the life insurance rates would decrease from $,75 per thousand
to $,69 per thousand; that the City could ask for a decrease
in the medical insurance but it was his recommendation that
the City continue with the present rate in order to build
up the reserve.

Councilman McCaron stated he had contacted the Board of
Directors of the Werner Tract Mutual Water Company; that
the latest word he had was that Mr. Hyndman's meter had been
sanded up; that in the past year this company had re-
organized and had been borrowing money and putting in
facilities to improve their water service.

he was speaking in behalf of the Baldwin Park Improvement
Association regarding the matter of the money which the
City has set aside for the Chamber of Commerce; that it
was the feeling of the association that the City should
modify the contract and should restrict the payments'to
items which benefit the City, not underwrite the Chamber
of Commerce with a blank check,

Regular Meeting of the Baldwin Park City Council
Planning Director KalbfJelscb presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No, PC 64-86 recommending approval of this case
on June 24, 1964.
Councilman McCaron stated in view of the number of applica-
tions in this area for R-3 zoning that there should be
a hearing held on a change in the General Plan.
As there was no one in the audience desiring,to speak,

Planning Director Kalbfleisch stated there would be
considerable loss of property on 50 feet; that it could
be much better developed if it were 54 feet.

City Clerk Balkus announced that it was the time and
place fixed for the continuation of a public hearing
on CP-14, an application initiated by Baldwin Park
Planning Commission to initiate action pursuant to the
revocation of Conditional Use Permit Special Use Permit),
Case Number Z-86, Baldwin Auto Wreckers, for noncompliance
of conditions as set forth in Resolution No. 61-167. The
property is located at 5048-5056 N. Merced Avenue.
Planning Director Kalbfleisch reviewed his report
dated April 15, 1964 and updated to July 15, 1964.
City Clerk Balkus readministered the oath.
TESTIMONY IN OPPOSITION TO THE REVOCATION OF THIS
CASE WAS CALLED FOR BY MAYOR MOREHEAD.,
Mr. David C, Marcus, Attorney, 215 West Fifth Street,
Los Angeles, stated there was at the present time a
five hundred gallon tank on the property that had been
used to store water and the gravity flow, he understood,
would be sufficient to take care of the fire hazard.
Planning Director Kalbfleisch stated that this would
have to be approved by the Fire Department.
Mr. Dennis Irving, 810 Via Escalata, Glendora, stated
there was a two inch opening at the base of the tank;
that the hose was not presently hooked up but it could
be.
Mr. Marcus stated that the block wall that was installed
was the entire length of the street 650 feet).
Mr. Irving commented that the corrugated tin had been
replaced.
Mr. Marcus stated with reference to any further construc-
tion of the block wall that in view of the fact that
the activity was all enclosed at the present time it was
requested that this condition be deleted.
Mayor Morehead stated that the City Attorney had suggested
that the public hearing not be closed and be continued
until the next meeting until some of the items were settled.
There was extensive discussion and review item by item
of Resolution No. 61-167 as to what had been complied
with and what had not.
City Attorney Flandrick stated that a formal resolution
would be drafted setting forth the findings of fact made
by the City Council.

City Clerk Balkus stated that proper publication had been PUBLICATION
accomplished.
Mr. James Simms, Ivor Lyons & Associates, 9763 W. Pico JAMES SIMMS, IVOR
Boulevard, Los Angeles, California, stated that the County LYONS & ASSOC.,
Sanitation District had directed them to consider two methods 9763 W. Pico Blvd.,
of serving this area Virginia Avenue); one would be to L.A.
construct a 2400 foot line and the other to provide a pump
station; that pump stations were expensive and did require
maintenance; that they had designed a line which was composed
of 1200 feet plus a ten-inch line, a jacked section and'
the balance of the line becoming eight inches; that in
the process of doing this they had modified this proposed
or designed line on Virginia Avenue from a ten to an
eight; that this line would tie into an existing line
which had already been constructed at the intersection
of Bess Avenue and Baldwin Park Boulevard; that the cost
for modifying this line as they had determined and out-
lined here was approximately $20,089.00,
Mayor Morehead asked what the cost and upkeep annually
of the pump station would be.
Mr. Simms stated he did not have the figures on maintenance
and operation; that the cost would be quite similar; that
one advantage in having this line installed as they had
shown it would open properties in here zoned M-l.
Mayor Morehead stated it was his understanding that'the
plans for Sewer District 62-A-1, which was now under
construction, were submitted to the County Sanitation
District and they accepted these plans up to the time
the district started construction; that it had been
in the last two or three months that the Sanitation
District had ruled that this line should not be
designed according to the original design.
Mr. Simms stated they had two letters from the County
Sanitation District; that perhaps they had taken some
time themselves to analyze the hydraulics in the siphon
structure; at some during a heavy rain storm this 42
inch line could possibly back up and if it did there
would be a condition where there might be some spillage
back here at the terminus of this originally designed
line on Virginia Avenue; that they had designed the
line oversize purposely so that in case of this condi-
tion they would have a certain period in there before
this spillage occured; that they again went to the
County and offered to put in a check valve and perhaps

