City Treasurer Pugh presented a revised Treasurer's Report
for February 1964`ahd a report regarding the revised
report frcm Finance Dire-or Duncan. The report indicated
that the revision had been discussed between ne Treasurer's
Office and the Finance Department and represented a joint
effort for a better and more concise report.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL ACCEPT THE
RECOMMENDATION OF THE FINANCE-DIRECTORAND THE C-TY

Regular Meeting of the Baldwin Park City Council
Mr. James Q. Gibson, 13268 East Francisquito, Baldwin
Park, requested that the City Council consider an appropria-
tion for a fireworks display at the Morgan Park on July
4, 1964. He stated it was hoped that the display could
be on a larger scale this year; that at this time this
was not an official request from the Baldwin Park Improve-
ment Association.
Councilman Holmes suggested that the Baldwin Park Improve-
ment Association send in the request in writing as soon as
possible.

Councilman Bishop explained that'the Council already had
such a report which recommended against the stop signs.
City Engineer Young stated he preferred to make another
study before making a recommendation; that he did not have
any objections to painting the crosswalk and using the sign.

R. and Thelma L. Wakefield, 12850 Salisbury Street.
City Attorney Flandrick stated from his conversation with
City Engineer Young and City Clerk Balkus it appeared that
this particular street was improved by means of an assess-
ment district some five 5) or six 6) years ago; that at
that time the indication was apparently made to the people
that once the improvement had been constructed and improved

and accepted by the City the street would then become a
public street; that he had been advised that for the past
five 5) or six 6) years the City had maintained the street,
and in all probability the area treated in that fashion
was now a public street by prescription; that if the Coun-
cil so desired a resolution could be prepared and submitted
at the next regular meeting formalizing the fact, and
designating Salisbury Street as a public street.
COUNCILMAN HOLMES MOVED THAT IF ANY FURTHER ACTION WAS
NECESSARY THAT THE CITY ATTORNEY AND THE CITY ENGINEER
GET THE NECESSARY DOCUMENTS PREPARED TO MAKE A FORMAL
DEDICATION OF THIS PORTION OF SALISBURY STREET. COUNCIL-
MAN BISHOP SECONDED. The motion carried by the following

City Clerk Balkus presented a letter dated March 20, 1964
from Charles Spooler, 4849 North Peck Road, El Monte,
California, regarding Police Officer kills an innocent
woman on the freeway".
Councilman Morehead asked that the letter be read at this
time or later in the meeting.
COUNCILMAN BISHOP MOVED THAT THIS BE HELD OVER TO THE NEXT
AGENDA. The motion died for lack of a second.
City Clerk Balkus read the letter in full. Copy in offi-

City Clerk Balkus announced that the hour of 8:00 p,.m,
having arrived that it was the time and place fixed for
the public hearing on Z-221, an application submitted
by Anna E. Brown for a change of zone from R-2 light
multiple family residential zone) to R-3 heavy multiple
family residential zone) or more restrictive use on
certain real property located at 3841 North Monterey Avenue.
City Clerk Balkus administered the oath to those in the
audience desiring to testify during the meeting.
City Clerk Balkus stated that the required publication and
mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution PC 64-40 recommending approval on March 11,
1964.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR BLOXHAM.
Mrs. Anna E. Brown, 3834 North Monterey Avenue, Baldwin
Park, stated the Planning Commission had voted in favor
of the change from R-2 and R-3 and asked the Council to
vote favorably for the change from R-2 to R-3.'

City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
resolution PC 64-42 recommending approval on March 11,
1964.
TESTIMONY IN BEHALF OF REQUEST WAS CALLED FOR BY MAYOR
BLOXHAM.
City Clerk Balkus readministered the Oath.
Mr. M. H. Devine, 920 Arlee Place, Anaheim, stated this
application had been approved by the Planning Commission
and it was hoped that the Council would act favorably
on it; that the encroachment was very little; that they
were actually replacing the present sign which was over
the setback now.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to ZV-88, Mayor
Bloxham declared the public hearing closed.
COUNCILMAN BISHOP MOVED THAT THE VARIANCE ZV-88) BE

City Clerk Balkus announced that this-was the time and
place fixed for a public hearing on ZV-90, an application
submitted by Mark Attie for a Variance to allow the
construction and use of a sign 240 square feet of face)
exceeding the allowable face area in the R-1 single
family residential zone) on certain real property located
at 3000 North Vineland Avenue.
City Clerk Balkus stated that the required publication,
postings and mailings had-been accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
resolution PC 64-44 recommending approval on March II,
1964. He stated that he would like Section 2 d" clarified
as to the amount of cash deposit required to assure the
removal of the said sign.
City Attorney Flandrick stated he would not be in favor
of City forces taking the sign down if it were necessary.

COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONCUR WITH

feet of the San Bernardino Freeway and encroaching into

the Agenda the Council had a resolution of approval for

operation.

Mr. Bruce G. Martin, representing Shell Oil Company, 1085
North Harbor Boulevard, Anaheim, California, pointed out
that there were several existing signs on the freeway
Beacons, Arden Farms and Krafts Cafe. He showed a
rendering of the proposed development Exhibit A CP-29
shown at March 18, 1964 Council Meeting).
Mr. Bernard Perlin, 1044 Montego Drive, Los Angeles,
architect for the project, stated that it was their
opinion that the sign would help the success of the entire
project and would enhance the development and not be a
safety hazard.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to ZV-9l, Mayor
Bloxham declared the public hearing closed.

WITH THE RECOMMENDATIONS OF THE PLANNING COMMISSION AND

City Clerk Balkus announced that this was the time and
place fixed for the continuation of a public hearing
on CP-14, an application initiated by Baldwin Park
Planning Commission to initiate action pursuant to the
revocation of Conditional Use Permit Special Use
Permit), Case Number Z-86, Baldwin Auto Wreckers, for
non-compliance of conditions as set forth in Resolution
No. 61-167. The property is located at 5048-5056 North
Merced Avenue.
City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of the
case. He stated he made a complete survey last week and
took photographs passed to the Council); that he found
that the property on the interior was well managed; that
on the exterior it was in bad shape; that conditions c",
d", e", i", j" m" and had not been completed;
that the metal fence was in bad shape around the exterior;
that he could find no intent of complying with the re-
quirements regarding development of streets, water hydrant
or block wall on the southerly part of the property.

TESTIMONY IN BEHALF OF NOT REVOKING THE PERMIT WAS CALLED
FOR BY MAYOR BLOXHAM.
Mr. Dennis Irving, 810 Via Escalita, Glendora, owner of
the Baldwin Auto Wreckers, stated he would like to have
a clarification of the intention of the City Council.
Councilman Holmes stated as-he recalled Mr. Irving had,
at the time the matter was carried over, some, negotiations
for a contract for improvements, engiheering, street
developments, financing and so forth.
Mr. Irving stated that was correct; that they were working
on it although the arrangements they had were not satis-
factory and were not for the best interests of the Baldwin
Auto Wreckers and had been relinquished.
Councilman Holmes suggested that Mr. Irving be instructed
to bring his documentary evidence by the next meeting
including the results of the efforts on the engineering
and acquiring, the right-of--way rather than having the
matter discussed in detail at this time.
Mr. Irving suggested sixty 60) days.

Discussion followed regarding the fact that Mr. Irving
had received Resolution No. 61-157 and was aware of the
conditions to be complied with.
Mr. David Marcus, 215 West 5th Street, Los Angeles 13,
Attorney for Mr. Irving, stated there were certain condi-
tions that to a certain extent were going to be impossible
to comply with; that the issuance of a valid permit from
the Fire Department was predicated upon provision g",
which he read; that if the mains did not carry enough water
to supply 1,250 gallons per minute Mr. Irving would not
be able to comply with that provision;. that the main that
was in there now would not-carry that amount of water; that
provision m", which he read, required Mr. Irving to pave
the entire steeet for the entire length of his property
and install curbs and gutters; that as he understood there
was no M-2 zone in Baldwin Park; that at the time the

