until the Council had the application
for the sign before them and make a decision on the
matters at that time.
City Attorney Flandrick stated first of all the Council
had before them an application for a conditional use
permit; that if this application was granted the Council
would not'be granting a zone variance; that there was
a zone variance application pending regarding the sign
situation; that this was a separate hearing; that the
Council had one of two alternatives; the Council could
consider only the conditional use permit this evening
and grant and/or deny it or in the alternative the
Council could take it under submission until such
time as the Council had the variance application hearing
finished and consider both applications at the same
time.

COUNCILWOMAN TAYLOR MOVED THAT CP-29 BE APPROVED TONIGHT

City Clerk Balkus announced that it was the time and place
fixed for a public hearing on AZC-6, which concerns an
amendment to permit the construction and use of signs
and marquees to encroach into the required front yard
setback in the commercial and industrial zones.
City Clerk Balkus stated that the required publication
had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution PC 64-29 recommending approval on March 3,
1964.
City Attorney Flandrick stated the present Code was
deficient insofar as signs, marquees and awnings were
concerned in terms of C and M zones; that by this proposed
amendment it was suggested that the Council permit these
structures to be erected not over public right-of-way
but only in required front yard areas; that this would
be part of the Zoning Ordinance if the Council saw fit
to adopt it; that in addition to this recommendation the
Planning Commission, at his request, had indicated in
Section 2 of Resolution No. PC 64-29 that the City
Council direct the City Attorney and the Chief Administra-
tive Officer to prepare and submit to the Council the
necessary amendments to existing Code provision; that the Code
i n his opinion, now, permits the- encroachment over pub l i c
righis-of-waysof private signs, marquees, and awnings.
In answer to a question by Councilman Holmes, City
Attorney Flandrick stated if the Council approved
the recommendations of the Planning Commission and
directs the preparation of the ordinance and adopts
it then the staff as an incident to that prepares and
submits to the Council drafts of an ordinance to accomplish
the other Code changes which would not require public
hearing.

In answer to a question by Councilwoman Taylor, City
Attorney Flandrick stated if the Council adopted this
as a part of the regulations for C" and M" zones it
would mean that anyone in a commercial zone would be
permitted, without a conditional use permit, variance,
or anything other than a building permit, to construct
a sign which would advertise their particular building;
that it could be across the front of the store or it
may be in front of the building encroaching into the
front yard area.
In answer to a question by Councilman Bishop, City
Attorney Flandrick stated the signs, marquees and
awnings could be erected in front yard areas so long as
they did not extend into the front yard area more than ten
10) feet measured from the rear of the required front
yard area.
City Attorney Flandrick stated that the staff recommenda-
tion insofar as public right=of-way was concerned would
probably be that there be no encroachment in the public
right-of-way without express written permission of the Counci

City Attorney Flandrick stated that the new proposed
Zoning Ordinance which was directed to be prepared
by the Council in January was now approximately 75%
completed and it he hoped to be able to present it to
the Council within the next three weeks; thatin con-
junction with nonconforming uses he was prepared to
recommend insofar as this type of a nonconforming use
was concerned that it be permitted provided that where
talking about encroachment over public right-of-way
that they still come before the City Council upon
not more than one weeks! time lapse and request
permission to construct it in that fashion.

Treasurer Pugh stated the registration fee was $15.00
including two meals; that the motel would be approximately
$10.00 a night; that she thought all expenses would total

to New York to the World's Fair and represent Los Angeles
County.

of the Council to attend the annual City Attorneys
Convention on April 1-3, 1964, in Monterey at an
expenditure not to exceed $50.00 on behalf of the City

submitted by him at the request of the City Engineer;
that this related to an item that appeared on the last
Agenda; that this was a easement that was acquired some
time ago relating to a portion of Lot 10, Tract No.
28515; that the proposal was to vacate this easement
being the southerly ten 10) feet of Lot 10, Tract No.
28515; that City Engineer Young also had a subsequent
request on the Agenda, Item 1 under his portion of the Agenda,
requesting the acquisition of an easement to replace

Chief Administrative Officer Nordby reviewed his report REPORT RE GROUP
on the renewal of City employees group insurance stating INSURANCE CITY
that on March 20, 1963, the Council awarded the group EMPLOYEES
insurance coverage of City employees and officials to
Aetna Life Insurance Company; that it was recommended
at that time that the insurance be continued for a period
of more than one year but be reviewed at the end of the
first year; that he recommended that the existing group
insurance coverage be extended for an additional year,
April I, 1965.

