REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL NOVEMBER 4, 1964
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met at 7:00 p.m. in the Converence room for
an informal session with the staff to be informed on
regular agenda items. A press representative was in
attendance.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.
Mayor Morehead led the salute to the flag.

The invocation was given by Reverend Carl Johnson of the INVOCATION
First Methodist Church.

At 7:40 p.m. Finance Director Duncan left the Council
Chamber.

Mayor Morehead stated it was his recommendation that
any Oral Communications be limited to ten minutes.
There were no objections.

Mrs. Eugenia Igna, 12819 East Garvey, Baldwin Park, stated
her attorney was unable to attend this meeting but wished
to speak at the next Council Meeting. She wished to discuss
the proposed Business License Ordinance, however Mayor
Morehead asked her to wait until this item was discussed
later on the Agenda. She asked if it was true that she
could not complete her building without putting in curbs
and gutters.
Planning Director Kalbfleisch stated there was a wiaver
procedure set out by the Baldwin Park Municipal Code.
Mrs. Igna presented a letter to the City Clerk dated
October 28, 1964, requesting a waiver of the chapter
of the City Ordinance pertaining to the construction of
curbs, gutters, and driveway approaches as applying to
a small building addition at 13409 E. Garvey Avenue in
Baldwin Park."
Mrs. Igna spoke of a letter she had received cutting her
spaces at her trailer park at 12793 Garvey and, ask the
reason for this.
Mayor Morehead suggested that Mrs. Igna contact Mr.
Kalbfleisch's office Wednesday, November 5, 1964,
for an answer to this question.
Mrs. Igna asked if she applied for a Conditional Use
Permit for 12793 Garvey) could she get it in writing
before she applied, that there would be no due date.
Discussion followed wherein City Attorney Flandrick
stated a letter could not be written to this effect;
that this would be determined by the Planning Commission
and City Council after the public hearing; that the $100.00
processing fee was not returnable if the Permit was denied.

Mr. William Ebaugh, 1006 Alessandro, La Verne, gave a REPORT ON EMPLOYEES
report on the employees group insurance for the period GROUP INSURANCE
April 1, 1964 to September 1, 1964. He stated that the BY WM. EBAUGH
total paid premiums were $7,297.30; that the total paid
claims were $5,894.00; that the claims to premium ratio.,
had gone up slightly during this period; that at this
time the total reserve was approximately $6,000.00.

Mayor Morehead stated that Jack H. Stafford was appointed
for a,.term of two years; E. A. Cannady and Geoffrey
Markell three years, and Sam Clanchetti Jr. and Gladys
Dargus four years.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
a public hearing on Z-252, an application submitted by
F. R. Halterman, agent for Delores B. Via for a change
of zone from R-i single family residential zone) to R-3
heavy multiple family residential zone) and C-2 general
commercial zone) or more restrictive use, on the property
located at 927 Baldwin Park Boulevard.
City Clerk Balkus stated that the required publication,
postings and mailings had been accomplished.
Planning Director Kalbfleisch presented a resume of the case
and stated that the Planning Commission had adopted
Resolution No. P.C. 64-118 recommending approval of the
request from R-I to R-3 on October 1~, 196..
City Clerk Balkus administered the oath to those in the
audience desiring to be heard during the meeting.
TESTIMONY IN FAVOR OF THE REQUEST WAS CALLED FOR BY MAYOR
MOREH EAD
Mr. Frank Halterman, 51 West Foothill Boulevard, Arcadia,
stated that they had applied for C-2 originally; that they
would now like the property all rezoned to R-3; that they
had their plans; that to the north was the drive-in
theatre, to the east M-1 in the County of Los Angeles,
to the south, the creek; that when they purchased the land
to build houses in this area it was zoned R-2 and they
had made an application for R-I which was approved.
The plans were passed for the Council to view and returned
to Mr. Halterman.
As there was no one else In the audience desiring to speak
either in behalf of or in opposition to Z-252, Mayor
Morehead declared the public hearing closed.

COUNCIL CONCUR WITH THE FINDINGS OF THE PLANNING COMMISSION
AND THAT ORDINANCE NO. 386 PASS FIRST READING BY TITLE ONLY

Report from the Fire Department.

