regular session at the above place at 7:30 p.m.
Councilman Adair led the salute to the flag.
The invocation was given by Pastor Eugene Perry of the
Ascension Lutheran Church.

Regarding the approval of the minutes of October 5, 1964,
City Clerk Balkus stated that on page I the time for
the opening of the construction bids for 64-A-I should

There were no objections, the motion carried and was so

City Clerk Balkus presented the City Treasurer's report
as of September 30, 1964,,pointing out that copies of

the report would be received and filed.

Mayor Morehead stated that starting this evening the City
Council would hold an open conference meeting in the
Conference Room at 7:00 p.m. prior to the regular meeting;
that the purpose of the meeting was to inform the Council
concerning Agenda items.

Mrs. Eugenia Igna, 13819 East Garvey Boulevard, Baldwin MRS. EUGENIA IGNA,
Park, stated she wanted to speak concerning the proposed 13819 E. Garvey
business license ordinance. Blvd., B.Pk.
Mayor Morehead asked Mrs. Igna to reserve her comments
on this matter until the item came up on the Agenda
later in the meeting.
Mrs. Igna stated also that she wanted to know why she RE ALTERATION OF
had to put in IIO wiring when she had had 220 wiring BLDG. AT 13409
before in order to convert a liquor store into four E. GARVEY
batchelor apartments.
Building Superintendent Kalbfleisch stated the property
at 13409 East Garvey was being altered from a liquor
store, a commercial use, into a motel, which was an H
Occupancy and still a commercial use; that under the Code
any time there were alterations for a difference in
occupancy the building must be made to conform to the
minimum standards 220 service) of the Code at the present
time; that the items in conflict were under the 1961
Electrical Code. In answer to questioning by Mayor More-
head, Mr. Kalbfleisch indicated that the City was not re-
quiring Mrs. Igna to construct or renew anything that
was unreasonable or outside the scope of the Code.
Mrs. Igna also asked about putting in curbs and gutters
in the way of her parking.
Building Superintendent Kalbfleisch explained the curb
and gutter requirements and read the conditions under
which they could be waived.
In response to Mayor Morehead's questioning, City
Attorney Flandrick stated that Mr. Kalbfleisch had
apparently examined the plans and had required that
certain conditions be met in accordance with the
Electrical Code, which was proper; that as far as
the curbs, gutters and sidewalks were concerned
again as Mr. Kalbfleisch had indicated they were
required to be constructed any time a building
permit for more than $1,000.00 was issued for
improvements.

City Clerk Balkus presented a resolution from the City
Council of the City of Monrovia urging State Legislature
to enact a general statute returning home rule to the
cities of California.

City Attorney Flandrick stated the League of California CITY ATTY. TO OBTAIN
Cities caused to be introduced in the 1963 Session a COPIES OF BILL
bill which points out what Mr. McCaron requested; that INTRODUCED IN 1963
he would obtain copies of this bill to present to the SESSION
Council along with the resolution.

from the Pacific Telephone and Telegraph Company.
City Attorney Flandrick recommended that.t.he City Council
deny the claim.

Chief Administrative Officer Nordby reviewed the matter
of the possible relocation of the State Employment Office
from El Monte to West Covina pointing out the summary
enclosed in the Council folders.

Chief Administrative Officer Nordby stated that the OFFER OF ROTARY CLUt
Rotary Club of Baldwin Park had offered to erect a OF B.PK. TO ERECT
marquee on the Civic Auditorium and that Mr. Bart MARQUEE ON CIVIC
Parker had donated the marquee on behalf of the Rotary AUDITORIUM
Club. He presented an architectural rendering of
the sign and stated that the sign would have changeable
letters.
COUNCILMAN CRITES MOVED THAT THE CITY COUNCIL ACCEPT THIS

having arrived that it was the time and place fixed for
a public hearing on ZV-97, an appeal from denial of
the Planning Commission, an application submitted by
Petro Development Incorporated, Peter Schabarum,
Agent, for a-Variance to allow construction and use
of an automobile service station in Zone C-2-A General
Commercial Zone, Acre) on less than an acre at 3174
Baldwin Park Boulevard.
City Clerk Balkus stated that proper publication, postings

