In accordance with Section 2703 of the Municipal Code the
City Council met at 7:00 p.m. in the Conference room for
an informal session with the staff to be informed on
regular agenda items. A press representative was in
attendance,
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.
Mayor Morehead led the salute to the flag.

Regular Meeting of the Baldwin Park City Council
City Clerk Balkus presented a communication from the League
of California Cities regarding Committee Hearings.
City Attorney Flandrick explained Assembly Bill 2334 and
1716 to the City Council and recommended to the Council
if they wished to take a position in opposition to these
bills that a letter be written to the Committee.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL GO ON
RECORD AS OBJECTING TO BOTH ITEMS. COUNCILWOMAN
GREGORY SECONDED. There were no objections,*the motion
carried and was so ordered by Mayor Morehead.
Councilman McCaron stated that the intention was that a
letter would be written to the League of California Cities.
City Attorney Flandrick stated he and the Chief Administra-
tive Officer would prepare a letter for the Mayor's signa-
ture indicating the Council's position on both of these
matters and transmit it to the Subcommittee and Mr. Carpen-
ter.

Chief Administrative Officer Nordby presented letters
from Webster*s Refuse Disposal and Selma Rubbish Company
regarding renewal oftheir business licenses and requesting
consideration of a franchise. He stated he had met with
Mr. Harry W. Otting, President of Webster's Refuse Disposal
and their ettorney;'that he had been given a copy of a
proposed agreement between Webster's and the City of Baldwin
Park this date but had not had an opportunity to read it
yet; that he requested that action be deferred until the
next Council meeting.
City Attorney Flandrick reported that he had talked with
Mr Hadley, Attorney for Webster's; that a franchise was
possible; that ordinance changes would be necessary.
The Council instructed that the ordinance provisions
necessary and the feasibility study of the Chief
Administrative Officer be presented to the City Council
prior td-the next regular meeting and that this matter
be deferred until that time.

Chief Administrative Officer Nordby presented a suggested
resolution from the Greater Los Angeles Safety Council
which urged all citizens to do everything in their power to
prevent accidents during the holiday season.

BE PREPARED FOR THE CITY OF BALDNIN PARK AND THE PROPER

Regular Meeting of the Baldwin Park City Council
City Engineer French presented his report regarding the
usage of the auditorium.
This was for INFORMATION ONLY.

City Engineer French reviewed his report on the Traffic
Committee meeting of November 25, 1964, which recommended
1. The installation of a four-way stop at the intersection
of Walnut Street and Palm Avenue.
2. The denial for crosswalks at the intersection of Cavette
Place and Maine Avenue.
3. The approval of no parking area as requested on MacDevitt
Street near the last school gate on the school grounds.
COUNCILMAN MCCARON MOVED THAT ITEM NOS. I AND 3 BE APPROVED
AND ITEM 2 BE DENIED AS RECOMMENDED BY THE CITY ENGINEER).
COUNCILWOMAN GREGORY SECONDED, There were no objections,
the motion carried and was so ordered by Mayor Morehead.

City Clerk Balkus announced that the hour of 8:00 p,m,
having arrived that it was the time and place fixed
for a public hearing on Z-254, an appeal from denial
of the Planning Comnnissiort,an application submitted by
Thomas W. Rodgers for a change of zone from R-1 single
family residential zone) to'R-3 heavy multiple family
residential zone), or more restrictive use, for the
property located at 14402 East Merced Avenue.
City Clerk Backus stated that the required publication,
postings and mailings had been accomplished.
Planning Draftsman Brunk presented a resume of the case
and stated that the Planning Commission had adopted
Resolution No. P.C. No. 64-119 denying this case on
October 14, 1964.
TESTIMONY IN FAVOR OF THE REQUEST WAS CALLED FOR BY
MAYOR MOREHEAD,
Mr. Thomas W. Rodgers, 14420 East Merced Avenue, Baldwin
Park, stated this was the second time he had applied for
a rezoning; that the lot was 440 x 91; that as the
property stood-now he could not build any more; that
there was too big a lawn to keep; that he must utilize
the property'to some effect; that the taxes were going
up every year; that, in his opinion, the Planning Commis-
sion was unjust in their decision since many of the
homes around him had been rezoned to R-3.
Joyce Barney, 3216 Big Dalton, Baldwin Park, stated she
owned the property directly behind Mr. Rodgers; that the
area was all highly populated with houses; that she thought
this property should also be rezoned R-3 due to the fact
that this area was high density; that it was near the
frontage of the freeway; that new apartment houses would
enhance this district; that it was her intention to ask
for R-3 zoning.
James Jirsa, 3312 North Big Dalton Avenue, Baldwin Park,
stated he was in favor of the zone change because of the
length of the lot; that there were weeds on the property
now and the property could be utilized to better advantage.