an automatic shut off valve at this point here still desiring,
of course, to take the shorter route to serve this area;
that finally they put their foot down and stated they
recommended to go one of two ways.
In answer to a question by Mayor Morehead, Mr. Simms
stated that the County Sanitation District accepted all
drawl ngs, except the particular case on Virginia Avenue;
that they had never given them the authorization to
go into that line; that they had pressed the Sanitation
District on that matter and finally did get them to put
in writing these two recommendations.
Regarding Item No. 2, Mr. Simms stated if they were
authorized to construct this line in here" they would
not require this 460 lineal feet of sewer line; that
in designing this line" they would eliminate a ten-
inch line in here" and replace It with an eight inch
line; that thi~sltepresented a $8,806.00 credit; that
they-had already calculated the difference in prices to
establish the $20,000.00 fee>fqr revision of the entire
project; that this did include engineering fees and other
things with the exception of the necessary right-of-way
required.
City Attorney Flandrick stated, there would be an addi-
tional savings of approximately $900.00 in the present action in terms of the
acquisition of right-of-way.
Mr. Simms stated that the line off of Foster Avenue
serves a new subdivision, No, 29528; that the length
of the line was 228,19 feet; that it would require that
length of sewer pipe, eight inch diameter, and two
additional manholes; that the cost was approximately
$1,700.00.
City Attorney Flandrick stated that this tract was
approved approximately one year ago; that this
particular tract was Included in the assessment district
but it was not served with any sewer line.
Mr. Simms stated that this subdivision came into
being long after the design program had been
completed; that it came to their attention about
three months ago; that this would also open up an
adjacent parcel in this area here" which he did
not believe was presently developed.
Councilman McCaron asked what was the saving by the
deletion of the 400 feet of sewer line.
Mr. Simms stated that the total savings including revising
the line on Virginia Avenue was $8,806.00; that it was
$8.15 a foot savings for 460 feet; that the $20,089.00
includes revising the ten-inch line to an eight inch line
and deducting the credit of the 460 foot line; that the
entire cost of this project would be $28,313.00.
Councilman McCaron stated That's for the 2400 lineal
feet".
Mr. Simms answered That's right sir".
In answer to a question by Councilman McCaron, Mr.
Simms stated they had just completed the latter part
of last week'a survey on this area and they had sub-
mitted to Mr. Vella the break-down as follows: 1240
ft. of 10 inch line; 1125 ft, of 8 inch line; 30 ft.
of jack'section; and 8 standard manholes, that they had
asked Mr. Vella for the unit cost on these items; that
they were, of course, higher than the breakdown on his
original contract; that Vella had taken the average
depth of all the lines in 62-A-1 in preparing his bid;

Mr. James Gibson, 13268 Francisquito, asked if the plans JAMES Q. GIBSON, 1326
for Sewer District 62-A-1 were submitted to the County Francisquito
Sanitation District.
Mr. Simms answered yes; that the plans were approved with
minor requests for revision; that if the Council approved
the changes before them the plans would be submitted to
the County Sanitation District for final approval.
Mr. Gibson stated, in his opinion, the City Council
should not have accepted the plans if they had not had
final approval by the County Sanitation District.
Mr. Letcher Bishop, 3918 Harlan Avenue, stated there LETCHER BISHOP, 3918
had been money provided for in the contingency fund Harlan Ave., B.Pk.
to make changes of this type; that he wanted to know
why the subdivision addition was being made.
City Attorney Flandrick stated there was a question in
his mind as to whether or not this was a proper charge
against the District; that in his opinion in all fairness
to the district that this should be charged against the
Sewer Maintenance Fund or the General Fund.
Mr. Bishop stated that all of this,land should have been
assessed at the time the sewer district was developed;
that the cost should be borne by the subdivider not out
of the contingency fund.
Mayor Morehead stated it was his understanding that the
land had been assessed but it was an engineering error
that this line was not designed to be put in until the-
present time.
In answer to a question by Mayor Morehead, City Attorney
Flandrick stated it was his belief on his best information
that the problem-occurred by the failure of the Engineering
Department to require, as one of the conditi-ons of
approval of the tract in addition to the dry sewer system
in Rockway-Drive, that he construct this line; that the
tract had been finaled and it was too late to require this
line to be constructed by the subdivider; that his recom-
mendation was that it not be made a charge against the
district.
Discussion followed that this should be set forth in
the Code so that i't would be automatic and not leave
room for human'error wherein City Attorney Flandrick
stated that Mr. Nordby, Mr. Simms, Mr.. Lyons, Mr. Martin
and himself had had a meeting last Friday; that their
suggestion would be in the next district that the date
of the hearing to approve the district would be the cut
off date for any lot split or subdivision; that after
that date the staff would then recommend to the Council
that a-complete dry sewer system be installed and that
there be sufficient lines installed by the subdivider
so that there would be no cost to the district.
Mr. Simms commented that the topography of this area
prohibited them from running a line back down Rockway
Drive; that the shortest route was the route they had
depicted on the drawing; that the route was through an
easement that a storm drain would share.
City Attorney Flandrick stated there would be no improve-
ments other than lawn on the easement.

