The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. In accordance with Section 2703 of the Municipal Code the City Council met at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items. Mayor Morehead led the salute to the flag. FLAG SALUTE Roll Call: Present: COUNCILMEN ADAIR, CRITES, ROLL CALL GREGORY, MCCARON AND MAYOR MOREHEAD Absent: PLANNING DIRECTOR AND BUILDING. SUPERINTENDENT KALBFLEISCH Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, CITY ENGINEER FRENCH, FINANCE DIRECTOR DUNCAN, PLANNING DRAFTSMAN BRUt4K, CITY TREASURER PUGH AND CITY CLERK BALKUS Acting Chief of Police Adams arrived at 7:50 p.m.) 00- CGUNC I LWOMAN GREGORY MOVED THAT THE MINUTES OF MARCH 4, 1963, MINUTES OF MAR. 4, BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN 1963, APPROVED ADAIR SECONDED. There were no objections, the motion carried AND FURTHER READING and was so ordered by Mayor Morehead. VIAIVED 00- Mr. Robert Weiss, Attorney At Law, 240 West Badillo Street, ROBERT WEISS, ATTY., Covina, stated they appreciated the opportunity to appear 240 W Badillo St., this evening in connection with this particular tract and Covina, Tract 30159 particularly with its denial; that his clients were shocked at a denial particularly in light of the fact the hearing was had without their having been advised of the hearing; that they did not know what the City records disclose but anyway they were not told that there was a hearing; that they were particularly shocked in light of the fact in regard to the denial came after a recommendation from the Planning Commission; that they had looked over the minutes of the Council meeting and the resolution Council adopted at the meeting which adopted denial was made; that they did not really understand why the denial; that they had a rather extensive study that was done as to the drainage or perhaps drainage problems; that they did not think the problem existed however if it did they would like the opportunity to develop the problem and perhaps assist in it's correction not only for their own tract but for the adjacent area; that Mr. Tracy Bousman, their engineer, was there this evening and if the Council would wish they could make a presentation of the drainage situation; that as to the other reasons given regarding the denial no doubt they were valid, certainly this Body would not adopt reasons that were not valid, however they were somewhat unexplained and certainly to their eyes unintelligible and ambiguous; that he would suggest this, if the Council could feel free at this time to vacate the resolution denying this particular tract map especially in light of the fact that the map, to a great extent was developed by the City Engineer; that they would suggest perhaps some workshop study be developed as between themselves, that is to say my clients and the people within the City who were cognizant with the City's Continued) BIB] 39576-U01 1965-U02 01-U02 06-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116848-U03 DO116849-U03 C4-U03 MINUTES1-U03 4/29/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1965 01 06 CC MINHÄ—@¸—-èÍ«21455' Regular Meeting of the Baldwin Park pity Council January 6, 1965 problems and with the development of this particular piece of property so they could go on perhaps in thirty or forty- five days after having the matter properly referenced out and come back before this Board to see if they could develop something that could be approved; that certainly it was not within his clients best interest nor within the best interest of the City to leave the land fallow without being developed; that it was going to be developed some day; that well might just as well make an honest effort and have the Council and his people try to do it now; that if this suggestion meets with any approval at all we" certainly would like an opportunity to carry through with this. In answer to a question by Councilman McCaron, City Attorney Flandrick stated that the resolution had been adopted; that this Body operated under Robert's Rules of Order; that there could not be a motion to reconsider; that the applicant could submit the map making the necessary revisions in conformance with the Code.,; Mayor Morehead stated even up to this point he saw no change in the design of the tract;, that he saw the same points this evening that he saw three-weeks ago when he voted against the tract; that this area had been before the Council before and it had been rejected; that each time it had come up for approval there was additional lots added which to him made the consideration of the tract more difficult; that he saw no improvement in the design of the tract for drainage; that in his opinion there was a portion of the area that was a bottleneck for drain- age and since Harlan Street was not open all the way through to Los Angeles Street he