Mr. Monte Hi.ilmer, 334 West Nora, West Covina, stated
he was a builder and acquainted with lots of this propor-
tion; that there was no other use for a lot this size near
a freeway and'in this particular location than to be in a
multiple zone.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-254, Mayor More-
head declared the public hearing closed.
Discussion followed that the street when fully developed
would be of sufficient width to accommodate this type
development; that it appeared there was some other property
next to it two properties to the west) that should possibly
be considered for this type.of zone-change; that there was
no testimony in opposition to the request fm m the adjacent
property owners; that all of these properties should be
considered for rezoning at the same time.
In answer to a question by Councilman McCaron, Planning
Draftsman Brunk stated that high density was indicated up
to this area.
Discussion followed regarding street dedication particularly
with respect to Garvey and Merced; that as close as the
property was to the on and off ramps of the freeway and
to the Garvey access road the subject request was not
especially out of order; whether or not there had.ever
been a design set up on this property for R-1 development;
that with the other properties below the subject property
this would make a good size area; that there was no access
but if it was all R-3 each one would have their own
access to Merced; that if properly developed R-I there
would have to be street access to the interior of the
property; that the Planning Commission should make a
further study as far as the street plan and development
of the area; that at the moment this was spot zoning but
if all of the property was considered ti would change the
picture;'that Big Dalton was inadequate to carry R-3;
that there was no apparent problem on Merced as far as
contribution to traffic; that if possible the area should
all be rezoned at one time.

FURTHER COMMENT ON THE DEVELOPMENT IF THEY HAVE ONE.

Boulevard, Glendale, stated the property was located at
the Frazier Street off ramp; that they were unable to
get sufficient loans to develop the property as R-3;
that the only feasible development that they have seen
for the property was for a motel site; that they planned
a motel unit with a coffee shop; that as far as multiple
units they would have to be low rental units because of
the financing; that these would be detrimental to the area;
that the area was checked by the financing agencies and
it was found that the rentals were bringing approximately
$65.00 to $69.00 a month and there was alarge vacancy

the type of unit he would like to build; that a motel
would be good in that area because of the proximity of
the freeway and manufacturing industry; that off street
parking would be provided; that the plans were for a
motel, coffee shop and a small general store.
Mr. Hal Eddy, 15940 Chase Street, Sepulveda, stated he HAL EDDY, 15940
had an'interest in the property; that he would be the Chase St., Sepulveda
builder-developer; that this would be developed as a
motel with'the buildings next to the R-3 as far away
from the freeway as possible to create a buffer between
the freeway and any development of adjacent properties;
that there would be on site parking; that it was designed
in such a manner that there would not be a hazardous
situation.

time the property was C-2; that at the time the City
Incorporated the Planning Corrmission rezoned the property and made
it R-3 and none of the property owners were sole to develop
their property C-2; that if this was rezoned, in his
opinion, the people who had lived their for years should
be able to develop C-2; that if they had the rezoning any
C-2 use could be put in there; that a specific zoning
should be put in so that the neighbors would know what
was going in, not just a general C-2 zone.

Park, stated she was opposed to the rezoning; that 13019 E. Judith St.,
$85.00 a month was low rental in the area; that the B.Pk.