Planning Director Kalbfleisch presented a resume of the
case and stated that the Planning CorF#nission had adopted
Resolution No. PC 64-117 denying this case on September
23, 1964.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD.
Mr. Peter Schabarum, 128 East College, Covina, stated he
had an attorney present at one of the Planning Commission
meetings who made an effort to clarify the criterion on
which a variance application should be considered; that
he also had representatives of the Shell Oil Company in
attendance who indicated specifically what was proposed
on the property; that the plot plan was on the board.
He read excerpts from the Planning Commission minutes
stating there was little or no discussion as to whether
the application met the criterion for the variance;
that in his opinion the criterion had been met; that he
had been put in the position now of having to acquire
additional property at equal to or in excess of fair
market value in order to assemble an acre; that in his
opinion for a person to have to do that to develop a
parcel of property was definitely a hardship.
Mr. John Colwick, 3438 North Maine, Baldwin Park, stated
this corner had the greatest car count of any corner in
Baldwin Park and this had been the case for many years;
that in his opinion a service station was the best use
possible for this corner; that it would be an asset
compared to what was there now.
TESTIMONY I N OPPOSITION TO THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD,
Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park,
indicated there were too many service stations in
Baldwin Park at the present time and not enough
shopping centers.
As there was no one else in the audience desiring to
speak in behalf of or in opposition to ZV-97, Mayor
Morehead declared the public hearing closed.
Discussion followed that the planners were trying to
keep large parcels for the future shopping center; that
by the minutes and testimony the Planning Commission were
concerned about the grading.
Planning Director Kalbfleisch stated that the grading
requirements would be imposed by the Engineering De-
partment; that the City needed a new grading ordinance.
Discussion followed as to whether or not the level of the
future shopping center would be the same as that of the
area involved.
City Engineer French stated if the Council wished the
City Engineer could approve the grading plan taking
into consideration that the grading plan would have to
conform with the existing property in the event that the
entire area would be developed.
City Attorney Flandrick stated that if the Council were
to grant this zone variance a condition should be in-
cluded that would require the applicant prior to obtain-
ing a building permit to submit to the City Engineer a
grading plan together with a drainage study which pro-
vided for adequate surface grading.

possibly the zoning of the entire area should be reviewed.

Mr. Schabarum stated he would agree to the conditions
stated but did not understand the referral to the Planning
Commission wherein City Attorney Flandrick explained that
this case had been recommended for denial therefore the
Council had no suggested conditions of approval from the
Planning Commission and staff.

City Engineer French reviewed his report regarding the
improvement of a grade crossing on Francisquito Avenue
which stated that on April Il, 1963, the Public Utility
Commission requested the installation of crossing pro-
tection at the Pacific Electric Railway and Francisquito
Avenue crossing; that to insure proper location of the
signals in regard to future widening of Francisquito
Avenue, the City had designed the street and requested
an agreement from Pacific Electric Railway Company; that
to construct the signals in the proper location to conform
to the future width of Francisquito Avenue it would be
necessary to obtain additional street dedication; that
two property owners concerned had been contacted and
they were agreeable to dedicate the necessary street
widening at no cost to the City subject to a letter
stating that they would be provided access in con-
formance with what they now had and that the street
drainage adjacent to the tracts be improved; that this
would constitute the construction of approximately sixty
60) feet of rolled curb and gutter on each side of the
approach and the pavement hook-up.
Discussion followed wherein the City Attorney indicated
that an agreement should be drawn.

Mr. Letcher Bishop, 3918 North Harlan, Baldwin Park, asked
if this matter should not have been set for public hearing
when the Municipal Code was being changed.
City Attorney Flandrick stated it was not required by law
to conduct a public hearing on the matter; that this was
up to the Council.
Mr. Letcher Bishop, 3918 North Harlan, Baldwin Park,
opposed the license fee on apartment buildings and
requested that the decision of the Council be delayed
and that the matter be set for public hearing and
publicized in the newspaper.