Conditional Use Permit was granted in 1961 from his
research there was no General Plan with respect to paving April 1,

this particular street; that the conditions that were
added were going to cost in the neighborhood of $30,000.00.
He asked that the matter be referred to the City Attorney's
office to see whether the conditions that had been added
to a conditional use required a person who had been in
operation since 1955 to expend this kind of money to
i rnpr,Y the property to continue in business that was in
exisrc:-~e prior to the time that Baldwin Park was incor-
porated; that his opinion at this time was that those
conditions could not be attached to a valid business and
a legal business that was in operation prior to the time
of the incorporation of the City when there was absolutely
no Zoning Ordinance in the City of Baldwin Park that per-
mitted the operation of this kind of lawful business.
Discussion followed between Councilman Holmes and Mr.
Marcus regarding the water problem wherein Councilman
Holmes stated this was a condition that the Fire District,
pursuant to the State Code, had recommended to the Plan-
ning Commission.
Councilman Morehead stated that the Planning Director had COUNCILMAN MOREHEAD
certified that Mr. Irving had not compiled with certain
conditions; that inspections had been made and photographs
taken; that approximately three months ago Mr. Irving
and his attorney had assured the Council that the condi-
tions would be met and asked for a certain period of time;
that the conditions were not met prior to that time and
had not been met up to this date; that he could see no INDICATED HE COULD
need to further continue this hearing for documental SEE NO NEED TO FUR-
proof; that he had inspected this property and could see THER CONTINUE HEAR-
no attempt being made to meet these conditions. ING FOR DOCUMENTAL

Mayor Bloxham stated that the Council had been very fair
with Mr. Irving; that in his opinion the City Hall staff
should come back with a complete program as to what has
happened; that there were water and street problems; that
the motion indicated that the City Engineer, City Attorney,
Chief Administrative Officer and Planning Director make
a survey of the property and bring back a full report.
At the request of Councilman Morehead Planning Director
Kalbfleisch went over every condition and indicated which
conditions had been complied with and which had not been
complied with.
Mr. Marcus indicated that f" had been complied with.
Mr. Irving stated that his operation closed at 6:00 p.m.
Councilman Morehead stated in his opinion that the Council
should be guided by item p" of Resolution No. 61-167

Mr. Marcus stated that Mr. Irving had approximately ten
10) employees working there; that Mr. Irving's payroll
was in excess of $1,000.00 a week; that Mr. Irving had
$150,000.00 invested in the property alone; that he
had a $250,000.00 property. Mr. Marcus suggested that if
the City insisted that the curbs be put in and the
street paved and installed that it be done according to
the manner in which the rest of the streets of Baldwin
Park were paved and Mr. Irving pay for it in the form of
taxes and not to revoke his permit; that Mr. Irving wanted
to comply; that Mr. Irving had been in Baldwin Park a
number of years; that some of the conditions were not com-
pliable; that some of the conditions in his opinion as
an Attorney were not valid.

Councilman Morehead stated it seemed strange to him that
Mr. Irving did not protest the requirements at the time
he agreed to the conditions; that Mr. Irving should meet
the conditions or t-he Council will have to take action.
The motion carried by the following vote:

Councilman Holmes pointed out that the streets, curbs,
and utility extensions were not put in by tax money; that
they were all put in by the developers; that the State
requirements for this type of operation were supposed to
be met and the City had nothing to do with the State per-
mits; that he understood that the County had taken steps
to revoke the permit-at the time the City of Baldwin Park
incorporated.

and was so ordered by Mayor Bloxham.
Mr. Marcus asked that the report indicate whether some of
those items, particularly the water problem, were subject
to compliance; that,.in other words, whether there was
enough water pressure or enough water in the main to
permit compliance.
Councilman Holmes again, stated that the Fire Department
made the recommendation of the amount of flow necessary;
that he believed thay said it was also part of the State's
requirements; that it would require the extension of a
main for some 700-800 feet; that there were no water mains
there at the present time any more than there was in any
subdivision or any other type of development; that in
numerous cases the Fire District requirements required
where there were mains that they be made larger.
City Attorney Flandrick suggested that in conjunction
with Mr. Kalbfleisch's report that a report be requested
from Chief Parson of the Fire Department.
Planning Director Kalbfleisch indicated he would obtain
such a report.

City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
Planning Director Kalblfeisch presented a resume of the
case and stated that the Planning Commission had adopted
resolution PC 64-45'recommending approval on March 11,
1964. He showed a plot plan of the layout and stated that
if the entire property was to be used for kennels that
it should be entirely enclosed by block'wall, twri sides
and the rear; that the plot plan did Indicate that the
entire property was to be used.