the costs might be lower but he did not know how much

Chief Administrative Officer Nordby reviewed his report
on companies engaged in sewer connection work. He stressed
that under no circumstances did the City send out anyone
to solicit this work or recommend anyone.
Councilman Bishop stated he did not believe septic tanks
were required to be filled in District No. I but were re-
quired in District No. 2; that he thought this was an
unrwcess.ary expense on the property owners.
Councilman Holmes stated the previous Uniform Plumbing
Code did not require this; that the new revision of the
Uniform Plumbing Code did require this; that the resolution
adopted at the last meeting eliminated this requirement.
City Attorney Flandrick stated the resolution before the
Council this evening amended a previous resolution to
correct a typographical error.
Discussion followed wherein City Attorney Flandrick stated
these companies were regulated quite thoroughly by the State
Contractor's License Board; that if the State revoked their
license the City would have an automatic right to revoke
their business license.

a letter of resignation from Mr. Glenn F. Welch dated March
13, 1964; that Mr. Welch had accepted a position in El
Monte; that the Council had copies of his letter of
resignation; that Mr. Welch was employed by motion of
the Council on October 17, 1962 and went to work on
November 5, 1962.

F. Crocker, Assistant Actuary for the State Employment
Retirement System was to be in Baldwin Park Monday, March
23, 1964, at 2:30 p.m.; that if the Council wished this
meeting could be adjourned to that time.

City Attorney Flandrick stated the Council should never
be seen other than two at one time except on social
occasions because it was so easy to accuse people of
violating the Brown Act and so hard to disprove it.

Chief Administrative Officer Nordby stated the property the
staff was directed to purchase from Mr. Horace Long was
in the final stages of acquistion.

City Engineer Young reviewed his report regarding con-
demnation for sewer easement and drainage right-of-way
on Grace Avenue which stated that the Engineering Staff
had reconsidered the sewer and drainage right-of-way
on Grace Avenue serving Tract 28515 and Tentative Tract
29417; that in order to best serve this area and the
most number of parcels, it was recommended that a
right-of-way sewer and drainage easement ten 10)
foot wide be condemned across a portion of the Valley
Acres Map Book 12, Pages 86 and 871 and as shown on
Tentative Tract Map 29417; that the total length of
this condemnation was two hundred twenty-nine 229) feet.
City Attorney Flandrick read Resolution No. 64-66 by
title as follows:

Chief Administrative Officer and himself to obtain the
necessary title reports and to employ the services of an
appraiser to determine the value in order to obtain an
Order of Immediate Possession.
In answer to a question by Councilman Holmes, City Attorney
Flandrick stated the cost for this easement would be paid
from the General Fund; that it could not be paid for from
the funds of Sewer District 62-A-I.
Discussion followed wherein Councilman Holmes and Council-
man Bishop indicated they did not think this should be
paid for from the General Fund; that the ones who would
benefit from the installation should pay for it.
Discussion followed.
Mr. Tracy Bousman, representing the owner, stated their
intention was to have the City acquire the right-of-way;
that they would deposit with the City cash required for
the acquisition of right-of-way.
COUNCILMAN HOLIAES MOVED THAT THE DIRECTOR OF FINANCE BE
DIRECTED TO ACCEPT AN AMOUNT OF CASH EQUAL TO THE APPRAISED
VALUE OF THE EASEMENT PROPOSED TO BE ACQUIRED, AS SHONN
ON THIS MAP; AND THAT THE DIRECTOR OF FINANCE BE FURTHER
INSTRUCTED TO ACCEPT A CASH DEPOSIT FROM THE SUBDIVIDER

that, in his opinion, if the Council desired to accept
the City Engineer's recommendation the Council could do
so and it was legal to do so.

City Engineer Young reviewed his report and attached
sketch concerning a Street Improvement District on Chevalier
Street from Depot to Vineland. He stated that Mr.
Ted Lackey, a resident of Chevalier Street, had obtained
the signatures of seventy-five 75%) of the residents on the
street; that it was the desire to put in curbs, gutters,
sidewalks and driveways where required. He stated the
Engineering Staff recommended adoption and approval of this
requested project.
Councilman Holmes stated perhaps there should be a matter
of option on the one side of the street where they want a
driveway in front or stay in the back; that there might
be a number of the lots that wanted a driveway on the
south side of that street even though they have an alley
entrance; that this should be considered as an option and
asked if the City Engineer would include this in his
recommendation.

