REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL

session at the above place at 7:30 p.m.
Mayor Morehead led the salute to the flag.

City Clerk Balkus stated that the microphones were not
working and that she would contact someone in order to
have them working for the public hearings if possible.
AT 7:32 P.M. COUNCILWOMAN GREGORY MOVED THAT THE CITY
COUNCIL RECESS FOR TEN MINUTES. COUNCILMAN ADAIR
SECONDED. There were no objections, the motion carried
and was so ordered by Mayor Morehead.
City Clerk Balkus indicated that a repairman had been
called and would report as possible.

City Engineer Young stated that in his opinion the policy
of the City was to require ornamental poles in new tracts,
however, there was no ordinance or written policy set
out by the Planning Commission or Council; that in review-
ing the matter of wooden and oranmental poles in tracts
he found that several tracts since 1961 had been approved
with both wooden and ornamental poles; that his former
assistant had approved wooden poles in the subject tract;

Discussion followed wherein it was brought out that the
City Council resolution stated that the street lights shall
be installed in accordance with the City standards; and
that this was the first tract.developed in this City by
California Property Brokers, Ltd.
Mr. John McCoy, California Property Brokers, Ltd., 3932 JOHN MCCOY, CALIF.
North Center Street, Baldwin Park, stated that the real PROPERTY BROKERS, LTC
point wasthat the Edison Company could not get access to 3932 N. Center St.,
the rear and the poles had to be put in front; that there B.Pk.
already existed wooden poles in the front and it would be
ridiculous to put ornamental poles beside the wooden ones.
It was the consensus of the Council members present to
accept wooden poles in this tract.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL APPROVE MOTION MADE AND
THE REFUND, THE AMOUNT TO BE DETERMINED BY THE CITY ENGINEER, CARRIED THAT CITY

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on CP 30, an applica-
tion submitted by Charles Hagerman and Marion Lellyett for
a Conditional Use Permit to allow the construction and use
of a dog kennel in M-1 light manufacturing zone) on certain
real property located at 1337 North Virginia Avenue.
City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
Assistant Planning Director Hill presented a resume of the
case. He passed out sketches submitted by Mr. Hagerman,
which had been requested by the City Council at the May
6, 1964 meeting, and there was a larger sketch on the wall
later marked Exhibit A). He stated that the Planning
Commission had initially recommended that the entire
property be enclosed with a concrete wall but had finally
recommended that the applicant put the block wall behind
the kennels and not go to the rear property line; that the
concrete well was to include go across) the driveway.

City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD.
Mr. Charles Hagerman, 1335-37 North Virginia Avenue,
Baldwin Park, stated with his original application he had
submitted a letter addressed to the City Council outlining
the details of the proposed operation letter not in offi-
cial files) and that he had submitted pictures of the front
entrance; that he was sure if they were allowed to continue
with their plans they would have something Baldwin Park
couid be proud of.
In answer to a question by Councilman McCaron, City Clerk
Balkus stated there was no recent written material on file
regarding this case and that the letter Mr. Hagerman mentioned
was not in the official file.
Assistant Planning Director Hill explained the letter
had been addressed to the Planning Commission.)
In answer to a question by Councilman McCaron, Mr. Hagerman
stated they could accommodate 50-60 dogs.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to CP-30, Mayor
Morehead declared the public hearing closed.
Councilman McCaron stated that the Master Plan designated
this area M-l; that it appeared the property owners in
the area did not wish to develop the property with M-I
uses; that the only developments in the area he could see
were two building material firms with open storage; that
there was an open lot and the rest of the•area was single
family residences; that in his opinion it was out of place
to permit a kennel in this area.
Mayor Morehead stated there had been two or three other
conditional use permits granted for kennels on this same
street; that the only opposition to these applications
was from the applicants with regard to the conditions
imposed.
Mr. Hagerman commented that the other kennels had been
started; that across the street was a plastering manu-
facturer and this firm had purchased the lot next to him.
Councilwoman Gregory pointed out that if the kennel use
was approved street improvements would be required and
this in itself would help upgrade the area.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL CONCUR
WITH THE RECOMMEDATION OF THE PLANNING COMMISSION; THAT
CP-30 BE APPROVED AND THAT THE CITY ATTORNEY BE INSTRUCTED

