In accordance with Section 2703 of the Municipal Code the
City Council met at 7:00 p.fn. in the Conference Room for
an informal session with the staff to be informed on
regular agenda items.
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.

on the first page an addition be made in the margin to

Also that on Page 7, paragraph 4, of the July 15, 1964 minutes
be changed to read as follows: City Attorney Flandrick stated
there would be an additional savings of approximately $993.00
in the present action Baldwin Park vs. Baird) in terms of
the acquisition of right-of-way."

City Attorney Flandrick presented proposed Resoiuti.on No.
65-17. He stated this was a proposal to, set for public
hearing as to whether or not certain chang#s"should be

was at the request of the contractor.

City Attorney Flandrick stated his second item was a
request from the Department of Water and Power of the
City of.Los Angeles; that in the second sewer district
it was necessary to acquire certain easements for the
sewer line; that six of the parcels owned by the Depart-
ment of Water and Power were crossed by the sewer line;
that an order of irrmediate possession was obtained and
the sewer was constructed in these areas; that they
had finally reached an area of tentative agreement with
the District; that the initial evaluation of the parcels
was $1.00 each, nominal value,in that there was no
interference with their facilities; that the District
checked this out both from an engineering and legal
standpoint; that they felt they were entitled to a sum
of $300.00; that in view of the small amount and the
fact that there was approximately $1,200.00 saved in
this particular acquisition; that it was recommended
to the Council that this be approved and authorize the
payment of $300.00.

AUTHORIZED TO EXECUTE A STIPULATION JUDGMENT WITH THE

Little League for a stand at the southeast corner of Jerry

Highway.

Chief Administrative Officer Nordby presented his report
regarding the design engineers for the Storm Drain Pro-
tects which recommended that agreements be executed with
Walsh-Forkert-Hutchison and Lampman and Associates, a
joint venture, to design Flood Control Project No. 1701
cost to be charged to the 1964 bond proceeds) and with
Harold L. Johnson Engineering to design Project No. 604
to be financed from the residue of the 1958 bond pro-
ceeds).

no action be taken on this resolution until the other
cities which were more affected than Baldwin Park were
conferred with; that the officials in West Covina had now
withdrawn their original thinking and had suggested that
we do the same pending further study.
As there were no objections, Mayor Morehead stated this
matter would be held over for consideration at,.a future
date.

City Engineer French reviewed his report regarding the
final approval of Tract 30067. He stated that the sub-
divider had posted the necessary improvement bonds, cash
deposit and had signed the Subdivision Agreement; that the
final map conformed to the approved tentative map and
recommended that the proper officials be authorized to sign
said map.

City Clerk Balkus administered the Oath to those in the
audience desiring to be heard during the meeting.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on the proposed
Truck Routes.
City Clerk Balkus stated proper publication had been
accomplished.
City Attorney Flandrick stated that the City Engineer had
posted on the board the map showing the staff recommenda-
tion.
Mr. James Gibson, 13268 East Francisquito, Baldwin Park,
asked if it would be possible for the proposed truck
routes to be read.
Mayor Morehead stated the present truck routes were:
Ramona Boulevard from the westerly City limits to the
easterly City limits; a small portion of Joanbridge which
gives ingress and egress to M-1. property; and south of the
freeway on Dalewood. He stated that two weeks ago he had
proposed for a north and south street, Sierra Madre, from
Live Oak to Baldwin Park Boulevard, Baldwin Park Boulevard
to *he freeway, Los Angeles Street, when the improvement
had been completed which would probably be three or four
months from now, from the westerly to the easterly City
limits; that at such time as there were off and on ramps
from the San Gabriel River Freeway onto Ramona Boulevard
that Los Angeles Street, as to whether or not it should
be a truck route, should be reviewed; Francisquito from
Baldwin Park Boulevard southerly to the southerly City
limits.