MAYOR BLOXHAM,
Mr. Charles Hagerman, 1335-37 North Virginia Avenue,
Baldwin Park, stated he had written a letter with his
application explaining in detail the entire operation;
that he did not want to use the entire property for
the dog kennel; that it was his understanding that the
Council had bypassed" the condition requiring the
applicant to install curbs and gutters.
Marion Lellyett, 1335-37 North Virginia Avenue, Baldwin
Park, stated they were going to use 1337 for the kennel;
that they already installed a chain link fence in the area;
that they were going to put the runs on cement floors on
the outside and asked if It would be possible if they
could wait on the fence without having to do all of it
at one time; that it would make a hardship on them to
tear down the chain link fence at this time.
Councilwoman Taylor commented that the Council should be
very sure where the block well was to be placed to eliminate
any misunderstanding; that she had sympathy with the request
to install the wall a little at a time but it was hard for
the Council'to judge just when the applicant would be ready,
financially, to meet the requirement.
Mr, Hagerman stated that the kennel would be on the back
part of the lot at 1337 North Virginia Avenue.
Discussion followed concerning the plot plan not showing
the definite location of the kennel area.

BE HELD OVER TO THE NEXT REGULAR MEETING AND BRING BACK

Councilman Morehead asked if there was some way this
ordinance could be brought to the attention of the
citizens.
Mayor Bloxham commented that two newspapers San Gabriel
Valley Daily Tribune and The Baldwin Park Sentinel)
were represented at the meeting.
The City Council agreed with the suggestion of Building
Superintendent Kalbflelsch that a record should be main-
tained of the septic tanks that were not filled. He
stated that a report was being maintained on the cess-
pools that were being built without septic tanks; and
also all cesspool and sewer locations were being main-
tained in a separate file.
Regarding proposed Resolution No. 64-71, City Attorney
Fiandrick stated the Council had a memorandum from the
City Engineer; that there were approximately forty-five
45) parcels to be acquired on Los Angeles Street to
permit the construction of the width indicated by the
Engineering Department and approved by the State
Division of Highways; that on the Warrant Resolution
tonight there were two warrants, one payable to O'Brien,
Mawhinney and Long and the other to J. A. Mann, in
the amount of $2,500.00 each for the appraisals in
accordance with the City Councils instruction; that
he received the last appraisal report this date; that
he was sending them In to the Division of Highways
for approval that their approval was required since
this was an expenditure of gas tax funds); that there were a
number of other parcels not included in the condemnation
action along Los Angeles Street; that In view of the
fact that eighteen 18) parcels had similar situations
in that the parties who own the property have in the past
either built a home or reconstructed a portion of it and
as a part of that construction; rather than condemn these,
since they were in use as a public street, he would pre-
sent at the next meeting on April 15, 1964, a resolution
that would accept an informal offer of dedication as to
these areas, thus eliminating them from the condemnation
action; that this would be a substantial savings; that
many of these persons were operating under a conditional
use permit or zone variance and were required to make
this dedication or they had in fact made the dedication
pursuant to a building permit; that the approximate cost
of this acquisition of right-of-way was $40,000.00; that
it had been budgeted In the gas tax project; that this
would not be a final figure in that the State would still
have to approve the appraisals and thereafter the action
would be filed and an order of immediate possession ob-
tained and then the project could be completed; that this
resolution was for the acquistion of parcels that the
City had no right whatsoever of.

Park to be at the southwest corner of Ramona Boulevard and
Francisquito. She stated that the City Council had already
approved eight 8) permits; that to approve any further

Councilman Morehead stated he was of the opinion that the
number of permits should not be Increased at the present

Regarding the selection of a Financial.Consyltant for
Sewer District No. 3, 64-A-1, Chief Administrative Officer
Nordby reviewed his report stating the City had entered
into an agreement with Stone and Youngberg on October 16,
1961; that the City Attorney concurred with him that this
was a valid and continuing agreement; that there was no
action required by the City Council.

