Mayor Morehead stated the proposed parking district was
the area directly in front of the City Hall and north of
the flag pole area; that Larry Brown had informed him that
the store owners had tentatively agreed to modernize the
rear of their stores if the parking district was approved.
Discussion followed wherein City Attorney Flandrick stated
he thought the Parking District Act of 1943 would probably
be the Act the Council would want to use; that any study
the Council directed the staff to make should bear in mind
that the maximum that could be spent on acquisition and
improvements was an amount equal to 35% of the assessed
value of the property in the District that would be bene-
fited; that over and above that the only increase that
could be made would be a contribution from the General
Fund; that preliminarily the Council would decide which
property would be benefited; that secondarily the Assess-
ment Engineer would; that the Parking District would belong
to the City; that the City Hall could be included in the
District; that the City would then have to pay its pro-
portionate share of the assessment.
Discussion followed regarding a study of this matter.
In answer to questions by the Council, Mr. Larry Brown
stated he was not a member of the Chamber of Commerce
and would not be willing to serve on the committee; that,
in his opinion, the City Hall should handle the matter;
that the City had experienced help; that only a feasibility
study was being requested; that they did not want anything
done that would cost money; that they wanted expert work
on it and, in his opinion, the City should do it.

Regular Meeting of the Baldwin Park City Council
Deputy City Clerk Langseth announced that the hour of
8:00 p.m. having arrived that it was the time and place
fixed for a public hearing on Z-243, an application sub-
mitted by Eugene M. Gilmore for a change of zone from
R-2 light multiple family residential zone) to R-3 heavy
multiple family residential zone) or more restrictive use,
on certain real property located at 3834 Foster Avenue.
Proper publications, mailings and postings had been
accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No. 64-98 recommending approval of this case
on July 22, 1964.
Deputy City Clerk Langseth administered the Oath to those
in the audience desiring to be heard during the meeting.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD.
Mr. Wallace Hanna, 841 South Hollenbeck, West Covina,
stated he would let his testimony in front of the Planning
Commission stand as his testimony.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition to Z-243,
Mayor Worehead declared the public hearing closed.
City Attorney Flandrick stated if the zone change was
approved the area striped in pink which was formerly
designated as P" Zone would also be rezoned to R-3
because of a provision of the Code presently which
stated that any unzoned property or any property not
designated in a particular zone recognized by the Zoning
Ordinance automatically takes on the zoning of the
property which immediately abuts it.
ORDINANCE NO. 375

Discussion followed that the Council could not require
the applicant to install a fence as a condition of
approval; that the Site Plan Review on all R-3 develop-
ments required a fence, obscuring wall or hedge around
the recreation and trash areas.

Regular Meeting of the Baldwin Park City Council
Deputy City Clerk Langseth announced that it was the
time and place fixed for a public hearing on Z-245, an
appeal from denial of the Planning Commission, an
application submitted by E. A. Rollins and E. C. Patterson
for a change of zone from R-I single family residential)
zone) to R-3 heavy multiple family residential zone) or
more restrictive use, on certain real property located
at 3125 and 3131 Big Dalton Avenue.
Proper publications, mailings and postings had been
accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No. PC 64-100 denying the request on July 22,
1964.
Deputy City Clerk Langseth read in full a letter from E. A.
Rollins dated July 27, 1964.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR
BY MAYOR MOREHEAD.
Mr. Tom Visa, 1932 East Garvey Avenue, West Covina, stated
he was speaking in behalf of Mr. Arthur Ryan, property
owner at 3111 Big Dalton Avenue; that Mr. Ryan owned
a lot two lots south of the property that was being
discussed at the present time. He passed to the Council
a plat map of the area; stating that if Mr. Rollins'
property was rezoned and subsequently developed as a
multiple he would imagine it would eliminate Mr. Ryan
from developing; that Mr. Ryan did not have any objection
to the rezoning if they could get an exception or a
variance to develop a single story development; that
Mr. Winblatt was also in the audience; that Mr. Winblatt
owned the first property to the south; that he had two
single units on his property; that Mr. Ryan and Mr.
1°linblatt had single family dwellings; that the dwellings
were not old enough that they could afford to tear down
the structures and develop a multiple.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD.
Mr. E. A. Rollins, 3947 Big Dalton, Baldwin Park, stated
the other man that was up here said adjacent property
had R-3 zoning already; that he was wanting to develop
as R-2; that there were two story buildings four blocks
away that did not have any effect on the surrounding
properties.
In answer to a question by Councilman Morehead, Planning
Director Kalbfleisch stated the only way Big Dalton could
be widened would be to condemn the property or have the
property owners make an offer of dedication; that Vineland
was sixty 60) feet.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-245, Mayor
Morehead declared the public hearing closed.
Discussion followed that the R-3 zoning to the south had
been there for some years; that a sixty 60) foot street
would be desirable.
As there were no objections, Mayor Morehead reopened the
public hearing on Z-245 for further testimony.

