The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilwoman Gregory led the salute to the flag. MAYOR MOREHEAD SECONDED. There were no objections, EXCUSED the motion carried and was so ordered by Mayor Morehead. Mayor Morehead reported that he had talked with Mrs. Taylor, who was in the hospital. 00- Mayor Morehead reported also that he had visited Planning PLANNING COMMISSIONEF Commissioner Lyle Thomas In the hospital. LYLE THOMAS IN HOSPITAL 00- Regarding approval of Minutes, City Attorney Flandrick stated that the Council was a continuing body regardless of change in membership and had the power to approve minutes of prior meetings. COUNCILMAN MCCARON MOVED THAT THE MINUTES OF APRIL 1, 1964, MAY 12, 1964 AND MAY 25, 1964, BE APPROVED AND FURTHER READING BE WAIVED, COUNCILMAN ADAIR SECONDED. The motion carried by the following vote: AYES: COUNCILMEN MCCARON, ADAIR, GREGORY AND MAYOR MOREHEAD NOES: NONE ABSENT: COUNCILWOMAN TAYLOR 00- Mayor Morehead stated that a gentleman In the audience had requested that Z-225 be taken on the Agenda at this time. City Clerk Balkus stated the public hearing on Z-225 had been closed on May 6, 1964 and had been referred to the Planning Commission for study for change to a more restrictive zone. He stated that during the public hearing before the Planning Commission the applicant had stated he would not consider anything more restrictive. Mr. H, R. Stoke, Attorney, 615 South Flower Street, Los Angeles, stated he had supplied material to the Planning staff concerning the proposed use in a less" restrictive zone and asked that that information be made available to the Council; that the less" restrictive zone could be C-I as for as the applicant was concerned. Planning Director Kalbfleisch stated that the applicant had discussed with him a neighborhood type development with possibly a service station on the corner which could be permitted with a conditional use permit subject to the property being zoned C-I. He stated that he had talked with the Planning Commission regarding both C-I and C-2; that the Planning Commission felt that C-2 use would permit too many uses within the area and would not be desirable and compatible with the general area; that the feeling was they would consider C-l; that they had not stated they would approve it but It would be subject to another hearing; that they would have to hear the voice of the neighborhood" before making any determination. City Attorney Flandrick stated If he understood the posi- tion of the Planning Commission correctly they said they were not now In a position to judge the question of commercial zoning due to the fact that It was not an issue at the time of hearing. Discussion followed that the public hearing notice of the Planning Commission did not state or more restrictive use" but that the City Council public hearing notice did state or more restrictive use". Councilman McCaron stated that another public hearing would be required for a nonconforming use in the C-i Zone If the C--1 zoning were granted. City Attorney Flandrick stated the hearings for, the C-I Zone Change and the conditional use permit could be set to be heard at the same time both before the Planning Commission and the City Council. He suggested if the Council felt that the C-I was a possibility that the City Council initiate the matter so that there would be no additional expense to the applicant as far as the zone change application was concerned. Discussion followed regarding the City Council accepting the monetary responsibility of the zone change application when the initial request was for NAP-I wherein it was brought out that the application did not Indicate or more restrictive use". Councilman McCaron suggested that In the future It might be suggested to the applicant to include or more restrictive use" on his applice tion if a more restrictive use use would be acceptable to the applicant. Mr. Stoke stated that the land use plan indicated M-1 use; that in his opinion the requirement of due process had been met because a more restrictive use could be considered by the Council whether public notice were given or not; that the area could be rezoned and In addition the applicant must file an application for a conditional use permit which they had prepared and which they would submit; that as far as public hearings were concerned particularly with respect to the conditional use permit for a service station, the people in the Continued) June 3, 1964 Page 2 P.C. City Attorney Flandrick stated that Mr. Stoke's point was well taken; that the notice before the City Council indicated what the possibilities were M-1 or more restrictive"; that the problem was that if the ordinance were adopted it could be attacked; that it was a possibility. Discussion followed that the City Council could initiate a zone change to C-1 and the applicant file for a conditional use permit. COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL INITIATE THE HEARING ON THE