Mr. Simms stated that the fee involved was in designing
the 2395 feet of I i ne.
Mr. Bishop stated that the cost should come out of the
Contingency Fund not the General Fund.
Mr. Gibson stated he would like a further investigation
of this; that he was not satisfied that the Engineering
Departmentmade the mistake; that he wanted to know whether
Ivor Lyons and Associates brought this to the attention
of the Engineering Department before the Council was
asked to approve Sewer District 62-A-1; that if necessary
this cai*'l'ed for a Grand Jury investigation; that he wanted
an answer.
Mayor Morehead asked-Mr. Simms if at the time that this
appeared to be a problem in the future was Mr. Young
aware of this problem.
Mr. Simms answered yes sir"; that he accepted" along
with the County and himself to use the shorter route; that
they had thought up until recently that they would be
able to use the shorter route; that finally the County
said use the longer route or the pump station.
Mr. Gibson stated he wanted the dates that Mr. Young
left the employ of the City and went with Ivor Lyons-and
then the;dete.he returned to the:City employ.
Mayor Morehead stated that Mr. Young was in the employ
of the City at the time the plans for District 62--1
were approved.
Mr. Gibson asked if Mr. Young was aware that the'County
Sanitation District had not approved finally the plans.
Mr. Simms stated yes he was; that again this was a period
of time after the plans had been approved by the City
Council that they continued negotiation or discussions
with the County Sanitation District; that Mr. Young in
his preliminary design attempted to save the City the
extra money on this extra length of line.
Mr. Gibson stated that it would seem to. him that Mr.
Lyons had deliberately deceived this City Council on
Sewer District No. 61-A-I and'it seemed to him that
he had made another attempt to deceive this Council
on Sewer District No. 62-A-1.
Mr. Elko asked if the Contingency Fund was exhausted.
It was brought out that there was approximately $30,000.00
left.
Mr. Elko stated in his opinion Ivor Lyons or Mr. Young
had properly foreseen the necessity of possibly taking
the longer route and the Contingency Fund was set up
in the amount that it was for this reason.
Mayor'Morehead stated he did not believe there had been
an error made in engineering as far as Ivor Lyons was
concerned but he did not recall at the time the plans
were recommended for acceptance by the City Engineer
that this was mentioned.
Mr. Bishop stated in his opinion members of the governing
board should discuss the problem with Mr. Parker of the
County Sanitation District including the possibility of
hooking onto Sanitation District No. 15 line.

Mr. Gibson askgd if he could hear the letter from the'
County Sanitation District.
Mr. Simms stated he had Plan letter; that this letter was
in reply to a letter sent by the City Engineer, Mr. Young.
He read the letter in full which was.from the County Sanita-
tion District of Los Angeles County dated May 28, 1964;
reference Sewer District 62-A-I.
Mr. Simms stated that the topography in this particular
area was quite critical; that the problem in this
particular case was the siphon structure; that eventually
when this area developed that this was M-l and the
businesses would contribute to the cost of the length
of the sewer.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to the proposed
changes in the work for 62-A-I, Mayor Morehead declared
the public hearing closed.
Discussion followed wherein Chief Administrative Officer
Nordby stated regarding Item No. 3 that the action would
be to delete this item from the resolution in order to
come back with a recommendation as to what fund this
should be taken from.

Planning Director Kalbfleisch presented a resume regarding
Z-229, continued from July 1, 1964, an appeal from denial
of the Planning Commission, an application submitted by
John B. Danis. for a change of zone from C-I neighborhood
commercial zone) to R-3 heavy multiple family residential
zone) or more restrictive use on certain real property
located southeast of Puente Avenue and northeast of the.
Alexander's Market. He stated that. on June 2, 1964, the
Planning Commission reaffirmed their recommendation of
denial.
In answer to questions by Mayor Morehead, Mr. John B.
Danis, 322 Avenue I, Redondo Beach, California, stated
his present plans were to still request a change from
C-1 to R-3; that together with Mr. Jefferies he owned
Alexander's Market and the property between the Market and
Francisquito; that this was approximately 245 feet of
frontage to be developed commercially.
