regular session at the above place at 7:30 p.m.
Councilman Morehead led the salute to the flag.

Mayor Bloxham stated due to the fact that there would be a
change in the Council the City Attorney had advised that
at 8:00 p.m. the public hearings should be opened, in-
dividually, and a motion made to continue them to May
6, 1964, at 8:00 p.m.
COUNCILMAN HOLMES MOVED THAT ALL OF THE ITEMS THAT ARE ON
THE AGENDA CONCERNING PUBLIC HEARINGS AND THE T1WW10 WRITTEN
COMMUNICATION ITEMS UNDER WRITTEN COMMUNICATIONS THAT THE
MATTERS OF.PUBLIC HEARING BE CONTINUED AND THE TWO ITEMS
UNDER WRITTEN COPM+IUNICATIONS BE SET FOR PUBLIC HEARING ON
MAY 6, 1964, AT 8:00.P.M. IN THE COUNCIL CHAMBER.
COUNCILWOMAN TAYLOR SECONDED.
City Attorney Flandrick suggested that this motion relate
only to Items I and 2 under Written Communications; that
each of the public hearings should be opened and continued
to May 6, 1964.
Councilwoman Taylor withdrew her second.
Councilman Holmes withdrew the motion.

WRITTEN COMMUNICATIONS BE SET FOR PUBLIC HEARING ON MAY 6,

Mr. Carpenter, representing the electronics class of
the Baldwin Park High School, extended an invitation
to the present Council, and newly elected Council members
to attend their Open House on Wednesday, April 22, 1964.
He stated that their closed circuit television station,
which was newly constructed, would be on display and
demonstrated during the refreshment hour at approximately
9:15 p.m.; that they wanted the Council to participate on
a panel; that a Civics teacher was willing to moderate;
that suggestions for topics were discussion on the
responsibilities of Baldwin Park youth, as citizens of
the community, what can the City Council do to encourage
juvenile decency in our City, and discussion on the youtt
center.
Mayor Bloxham thanked Mr. Carpenter for the invitation.

Mr. James A. Garrow, 1011 North Baldwin Park Boulevard,
Baldwin Park, read his letter dated April 15, 1964,
addressed to the City Council, regarding an incident con-
cerning the service of the San Gabriel Valley Humane
Society. Letter in official files).

Mrs. Eugenia Igna, 128:9 East Garvey, Baldwin Park,
stated she wanted to know what to do to make her
property conform; that she understood if she sold
her property the new owners could not operate as
it existed.
Planning Director Kalbfleisch stated Mrs. Igna had
conforming and nonconforming uses on her property;
that a Variance could be applied for and if granted
could make the nonconforming use conforming.
City Attorney Flandrick stated that would be one method
of handling the matter; that the status of the property if
it was now nonconforming would not be altered in any
respect with the change in ownership.
Mrs. Igna asked about the expiration date of the noncon-
forming uses.
City Attorney Flandrick stated that any nonconforming use
was subject to abatement at the end of its useful economic
life; that the answer to this question would have to be
determined by studies being made of the property in question
and findings were made by the Planning Commission and by the
City Council.
Mrs. Igna asked if she sold a trailer park would the new
owners be able to use it.
City Attorney Flandrick stated that a change in ownership
would have no effect upon its status.
Mrs. Igna asked for this statement in writing.

CITY ATTORNEY TO WRITE MRS. IGNA A LETTER CONFIRMING THE
OPINION OF THE CITY ATTORNEY. COUNCILMAN MOREHEAD SECONDED.