stated he was in the kiddy ride business; that he lived 4246 Park Place,
in the City but his business was not here; that, in his B.Pk.
opinion, the Mayor's proposal was very.good; that it would
help him get in and out.of town, otherwise he was going
to have to move; that he parked his trucks on his property
which was M-I.
Mr. H. H. Erwing, 1712 Leewood Street, West Covina, stated H. H. ERWING,
he ran a business in the City, Auction Village; that he had 1712 Leewood St.,
a problem trying to get merchandise into Baldwin Park and W. Cov.
the only way to get it in was to truck it in; that without
a truck route coming into the downtown section of Baldwin
Park there was a real problem; that the proposal of coming
down Baldwin Park Boulevard was good and he went along
with this proposal.
Mr. Edward A.. Wren, 14835 Badillo Street, Baldwin Park, EDWARD A. WREN,
stated he was for the proposal to be able to get Garvey 144835 Badillo St.,
businesses associated with where his business was located; B.Pk.
that it made it possible for his trucks that needed
examination for license or to take their chauffeur's test
to reach the Highway Department; that he was in the truck
maintenance business.
Mr. Ray Cameron, 131402 Tracy, Baldwin Park, stated he was RAY CAMERON,
also in the trucking business; that there was no way of 131ao2 Tracy, B.Pk.
getting into this town at all legally with a truck; that
for him to go to West Covina or any place south legally he
had to go to Azusa Avenue east or Peck Road west and double
back; that he was for the proposed truck routes; that his
business was the Baldwin Park Transfer and Storage, 13916
East Ramona Boulevard.
Mr. Merle L. Cost, 4246 Park Place, Baldwin Park, stated MERLE L. COST,
he believed the Baldwin Park Boulevard truck route was a 4246 Park Place,
good idea; that it would make it much easier to get in and B.Pk.
out of town; that he had a kiddy ride business; that he
parked his equipment on his lot at his house; that his
property was M-I.
Mrs. Mildred Longan, with Renfro-Franklin Company, 14820 MILDRED LONGAN,
Ramona Boulevard, Baldwin Park, stated they had appeared Renfro-Franklin Co.,
before the Council a couple of times asking for truck IIA20 Ramona Blvd.,
routes; that it was hard for trucks to get in and out; B.Pk.
that Baldwin Park Boulevard would suit them fine, in
fact, any north or south route would.

route on Baldwin Park Boulevard all seemed reasonable;
that he believed there were conflicting interests; that
certainly it would make it more convenient perhaps for
selected commercial and manufacturing enterprises in the
City as well as those outside the City to be able to use
this thoroughfare as a means of ingress or egress as well
as a through route; that he believed when the inconveniences
were measured that a minority of businesses would be in-
convenienced against the inconvenience of the residents
that live on the proposed truck route as well as adjacent
to this street; that dust, dirt, fill gravel, refuse,
hazard to pedestrians, traffic on these streets as well as
congestion indicated overwhelmingly that Baldwin Park
Boulevard should not be. devoted to t+ti s purpose.

Mayor Morehead asked for Mr. Long's comments on Sierra
Madre, Los Angeles and Francisquito.
Mr. Long stated he was not really familiar with the extent
of the complete route; that, in his opinion, any present
residential streets should remain residential; that a
solution should be sought in the near future to simplify
this problem or to remove it; that he did not believe to
begin with that Baldwin Park Boulevard was constructed for
this type of traffic as far as the structure of the street,
the absence of sidewalks, and the bottleneck; that he did
not believe that the truck route on Baldwin Park Boulevard
would be in the best interests of the greatest number of
residents of the City; that from a tax standpoint he realized
how important it was to keep the commercial interests here;
that he believed that the tax burden would increase with
the increase in maintenance cost as well as the traffic
hazard.
Mrs. Dorothy Mol, 3503 Baldwin Park Boulevard, Baldwin MRS. DOROTHY MOL,
Park, stated she was testifying'against the proposed 3503 B.Pk. Blvd.,
truck route on Baldwin Park Boulevard; that she felt B.Pk.
Rivergrade Road could be used and come down Ramona Boule-
vard which was a much more commercial street.
Mayor Morehead explained that there was no way for the
trucks to get out of the City on Rivergrade Road from
Ramona; that there would be on and off ramps at Ramona
Boulevard from the San Gabriel River Freeway but that
construction was two to four years away.
Mrs. Mol asked where was the Planning Commission that they
did not plan a proper route and why were trees planted on
Baldwin Park Boulevard if it was going to be a truck route.
She stated that trucks caused cracks in the homes; that
residents were awakened at 3:30 a.m. and 4:30 a.m.; that
this was a truck route at one time and we" voted it down;
that there should be some way to get onto Ramona Boulevard.
Mr. Frank Williams, Baldwin Park Boulevard, Baldwin Park, FRANK WILLIAMS,
stated he was proud of the street; that he would not like B.Pk. Blvd., B.Pk.
to see trucks rolling over it, beating it up, strewing
rocks, sand and gravel.
Mrs. Lucy Scott, 3522 North Baldwin Park Boulevard, Baldwin MRS. LUCY'SCOTT,.
Park, stated she was a crossing guard for the City of 3522 N. B.Pk. Blvd.,
Baldwin Park in front of St. Johns; that she knew what B.Pk.
trucks could do to the streets as far as endangering the
children's lives; that the children from five schools
crossed in front of St. Johns; that the businessmen were
a minority in the town and we citizens" pay the taxes
and she believed they were a majority; that she was in
opposition.
Mr. Edwin Elko, 13057 E. Bess Avenue, Baldwin Park, stated EDWIN ELKO,
he was wondering if this question was not a couple of 13057 E. Bess Ave.,
years premature; that, in his opinion, truck routes B.Pk.
should be considered as more or less of a regional matter;
that the question should be solved by several cities in
the general area all getting together and establishing
truck routes; that unless'he was mistaken a truck making
a delivery had the right to go anywhere in the City of
Baldwin Park by taking the most direct route from the
truck route to the point of delivery; that he could see
no problem; that he did not think now was the time to
consider the proposed truck routes in light of the on and
off ramps which would be constructed from the San Gabriel
River Freeway.
Mrs. Gladys Dargus, 13260 East Francisquito, Baldwin Park, MRS. GLADYS DARGU6w
stated her only objection to a truck route on Sierra 13260 E. FranCis-
Madre was that there was a park there; that the County had quito, B.Pk.

