In accordance with Section 2703 of the'Municipal Code the
City Council met at 7:00 p.m. in the Conference Room for
an informal session with the staff to be informed on
regular agenda items. A press representative was in
attendance.
The City Council of the City of Baldwin Park me

There were no objections, the motion carried and was so

Mr. Scottie South, 4142 Bogart Street, Baldwin Park, SCOTTIE SOUTH,
stated he occupied a garage at 14515 Ramona Boulevard; 4142 Bogart St.,
that he had contacted the City before he moved into the B•.Pk.
garage; that the records were checked and he was told he
could have an auto repair garage at this location; that
he had run advertisements in the newspaper and painted
signs on the building and had been in business close to
thirty 30) days when he received a citation; that he
removed and replaced parts on automobiles; that he did
no welding and-stored no chemicals that were explosive;
that he had been refused a City license.
Chief Administrative Officer Nordby stated Mr. South did
call the kicense Clerk to inquire about the zoning and
whether or not the structure at this particular location
could be used for this purpose; that it was checked and
the answer to the question was in the affirmative that
it was in the proper zone; that he also inquired and was
told about the license rates; that Mr. South did not
apply for his license until after he was in business;
that upon receipt of an application for a license was
when other departments were alerted to determine the
condition of the structure and whether or not there were
any deficiencies; that activity had been noticed in the
building and Mr. Downer, Building Inspector, had been

Regular Meeting of the Baldwin Park City Council,
alerted; that he along with Mr. Taylor, Fire Inspector,
inspected the building; that it had been determined that
the structure was deficient in several respects and he
could no longer operate. 1
Mr. South brought out that the building was made out of
red brick and that it had an iron and tin roof; that he
understood there was a thirty'(30) day grace as he was
moving into business and getting set up to get his City
license.
Further discussion followed.
COUNCILMAN MCCARON MOVE) THAT THE DIRECTOR OF FINANCE BE
DIRECTED TO ISSUE THE BUSINESS LICENSE AND ASK BUILDING
SUPERINTENDENT KALBFLEISCH AND THE COUNTY FIRE DEPARTMENT
TO REINSPECT THE BUILDING AND ADVISE COUNCIL AND MR. SOUTH
EXACTLY WHAT DEFICIENCIES, IF ANY, EXIST. COUNCILMAN
CRITES SECONDED. There were no objections, the motion
carried and was so ordered by Mayor Morehead.
Discussion followed wherein Mayor Morehead stated Mr. South
could operate after obtaining a business license) until
such time as he was told to close down.
City Clerk Balkus passed a letter to the Council dated
December 10, 1964, from Mrs. Willard F. Hostetler, 14622
East Baldwin Avenue, Baldwin Park, and stated she was in
the audience and wished to speak.
Mrs. Hostetler, 14622 East Baldwin Avenue, Baldwin Park,
requested a waiver on curbs, gutters and sidewalks stating
that she wanted to build an addition on her home; that she
did not-feel the street warranted curbs, gutters and side-
walks at this time; that it was a private street; that it
would be a detriment as the water from her porperty would
run into the neighbor's property.
Discussion followed.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL WAIVE
THE APPLICATION OF THE CHAPTER REQUIRING CURBS, GUTTERS,
AND S IDBNALKS TO THE HOSTETLER PROPERTY AT 14622 EAST
BALDWIN AVENUE PROVIDING THAT SHE AND MR. HOSTETLER WILL
ENTER INTO AN AGREEMENT WITH THE CITY PROVIDING THAT IF
AT ANY TIME IN THE FUTURE AN IMPROVEMENT DISTRICT WAS
FORMED FOR THE RECONSTRUCTION OF IMPROVEMENTS IN AND ALONG
THE STREET THEY WILL NOT PROTEST THE DISTRICT. COUNCILMAN
ADAIR SECONDED, The motion carried by the following vote:

Mr. Hugo Biaselli, 4050 Baldwin Park Boulevard, Baldwin HUGO BIASELLI,
Park, stated his license fee for a shoe repair shop since 4050 B.Pk. Blvd.,
the time of incorporation had been $12.00; that now he B.Pk.
had been reclassified from Section 6152 to 6129 and his
fee was now $28.00.
Finance Director Duncan explained that the City had
simplified all of the license categories for 1965 licenses
trying to obtain a fair and equitable distribution; that
Section 6129 was retail, wholesale and manufacturing
businesses and other businesses not otherwise provided
for; that the cobblers category was adopted in 1956 and the
fee was $12.00 while other similar small businesses were
charged $24.00 and barber shops were paying $18.00.

City Attorney Flandrick reviewed the case and stated there
was a provision in the resolution granting the zone variance
that the time could be extended for a period of not to ex-
ceed six months.

Discussion followed concerning the existing agreement re-
garding the demolition of three structures on the subject
property which provided for the demolition to be accomplished
prior to December 31, 1964 provided that said time limit
may be extended for a period not to exceed one 1) year,
by the City Council of the City, upon good cause appearing
therefor".
Mr. Charles E. Berthel stated he was requesting the exten- CHARLES BERTHEL

forth he did not have the money to remove the remaining two
houses this year; that if the extension was granted he would
remove them within the next year.
Discussion followed wherein it was brought out that the
houses were occupied; that the houses were not under
condemnation at the present time.

City Clerk Balkus presented a letter from Avon Products
regarding solicitors licenses for 1965.
Mr. J. L. Bernousky, 2940 East Foothill Boulevard, Pasadena,
explained that Avon representatives were housewives who
worked on a part time basis; that there were five full
time routes in the City of Baldwin Park and five to nine
representatives to cover these routes; that these
representatives did not stay with the company sometimes
as long as a year; that he would like to propose to the
City Council a principals solicitors license be added as an
and if" to the present ordinance; that they would be very
happy as a company to pay for the five full time routes
coming to approximately $140.00 and let each representative
pay the $2.00 as they register.
Discussion followed that the City had processed approximately
sixty applications during this year but only four licenses
had been issued; that the Avon representatives were in-
dependent contractors.
The Council held this matter over and referred the matter
to the Chief Administrative Officer and the City Attorney
for study and suggestion by the next meeting.

City Clerk Balkus presented a letter from California
Property Brokers Ltd. regarding acceptance and release
of bonds on Tract Nos. 29496 and 29528.
City Engineer French presented his report.
COUNCILWOMAN GREGORY MOVED THAT THE IMPROVEMENT BONDS BE
RELEASED AND THE CASH DEPOSIT BE RETAINED UNTIL THE LIGHTS
HAVE BEEN INSTALLED. COUNCILMAN ADAIR SECONDED. The

1964, from R. E. Weiss of Wiener and Weiss regarding

tract had been denied by Council resolution at the last
regular meeting; that no hearing had been held nor was
one required.

Regular Meeting of the Baldwin Park City Council
Councilwoman Gregory stated that she had attended the
ground breaking ceremonies of the new building of the
San Gabriel Valley Daily Tribune to be located on Azusa
Canyon Road in West Covina.

Councilman Crites stated he had attended the dedication
of a new County Library in Gardena.

City Attorney Flandrick stated at the last Planning
Commission Meeting a conditional use permit CP-45)
was approved to operate and maintain a nursing and
convalescent hospital at 3686, 3674, 3672'N. Vineland
Avenue; that, as a condition of approval it was required
that the existing buildings and structures not up to Code
be demolished and that the applicant execute an agreement
with the City providing for the demolition within a period
of time stated, namely one year after construction of the
first unit of the new development; and that the applicant
deposit a corporate surety bond in the amount of $5,000.00
to insure faithful performance and that the surety on the
bond shall be liable to the City for the sum of $25,00
per each and every day such failure occurs. Mr. Flandrick
presented the agreement for Council approval.