Mr. E. A. Rollins stated there was no through traffic
on Big Dalton.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-245, Mayor More-
head declared the public hearing closed.
Discussion followed that if this was approved there
would be no buffer between R-I and R-3.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL CONCUR
WITH THE FINDINGS OF THE PLANNING COMMISSION AND THAT
Z-245 BE DENIED AND THAT THE CITY ATTORNEY BE DIRECTED
TO PREPARE THE NECESSARY RESOLUTION. COUNCILMAN CRITES

intent of the Baldwin Park Planning Commission to initiate
a change of zone from A-I light agricultural zone) to
R-I single family residential zone) or more restrictive
use for all properties presently within the hereafter
described boundaries: Ramona Blvd. on the north; Syracuse
Ave. on the west; Salisbury St. on the south; and the Los
Angeles Department of Power and Water Power Line on the
east.
Proper publications, mailings and postings had been
accomplished.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No. PC 64-101 recommending approval of this
case on July 22, 1964.
At 8:40 p.m. Chief of Police Best arrived.

arrived, this is the time and place fixed for the
hearing on the Resolution of Intention for the Chevalier CHEVALIER DISTRICT
District 1964, being Resolution No. 64-153 of the City 1964
of Baldwin Park.
Deputy City Clerk Langseth presented the affidavit of
Publication of Resolution No. 64-153, affidavit of posting
Notice of Improvement, affidavit of mailing Notice of
Improvement and Statement regarding recordation.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL ACCEPT AFFIDAVITS ACCEPTED
THE AFFIDAVITS AND ORDERED THEM FILED. COUNCILMAN CRITES AND ORDERED FILED

Special Counsel Charles Martin stated this was a proceeding
under the 1911 Act to improve Chevalier Avenue and abutting
streets by surfacing, curb, gutter and other improvements;
that it was a decision and announcement of the City Council
to make the improvements and the Council had previously
determined to hold a public hearing to determine whether
a district should be created and if created what the
boundaries of that district should contain for the
particular improvement proposed; that this was a project
and an improvement of local benefit and not primarily
of City wide benefit otherwise the matter would be improved
by General Funds or by Gas Tax Funds whichever would be
applicable and appropriate in this particular case; that
the proper notices have been mailed out and the hearing
was properly held at this time to determine the matter;
that the hearing was held for the purpose to decide whether
the improvement should be made, to decide whether a district
should be formed to pay for it and to determine what the
limits or boundaries of the district should be; that the
hearing was not held for the purpose of determining what
each item or each parcel of property within the proposed
district should pay but only to determine what the district
should pay as a whole; that a hearing would be held at a
subsequent date to determine how the ultimate amount or
eventual amount of money expended should be then apportioned
among the properties; that protests were eligible for filing
up to 8:00 p.m. this evening.
Mayor Morehead asked if any written protests had been WRITTEN PROTEST
received.
Deputy City Clerk Langseth read in full a letter from LETTER FROM EDWARD
Edward Lowers, 15112 East Nubia Street, Baldwin Park, LOWERS, 15112 E.
dated August 11, 1964, stating he was the owner of the Nubia St., B.Pk.
property at 14503 Chevalier Avenue and protested the
construction of sidewalks.
Mayor Morehead asked if anyone wished to make an
oral protest.
Deputy City Clerk Langseth administered the oath. OATH ADMINISTERED

stated he had no objection to the district itself, only 15112 E. Nubia St.,

sidewalks repaired by making arrangements with the
contractor who would eventually get the contract for the
curbs and gutters couldn't they; that his sidewalk was
good.
Assistant City Engineer Fogle stated the plan was to
remove all existing sidewalks and install curbs,
gutters and sidewalks adjacent to the curb; that it
was necessary in this case because of the restrictive
width of the street where there was only forty 40)
feet total right-of-way.
As there was no one else in the audience desiring to
speak either in behalf of or in opposition, Mayor
Morehead declared the public hearing closed.
City Attorney Flandrick stated that the single protest
filed would be much less than 50% protests.
Mr. Ted Lackey, 14553 East Chevalier Avenue, Baldwin Park,
stated the only question seemed to be when would the work
be done.