approved a library on Sierra Madre; that there was Landis
School on Sierra Madre and several cross streets that
children cross to get to Margaret Heath and other elementary
schools; that there should be sidewalks on truck routes.

At the request of Mayor Morehead, City Clerk Balkus read LETTER FROM MRS.

Park Boulevard which indicated she was against truck routes 3579 B, Pk. Blvd.
without sidewalks and that the sidewalks should not be
put in at the homeowner's expense.
At the request of Mayor Morehead, City Clerk Balkus read RES, FROM B,PK.
a resolution from the Baldwin Park Chamber of Commerce CHAMBER OF COMMERCE
which indicated that the establishment of north, south
east and west truck routes was in the best interests of
the City.
As there was no one else in the audience desiring,to speak PUBLIC HEARING
either'in behalf of or in opposition to the proposed truck DECLARED CLOSED
routes, Mayor Morehead declared the public hearing closed.
In answer to a question by Mayor Morehead, City Engineer
French stated that the structural section of Baldwin Park
Boulevard was designed to carry trucks as required by the
State.
Councilman McCaron commented that the property owners be-
tween the freeway and Francisquito and two hundred feet
north had ask for C-2 zoning; that at the present time if
they have no access to the property they have no way of
being able to make deliveries; that a good deal of the
property on Baldwin Park Boulevard was going to R-3; that
Baldwin Park Boulevard had been signalized at Merced and
Francisquito; that the Catholic Church now had their
entrance for the children's playground on Baldwin Park
Boulevard; that, in his opinion, the entrance should be
changed to the side street; that there was a lot of traffic
on Baldwin Park Boulevard whether there were trucks or
not; that it had been proven that there had to be a route
for the development of the City north and south; that there
had to be access; that the longer it was delayed the longer
it prolonged the time that the industrial and commercial
areas of this City could progress; that there had to be
a decision as to whether or not Baldwin Park would remain
a bedroom City or improve and receive some of the benefits
of commercial business; that the businesses contribution
to the taxes in the City was considerable; that he be-
lieved the truck routes as Mayor Morehead outlined and
suggested seemed to be the most favorable; that they would
be mainly for the benefit of the residents and the people
doing business in Baldwin Park.
Councilman Adair stated that the routes that had been
considered should be the routes;. that the trucks were
8% of the traffic and were paying 24% of the road cost;
that each one of the trucks delivering in this town alms
paying a City license fee; that if Francisquito and Baldwin
Park Boulevard was going to be developed provisions for
delivery must be made.