BE AUTHORIZED TO EXECUTE THIS AGREEMENT ON BEHALF OF THE

Chief Administrative Officer Nordby presented his report
on Franchise Webster's Refuse Disposal and a proposed
agreement and recommended that in some form the City grant
a franchise or approve the agreement with Webster's Refuse
Disposal.
Mr. Harry J. Ott i ng, President, Webster's Refuse Disposal,
stated that all of the blank spaces on page 3 that needed
to be filled in in the agreement should read 54%.
It was brought out that the commencement date of the agree-
ment should read March 1965 not March 1964.
Discussion followed regarding Item 6 c) requiring four-
fifths vote of the Council and the suggestion of
a majority vote but this was not changed.

weight of container and contents to seventy-five 75)
pounds. Mr. Otting commented that seventy-five pounds
was normal throughout the area; that at the present time
these limits were not held to entirely; and regarding
maximum weight from any one place of service he stated
he preferred this to be one cubic yard or one hundred
pounds.
Discussion followed wherein Council decided to change
Section 5211 e) in proposed Ordinance No. 391 to read
116M IMUMWEIGHT. There shall be a maximum amount of
garbage or rubbish to be collected from any one place of
service at any one time of not to exceed one hundred

City Engineer French reviewed his report regarding the
stump cutter which requested that the Public Works
Department be authorized to purchase the Model 10
Vermeer Power Stump Cutter for $3,889.60 without
obtaining competitive bids. He stated that this was
the only stump cutter available on the west coast with-
in the budgeted amount that met the specifications of
the department.
Chief Administrative Officer Nordby stated that the stump
cutter could be purchased in the third quarter and pay-
ment would be scheduled in the fourth quarter when funds
would be available.

City Engineer French stated he had placed Final Tract Map
No. 29239 on the Agenda with the understanding that the
subdivider would supply the Subdivision Map, Subdivision
Agreement and a signed tract map prior to the Council
Meeting; that these had not been submitted and he requested
that this Item be dropped from the Agenda.
As there were no objections from the Council, Mayor More-
head ordered this item dropped from the Agenda.

Councilwoman Gregory asked if the Council wished to take
up the matter of the Personnel'Board under Unfinished
Business.
As there were no objections, Councilwoman Gregory passed
to the Council copies of a draft ordinance on the creation
of a Personnel Board.
Discussion followed wherein it was decided that two
members of the Board would be appointed by Council,
two by the Employees Association and the four members
would select a fifth member; that none of the members
would be an employee or member of any Commission or
Council; that Department Heads and the Chief Administra-
tive Officer would not be affected, only employees below
these categories.
City Attorney Flandrick stated if this ordinance were
adopted as amended there were provisions regarding appeal
in the Municipal Code that would have to be changed and
it would be necessary to hold a public hearing on these
changes prior to the adoption of this ordinance.
Discussion followed wherein it was the opinion of the
majority of the Council that the employees should have
the right to appeal the decision of the Personnel Board
to the Council.
Discussion followed regarding the power of subpoena
wherein City Attorney Flandrick stated it was his
opinion that this power could not be given to a Board
or Commission.
Council decided that reappointments would be handled
in the same manner as appointments; that the removal of
any member would be by Council; that there would be
four year terms with the initial terms to be staggered
as in the case of the Board of Zoning Adjustments.
City Attorney Flandrick read Section a) as it would be
amended. There were no objections.
Discussion followed that the Employees Association would
probably select two members by written ballot or however
they designate as long as a majority of the membership
vote in favor of the two individuals.

the City had participated in and stated he had been asked

Chief Administrative Officer Nordby stated he had an
appointment in his office on December 17, 1964, at

President of the Baldwin Park High School Braves
Booster Club; that he would be giving Council a report
regarding this meeting as to what they proposed.