visualized the'entire area which now was flooded when it rained, which stands and soaks into the ground,would be completely drained by the improvement of this tract; that this water rushing down Harlan Street with only two outlets at Demblon and two streets north of Los Angeles Street where Harlan dead ends. Page 2 Mr. Weiss stated perhaps it was because he had the flu and was very inarticulate tonight, he would suggest that he had not'made himself understood; that he was not suggesting at this time that their map was proper; that obviously this Council dealt in good faith and had suggested that there were drainage problems, that their map didn't completely satisfy these drainage problems; that what he was saying was this rather than perfunctorily with- out notice of the hearing say your map is not good, it does not satisfy the best interests of the people of this City and therefore we deny, he thought they were entitled to go forward with the help of the people within the City and with all due respect your Honor the Mayor is not a professional in planning just as he was not nor he didn't suppose a drainage engineer; that perhaps there were persons within the City who could assist in that so that with all these people helping including his client's assistance and the City perhaps we" could get rid of this drainage problem; that we" were not going to solve it just by walking away from it; granted there had been three maps before and there might be more maps; that they were going to be rather persistent' at it he had to admit; that he thought the City-owed it to them to assist them if nothing else in going forward; that the City dealt for all of the people within the City; and if he might address a comment to the City Attorney certainly this Body operated within Robert's Rules; that he still would think that they could move to have it reconsidered; that there must be some way this could be done rather than simply deny it and say go start from scratch; that he would again impress Continued) BIB] 39576-U01 1965-U02 01-U02 06-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116848-U03 DO116849-U03 C4-U03 MINUTES1-U03 4/29/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1965 01 06 CC MINHÄ—@¸—-èÍ«Regular Meeting of the Baldwin Park City Council January 6, 1965X,6 Page 3 I upon this Body that the City Engineer basically developed this design, at any rate this was what he was told; prior to the approval by the Planning Commission another design had been submitted; that it was suggested by the City Engineer that it be changed to conform with this"particular plan, not their original plan. Mayor Morehead asked City Engineer French if he had any comment to which City Engineer French answered not really". Councilman McCaron stated it appeared on advice of the City Attorney that they had no course to take; that there was no motion to be made; that according to the City Attorney they would have to resubmit the tract and that was all that the Couddilcould do at the present moment; that if the Council was advised that they could proceed on some course then he would say the Council should but otherwise not; that it should be taken up with the proper department and all of the things that were found wrong with the tentative tract map should be corrected and re- presented.- Mr. Weiss stated the easement situations were problems of title; that this was up to them to take care of and they would; that they could not go of.record without that. In answer to Mayor Morehead, Attorney Flandrick stated' that the map could be resubmitted; that the staff was'now apparently aware of the Council's feeling regarding this matter; that if the map was resubmitted he was sure Mr. Kalbfleisch and Mr. French would work with the applicant to attempt to solve the problems. Mr. Weiss asked if it was suggested that they start from scratch as it were, resubmit, reapply, repay the fees and begin all over. City Attorney Flandrick answered yes sir". Mr. Weiss stated he would respectfully move, if at all possible, that certainly at least the fees be waived in this instance and he would again suggest that there was a hearing on this matter without notice to the applicant; that he thought it was abjectly unfair; that the people who were involved were taxpayers and property owners in the City and their interests should be considered and this was certainly one of their interests; that he would also suggest that by reason of fact that a prominent City employee owned property immediately adjacent and contiguous to this property that the City should not let any eye or view or thought of anyone indicated here in these particular dealings that there may be an item of discrimination and for that reason he thought that particular attention should be paid to this tract. City Attorney Flandrick stated there was not