Mr. Ernest Blankenship, 811 N. Frazier Street, Baldwin
Park, stated he owned the second and third parcels from
the parcel in question; that he wished to go on record
as objecting to this type of development; that a motel,
coffee shop and market on this $ize of lot would be a
jumbled up affair" that if It were to be market with
parking that would cover the entire area possibly he
and his neighbors would look at It in a different light.
Mrs. Howard stated this was a two lane street and not
designed for heavy traffic;'that bringing business in there
would create a real problem.
IN REBUTTAL Mr. Eddy stated he used nothing but A.I.A.
architects on his buildings; that he was presently develop-
ing projects in'Los Angeles including eleven houses and
one hundred thirty units, garden type, spread over five
acreas of land; that' he was improving for the City of
Los Angeles three streets with curbs, gutters, sidewalks
and lights; that he was building fifteen units with off
site improvements in Hollywood; that he felt he could
develop this piece of property in such a way that it
would enhance the area; that in his opinion there would
be no problem with the freeway off ramp; that if the
other people want to come in and build a shopping center
they would not object to it.
Discussion followed regarding Mr. Welch's deed wherein
City Attorney Flandrick suggested if the Council so
desired that the Council could continue this hearing
to the next meeting and ask the applicant to meet with
City Engineer French to determine the exact boundaries
of the applicant's property.
Mr. Thomas Hurley stated he did own the property; that he
had a map from the Title Insurance Company which showed
the outline'of the property as it was shown on the map
on the wall.
Mr. Baer, 856 Frazier Street, Baldwin Park, indicated
the application should be considered on other merits"
besides just whether or not they had sufficient area.
IN REBUTTAL Mr. Eddy stated it indicated" this property
would be good as C-2 if at one time It was C-2; that
the City changed the'zone to R-3; and that nothing had
been done with the property as R-3.
Mrs. Baer stated she had had C-2 zoning on two pieces
of her property which had been developed into rentals
under the multiple dwelling rezoning; that she could
not see why the applicant should have the C-2 zoning
and not the rest of the property owners who used to
have C-2 zoning.
Mr. B. W. Jensen, 13008 Judith Avenue, Baldwin Park,
stated in his opinion'there should not be commercial
zoning on that corner.

determined actual water flow on proposed Dunia sixty feet
wide) through the unlined six foot or seven foot drainage
ditch to Harlan. He suggested checking rain charts, square
footage of areas involved, existing elevations and so forth.
He further stated'that Mr. Baker had gone to the City to
have the water which ran along the north side and across
the back of Ms property diverted; that the water still ran
across the back of the Ba lkus property. He questioned the
dangers involved by either an-open or closed drainage ditch
and,who would maintain It, the safety of children, erosion,
mosquito control, etc. and that the map did not show a
cul-de-sac on Duni;a against adjacent property. He pointed
out the question of future development stating that Dunia
was shown as sixty feet wide, a drainage ditch eight feet
wide and Harlan as sixty feet wide which would lead to the
assumption that the street would connect and if so fifty-
two feet of the Balkus developed lot would have to be
donated to help someone else develop. He further stated
that he felt the tract could be designed and developed so
as to eliminate any problems but that this should be done
now and he requested that the tract be held in abeyance
until all problems were resolved.
Council discussion followed regarding the double barreled
dog leg Norco)'; that lot sizes were uneven; drainage
regarding the tract to the south; drainage easement from
Norco; possible undergound drainage and drainage at Center
and Benbow.
City'Engineer French stated that the Master Plan
as drawn by Simon Eisner showed Harlan and Dunia
connecting making a full intersection wherein Council-
man Crites pointed out that there was a wall on the
property which did not show up on the map.
City Engineer French suggested the Council could give
tentative approval and the engineer could resolve some
of the problems; that some of the problems would not'
be resolved 100% until the entire area was developed.
Discussion followed that the water from Olive Street
flowed down Dunia; that' the cul-de-sac street or,ly
collected what it generated of its own;' that an under-
ground drainage would possibly take care of that; that
something would have to be done with the drainage on
Dunia; that due to the fact of the houses being built
so close to the street on Benbow it was impossible to
ask for any more right-of-way; that if Benbow'remained
a fifty foot street with the center of the street
being moved over five feet to allow proper development
for this area the sidewalks would be adjacent to the
curb and that would be the pattern to follow on out to
Center S'treet; that the water draining off of the side
of the'property now would tend to drain down Dunia
Avenue.
City Engineer'French stated that Norco Street, the
cul-de-sac street drained back to Dunia at the periphery
of the tract; that the only drainage that would go to
the drainage easement was the part within this sub-
division-and from Dunia; that if the Council wished
the water could be drained down Harlan and make him
acqui're'the property or right-of-way it could be stated
as a requirement for the health and welfare of the
people of the area.
City Attorney Flandrick stated the Council could require
certain off site requirements if the subdivider was given
certain alternatives; for example if the Council found
that the street access was insufficient for the lots pro-
posed'the subdivider could be given alternatives either
acquire sufficient additional right of way or redesign