APPLICATION FOR THE CHANGE OF ZONE TO C-1 ON Z-225 AND REFER THE CASE BACK TO THE PLANNING COMMISSION. COUNCILWOMAN GREGORY SECONDED. Osborne regarding Tract No. 29528. City Attorney Flandrick advised the City Council that the 640 Corporation was and had been a client of one of his partners and prior to the formation of their partnership; that Mr. Halterman had been advised that he Mr. Flandrick) was the City Attorney for the City of Baldwin Park and to obviate any conflict of interest he was advising the City Council of that fact; that he felt free in advising the Council concerning the request made. City Engineer Young stated that there were two houses on Lots 14 and 15; that while they were part of the tract they faced Frazier Street; that curbs, gutters and sidewalks would be installed but he did not consider the houses al being part of the tract; that this was not the part being developed, however it was part of the land being purchased from the Osbornes. City Attorney Flandrick stated in view of the letter written by the Osbornes, if the Council desired he could bring back a corrected resolution at the next meeting and at the same time a proposed agreement would be pre- sented whereby they would formally agree to do all of necessary work within a period of ninety 90) days. COUNCILMAN MCCARON MOVED THAT THE CITY ATTORNEY BE INSTRUCTED TO CHANGE THE RESOLUTION DELETING THE IMPROVE- MENTS FOR THE TWO LOTS LOTS 14 AND 15) FROM THE TRACT MAP; THAT THE CITY ATTORNEY BRING IN A SEPARATE AGREEMENT WHEREBY THE TWO HOUSES WOULD BE BROUGHT UP TO CODE WITHIN NINETY 90) DAYS. Crowhurst for a Conditional Use Permit to allow the construction and use of a nursing and convalescent hospital in the C-2 general commercial'zone) on certain real property located at 13932 East Ramona Boulevard. City Clerk Balkus stated that the required publication, postings and mailings had been accomplished. City Clerk Balkus administered the oath to those in the audience desiring to be heard during the meeting. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission had adopted Resolution PC 64-74 recommending approval on May 13, 1964. City Clerk Balkus again administered the oath. Mr. Frank C. Crowhurst, 1585 Riviera Drive, Pasadena, stated he was the optionee-developer-of the project; that this would be a ninety-two 92) bed convalescent hospital; that the value when completed would be $700,000.00; that it would be attractively designed and would upgrade the area. As there was no one else in the, audience desiring to speak either in behalf of or i I n opposition to CP-28, Mayor More- head declared the public hearing closed. Councilman McCaron asked if there would be any adverse effect on the property all not being one unit. City Attorney Flandrick stated that in his opinion by his application covering all.of the parcels that the applicant had in fact joined them together into a single unit; that the Council could require as a condition of approval, the applicant to sign and record a covenant which would in effect join the parcels together for the purpose of this development. Planning Director Kalbfleisch palced on the wall the plan of development for a eighty 80) bed convalescent hospital. Mr. Crowhurst stated this plot plan was the original plot plan; that the plan approved was for a ninety-two 92) bed convalescent hospital. As there were no objections, Mayor Morehead declared the public hearing on CP-28 reopened. Mr. Crowhurst explained the details of the approved plot plan and Planning Director Kalbfleisch concurred. COUNCILWOMAN GREGORY SECONDED. At this time the correct plot plan was shown which had been obtained from the Planning Department. Planning Director Kalbfleisch stated that the plot plan called for ninety-two 92) beds but the Planning Commission resolution called for eighty 80) beds. Mr. Crowhurst stated he would like ninety-two 92) beds approved, however 80) beds would be acceptable. With the approval of the second Councilman McCaron amended his motion to indicate NINETY-TWO 92) BEDS AND THAT THE REQUIRED AMOUNT OF PARKING BE AVAILABLE FOR THE NINETY-TWO 92) BEDS, WHATEVER THE CODE REQUIRES". City Attorney Flandrick brought out that the plot plan showed sufficient parking for the ninety-two 92) beds. The motion carried by the following vote: AYES: COUNCILMEN MCCARON, GREGORY, ADA I R AND MAYOR MOREHEAD NOES: NONE ABSENT: COUNCILWOMAN TAYLOR 00- Councilman Morehead reported that new officers were elected at the last meeting of the East San Gabriel Valley Planning Committee; that Mrs. Elaine Hopkins, a Pomona Councilwoman, was elected Chairman and Mr. Lorne Cook, Pomona Councilman, elected Vice Chairman. 