REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL SEPTEMBER 16, 1964

regular session at the above place at 7:30 p.m.
Councilman McCaron led the salute to the flag.

of August 31, 1964 in full.

City Treasurer Pugh asked that the Council consider her
letter regarding her proposed absence from the Council
Meetings during the period September 30, 1964 to November

Chief Administrative Officer Nordby read the report of the
City Engineer which recommended that the award be made to
Crowell and Larson, 4926 Azusa Canyon Road, Baldwin Park,
California in the total amount of $7,078.38.
City Clerk Balkus read Resolution No. 64-216 by title as

alley adjacent to his property stating that his surveyor's

affects the location of City facilities and utilities
which might possibly be located in error on private property;
that in line with this request the people of Jerry Avenue.
should be informed, in advance, of the intended removal
of the trees on this street; and he asked that the City
Council consider reimbursing him the cost of resurveying
his property and relocating the surveyor's monument and
submitted a copy of the invoice he had paid.
City Attorney Flandrick advised Mr. Carpenter that he
would have to file a written claim with the City Clerk.
City Engineer French stated that the alley was resurfaced
approximately two months ago; that the subgrade of the
alley had failed; that the crews were trying to hold the
alley until the sewer work was accomplished which was
probably six months to one year away; that the patch work
was done as a result of complaints of persons fronting on
the alley; that the alley did have enough fall if the flow
line was carried all the way through the alley; that the
the City had replaced the property marker.
Mr. Carpenter asked that arrangements be made to have
the alley swept. He indicated that the City replacement
of his survey monument was six inches off.
Discussion followed regarding the survey monument.
The Council instructed that the City Engineer, together
with the Assistant City Engineer and Public Works Foreman,
make a full report to the Council regarding this matter.
Mr. Carpenter loaned the small pictures he had taken to
the City Engineer.

City Clerk Balkus stated she had received a request' to
hold Z-244 until H, R. Stoke, Attorney had arrived;
There were no objections to this request.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
a public hearing on AZC-9, an amendment to the Zoning
Code of the City of Baldwin Park for a requirement for
covered parking area in R-3 heavy multiple family
residential zone).
City Clerk Balkus stated that the required publication
had been accomplished.
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning Commission had adopted
Resolution No. PC 64-112 recommending approval of this
case on August 26, 1964.
As there was no one in the audience desiring to speak
either in behalf of or in opposition to AZC-9, Mayor
Morehead declared the public hearing closed.

Mayor Morehead stated that Mrs. Ball had spoken with him
and requested time to speak before the Council; that it
was his recommendation that she be heard.
There was no objection.
Mrs, Alma R. Ball, 3856 North Willow Avenue, Baldwin Park,
stated that her concern was personal and pointed out
her husband and neighbors in the audience stating they
echoed her feelings. She stated that her concern was
with the youth and their regard and respect for the
Sabbath; that she represented no religious, political
or any other group; that she had lived in her home since
1950 and every window of her home with the exception of
one faced directly onto the football field of Baldwin Park
High School. She pointed out the problems of noise,
lights glaring and parking especially on Friday and
Saturday nights and stated she was not complaining about
this because she understood It was a part of high school
life; however the Pop Warner Football games started last
Sunday and Sunday games vwuld continue through November
2, 1964; that there had been a parade last Sunday morning;
1Septemb*r-73) that church services were disturbed by the
noise of the honking cars and during the day band music
and the public address system blared into private homes;
that she was in sympathy with the rights of the High
School to hold football games Monday through Saturday
both during the day and in the evenings; that her family
would tolerate Friday and Saturday evenings of noise and con-
fusion but they were definitely opposed to any group, any
individual or any organization which came into their
community on a Sabbath and disturbed the feeling of
reverence or the dignity of worship; that children had to
be shown how to respect the Sabbath and rights of other
citizens and she would like the Council to think of what
was being done individually as adults In respecting the
Sabbath; that she was aware that the granting of the use
of these facilities for football games belonged to the
Department of the Board of Education and that she had
spoken before the School Board; that her basic reason for
speaking to the Council and giving them an over-all opinion
was not that she was concerned because she lived fifty feet
away; but that she would be concerned no matter what dis-
tance away she lived.
Mayor Morehead thanked Mrs. Ball.

Regular Meeting of the Baldwin Park City Council
Councilman McCarron stated in his opinion Mrs. Ball had a
proper subject and suggested that she present this matter
to the Community Counsel.
Mayor Morehead suggested also that she might talk with the
Board of Directors of the Pop Warner Conference.
The Council directed that Chief of Police Best look into
the matter of the parade.
Chief of Police Best indicated that he would.
City Clerk Balkus read in full a letter from James B.
Legg, 14354 Jeanette Lane, Baldwin Park, dated September 9,
1964 requesting a review of Lot Split No. 590 and asking
for a waiver on walks and curbing at 14354 and 143541
Jeanette Lane.
Planning Director Kalbfleisch gave a resume of the
conditions of approval on Lot Split No. 590.
Mr. James Legg, 14354 Jeanette Lane, Baldwin Park,
stated that his house was not set back for enough to
permit sidewalks; that he understood the street would only
extend one hundred sixty feet 160) further when and if
the property was built up; that he did not believe there
would be enough foot traffic to necessitate sidewalks;
that he was under the impression that the requirement
only applied to new construction; that it would create
a hardship on him; that he believed that the street would
have to be lowered; that he and his neighbor would lose about
six or seven trees and ornamental brick walls; that this
property faced the wash and there would be no houses across
the street.
Mrs. Legg stated that Mr. Legg offered to get the lot split
after the lot was sold; that the new owner's attorney was
supposed to obtain the lot split but did not.
In answer to a question by Councilman Crites, Planning
Director Kalbfleisch brought out that a one foot outlot
had been received on the southerly end of the property.
City Engineer French stated that on a forty 40) foot
dedicated street the sidewalk would be adjacent to the
curb and five feet in width`.
Mayor Morehead read the report from the City Engineer
which recommended that the sidewalk and curbing be
installed as previously agreed.
Discussion followed regarding the grade of the street;
that there were no curbs or sidewalks on any portion of
the street at the present time; that sewers would be going
in under Sewer Assessment District No. 64-,A-I.
COUNCILMAN MCCARON MOVED THAT THE REQUEST BE GRANTED
ON THE IMPROVED PORTION ONLY PARCEL A)
Discussion followed wherein it. was brought out that
Parcel A was now under two ownerships.