Assistant Planning Director Hill presented a resume of the RESUME
case and stated that the Planning Commission had adopted
a resolution of denial on April 22, 1964, PC 64-67.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHPIF
MAYOR MOREHEAD.
Mr. Gilbert Pritchard, 3735 Monterey Avenue, Baldwin Park, GILBERT PRITCHARD,
stated all of the property owners, with the exception of one, 3735 Monterey Ave.,
who had properties that could be developed had signed the B.Pk.
petition. He explained the uses of the surrounding property
stating this location was close to schools, a child care
center and easy access on Ramona and Baldwin Park Boulevard;
that Mr. Kalbfleisch had last year indicated there were 170
acres of R-3 and only 70 acres of R-2; that there should be
twice as much R-2 as R-3; that the property owners who signed
the petition were 100% in back of this and in his opinion
it was an ideal location for R-2; that a Mr. Gonzales was
the person who did not sign the petition and he had purchased
a lot next to his home for his children to play in.
Mr. Frank Halterman, 915 East Gaillard, Azusa, stated he FRANK HALTERMAN,
represented the property owners of 3808, 3812, 3818 and 915 E. Gaillard,
3830 North Grace; that these property owners had their Azusa
property sold subject to the approval of zone R-2; that
this property was close to Ramona Boulevard; that these
property owners would be agreeable to approval subject
to a precise plan; that their builder was here tonight;
that the people were interested in doing something in
this area, not just getting it rezoned.
As there was no one else in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to Z-220, Mayor Morehead DECLARED CLOSED
declared the public hearing closed. Z-220
Mayor Morehead stated this was the second time this piece
of property had been before the Council recently; that he
would consider R-2 from Athol north and east of Grace,
the five properties in the north portion of this area;
that south of there he could not agree that it would be
compatible with the neighborhood if rezoned to R-2 without
a street.
Discussion followed that a cul-de-sac had been dedicated
and an interior lot just above the church property had
been split, the 30' dedication made for the future street,
and a home built facing the future street.
Councilman McCaron stated it appeared too broken up; that
there was no definite plan; that portions of the street had
been dedicated but there was no outlet; that there would
be no circulation of traffic; that this much property if
rezoned to R-2 would have to open onto a major street; that
Frazier at this point was only a sixty 160) foot street;
that possibly the City would be held liable if the plans
were abandoned for the cul-de-sac street; that consideration
should be given to the property owners who had built facing
the future street.

As there were no objections, Mayor Morehead reopened the
public hearing on Z-220
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR
MOREHEAD.
Mr. Pritchard stated they did not know and neither did
the Planning Commission know where the street should
go; that they were willing to listen to a plan that
would accomplish this; that there were really two problems
but they were difficult to separate zoning street); that
when the problems were taken together it seemed to cloud
the issue.
Councilman McCaron suggested that all of the property owners
might plan the street and share the costs; that the outlet
should be made toward Ramona Boulevard. the major highway)
Mr. Pritchard stated there were brand new apartment build-
ings all along Ramona Boulevard.
Mr. Halterman stated in order to obtain an outlet the
property owners would have to get together and buy a
parcel for this purpose; that some of the cities were
coming down to a 500-600 foot cul-de-sac street.
Mr. Harris, 3714 North Grace, Baldwin Park, stated he
owned a•parcel 160 x 600 involved in this zone change;
that putting in a street and paying for it would be out
of the question.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-220, Mayor
Morehead declared the public hearing closed.
COUNCILMAN MCCARON MOVED THAT THE CITY ATTORNEY BE
INSTRUCTED TO DRAW A RESOLUTION DENYING Z-220. COUNCIL-
WOMAN GREGORY SECONDED. The motion carried by the
following vote:

Mr. Halterman asked if the north part of Athol was
included in a request for rezoning would the Council
be willing to listen to that.
Mayor Morehead stated he was not in a position to say
anything about that; that the application would have
to be made through the proper routing.
Mr. Pritchard asked just what the people were going to
do with the properties; that he was an angry taxpayer and
asked that the City Council tell them what they did want.
Mayor Morehead stated that the Master Plan recommended
R-I development.

the denial of the Planning Commission, an application
submitted by John B. Danis for a change of zone from
C-I neighborhood commercial zone) to R-3 heavy multiple

east of the Alexander's Market.