00- Regarding the Pacific Electric Railway Company Lease Agree- ment for slope and beautification purposes along Rivergrade Road, City Attorney Flandrick stated the agreement had been tentatively approved by the Council; that there were some changes in that Pacific Electric wanted a five 5) year time limit with a thirty 30) day expiration clause; that the agreement had been approved by Pacific Electric; that this agreement was necessary for the Ramona Boulevard improvement project; that the effective date would be July I, 1964. She read portions of a letter dated May 28, 1964, from Frank Ficke, Chairman of the 4th of July activities,which requested a waiver of the fees for the temporary use permit and business license. The letter stated there would be two main events, a daytime family picnic program at Morgan Park and the fireworks display to be held at the Baldwin Park High School Athletic field during the evening. Discussion followed. COUNCILWOMAN GREGORY MOVED THAT THE TEMPORARY USE) PERMIT FOR THE FIREWORKS DISPLAY BE GRANTED AND ANY FEES, INCLUDING LICENSE, BE WAIVED. COUNCILMAN ADAIR SECONDED. The motion carried by the following vote: AYES: COUNCILMEN GREGORY, ADAIR, MCCARON AND MAYOR MOREHEAD NOES: NONE ABSENT: COUNCILWOMAN TAYLOR Mayor Morehead stated that most of the surrounding cities were planning fireworks displays but he was not aware of one planned for Irwindale. As there were no objections, Mayor Morehead directed the Chief Administrative Officer to write the officials in Irwindale and invite their citizens to attend the fireworks display in Baldwin Park. He stated that on Depot the project would only include to the end of the curb returns and on Vineland the project would include curb, gutters and sidewalks on the south side of Vineland to the end of the property that faces Chevalier. City Attorney Flandrick stated there was a problem with the petition; that there was no indication in the petition as to what exactly the work would consist of. He stated this was a hardship situation in that the property owners in this area had gone to the trouble of circulating a petition not once but twice; that he suggested between now and the next Council meeting that individual copies be sent out to each party who signed the petition with the correct information in the petition and ask them to resign and submit the petition to the City Engineer*s office and at the next meeting a resolution of intention to commence the district could be presented. Mr. Doyle Ted Lackey, 14553 East Chevalier Avenue, Baldwin Park, stated that three petitions had already been circulated; that the first circulation of a petition was on December 20, 1960. He brought out that the power poles would have to be moved; that in his opinion the Edison Company would have to secure an easement from each property owner; that all of the property owners he had talked with in the area would be glad to sign the easement to have the poles set inside the property instead of out in the street. City Attorney Flandrick stated the Edison Company would not locate outside of the existing right-of-way unless they have easements; that their policy was, at their expense on a street program of this kind to relocate at no expense to the City if there is sufficient right-of-way; that this should be done in advance or as a part of the district. City Engineer Young stated he would be most happy to contact Mr. Perry of the Edison Company Thursday, June 4, 1964. He stated there was no parkway; that this was a very narrow street; that Mr. Lackey and he had discussed placing the poles approximately one 1) foot inside the property line making them about six 6) inches from the sidewalk• that in his opinion the ground was such that they could trench over and slide the poles over and there would not be much cost. Mayor Morehead asked the City Engineer to prepare a letter explaining to the property owners why the signatures were required again. City Attorney Flandrick recommended against any affirma- tive action at this time and stated that the petition and necessary resolution could be presented at the next Council meeting. Mayor Morehead stated that this matter would be held over until the City Council had the necessary legal documents. Mayor Morehead commended Mr. Lackey for his leadership and time spent in getting this petition signed and pre- sented to the City Council. Mr. Lackey suggested that there be some department in the City where citizens could get the technical information re- quired in such a matter. Mr. Lackey commented that the petition the same proposal before the City Council now) submitted in 1960 was rejected by the former City Council because of the width of the street; that the Council wanted the property Owners to dedicate another five 5) feet of property on the east side of the street; that the lots were only one hundred twelve 112) feet deep on the south side of Chevalier Street; that the people who signed the petition had spent a combined total of over three hundred fifty 350) years on that street; that the property onwers indication to him was that the people had tried since the year one" to get curbs and gutters; that on March 18, 1964; a petition was pre- sented to the City Council. Mr. Lackey complimented City Engineer Young on his drawing and