The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Mayor Morehead led the salute to the flag. Mayor Morehead announced that Councilman Adair had attended the October 5th Council Meeting and from all indications he should soon be attending Council Meetings regularly. 00- COUNCILWOMAN GREGORY MOVED THAT THE MINUTES OF JANUARY 21, MINUTES OF JAN, 21, 1963, AND SEPTEMBER 16, 1964, BE APPROVED AND FURTHER 1963 AND SEPT. 16, READING BE WAIVED. RAIL- ROAD At the request of Mayor Morehead, Chief Administrative Officer Nordby reported regarding past letters and petitions and the proposed signalizing of the crossings at Pacific, MacDevitt, Merced, Francisquito and Ramona. City Attorney Flandrick stated under the constitution of the State of California railroads, as such, were regulated completely and exclusively by the Public Utility Commission; that there was nothing the City could do about the hours or the manner of operation. The following persons elaborated on their particular problems concerning the trains: Mr. E. Blagg, 3471 Feather; Mr. Ed Givens address not given); Mrs. Edna Boettcher, 14431 Adoue; Mrs. Irene Buchen, 3822 Paddy Lane; Miss Lucy Spellman, 14431 Adoue; Mr. Mike Dargus, 13260 Francisquito; and Mr. Aldwood, Cedarwood and Feather. PERSONS WHO SPOKE The Council instructed the Chief Administrative Officer COUNCIL INSTRUCTION to write a letter to the Pacific Electric and the Public C.A.O. City Clerk Balkus stated that the required publication, postings and mailings had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission had adopted Resolution No. P.C. 64-110 denying this case on August 26, 1964. TEST IMONY I N FAVOR OF THE REQUEST WAS CALLED FOR BY MAYOR MOREHEAD, Manilla Pierce, 33900 Chesebro Road, Palmdale, explained her proceedings prior to her application for the zone change. She stated, in her opinion, this was apartment house property; that her idea was to help Baldwin Park; that there were four 4) persons in the audience that would be requesting rezoning if this case was approved; that there had been an apartment house on Fairgrove granted on a sixty 60) foot lot; that they willing to give five 5) feet on each side to make a seventy 70) foot street. Mr. Raymond Guthrie, 3148 North Mangum, Baldwin Park, stated he owned this property; that he had talked with people in this neighborhood who had owned property there for twenty 20) years and in their opinion it would be good to rezone this property; that the City of Industry was across the street and the property was in large lots; that approximately 90% of the houses were old and needed to be torn out; and he did not see why the entire area could not be rezoned for apartments. In answer to a question by Councilman McCaron, Mr. Guthrie stated that the houses in the area were generally twenty to twenty-five years old. Delores Morales, 7461 Cravell Avenue, Pico Rivera, stated she owned the property at 12943 Bess Avenue; that she had constantly fixed up the home but it was old; that she had just paid the sewer bill; that she could not get good renters because the area needed cleaning up; that if this zoning were approved she planned to tear her house down and build something nice. Mr. 0. E. Parris, 3162 Mangum, stated he was in favor of the rezoning; that the neighborhood was getting old and run down; that the lots were two big for single family dwellings. Council A gentleman stated he owned 3223 and 3229 Mangum; that he was in favor of the rezoning because of the lot size and the construction that had already started around; that it would be natural to continue and have the entire area for apartments. Mrs. V. G. Steiner, 3217 Mangum, Baldwin Park, stated she did not want it rezoned just because it was a run down street; that she wanted it rezoned because of the lot size and because of the way the City was growing and the closeness to the off and on ramps of the freeway. TESTIMONY I N OPPOSITION TO THE REQUEST WAS CALLED FOR BY MAYOR MOREHEAD. Mrs. Fern Rogers, 3339 Mangum, Baldwin Park, stated that everyone in the 3300 block on Mangum that she had talked with did not want the rezoning; that the beautiful trees would have to be taken out; that the people did not want apartments; that apartments would cut out the air; that some of the land would be taken to make an-eighty foot street. Mr. Edward Van Buskirk, 3235 Mangum, Baldwin Park, stated he was a home owner, a tax payer and a veteran; that he had lived there since 1955; that the area had been Improved a great deal in the past seven or eight years; that he did not want the area rezoned for apartment buildings. in answer to a question by Mr. Van Buskirk, Planning Director Kalbfleisch stated that this property had been rezoned from A-1 to R-1 within the last year; that the property owners did not receive individual notices; that it was published in the San Gabriel Valley Daily Tribune. Mr. Van Buskirk stated there were elderly