the tentative tract. He pointed out that the tract map
on the wall was different than the one submitted to the
Council in their folders.
Further d'i'scussion followed regarding the design of
Benbow Street, the well and the easements to this well
and the drainage.
City Attorney Flandrick-explained that if the Council took
no action by"December 5,1964J.' either approval or denial,
the City Clerk would be required to certify'to the tract
map as submitted with the conditions as approved by the
Planning Commission. He stated the subdivider could agree
to a time extension if present.
Further discussion followed regarding the problems. Council
considered approving the tentative map and requested that
changes be made in the final map, however, City Attorney
Flandrick explained that if the tentative were approved
as presented then the final if presented the same way
would have to be approved.
Mayor Morehead asked if there was anyone in attendance
representing the tract.
COUNCILMAN CRITES MOVED THAT TENTATIVE TRACT MAP FOR TRACT MOTION MADE AND
NO, 30159 AS REVISED BE DENIED AS OF DECEMBER 2, 1964, AND CARRIED THAT TENT.
THAT THE BASIS FOR THE DENIAL IS THAT THE STREET PATTERN TRACT NO, 30159 AS
AS SHOWN ON THE TENTATIVE TRACT MAP WILL NOT PROPERLY REVISED BE DENIED
SERVICE THE LOTS AS SHOWN ON THAT MAP AND WILL CAUSE A AS OF DEC. 2, 1964
DETRIMENT TO IMMEDIATELY ADJACENT AND ABUTTING PROPERTIES
AND PROPERTY GUNNERS AND THAT THERE IS A SERIOUS STORM WATERS
DISPOSAL PROBLEM THAT HAS NOT BEEN SOLVED BY THE SUBM138ION
OF THE MAP AS DESIGNED AND THAT THE MAP AS SUBMITTED DOES
NOT COMPLY WITH THE BALDW I N PARK ZONING REGULATIONS OR
WITH THE BALDW I N PARK SUBDIVISION REGULAT IONS AND THAT
THE CITY ATTORNEY IS DIRECTED TO PREPARE A RESOLUTION
RATIFYING THE ACTION TAKEN BY THE CITY COUNCIL AS CF
DECEMBER 2, 1964, IN THE DENIAL OF TENTATIVE MAP FOR
TRACT NO, 30159. COUNCILMAN ADAIR SECONDED. The
motion carried by the following vote:

City Clerk Balkus suggested that notices be sent when NOTIFICATION OF
Tentative Tracts were being considered. PROPERTY OWNERS RE

COUNCILWOMAN GREGORY MOVED THAT THE EXISTING CODE
PROVISIONS BE AMENDED RELATING TO TENTATIVE TRACT
MAPS TO REQUIRE THAT AS A PART OF THE SUBMISSION
OF TENTATIVE TRACT THAT THE APPLICANT SUBMIT
ADDITIONAL COPIES, SMALL LETTER SIZE COPIES, OF
THE MAP AS PROPOSED SHOWING THE GENERAL LOCATION OF
LOTS, LOTS, STREETS AND SO FORTH AND THAT THESE COPIES
BE MAILED TO PROPERTY OWNERS WITHIN 300 FEET OF THE
BOUNDARIES OF THE TRACT SO THAT THEY ARE MADE AWARE
OF THE PROPOSAL TOGETHER WITH WRITTEN NOTICE OF THE
T iME AND PLACE THAT THE MATTER WOULD BE CONSIDERED
BOTH BY THE PLANNING COMMISSION AND BY THE CITY COUNCIL.
COUNCILMAN CRITES SECONDED.
City Attorney Flandrick stated, in clarification of the
motion, that the instruction would be to make the
suitable ordinance change to accomplish the notiflca-
tion regarding tentative tract maps to property owners
within 300 feet of the boundaries of the tentative
tract and pending the preparation and adoption of this
ordinance that all tentative tract maps which were