a require- ment for a hearing. Mr. Weiss stated he recognized that. City Attorney Flandrick stated that the State law says that once the Planning Commission had acted on the map it automatically came up at the next regular council Meeting; that Mr. Bousmen had been involved in many other tracts in the City. Mr. Weiss stated they understood that and they also understood that it was customary to give notice of these hearings. City Attorney Flandrick stated no it was not customary. Mayor Morehead stated that was the way it was explained to him that it would have to be handled; that if he would adivse his clients to take that action, start over and see what happens, that was all that could be done tonight or until his client initiates further filing. Mr. Weiss stated Mr. Mayor I promise you we will initiate some action, I an not quite sure what it is. Thank you for having us here, we appreciate it." 00- Mr. Wes Travis, Travis Realty, did not come forward when his name was called. 00- Acting Chief of Police Adams arrived at 7:50 p.m. 00- City Clerk Balkus presented a letter dated December 9, 1964, from Real Estate Brokers, which requested the Council to review the license fee and scheduling the Real Estate Brokers under Section 6128 Professional $28.00 Fee. Mayor Morehead asked if anyone was present who wished to speak regarding this matter. No one came forward. COUNCILWOMAN GREGORY MOVED THAT THE LICENSE FEES FOR THE REAL ESTATE BROKERS REMAIN AS REVISED. COUNCILMAN ADAIR SECONDED. The motion carried by the following vote: AYES COUNCILMEN GREGORY, ADA I R, CR I T ES MCCARON AND MAYOR MOREHEAD NOES NONE ABSENT: NONE 00- City Clerk Balkus read in full a letter from William Geisler received December 15, 1964, regarding paint- ing house numbers on the curbs throughout the City. Council discussion followed regarding possibility of City's name being used as a way to get donations; that this type of business should be a licensed business within the City and a fee established; that there should be a set charge established for this painting; that the color of paint, size of numbers and placement should be regulated by the City Engineer; that permission should be obtained from the owner or occupant before painting the number on the curb. The Council instructed the Chief Administrative Officer to write a letter to this gentleman and explain the Council's feelings and if he desires to puruse this matter further that he make a request to the City for a business license. CCUNCILMAN MCCARON MOVED THAT THIS BE REFERRED TO THE CHIT ADMINISTRATIVE OFFICER AND CITY ENGINEER FCR A M''e i G WITH THE STATE DIVISION OF HIGRVAYS AND RETURN W 1 H 1L Ji HER INFORMATION, COUNCILWOMAN GREGORY SECONDED, There were no objections, the motion carried and was so ordavei by Mayor Morehead. 00_ City Clerk Balkus presented Resolution No.- 4769 from the City of Azusa which urged the State Legislature and the State Division of Highways to amend the proposed Hunting- ton Beach Freeway, Route 39, so as to eliminate that portion between the Pomona Freeway, Route 60 and the Foot- hill Freeway, Route 210. She stated that similar resolu- tions had been received from Covina and West Covina. Chief Administrative Officer Nordby stated that he and the City Engineer agreed that the City should. not oppose entirely the construction of the freeway; that it did create problems in neighboring cities. He stated that a similar resolution had also been received from La Puente. Discussion followed wherein Chief Administrative Officer Nordby stated later in the meeting a request would be made for an adjourned meeting and that he could present a resolution in connection with this matter at the adjourned meeting. As there was no ob3ection from the Council, Mayor Morehead stated this matter would be held over for the time being. 00- City Clerk Balkus administered the Oath to those in the audience desiring to be heard during the meeting, 00- City Clerk Balkus announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on Z-258, an application submitted by Ralph Nathanson, et al for a change of zone, from R-2 light multiple family residential zone) to C-l neighbor- hood commercial zone), or more restrictive zone, for property located at 1648, 1650, 1652 North Big Dalton Avenue. City Clerk Balkus stated that the proper publication, mailings and postings had been accomplished. Planning Draftsman Brunk presented a resume of the case and stated that the Planning Commission had adopted Resolution No. PC 64-132 recommending approval of the request from R-2 to R-3 on November 25, 1964. Mr. Marshall Hadley, 14304 East Ramona Boulevard, Attorney for Mrs. Ruby Hendricks, stated that Mrs. Hendricks wanted to expand her existing nonconforming use to a fifteen bed home; that some of the past confusion had centered around the completion of the