Chief Administrative Officer Nordby presented his
report regarding the revised business license fee
schedule,
COUNC I I.WOMAN GREGORY MOVED THAT THE REVISED BUSINESS
LICENSE FEE SCHEDULE BE APPROVED AS PRESENTED AND THAT
THE CITY COUNCIL DIRECT THE CITY ATTORNEY TO PREPARE THE
NECESSARY ORDINANCE FOR ADOPTION. COUNCILMAN ADAIR
SECONDED.
Discussion followed that there were two schedules as
far as apartments were concerned.
Mrs. Eugenia Igna, 13819 East Garvey, Baldwin Park, asked
Special Enforcement Officer Palmer where this ordinance
was copied from.
Special Enforcement Officer Palmer explained the survey
and the proposed rates for trailer parks.
Mrs. Igna indicated that some cities only charge license
fees for new apartments and new trailer parks.
Mrs. Igna requested to be on the Agenda at the next
meeting.
Discussion followed wherein Councilwoman Gregory with
the consent of the second, added to the motion SCHEDULE
A FOR APARTMENTS".
There was further discussion concerning apartment house
license fees.
Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park, asked
what the fee would be for four apartments.
Mayor Morehead stated it'would be $20.00 under the proposed
schedule.
Mrs. Hickey stated she had never heard of license fees
for apartments; that taxes were already high; that
apartments were rentals just the same as homes; that
the Council should have known where the revenue was
coming from before wages wee raised and so forth.
Mayor Morehead stated that money was not authorized to be
spent without knowing where the money was coming from;
that it had been several years since the present license
fees had been changed; that as the years went by there
was more revenue needed for the services required.

Mrs. Hickey stated that the City should be progressive
and not charge the people who were trying to make a living
here more taxes.
Mr. Jim Duncan stated he owned a trailer park at 12775
East Garvey and asked what the fee would be on a motel
unit.
Special Enforcement Officer Palmer stated the charge
would be $28.00 plus $2.00 for each unit over three
for motels and trai ler parks.

City Clerk Balkus presented the report of the City Engineer
recommending the release of the subdivision improvement

RELEASE OF THE BOND ON TRACT NO. 28515. COUNCILWOMAN
GREGORY SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Morehead.

Planning Director Kalbfleisch presented his report concern-
ing the request of the Planning Commission for the Council
to consider the need of an urgency ordinance to require
the construction and use of an Automobile Service Station
within any use zone in the City of Baldwin Park to be
subject to approval of a Conditional Use Permit and
delete Section 9610, Subsection 46, Super Service Station.
Discussion followed wherein Planning Director Kalblfeisch
stated the matter was being advertised for a hearing before
the Planning Commission.

Tentative Tract No. 30067 located westerly of Center
Street and northerly of Los Angeles Street, owner and
subdivider, Emerald Estates Frank Perricone, Presi-
dent), 4446 Live Oak Avenue, Arcadia; Engineer, Tracy
R. Bousman, 1224 South Second Street, Arcadia Calif-
ornia. He stated that the Planning Commission had
recommended approval of Tentative Tract No. 30067
as set forth in Planning Commission Resolution No.
64-127 adopted on October 28, 1964.
Discussion followed regarding drainage.

Regarding Lot Split Nos. 544 and 572, City Engineer French
stated there had been a request that was recommended for
approval by the Planning Commission for the adjustment of
street area to allow for better development in the area.
He pointed out the present and proposed street area on a
map on the wall and stated that he recommended that the
City Attorney be instructed to prepare a resolution amend-
ing the resolution approving the two lot splits and directed
to proceed with the vacating of excess street subject to
getting the dedication necessary to complete this street.
COUNCILMAN MCCARON MOVED THAT THE CITY ATTORNEY BE IN-
STRUCTED TO PREPARE A RESOLUTION AMENDING THE PREVIOUS
RESOLUTIONS APPROVING THESE LOT SPLITS, COUNCILMAN
CRITES SECONDED. The motion carried by the following
vote:
AYES: COUNCILMEN MCCARON, CRITES, ADAIR,

City Clerk Balkus asked if it was now necessary for the
City Council to have two motions on ordinances.
City Attorney Flandrick stated that the problem was
brought about by a recent Los Angeles Superior Court
trial decision; that there had not been an appellate
court decision regarding this matter.
Discussion followed wherein City Attorney Flandrick
recommended that the Council have two motions regarding
ordinances: one to waive further reading of the
ordinance and one to introduce the ordinance.
With the approval of the second Councilwoman Gregory
withdrew her motion.