Regular Meeting of the Baldwin Park City Council
City Engineer Young stated he and the City Attorney had
drafted the General Conditions for the vault. He asked
that bids be received April 10, 1965 at 12:00 p.m. and
that the bids be opened at 12:10 p.m.
Councilman Holmes asked if the revisions were completed.
City Engineer Young stated they were not in final form
but the design was done and it was ready to go to bid.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ACCEPT THE
PLANS AND AUTHORIZE REQUEST FOR BIDS TO BE OPENED APRIL
10, 1964, AT 12:10 P.M. IN THE COUNCIL CHAMBER OF THE
CITY HALL. COUNCILWOMAN TAYLOR SECONDED.
In view of the letter received from the Improvement
Association, Councilman Morehead asked if there was any
idea how long the City Hall facilities would be remain-
ing where they were and would it be long enough to
warrant the expenditure for this vault.
Mayor Bloxham stated the records needed protection until
other quarters were built,
Councilman Holmes stated that microfilming would also
be expensive.

was speaking regarding a Building Permit. He stated
fill was put in this area; that late last summer there
was a construction loan taken and an engineer who sub-
mitted certain grade plans; that the grade plans were later
altered; that at the same time there was a road plan sub-
mitted, and when it was found that the fill was inadequate
and that the water had to be run down the street and out to

grade plans; that the streets plans were approved and the
street was put in, and there was much added fill put in
than was originally anticipated; that the street had been
put in and there was some question now regarding the
compaction and the amount of fill on the particular site
at this time; that there was a compaction report submitted
by the Triad Engineering Company of 970 Anaheim and Puente
Road, Industry, to the effect that it was properly com-
pacted and was a proper building site at this particular
time; that there was some question now as to the amount of
fill and whether there should be a small retaining wall
built adjoining one side of the property.
In answer to a question by Councilman Holmes, Mr. Blietz
stated the builder completely disclaimed anything to do
with the fill and so forth. but he did hire an engineer
and the engineer drew some specifications for fill to be
put in, and, at that time, it was anticipated that the
run off water could be run off in another direction,
however, an adjoining property owner would not allow this
and the engineer redrew the plans for both the building
site and the road taking into consideration that the water
had to be run out down Torrey onto Foster; that then the
street plan was approved by the City Engineer and the
street was put in and the fill was added to the back part
of the lot; that the question arises now whether there was
proper compaction on the fill that was put in and whether
there'should be a small retaining wall along one portion
of the property because there was fill up approximately
four 4) feet in this particular area, sloping from about
two and one-half 2z) to four and one-half 41) feet.
In answer to a question by Councilman Holmes regarding
the fill, Mr. Blietz stated to his knowledge the fill was
never submitted to the City for approval; that there were
no grading plans that were actually submitted to the City
regarding the fill; that the street plans were submitted
and approved; that it seemed there°was a breakdown in'
communications between the engineer for the builder and
the actual homeowners in this area; that it was the
originalunderstanding that the builder would take over
the entire job, however in the contract that the home-
owner signed the building site,was excluded.
City Engineer Young passed a report to the Council
regarding this matter.
Discussion followed regarding whether Lot Split No. 591
and 529 constituted a subdivision.

Mr. Dan Brown, 3719 Grace Avenue, Baldwin Park, stated DAN BROWN, 3719
this was his property that was being discussed where Grace Ave., B.Pk.
the fill was) and asked if the dirt. was put on the lot
to the south how would the lot to the north be drained..
City Engineer Young stated there was another lot split and
if both parcels would get together it could be graded into
one and the drainage should slope to the street.
Mr. Clint Peppers, 965 Garden Grove, Norco, stated he CLINT PEPPERS, 965
owned property adjoining where the fill was; that the way Garden Grove, Norco
the fill was in there now was detrimental to his side
of the property; that he would like to have the fill
removed or a retaining wall put in; that he would prefer
the fill removed.
Councilman Holmes stated it appeared from City Engineer
Young's report that Lot Split No. 591 and 592 would need
fill; that with cooperation between the neighbors the
proper fill and drainage could be accomplished.

Mr. Blietz stated he believed as far as the retaining wall
was concerned this could be accomplished after the building
permit was issued.
Further discussion followed.
As there were no objections Mayor Bloxham Instructed that
the grading plans be submitted to the Engineering Depart-
ment and work out the problem with City Engineer Young.
Mr. Blietz stated that the grading plan had been submitted
by City Engineer Young.

Councilwoman Taylor stated there was a problem regarding
the number of laterals for the property at 4606 Center
Street, Mrs. Charlene Jordan. She stated the sewers were
due to reach this property tomorrow and they wished a
clarification as to how many laterals were required;
that there were four lots at this location.
As there were no objections, Mayor Bloxham instructed
that the Chief Administrative Officer, City Attorney
and City Engineer handle this matter.