proposed cul-de-sac to the'west side of her property; that if the cul-de-sac were completed it would mean taking a good portion of her property to complete it; that there were three homes on the west side of the cul-de-sac; that they now had adequate street facilities; that there were no plans for the development of the balance January 6, 1965 Page 6 PUBLIC HEARING DECLARED CLOSED Z-258 ORD. Mr. Westover, 8867 East Mission Drive, Rosemead, Corlin Construction Corporation, Covina, came up to the map on the wa!l. He pointed out the existing portion of the rest home; that this was a central hall plan; that the completion of the cul-de-sac as shown on the map would make it prohibitive to construct this type of building. CP-43 Councilman McCaron stated there were several questions he would like to have answered. As there were no objections, Mayor Morehead declared the PUBLIC HEARING public hearing on CP-43 reopened. REOPENED CP-43 In answer to questions by Councilman McCaron, Mr. Hadley stated he thought the law was that there was a fifteen total limitation on this type of unit. Mrs. Ruby Hendricks, 3717 Foster, stated the people in her rest home were called well walking ambulatory people. Councilman McCaron asked how much of the street could be developed and still maintain the proposed plan. Mr. Westover stated there could be a turn around with seventy feet across the circle. As there was no one else in the audience desiring to. speak either in behalf of or in opposition to CP-43, Mayor Morehead declared the public hearing closed. City Clerk Balkus stated that the proper publication had been accomplished. TESTIMONY IN FAVOR CF THE PROPOSED TRUCK ROUTES WAS-CALLED FOR BY MAYOR MOREHEAD. Mrs. Clara Franklin, co-owner of Renfro-Franklin Co., Inc., 14820 East Ramona, stated they were in the wire business and had''been here for fifteen years; that they had a large truck and could not go on any of the north-south streets; that they had been before the City Council many times and had been told that something would be worked out; that their suppliers did not want to deliver to them; that sometimes they had-to wait two or three weeks for small orders; that they would like to be able to go north and'south without going to Peck Road to get to their back door. Mr. Ted Lackey, 14553 Chevalier Street, stated he did not feel qualified to speak for or against the proposal but there was a dire need for a way in and out of Baldwin Park more than the City presently had; that everything that Baldwin Park got was brought in by truck; that as he understood the truckers were to take the nearest route from the truck mute. Councilman Adair stated he had the same problems Mrs. Franklin had; that there had to be a north and south route for the trucks. Councilwoman Gregory stated she had noticed in Pomona that truck routes seemed to be on cement streets of a certain width and asked for comments from the City Engineer. City Engineer French stated that Pomona had many Cement streets that were not truck routes; that Pomona's truck route system was their Select System. Mrs. Franklin stated there were no truck routes from the freeway. Councilman Crites commented that the City used to have some truck routes in the City and some of the people ccmplained bitterly about them; that now the City had the different problem of not having any routes where the trucks legitimately travel and in his opinion it was time to get some; that Baldwin Park Boulevard was direct access from the freeway and it was a wide street and asked if it was adequately prepared to handle truck traffic. City Engineer French stated that Baldwin Park Boulevard's structural section was sufficient to handle truck traffic. City Engineer French brought out that there was no money budgeted for additional signals on Los Angeles Street; that the State had approved the plans; that underground preparation for signals became obsolete in approximatley five to six years. The second aspect of the problem was the existence of the losses in the amount of the $1100.00 claim from Mr. Lyons under the existing contract. He stated the Chief Administrative Officer recommended the Council consider favorably the m)tce#leneous lawsuit in return for which Mr•. Lyons woq#4 release claims that he may have against the City in the first sewer district. Councilman McCaron suggested negotiation first before any action is taken and require a written release. Council instructed the City Attorney and the Chief Administrative Officer to contact Ivor Lyons and inform him that Mr. Nordby will recommend to the Council at the next regular meeting that if he is willing to dismiss any and all claims against the City arising out of sewer assessment districts one and two, in return for that the City will dismiss the law suit with prejudice, and relinquish our claim against him.