Mrs. Faye Hickey, 14322 Gage, Baldwin Park, opposed the MRS. FAYE HICKEY,
license fee on apartments and asked who brought this 14322 Gage, B.Pk.
item before the Council.
Mayor Morehead stated that the Council ordered the
administration to study for additional sources of
revenue.
Mrs. Hickey questioned why additional manufacturing was
not brought in and stated that people would be run out
of Baldwin Park with this license fee.
In answer to a question by Mrs. Hickey, Special Enforce-
ment Officer Palmer stated that under the proposed
ordinance the license fee for thirty units would be
$160.00 per annum.
Mrs. Eugenia Igna, 13819 East Garvey Boulevard, Baldwin MRS. EUGENIA IGNA,
Park, stated she would have her lawyer present at the next 13819 E. Garvey Blv
Council meeting. She questioned the statement in the B.Pk.
newspaper concerning the license rates.
Chief Administrative Officer Nordby stated he made a
statement on September 22, 1964, that substantially
there have not been any increase in license fees since
the City incorporated. He reviewed the past ordinances
with respect to license fees on trailer courts.
A gentleman came forward concerning some vacated property GENTLEMAN RE VACATEE
on Dundry wherein Mayor Morehead asked him to meet the PROPERTY ON DUNDRY
Planning Director and the City Attorney in the hall to
discuss his problem.
Mr. Mark O'Brian, 13822 East Garvey, Baldwin Park, stated MARK O'BRIAN, 13822
he was opposed to the increase in license fees for trailer E. Garvey, B.Pk.
parks; that his fee would more than double and asked how
the rate was arrived at, wherein Special Enforcement
Officer Palmer reviewed the survey taken of 72 cities.
Mr. Paul Edwards, 12767 East Garvey, Baldwin Park, stated
he had a trailer park; that in his opinion the proposed
license fee was out of line; that a public hearing should
be held; that all of the people should get together and
agree; that the proposed fee would drive business out
instead of increasing it; that recently his neighborhood
had been cut off from the freeway.
Mr. Letcher Bishop suggested that this matter be held over
and that a pubic hearing be set. He also stated that it
had been reported to him that employees of the City had
been selling real estate while on duty.
Mayor Morehead indicated that the person shou!d report
this to an official of the City giving the names and
addresses.
Councilman McCaron stated that it appeared there was
more of an educational program needed; that in his
opinion this should be taken under further study and
possibly a public hearing; that policing is costly and
apartments should carry their load.
Councilman Crites withheld comment.
Councilwoman Gregory stated in her opinion a public hearing
was not needed; that she Was concerned about what the
people said about reaching out for industry and wondered
how this was to be done without community development;
that community development required money and where did
the money come from; that industry was not coming Into
Baldwin Park as it was now; that perhaps a newsletter
should be printed on nothing but this matter but she
believed it should be continued.

Planning Director Kalblfeisch reviewed his report
regarding Z-248, an application filed by Rudy C.
Serrano et al for a change of zone from A-1 to M-1 on the
property located at 5040, 5052, 5064 and 5063 Lante
Street. Regarding Lante Street he stated in his opinion
a fifty 50) foot dedication and a forty 40) foot
improved street would be sufficient for the area.
City Engineer French stated in his opinion it should be
a minimum fifty t50) foot dedication and forty-eight 48)
foot curb to curb; that this would be sufficient for an
industrial development.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL ACCEPT
THE RECOMMENDATION OF THE CITY ENGINEER AND PREPARE A
SUITABLE AGREEMENT PROVIDING FOR DEDICATION 50 FOOT
DEDICATION) AND FOR THE IMPROVEMENTS AND SUBMIT THEM
TO THE APPLICANTS FOR SIGNATURE PRIOR TO THE SECOND
READING OF THE ORDINANCE. COUNCILMAN CRITES SECONDED.

Planning Director Kalblfeisch reviewed his report regard-
ing his investigation of the premises at 4665 North
Edra Street, pertaining to a dog kennel. He stated at
the present time there was no violation.

Code, Councilwoman Gregory suggested that the room for
the members of the City Council to assemble informally
be changed from the City Clerk's Office to the Con-