Assistant Planning Director Hill presented a resume of the RESUME
case and stated that the Planning Commission had adopted
a resolution of denial on April 22, 1964, PC 64-68.
Mr. John B. Danis, 322 Avenue 1, Redondo Beach, stated JOHN B. DANIS, 322
that he and George Jeffries owned the property in question; Avenue I, Redondo
that he had constructed Alexander's Market; that he had Beach
strived to obtain additional tenants adjoining the market
but was not successful; that about two years ago he began
to work with Mr. Jeffries; that they constructed approxi-
mately eight to nine retail stores adjoining Alexanders;
that neither Alexanders or the retail stores had been
highly successful; that there was still ground between the
retail stores and Puente which they controlled and they had
not been able to find any takers; that the Master Plan
indicated high density residential for this area; that they
conducted a survey and found, in their opinion, there was a
need for R-3 zoning and made an application for a zone change;
that if the zoning was approved they were prepared to proceed
immediately and draw a map" for an R-3 apartment subdivision
on this land.
Councilman McCaron asked who owned the R-I property next
to the C-I.
Mr. Danis stated they also owned that property; that it
was not included in the application due to an oversight;
that the legal description covered the entire property
but they failed to insert the words R-I on the application.
He stated they owned all of the property up to the wash.
As there was no one else in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to Z-229, Mayor DECLARED CLOSED
Morehead declared the public hearing closed. Z-229
Councilman McCaron stated there was a problem of access
in that next to the wash the grade on Puente rises at
that point to go over the bridge.
Discussion followed.

Regarding Z-220, Councilman McCaron asked that the
Planning Director draw a sketch showing what would be
an acceptable plan, including the future cul-de-sac
street.
Mayor Morehead stated there was such a street design
recommended by Planning Director Kalbfleisch but it
was not acceptable to the property owners; that no one
wanted to dedicate property for a street.
Assistant Planning Director Hill passed to the Council the
plan of the cul-de-sac street.

The Council instructed that the Planning Director contact
the applicant and try to work out something along the line
of R-1.

COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL RECESS FOR
FIVE MINUTES. COUNCILMAN ADAIR SECONDED. There were no
objections, the motion carried and was so ordered by Mayor
Morehead.

City Attorney Flandrick passed to the Council copies of
the proposed Zoning Ordinance and corrected sheets for
insertion. He suggested going through the Zoning Ordinance
before opening the public hearing. He stated that after
the adjudication of the Baldwin Park Bulletin all ordinances
would have to be published; that the Baldwin Park Bulletin
had agreed to delay their adjudication until July 1, 1964;
that the estimated cost of publishing this Zoning Ordinance
was $4,000.00.
Mayor Morehead stated that the City Council had made
findings that the Zoning Ordinance contained ambiguities
and had authorized the City Attorney, Planning Director
and Planning Commission to study the current Zoning Ordinance
and submit their recommendation.
City Attorney Flandrick went through the proposed Zoning
Ordinance in its entirety pointing out the changes that
the Planning Commission made from the original draft.

