Roll Call: Present: COUNCILMEN ADAIR, CRIT ES, GREGORY, MCCARON AND MAYOR MDREHEAD Absent: PLANNING DIRECTOR AND BUILDING SUPERINTENDENT KALBFLEISCH, FINANCE DIRECTOR DUNCAN, CHIEF CF POLICE BEST AND CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, AND CITY CLERK BA LKUS 00- Mayor Morehead announced that the hour of 7:30 p.m. having arrived that it was the time and place fixed for a public hearing on certain changes and modifications in the Resolution of Intention, No. 64-211, and Plans for Assess- ment District No. 64-A-1 as set forth in Resolution No. 64-237 adopted on October 23, 1964. City Clerk Balkus stated that the required publication had been accomplished. City Attorney Flandrick stated that the City Clerk had in her possession a statement consenting to these changes signed by the contractor. City Clerk Balkus stated there had been no written protests filed in her office. Mayor Morehead asked for an explanation of the changes wherein City Attorney Flandrick stated that the con- tractor on a 1911 Act was generally financed by a bond house or other financial institution; that before the bond house or other financial institution would approve the loan to be made then and in the future they have an attorney examine the files and insure that the district was proper in form; that Mr. McKensie-Brown was the attorney for the contractor on this particular case; that all of the items, with one exception, in the pro- posed changes relate to minor changes such as in Item No. I a) for example the alley south of Los Angeles Street" formerly read the alley southeasterly of Los Angeles Street"; that he and his licensed land surveyor requested the change to south; that this in substance was the kind of changes to be made; that Item 5 on Page 3, deletion of a certain sewer line, tiaras being accomplished at the same time due to the fact that Mr. French reveived a letter from the subdivider who was subdividing the property that would be served by this line who indicated that in view of the subdivision he felt it would be more expedious for the development of the property for him to build the line himself rather than wait anywhere from three months to one year for the line in that area. that it was the recommendation that the request of the subdivider be approved. In answer to a question by Mayor Morehead, City Attorney Flandrick stated the subdivider was ready to or had filed a final subdivision map; that there was no way of assuring the subdivider the exact time the sewer line would go in. He stated that the letter stated A contract shall be let to a responsible sewage maintenance company which shall pump said cess- pool periodically if required,- with all of said costs being borne by the undersigned. Said contract shall be approved by your City Engineer. When an operating sewer line has been installed in Big Dalton Avenue, the undersigned shall then pay his acreage hook-up" charge, but shall otherwise be freed from any other expenses or costs as established by the newly formed sewer district for this area." Discussion followed that this sewer line was the only deletion. As there was no one in the audience desiring to speak either in behalf of or in opposition to the proposed changes and modifications, Mayor Morehead declared the public hearing closed. City Clerk Balkus read Resolution No. 64-246 by title as follows: RESOLUTION NO, 64-246 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE WORK TO BE DONE I N ASSESSMENT DISTRICT NO. 64-A-I" COUNCILMAN MCCARON MOVED THAT RESOLUTION NO. 64-246 BE APPROVED AND FURTHER READING BE WAIVED, COUNCILWOMAN GREGORY SECONDED. The motion carried by the following vote: AYES: COUNCILMEN MCCARON, GREGORY, ADAIR, CRITES AND MAYOR MOREHEAD NOES NONE ABSENT: NONE 00- City Clerk Balkus read Resolution No. 64-245 by title as follows: RESOLUTION NO. 64-245 A RESOLUTION OF THE CITY COUNCIL CF THE CITY OF BALDWIN PARK ALLONING CLAIMS AND DEMANDS AGAINST THE CITY CF BALDWIN PARK" Chief Administrative Officer Nordby explained that Warrant No. 5180 was the progress payment to Hess Construction Company; that it had been inspected by Walsh-Forkert and the staking had been approved by the City Engineer; that funds were available from gas tax allocations; and that it was recommended that payment be made. Chief Administrative Officer Nordby explained that Warrant No. 5181 was a transfer from the Bank of America to Crocker-Citizens; that this was the deposit made by N. A. Artukovich, Inc. COUNCILWOMAN GREGORY MOVE) THAT RESOLUTION NO. 64-245 BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN CRITES SECONDED. Discussion followed wherein City Attorney Flandrick stated that a general law City was not permitted to impose an excise tax; that the League of California Cities had indicated they would take favorable position on enabling legislation for general law cities to impose excise tax. At the request of Mayor Morehead, City Attorney Flandrick reviewed the qualifications necessary to become a chartered city. There was NO ACTION. NO ACTION 00- AT 7:55 P.M. COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL ADJ. AT 7:55 P.M. ADJOURN. COUNCILMAN ADAIR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Morehead. 00- i THELMA L.