Special Counsel Charles Martin stated this completed the
matters on this particular district for tonight; that the
notice inviting bids would now go out for bid returns on
September 16, 1964; that at this time they would be
read and considered by the Council and the contract
awarded; that it was estimated that the completion date
would be sixty 60) days after September 16, 1964;
that on or about November 16, 1964, there would be
another hearing to determine the final costs and to
apportion those costs among the parcels within the
district.

Chief Administrative Officer Nordby reviewed his report
on the bid opening on August 5, 1966, for the Baldwin
Park Boulevard Improvement, Gas Tax Project No. 8, stating
the City was faced with one problem when they considered
the bids concerning the cost of relocating certain water
lines in the right-of-way; that the Board of Directors
of the Baldwin Park County Water District had had a special
meeting this morning and the Council had before them copies
of the proposed agreement. He stated that Mr. Harold
Johnson, Acting City Engineer, had recommended that the
award be made to Hess Construction Company Incorporated
for the sum of $203,272.83. He further stated that some
time ago the Assistant City Engineer had notified the
utility companies of the City's intention to proceed with
this project; that there was a problem with the communica-
tion lines for General Telephone; that General Telephone,
in a letter to the Assistant City Engineer, had indicated
their new cable would not be delivered for approximately
ninety 90) days.
City Attorney Flandrick stated the contractor was aware of
the position taken by General Telephone; that the General
Counsel of General Telephone had been contacted and told
that there was no need for a ninety 90) day delay; that
the General Telephone Company was under a state wide
franchise for the use of streets but could not interfere
to this extent; that he suggested that the Council feel
free to proceed with the award of the bid without regard
to this problem; that if this matter could not be resolved
verbally he would advise the Council at the next meeting
as to their legal rights.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL AWARD THE
BID FOR THE BALDWIN PARK BOULEVARD PROJECT, BEING PROJECT
NO. 8, TO HESS CONSTRUCTION COMPANY, INCORPORATED IN THE
TOTAL AMOUNT OF $203, 272.83 AND AUTHORIZE THE MAYOR AND
THE CITY CLERK TO EXECUTE THE AGREEMENT BETWEEN THE CITY
AND HESS CONSTRUCTION COMPANY, INCORPORATED AND TO DENY
AND REJECT ALL OTHER BIDS. COUNCILMAN CRITES SECONDED.
Roll Call. There were no objections, the motion carried.

leave between the dates of August 31 and September 11
inclusive.

Chief Administrative Officer Nordby stated as the Council
was aware, the Engineering Department was understaffed
at this time; that in order to properly survey and inspect
the Baldwin Park Boulevard Improvement Project it could
not be done as routine work of the Engineering Department;
that in the agreement with the Water District, the inspec-
tion of the installation of the water lines was taken over
by the Water District but the inspection of the street was
the city's responsibility; that Mr. Fogle had made the

suggestion, in which he concurred, that Walsh-Forkert
accomplish the survey and inspection work; that it was felt
if there were any defects that showed up in the design
that the firm who actually made the design would be
inspecting the work. He recommended that the City
negotiate on a standard fee basis.

Chief Administrative Officer Nordby reviewed his report
on the offer of a second police dog by Officer McNulty
stating that the City Attorney concurred with the pro-
cedure outlined in his report by which the City would
accept the services of the dog; that he recommended that
the City Attorney draft the necessary document which
would result in placing Officer McNulty's dog in the
service of the City.
Mayor Morehead asked Officer McNulty what he understood
as to compensation for the use of the dog.
Officer McNulty stated his understanding that the dog would
be offered to the City on the basis that he would retain
ownership; that he would expect normal handler's fee and
the cost of maintenance of the dog including food.
City Attorney Flandrick suggested, so that there would be
no problem on liability insurance, that the agreement provide
for the sum of $1.00 to purchase the dog from Officer
McNulty and upon Officer McNulty's termination from the
City's service that he be allowed to purchase the dog for
the sum of $1.00.
In answer to a question by Mayor Morehead, Chief of Police
Best stated the dogs would be overlapped in terms of days
off; that they would be utilized between the hours of
8:00 p.m. and 4:00 a.m. basically; that on occasion they
would be on duty at the same time.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL AUTHORIZE
THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT WITH
MR. THOMAS B. MCNULTY FOR THE PURCHASE OF THE GERMAN