people in this area and it was his opinion they had the right to live out their lives on the property they had worked hard for; that he asked the Council to consider both sides of the picture; that if the Council felt this area was productive of more money by all means go all the way and make it a fine big industrial area. In rebuttal, Mrs. Manilla Pierce stated in her opinion this was apartment house property; that it was a block from the San Bernardino freeway, and four blocks from the other apartment zoning. At the request of Mayor Morehead, City Clerk Balkus read in full a telegram delivered to the Mayor at this time, 8:55 p.m., from Gaylord E. and Mark W. Lee, Costa Mesa, California, which indicated they were for the rezoning to multiple dwelling or R-3. Mrs. Fern Rogers stated that Mrs. Goldle Hown who owned too lots on Mangum) did not want the rezoning; that the property owners at 3119 Mangum did not want the rezoning either. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-247, Mayor More- head declared the public hearing closed. Mr. Chan Lefbvre, representing Harker Development Company, 10600 Katella Avenue, Anaheim, first congratulated the Council on the formation of Sewer District No, 3., He stated that Baldwin Park Boulevard was going to become, if it had not already, the gateway to Baldwin Park; that contracts had been let and work had commenced on the installation and relocation of utilities and Baldwin Park Boulevard was going to be a fully Improved one hundred 100) foot highway; that he would think that the Council had heard all the arguments with regard to the appropriateness of commercial zoning at this inter- section since the Council had apparently already rezoned the other three corners C-2. He presented a petition to the Council which he stated had forty 40) signatures of persons living within a small radius of the property. As there was no one else in the audience desiring to speak either in behalf of or in opposition to Z-251, Mayor Morehead declared the public hearing closed. As there were no objections, Mayor Morehead reopened the public hearing on Z-251 for the benefit of the Council members who wished to ask the applicant questions. Councilman Crites askeid Mr, Lefbvre f he was planning on anything in particular for this property. Mr,0 Lefbvre stated they were presently entertaining two proposals; that one was a service station with an adjoin- ing•retail business. and the other was a major restaurant chain. Councilman Crites explained that a service station request had been denied recently-on the diagonal corner. It was brought out that this property was C-2A. Mr. Lefbyte stated that the property concerned in this zone change application was approximately one-half an acre. As there was no one else in the audience desiring to speak either in beahiff of or in opposition to Z-251, Mayor Morehead declared the public hearing closed. City Attorney Plandrick stated if the Council wished they could direct the City Clerk to advise the individual that an offer would be considered providing that there would be a stipulation in the escrow instructions or otherwise that there would be a condition that it be combined with Lot 35 or some other lot to eliminate the problem of the landlocked property; that the City's title was a tax deed and the City could only convey such interest as it had; that the Council could set the price at whatever they deemed appropriate; that a preliminary appraisal could be obtained. The Council instructed that the prospective buyer be notified that the City would consider selling this property and ask them to submit a price and in the meantime have it appraised, at no cost if possible. 00- City Clerk Balkus stated that the annual conference of the League of California Cities would be October 11-14, 1964. 00- City Clerk Balkus stated that the dedication ceremonies for the Los Angeles County Fire Station No. 29 located at 14334 E, Los Angeles Street, would be Saturday, October 10, 1964 at 10:45 a.m. She requested authoriza- tion to purchase the refreshments for this ceremony and stated that the estimated cost was $20.00. He stated that the Public Utilities Commission had made a ruling last week which it appeared would have an effect pertaining to the cost on this matter; that a written copy of this ruling was not yet available. Duncan, Chairman, which recommended that the City enter Into a contract with the State Retirement System for an actuarial study for all employees at an estimated cost of $600.00. He stated that City had had both Ford and Chrysler products and that it had been the City's experience that the Plymouths were the most economical as far as repair bills and that he recommended that the bid of Haefner Chrysler Plymouth, Incorporated be accepted at the total cost, Including tax, of $7,806.99. He stated that funds were available at this time; that there were no trade-ins. Discussion followed.