the help he had given. Mayor Morehead stated, in his opinion, the technical information regarding this matter should be given by the Engineering Department. He stated, in his opinion, the City should go along with their recommenda- tion. He also pointed out the location of the changes requested on a map. The changes pointed out were on Ramona Boulevard, Virginia Avenue and Francisquito. City Attorney Flandrick conmented that he would like to go over the proposed change order; that the City could not at this time include any property in the sewer dis- trict that was outside of Baldwin Park. Discussion followed wherein City Engineer Young stated that the cost of the proposed change in the area adjacent to Walnut Creek westerly of Virginia Avenue would be approximately $25,000.00 plus the cost of right-of-way that might be needed. Councilman McCaron commented that there were siphon problems on the County lines. City Engineer Young stated his recommendation was that the City concur with the Flood Control on extending the 2400 feet of 10") sewer line from the end of Virginia Avenue along the wash and extending through County terri- tory to the trunk line on Baldwin Park Boulevard and Bess Avenue, if the right-of-way'could be obtained and if it was-within the legal bounds. Chief Administrative Officer Nordby suggested that the City Counci.1 defer any action until it was determined how much there was in the contIgency fund. City Attorney Flandrick suggesteA that the patters be considered as separate items in a single change order hearing. Chief Administrative Officer Nordby stated that the problem on Francisquito was in the process of being solved at the present time. He stated under this design there could be twenty-four 24) lots; that this would still maintain approximately two hundred-twenty 220) feet in property for commercial development. He stated that the Planning Commission had seen this proposed development map but he had not talked with the applicant regarding this map. Planning Director Kalbfleisch stated the Planning Commis- sion had upheld its original recommendation'of denial of the proposed zone change from 4-3 to M-I. Councilman McCaron suggested that the applicant be shown the proposed development design and see if the applicant had any alternate suggestion. Mr. Colwick stated that the Planning Commission had indicated they would be agreeable to changing the back portion to R-3 if the C" zone now existing in the front was left as is; that this would be agreeable with them; that it was denied by the Planning Commission because they did not feel that the C" zone should be split up on Maine Street. Councilman McCaron stated he did not think it was necessary to retain C-1; that there was R-1 development across the street and the church property was next door. He suggested possibly denying the application as it was and an application be filed taking in the rest of the area or get some indica- tion from the rest of the property owners as to what they would like. REPORT ALSO ON RAMON/ AT PUENTE 00- i Councilman McCaron stated he would like the Council to give some thought to a program of constructing sidewalks throughout the City on whatever could be done with avail- able funds as they accrue; that perhaps have a program of developing sidewalks on one side of the street initially, principally starting in the vicinity of the schools and working away from them, and then when one side was completed start a program taking in the other side; that possibly some of the money spent on tie in paving could be spent on sidewalks; that perhaps a design could be worked out whereby there could be considerably more mileage by changing the design taking into considera- tion on the older streets where improvements were close to the street center and the street needed widening rather than having a parkway have the sidewalk next to the curb. Schabarum, 109 West College Street, Covina, stated with regard to procedure that the City Attorney and he knew that the item just acted upon Z-195) was going to be before the Council two weeks ago and asked why the new members of the Council did not have the material they needed to examine; that he had been impressed with the attention given and the work the new Council had accomplished in the past two months; that he was discouraged and he felt that a disservice had been rendered to those involved in trying to accomplish something in the south part of the City. He stated he wanted to submit for the Council files some resumes of the zoning actions and so forth that he had submitted for the Planning Commission files material not handed to Council at meeting). Mayor Morehead explained that the Council was now con- sidering C2A. Councilman McCaron stated the Council had acted to change the ordinance to read C2A" and regardless of whether or not the Council had the material the City Attorney mentioned the Council had gone as far in their action this evening as they could at this time.