Assistant City Engineer Fogle reviewed his report on
proposed stop signs for Bess Avenue stating that due to
the reopening of Bess Avenue between Baldwin Park Boule-
vard and Dalewood Street it seemed apparent that a hazardous
traffic condition would exist at Judith Street and
Leorita Street; that the Traffice Committee had made a
study of the situation and recommended that a stop sign be
placed on Judith Street at its intersection with Bess
Avenue and that stop signs be placed on Leorita Street
to stop all traffic on Leorita Street at its intersection
with Bess Avenue.
COUNCILMAN CRITES MOVED THAT THE RECOMMENDATION OF THE
CITY ENGINEER BE ADOPTED. COUNCILWOMAN GREGORY SECONDED.

Assistant City Engineer Fogle reviewed his report on
proposed restricted parking on Clark Street at the Post
Office exit stating that vehicles parking east bound on
Clark Street in front of 14418 Clark Street obstruct the
view of the east bound drivers using this exit; that this
created a traffic hazard not only to the drivers using
this exit but also to all west bound traffic on Clark
Street. He recommended that a sign be posted for No
Parking" between the hours of 8:00 a.m. and 5:00 p.m.
Monday through Friday, and between the hours of 8:00 a.m.
and 12:00 noon on Saturdays; parking would be permitted
on Sundays and holidays.

WITH THE RECOMMENDATION OF THE CITY ENGINEER. COUNCILMAN

reports from Civil Defense and show more interest in
Civil Defense. She asked if Councilman Crites could

they were only allowing 705' credit towards the purchase;
that there were no documents and no signed agreements in
City Hall, however at the end of a three year period the
machine must be purchased, or go on a program that the
City Attorney rules illegal; that the City had no alternative
other than to purchase the machine outright at this time
as the Finance Department was geared for machine accounting.
City Attorney Flandrick stated the problem was that the
City was in the position on this or any other piece of
equipment that you may lease it or you may buy it but
the Council could not, according to the Supreme Court,
buy it on a conditional sales contract as proposed.
Chief Administrative Officer Nordbyy stated that Mrs.
Duncan had mentioned the City was geared for machine
accounting; that the City could turn the machine back
in and go back to manual accounting or purchase the
machine; that Mrs. Duncan was not responsible for this
arrangement in that she was not in charge of the Depart-
ment at the time of the agreement.
City Attorney Flandrick stated the minutes of the Council
had been searched and there was nothing reflecting the
approval of any such arrangement as had been made.

interview scheduled for next Tuesday, August 25, 1964, TAPE TO BE PLAYED
at 5:00 p.m. to be played back on KLAC; that Mr. Don ON KLAC TUES.,
Davis of Foster and Kleiser represented Metro Media AUG. 25, 1964
which in turn owned KLAC; that in his opinion this was AT 5:00 P.M.
a good opportunity for the City of Baldwin Park to
get free publicity.
City Attorney Flandrick stated that there were several ADJ. MTG. NEC.
items which the Council would have to consider at an
adjourned meeting, namely the tax resolution and appoint-
ment to the Southern California Transit District.
Chief Administrative Officer Nordby stated the Rapid RE SB 41 BECOME
Transit Bill known as Senate Bill 41 became effective EFFECTIVE AUG. 22,
on August 22, 1964; that the appointment to the City 1964 APPOINTMENT

Mayor Morehead stated that some time ago he had asked
the Council to review the current rules and regulations
and also the consideration of what he had furnished
regarding the possibility of establishing a Personnel
Board.
Mayor Morehead asked that the Chief Administrative Officer
make a copy for Councilman Crites and return the document
to him and that this matter would be discussed at a
later date.

Deputy City Clerk Langseth stated that the League of
Independent Cities would be holding their annual
seminar in Palm Springs September 19 and 20, 1964.
Discussion followed.
As there were no objections, Mayor Morehead instructed the
Planning Director to find out how many of the Planning
Commissioners would like to attend this meeting and report
to the Council as soon as possible.

Chief Administrative Officer Nordby stated the City had
received three applications for Planning Director.
