FLANDRICK Superintendent of Building and Safety which indicated this REVIEWED REPORT FROM was a civil matter between the adjacent property owners. SUPT.OF BLDG. AND Mr. Flandrick indicated that this was not something the City SAFETY INDICATING THIS was responsible for and no action was necessary. He stated he had asked for a recap of TOMORROW each of the talks given at the conference. PROJECT) Mr. Henry Littlejohn, President, Valley View Mutual Water Hpl LITTLEJOHN Company, stated his company was presently negotiating a PRES., VALLEY VIEW new contract with Mobile Oil Company regarding the removal MUTUAL WATER CO. and reconstruction of an existing service station at the southwest corner of Los Angeles and Merced; that the existing service station had been there approximately twelve 12) years; that if the conditional use permit for RE DEDICATION OF the service station was granted his company was willing RIGHTS-OF-WAY to agree to the City's acquisition of the rights-of-way MERCED AND L.A. IF on Merced and Los Angeles If the City would construct CITY WOULD CONSTRUC curbs, gutters and sidewalks along the street frontage CGS of the property; that two studies had been made regarding the best use of this land, one by the 01i Company and one by Valley View Mutual Water Company; that both had Indicated a service station use would probably be the best use of this area at this particular time. He pointed out the uses of the adjacent properties and that an on and off ramp of the freeway proposed at Los Angeles Street would carry a tre- mendous amount of traffic which showed a great potential. MAILINGS I Planning Director Kalbfleisch presented a resume of the RESUME case and stated that the Planning Commission had adopted Resolution No. PC 64-73 denying this case on May 13, 1964. TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHALF MAYOR MOREHEAD, Minute Clerk Langseth again administered the oath. OATH AGAIN ADMiNISTE Mrs. Charles Marshall, 3761 Vineland Avenue, Baldwin MRS. CHAS. MARSHALL, Park, stated in their application they had asked for 3761 VINELAND AVE., R-3 or greater use"; that the Planning Commission had B.PK. brought out the point that it would overload the street; that their property adjoined Pacific Avenue and the traffic would not all have to go down Vineland; that the Planning Commission had stated the Building Code did not allow them enough control over the kind of build- ings that went up; that they as property owners had no control over changing the Building Code; that R-2 would allow them them to make greater use of their land. TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR TESTIMONY IN OPPOSIT BY MAYOR MOREHEAD. Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park, MRS. FAYE HICKEY, indicated there were already several areas zoned for 14322 GAGE ST.,B.PK. apartments which were undeveloped; that her advice was to think about it until the areas now zoned for apart- ments were developed and then go from there". Councilman McCaron stated the fact that the lots were RE WIDTH OF VINELAND deep did make them difficult to Improve; that there were AVENUE single houses on the street adjoining; that there was not sufficient area for another street to go In between so that they could have development on both sides; that the street was a through street and developed as a sixty 60) foot street with forty 40) feet of paving; that it would appear to him that the street itself should be the primary thing that would have to be considered before more dense development could be allowed on Vineland; that Vineland provided access for some streets which only had access to Vineland; that some thought should be given to the type of development that could go on Vine- land, however, before that was done, in his opinion, the people themselves should decide what they want on Vineland and try to make preparation for It through widen- ing of the street to take care of traffic. In answer to a question by Councilwoman Gregory, Planning Director Kalbflelsch stated the application did state R-3 or more restrictive use. Mr. Kalbfleisch stated he had made a study of this general area; that he felt with an R-2 development the potential dwelling occupants would be increased approximately 900 within this general area and the street right-of-way would be increased with 1500 cars additional load; that the street was only a sixty 60) foot right-of-way and thirty-five hundred 3500) feet in length before any outlet; that the survey Indicated R-2 would be undesirable until the street was widened. He asked where the buffer zone was going to be; that in his opinion Vineland was an ideal place for R-3 zoning particularly with the plans for a park in this area; that If the taxpayers money was to be spent for parks In this vicinity this was where multiple dwellings should be. Councilman McCaron stated he believed he had stated the cutting off point in the statement when he said that the street was too narrow for intensive development. Councilman Bishop stated then Councilman McCaron felt that there should be no R-3 development on sixty 60) foot street. Councilman McCaron agreed and stated that the Council had turned down-one zone change case approximately two or three weeks ago where the same condition existed. Councilman Bishop stated, in his opinion, secondary highways were better for multiple development. As there was no one else In the audience desiring to speak either in behalf of or In opposition to Z-230, Mayor Morehead declared the public hearing closed. Councilman McCaron asked if the applicant was shown this development plan wherein Planning Director Kalbfleisch stated yes that the applicant felt this would be a good development but he would propose R-2. As there was no one in the audience desiring to speak either in behalf of or In opposition to Z-231, Mayor Morehead declared the public hearing closed. COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL CONCUR WITH THE FINDINGS OF THE PLANNING COMMISSION AND DENY ZONE CASE Z-231. COUNCILWOMAN GREGORY SECONDED. Discussion followed regarding retaining the property as one parcel for development wherein the City Attorney stated this could be done if the property owner was willing to sign a covenant to hold it as a single parcel; that the matter could be continued until the next meeting and in the interim ask Mr. Kalbfleisch to con- tact the applicant and ask if he would be willing to sign such a covenant and to appear at that meeting. Mr. Jerry Hannond, 14022 Ramona Boulevard, Baldwin Park, stated he was one of the people Involved in the zone change; that Mr. Kalbfleisch had mentioned that the water plant in the back was setting in the middle of a proposed street upon which they proposed to build; that the water plant would be expensive to remove and the water district would not be inclined to do this. There were none. City Attorney Fiandrick commented that the Chief Engineer for the State had come out and reviewed this project with Mr. Nordby, Mr. Glenn Welch and himself. Regarding the Los Angeles Street Project, Mr. Fogle stated he had been under the impression that the plans and specifications for this project had been submitted to the State but he had found out that they had never been submitted and that he had now submitted them. Discussion followed as to whether or not Los Angeles Street could be coordinated to where the improvement on Los Angeles Street would follow immediately after the sewers were installed on the balance of it or whether it would be just as well to make it into two contracts. Assistant City Engineer Fogle stated considering that the condemnations were not complete and the plans had not been approved, it was his opinion that this could be coordinated as one complete project. 00- Discussion followed regarding the complaints received on the clean up portion of the sewer districts. City Attorney Fiandrick brought out that the ten percent i0%) retention could be held until the clean up was accomplished. The Council asked that the Chief Administrative Officer speak to the contractor regarding the fact that the City was was not satisfied with the clean up. City Attorney Fiandrick commented that Mr. Nordby had advised the consulting engineer to have a representative of Vella Construction at the Council Meetings of July 15, 1964, and August 5, 19E4, at which time change orders were to be considered, and the clean up matter could be dis- cussed at that time If the Council desired. 00- Assistant City Engineer Fogie reviewed his report on the Civil Defense generator Unit and recommended that the generator be located on the east side of City Hall near the south end of the building and that the City Council take the necessary action to appropriate the additional $1,000.00 necessary to locate the unit. Discussion followed that this generator would cut in automatically If the power failed; that the chain link fencing and covering would be done by City forces; that this would require a budget amendment by resolution.