Discussion followed wherein Mr. Legg stated that he had
sold a portion of Parcel A as shown on the map of Lot
Split No. 590) approximately eight 8) years ago.
Councilman Crites withdrew his motion. MOTION WITHDRAWN
COUNCILMAN CRITES MOVED THAT THIS MATTER BE POSTPONED MOTION MADE
UNTIL IT IS FOUND OUT WHAT IS THE COMPLETE STATEMENT
OF INFORMATION ON THE SUBJECT,
Discussion followed wherein it was brought out by the
City Attorney that the present lot split ordinance puts
the burden on the owner to divide the land prior to sale.

City Attorney Flandrick stated the matter should
be examined to see if there was a possible violation of
the State Map Act; that it would be a cloud on the title
that would remain forever and that it should be cleared
up at this time.

Resolution No. PC 64-96 recommending approval of this
case on July 8, 1964.

Mr. H. R. Stoke, 615 South Flower, Los Angeles, thanked the H. R. STOKE, 615
Council for carrying the matter over.. He stated that S. FLOWER, L.A.
originally the request was for M-I Z-2251 which was denied by the
Council; that they then proceeded with C-1 zoning through
the Planning Commission and also a conditional use permit
for a service station; that the conditional use permit had
been granted by the Planning Commission subject to condi-
tions, which he enumerated; that a ranch type Texaco station
was proposed and the plans had been submitted to the Planning
Commission; that they had met with the Traffic Committee; that
if the property were developed R-3 this would be injecting
residential further into industrial; that C-I would be more

complementary; that in his opinion this request was con-
sistent with the public convenience and necessity and
was in accordance with the zoning ordinance.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD.
Mr. E. U. Baker, 1308 North Maine, Baldwin Park, stated
he had the property at 1302, 1304 and 1306; that he along
with other property owners had opposed this zoning; that
they had come to an agreement that this was satisfactory
if the portion of property that was not being used was
fenced and blacktopped and the portion of Maine and Dale-
wood was to be curbed and sidewalks installed.
Planning Director Kalbfleisch indicated these conditions
were included in the Planning Commission's resolution and
would be required before occupancy.
Mr. Baker stated it was his understanding the area that
was going to be fenced was not to be used for a parking
area for cars or trucks. He asked that a sign be posted
indicating'no parking until the property was under con-
struction.
Mr. Stoke stated he agreed to construct two or three
signs, whatever was needed, to indicate no parking until
the property was under construction.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-244, Mayor More-
head declared the public hearing closed.

Mayor Morehead reported regarding the selection of four
delegates to the Southern California Rapid Transit
District. He stated according to the recommendation of
the Los Angeles County League of California Cities to
divide the member cities into four 4) corridors, Baldwin
Park was in Corridor D along with twenty-eight 28) other
cities; that the candidate from Corridor D was Mayor
Falls from Pomona; that there was a meeting called by
the Secretary of State on September 22, 1964 and the
seventy-three 73) member cities of the League had, by
gentlemens-agreement, agreed to support the candidate from
their Corridor at that meeting.

bids for Sewer Assessment District No. 64-A-I would have
to be delayed for three days due to a publication factor.

Planning' Director Kalbfleisch presented a resume of Tentative TENTATIVE TRACT NO.
Tract No. 29817 located northerly of Francisquito Avenue and 29817
easterly of Puente Avenue, owner and subdivider John B.
Danis, 322 Avenue 1, Redondo Beach, California; engineer
Walsh-Forkert, Civil Engineers, Incorporated, 127 North
Lang Avenue, West Covina, California. He stated that
the Planning Commission recommended approval of the
subject case subject to the conditions as set forth in
Resolution No. PC 64-113 adopted September 10, 1964.
Discussion followed.
COUNCILMAN MCCARON M)VED THAT THE CITY COUNCIL APPROVE
TENTATIVE TRACT NO. 29817 SUBJECT TO THE CONDITIONS IN
PLANNING COMMISSION RESOLUTION NO. PC 64-113 WITH THE
CHANGE JADE THAT THE POLES IN THE STREETS SHALL BE STEEL
POLES AND THAT THE CITY ATTORNEY BE INSTRUCTED TO DRAW
THE NECESSARY RESOLUTION. COUNCILWOMAN GREGORY SECONDED.

City Clerk Balkus presented the Civil Defense report of
activities for the months of July and August 1964.
Discussion followed.
There was NO ACTION REQUIRED.

Planning Director Kalbfleisch reviewed his report regarding
Lante Street and Case No. Z-248 which indicated there was
a need for additional widening of Lante Street for develop-
ment as an Industrial area and suggested that the street
be widened to a very minimum of forty 40) foot of paved
area in order to permit a desirable two-way traffic flow.
Considerable discussion followed wherein It was brought out
that Lante Street had not been formally declared a public
street.
At 11:15 p.m. Chief of Police Best left the Council Chamber.
City Engineer French brought out that Lante Street was
now a fifty 50) foot right of way with thirty 30)
foot of pavement.