Mr. Jerry Hammond, 14022 Ramona Boulevard, Baldwin Park, JERRY HANMOND, 14022
stated that in his opinion 1500 square feet per unit was Ramona Blvd., B.Pk.
unreasonable in R-3); that he did not think there should
be a set requirement; that this would decrease the property
values; that it would be unjust and unfair to the people
in Baldwin Park.
Mr. Edwin Elko, 13057 East Bess Avenue, Baldwin Park, EDWIN ELKO, 13057
stated he agreed with the gentleman who just spoke; E. Bess Ave., B.Pk.
that he also thought it was unnecessary to set a square
footage but if there was one set, in his opinion, 1,000
square feet should be the maximum; that no single house
permitted in R-3 was'too vague; that perhaps the manager
would like to live in a single house; that nine 9) feet
would be sufficient for the width of parking spaces in-
stead of ten 10) feet; that he had not been able to
obtain a copy Of the proposed commercial section of the
zoning ordinance; that in his opinion these items should
be given further consideration.
Mr. Jerry Hammond stated these problems had,been brought
up by another gentleman at the Planning Commission meetings
and the problems were completely ignored.
Mr. Elko asked about motels wherein City Attorney Flandrick
stated motels were a permitted use in the C-2 zone under
the proposed zoning ordinance.
Mr. Peter Schabarum, 109 West College, Covina, stated he PETER SCHABARUM,
had had copies of the amendments to the C-i and C-2 109 W. College,
for some two or three weeks; that the County and several Covina
of the surrounding cities required 1000 square feet per
unit and, in his opinion, this would not be an undue
requirement so far as that particular aspect.
Discussion followed between Mr. Schabarum and Mr. Flandrick
regarding procedure on Site Plan Reviews, Conditional Use
Permits and Variances.
As there was no one else in the audience desiring to speak PUBLIC HEARING
either in behalf of or in opposition to AZC-7, AZC-8 and DECLARED CLOSED
AZC-4, Mayor Morehead declared the public hearing closed. AZC-7, AZC-8 AND

City Attorney Flandrick reviewed an item on Resolution No.
64-101, Warrant Number 4527 to Hartland Hospital in the
amount of $487.90 stating there had been a problem in the
past in terms of who was responsible for the payment of
hospital claims for persons in custody of the Police De-
partment; that this particular amount dated back to 1962,
1963 and part of 1964; that he had been in contact with
the County and obtained an opinion from the County Counsel's
office which denied any liability on behalf of the County;
that his suggestion was that Council treat this matter as a
claim against the City, authorize the payment of it and at
the next meeting he and the Chief Administrative Officer
would present a memorandum to the Council of some possible
alternatives to take care of this problem in the future.

would be $.50 for the first quarter mile, $.90 for one
mile day rate), $5.00 per hour standing time; that the
time starts from the time a passenger enters the car.

No. 64-112 would authorize the execution of a contract
with Los Angeles County for Pound Services; that the
Council had received a copy of the proposed agreement
in their Agenda folders; that this was essentially the
same agreement the City of Baldwin Park had with the
County of Los Angeles previously.

Chief Administrative Officer Nordby stated that a few
weeks ago the Council had instructed him to draft a letter
to the Los Angeles County Flood Control, Board of Super-
visors and a number of cities in regard to the allocation
of the property, $200 million dollar bond issue proceeds;
that.the original allocation proposed was $485,000.00; that
the allocation now proposed was $1,460,800.00.

City Engineer Young presented Final Tract Map No. 29496
located north of Earl Avenue on Torrey Circle and Loma
Lane stating that he recommended approval of the final
tract map, also street and sewer profiles.
In answer to a question by Councilman McCaron, City
Engineer Young stated that Areo Construction had put
in a half street and a sewer line and also ran the
sewer line from the County trunk line at Frazier down
Earl past the point where they hooked in; that he could
not state definitely if they obtained a reimbursement
agreement or not; that it was suggested that the Council
require the Subdivider to pay half of this sewer installa-
tion cost which would be $1,544.50.

Commission, an application submitted by A. W. and Golda
Cole and T. A. and Mary Colwick for a change of zone
from C-I neighborhood commercial zone) and R-I single
family residential zone) to R-3 heavy multiple family
residential zone) or more restrictive use on certain
real property located at 4642 and 4646 North Maine Avenue.
Mayor Morehead stated this was one of the areas that the
Council had requested a study of the area.
Chief Administrative Officer Nordby stated this was
one of the areas under study by the Planning Consultant
and suggested that this matter be held over.
Mr. Jerry Hammond stated the Council had requested a plot
plan and elevation on this matter at the last meeting;
that the Council had been concerned with the elevation
and the parking area in the back.
City Clerk Balkus read back the motion made at the
May 6, 1964, meeting which did not request an elevation
of plot plan.
In answer to a question by Councilman McCaron, City
Attorney Flandrick stated the Council could take the
matter under submission but any further evidence that
the Council would consider would have to be by means
of another public hearing.