Regular Meeting of the Baldwin Park City Council
City Clerk 34Ikus read in full a letter dated March 26,
1964, addresseq to the City Clerk from Davidson Optronics1
Incorporated which stated that the stop signs installed
at the inter$ection of Puente Avenue and Ramona Boulevard
had created'ai situation for their plant that was both
annoying and hazardous.
Councilman Holmes stated that he had inspected this area
on two separate evenings; that he did not find the problem
that was pointed out.
Councilwoman Taylor stated she went down Monday evening;
that at no time while she was there one hour and fifteen
minutes) were the driveways backed up.
Councilman Bishop commented that he had seen nothing
there that would be detrimental to the employees ingress
and egress)
City Clerk pa kus also read a letter dated April 8, 19641
addressed to councilman Letcher-Bishop from Mr. J. L,
Howard regarding the same subject. This letter suggested
leaving them there, and letting the motorist get used
to them'.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on CP-14, an applica-
tion initiated by Baldwin Park Planning Commission to
initiate action pursuant to the revocation of Conditional
Use Permit Special Use Permit), Case Number Z-86, Baldwin
Auto Wreckers, for non-compliance of conditions as set
forth in Resolution No. 61-167. The property is located
at 5048-5056 North Merced Avenue.

Chief Administrative Officer Nordby reviewed his report
concerning the policy regarding cash deposits for improve-
ments required pursuant to lot split agreements. He stated
that each resolution which granted approval of a lot split
contained a section providing for the deposit of cash in
lieu of improvements if the improvements could not be
constructed within a given.period of days; that it had been
the practice of the City to accept cash deposits with the
added stipulation that if, at a later time, say two or
three years or more, it was found that the deposit was
insufficient to cover the cost of the improvements, the
City may demand additional funds to complete the subject
improvements; that it was his opinion that such a condi-
tion was not only morally wrong; that it was the City
Attorney's opinion that such a condition may not be
legally enforced; that it was their opinion Chief Administra-
tive Officer and City Attorney) that future lot split
agreements should not require an upward adjustment in the
cash deposit in view of the fact that the applicant was
capable, financially and otherwise, of constructing the
improvements and whatever delays were created were not
within his control.
Discussion followed.

THE RECOMMENDATION OF THE CHIEF ADMINISTRATIVE OFFICER ON
THE CARRIED FORWARD INSTALLATION CLAUSES OF THE ADDITIONAL
COSTS AND BE DETERMINED AS THEY EXIST NON IN EACH OF THESE
CASES. COUNCILWOMAN TAYLOR SECONDED. The motion carried
by the following vote:

Chief Administrative Officer Nordby reviewed his report
regarding a retirement plan for miscellaneous and public
safety employees. He stated that in his opinion a retire-
ment program should apply to all employees; that the
annual estimated cost, from the information provided by
Mr. T homes Crocker and from the City's employment records,
of the combined prior and current service for all employees
was $45,216.01; that this would represent a tax rate in-
crease of I22 cents per $100.00 of assessed valuation;
that this would be a matter to further discuss in budget
sessions.

Discussion followed wherein it was brought out that
approximately $2,700.00 annually would be for prior
service on the basis of twenty 20) years; that the
$45,000.00+ amount was subject to audit.
Councilman Holmes stated this matter would have to be
considered by the new Council; that a majority of the
present Council had felt in the past that a matter of
that magnitude and permanency should be submitted to the
voters; that if decided by the voters it would be
permanent; that if decided by Council action it would be
subject to revision by Council action. He pointed out
that this would be in addition to Social Security which
the City now provided.
Councilman Bishop stated he concurred that this should
be put to a vote Of the citizens.
Chief Administrative Officer Nordby stated he had con-
tacted an insurance company to see what they would offer.
Councilman Holmes stated that he had heard of other cities
having problems with the complications involved in the
State Retirement System and that this should be checked out.
COUNCILMAN BISHOP MOVED THAT THE CITY COUNCIL CARRY THIS
OVER, THAT THE NEW COUNCIL WOULD HAVE TO MAKE THE
DECISION. COUNCILW'I(Y,%N TAYLOR SECONDED. There were
no objections, the motion carried and was so ordered
by Mayor Bloxham.
Councilman Morehead asked that the Chief Administrative
Officer furnish the new Council members with all of the
information available on this matter.

At this time Mayor Bloxham asked the newly elected Council
members, William S. Adair, Adelina Gregory and Joseph
McCaron, who were in the audience, to stand. He stated
that they would be officially sworn in on April 21, 1964.

Engineer Young was ordered home by his doctor this
afternoon; that he might have wanted to comment on
the engineering items.