Councilman Holmes commented there had been a policy
established long ago that the City Engineer was
authorized to run a six inch lateral and each connection
would come off of each lot into this lateral.

Councilman Morehead stated that something should be done
concerning the filling of septic tanks.
City Attorney Flandrick stated that presently Section 409
and Section 1119 of the Uniform Building Code, that the
Council had heretofore adopted, did require the filling
of septic tanks. He asked if he understood that the
Council wished an ordinance prepared to delete these
sections so that the filling of septic tanks was not
required.
Mayor Bloxham stated this would be his thinking.
Councilman Morehead stated it was his opinion that septic
tanks constructed of concrete or concrete block should
not be required to be pumped and filled in this City
but if the septic tanks were made out of material that
would deteriorate such as redwood then they should
be pumped and filled.
Discussion followed regarding steel tanks wherein
Councilman Holmes stated that steel would rust out
in a few years and collapse; that steel tanks should
be pumped and filled.
Planning Director Kalbfleisch stated he agreed that steel
tanks should be pumped and filled.
Further discussion followed.
As there were no objections, Mayor Bloxham instructed that
this matter be referred to Mr. Kalbfleisch and the City
Attorney for a reconmendation and proper ordinance.

CLAIMS AND DEMANDS AGAINST THE CITY
OF BALDWIN PARK"
Discussion followed regarding Warrant Nos. 4178, 4189 and
4192.
COUNCILMAN BISHOP MOVED THAT THE CHIEF ADMINISTRATIVE
OFFICER CHECK IN ON ALL EXPENSES OF CITY EMPLOYEES AND
THAT THEY HAVE THE PROPER DOCUMENTED EVIDENCE BEFORE A
WARRANT IS DRAWN. The motion died for lack of a second.
Further discussion followed.

papers which would cover any City documents in his
possession; that he had a letter from Bill Betts Agency,
2454 Overland Avenue, Los Angeles 64, which he read in
full, concerning public liability insurance, the maximum
amounts of $100,000.00/$300,000.00 bodily injury,
$25,000.00 property damage, which was much in excess of
the requirements of the agreement. He stated this letter
would constitute, a sufficient, in his opinion, indica-
tion of insurance as to that policy; that the physical
policy had not yet been received; that a Workmen's
Compensation and Employers Liability Policy in the
minimum amounts required by law had been received; that
he thus had complied with all immediate conditions of
the contract insofar as insurance was concerned; that
this would leave him with the responsibility to obtain,
which Mr. Lyon's had advised him and he was in the
audience), that he had in fact applied for the errors
and omissions insurance and had indicated to the Chief
Administrative Officer and himself that this was a policy
that took approximately thirty 130) days to process and
issue; that the Performance Bond will also be issued,
according to Mr. Lyons, shortly; that Mr. Lyons had sub-
mitted all of the policies required insofar as immediate
execution of the agreement was concerned and had given
Mr. Nordby and himself to understand, and certainly his
assurance was sufficient for them to recommend, that this
assurance be accepted that he will supply all of the
bonds and the errors and omissions insurance as soon as
the same was received; that therefore Mr. Nordby, Mr.
Young and he recommended the approval of the agreement
as submitted.
Councilman Bishop stated he thought it was good that the
contract was pinned down this tight.
Councilman Holmes asked for a clarification on Page 4,
second paragraph under Section 5 concerning field staking.
He asked if this was all inclusive including surveying
that might be necessary during the making up of design
plans and also the construction staking.
City Attorney Flandrick stated yes it did.
Councilman Holmes asked about the blank on page 5,
paragraph d under 6. He asked if these figures should
be determined now.
Discussion followed and the amount of one percent 1%)
was inserted.
Further discussion followed with no changes being made
in the contract.
Councilman Holmes commented that the City had a contract
far better than the ones they had had before.
City Attorney Flandrick stated that Section II b. on page
11 should read The original ink on vellum assessment
diagrams, plus 3 final copies thereof".
The Council commented that their copies did read that
way with an added sentence of One ink on linen print,
two on paper)".
Councilman Morehead questioned the inspectors for the crews
wherein City Attorney Flandrick referred him to Section 5,
the third paragraph, page 4. Mr. Flandrick stated this
language was deliberately vague because it was not known
at this point exactly how the contractor was going to
perform this job nor was it known how Mr. Lyons was going
to suggest that the job be done; that Mr. Lyons might come