Chief Administrative Officer Nordby reviewed his report
with regard to a legal Consultant for Sewer District
No. 3 64A-1). He stated with regard to the proposal
from Martin and Stevens the proposed fee should read
1.9% of the first million dollars plus i of 1% of the
remainder instead of 1% of the remainder. He further
reviewed his report and the reason for his decision
and stated that he recommended the firm of Martin and
Stevens be employed.
City Attorney Flandrick explained that 1is relationship
with Charles Martin was that they were associates; that
they shared office space; that on this project If Martin
and Stevens were employed to handle this district, he,
Mr. Flandrick) would work on this project jointly with
Mr. Martin.

Councilman Holmes asked if he understood that Mr. Nordby
felt that the quality of work and added attention that
would be given by Martin and Stevens would justify the
small difference in fee.

Chief Administrative Officer Nordby reviewed his report
and a letter from Pyle, Lance, Schlinger & Soil'dated
March 24, 1964, regarding the auditing contract. He
stated that the letter proposed an increase from $1600.00
to $1800.00; that this increase was because of the
increased activity generated primarily from improvement
district work; that the increase in cost was still the
next lowest proposal of a year ago Swenson and
Clark: $2,000); that he recommended that the City
negotiate a new agreement with Pyle, Lance, Schlinger &
Soil in line with their proposal.
Finance Director Duncan stated in previous audits Pyle,
Lance, Schlinger and Soil did a brief examination of
the sewer district bonds; that they intended to go into
it more thoroughly this year; that this was the first time
any audit form'had taken a look at the bonds without an
additional fee.
Councilman Morehead asked the Finance Director if she was
satisfied with their audit.
Finance Director Duncan stated yes; that there had been no
problems.

adequate flourescent fixtures in the C.A.O. secretary's
office and reception room r. $148.80. He stated that the
best quotation Mr. Welch was able to obtain was from
Paul H. Elmore Electric, Baldwin Park; that Mr. Elmore
had previously done satisfactory work for the City; and

$4500.00 for two fifty-four 54) inch culverts; that this COST FOR TWO 54 INCH
would take care of the drainage temporarily; that this would CULVERTS
be providing that the fill could be obtained; that some
of the fill could probably be obtained from the sewer work;
in order to take care of the drainage properly in accordance
with the Flood Control Program from the wash up across
Garvey under the Freeway and up to Robinette and on over

Í«173 3 Regular Meeting of the Baldwin Park City Council
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
resolution PC 64-46 recommending approval on March 11,
1964.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR
BLOXHAM.
Mr. James H. Newnan, 4338 North Maine, Baldwin Park,
stated the Planning Commission had asked whether the
five 5) feet would be dedicated for the widening of
Maine Avenue and stated that he was sure the church
would give the dedication; that they had torn down
the building on Maine and it had been disposed of.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to CP-31, Mayor
Bloxham declared the public hearing closed.
COUNCILMAN HOLMES MOVED THAT THE CITY COUNCIL CONCUR WITH
THE CONDITIONS{IN RESOLUTION PC 64-46 AND THAT CP-31 BE
APPROVED AND THE CITY ATTORNEY DRAW THE NECESSARY RESOLU-
TION TO ACCOMPLISH THIS. COUNCILMAN MOREHEAD SECONDED,
Discussion followed wherein City Attorney Flandrick brought
out that Section 2 a" of PC 64-46 called for a ten 10)
foot dedication on North Maine Avenue,

TAYLOR AND MAYOR BLOXHAM

City Clerk Balkus announced that this was the time and
place fixed for a public hearing on the vacation of a
portion of Torch Street.
City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
City Attorney Flandrick stated the purpose of the hearing
was to determine whether or not the area was needed for
present or prospective street purposes.
City Engineer Young stated the area involved was concerned
with an old lot split and originally in an R-I area; that
it was recently zoned R-3 and it was desired to build an
apartment building at this location and the request was
that the lot split be deleted and this area, a small
portion at the end of a cul-de-sac, be vacated; that in
discussing this with the Planning Director it did not
appear that this portion of dedicated street was needed
for any future street use and since this had been rezoned
to R-3 it seemed desirable to vacate this particular
portion; that it was their recommendation the area be
vacated.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to the vacation of
a portion of Torch Street, Mayor Bloxham declared the
public hearing closed.