Councilwoman Gregory stated she was against; that she had
jotted quite a few things down and surprisingly the neigh-
bors had come up with practically the same things; that it
had already been established that there were east and west
truck routes, Ramona, Arrow Highway and San Bernardino
Freeway; that north-south routes for trucks were Rivergrade
Road, Peck Road, Azusa Canyon Road, Irwindale Avenue, and
Azusa Avenue; that merchandise sold to and used by the
people of Baldwin Park was trucked in at the present time
and therefore made a lie of the fact that there was a need
for a truck route; that she was against having a truck
route that would allow every truck to drive through the
City nonstop to make deliveries to other cities; that when-
ever and wherever there was a request for a delivery to
anyone in the City at the present time this was allowed
by State law; that as for the cost of delivery everyone
knows that the charge for freight cartage was established
by Public Utilities or Interstate Commerce and through zones;
that it was through these area zones that the consumer
was charged; that this was the reason why Covina, West
Covina, Azusa, Baldwin Park and cities east paid a higher
rate for merchandise out of Los Angeles and notbecause the
deliveries were difficult to make in Baldwin Park; that
she believed Pomona used its Select System for trucks and
Pomona was a much larger city than the six and one-half
square miles which was Baldwin Park; that she was against
the truck route on the streets named; Sierra Madre for
one, for there was a park, a bowling alley, there will be
a public library, there were two schools and one boulevard
stop between all this; that she was against truck routes in
the City on nearly any street you may mention for one very
good reason; that we have no sidewalks to speak of; that
as one of the citizens so aptly put it Don't charge us
for sidewalks just so the trucks can use the streets"; that
if we were to have a truck route then there must be a
weight limit and she would say that the weight limit should
not exceed 20,000 pounds; that she believed this Council
owed this to the taxpaying citizens.
Councilman Crites stated that Baldwin Park Boulevard had
previously been a truck route with all of the dirt along
the edge of the pavement; that today with curbs and paving
all the way out to the curbing it would not be nearly so
dusty as it had been previously; that a street nearly twice
as wide as it was at one time should be safer; that it seemed
that additional north and south routes i n order to qua l i fy
for additional tax funds would help produce and maintain
a great number of projects; that it would definitely help
and'assist in maintaining these streets; that it appeared
with a couple minor variations of ingress and egress that
there was only one truck route provided or planned Borth
and south and he did not feet that this one particular
one north and south was going from any one city to any one
other city; that it was merely a means from going from the
north end of Baldwin to tfie south end.

I am protesting the way my asphalt driveway
end was finished to meet the higher sidewalk.
Powered cement was put on top loose and was
not rolled in."
City Engineer French stated this was work that the City
did over and above the work in the district'; that he
would have some men go out tomorrow and do what could
be done to square this off; that this was not part of the
cost of this district.
Mr. F. C. Renwick, 14516 Chevalier, Baldwin Park, stated
the sidewalks, curbs and gutters would be a wonderful
thing if it was done properly, that their cars dragged going
in and out the driveway; that a person up the street lost
his power steering unit going in; that he had talked
with a good 61% of the neighborhood and they did not agree
that this was a good job; that the contractor said that
the men that did this job were not cement men; that
the job was crummy; that he could do better blindfolded}
that he did not think this should be allowed, not for the
price they were being charged, it was not worth it;
that they already had sidewalks; that walking down the street
you could slip on a gravel driveway.
City Engineer French stated the work was done by a
licensed contractor licensed by the State; that the
cement work was done respectively In accordance with
the specifications; that the drive approaches were
not the standard driveway approaches for the City
of Baldwin Park but they were the type approaches that
the people in the area requested.
Mr. Renwick stated they did not request this; that they
did not know what they were getting or they would not
have signed.
Mr. Ted Lackey, 14553 Chevalier, Baldwin Park, stated
under date-of March 18, 1964, the City Engineer at that
time, Mr. Vincent T. Young, sent the City Council a
letter with a proposed street section attached; that
the last paragraph of the letter stated Since the street
was narrower than the standard and the request did not
comply with the standard as set forth in our City
ordinance the attached sketch is submitted to you for
City Council approval, the design for your recommendation
that the proper resolutions of intentions match the
specifications be made so that the 1911 Act may be
initiated. The Engineering staff recommends an adoption
an approval of this requested project."; that he had
not had any complaints from any of the residents; that
he had drawn up a plan and made a templet and showed
it to most of the people there; that the street was
only eight hundred feet long; that every 50 feet on
most of the lots there was a driveway; that if there
was a driveway approach across the entire sidewalk

Young he agreed to make the approach shorf and allow thirty

that it was realized this would not be an Ideal situation
but it was better than what they had.

City Attorney Flandrick stated that the Personnel Rules
adopted by this City on January 19, 1964, among other
things,, provided that a permanent employee who had received
any disciplinary action or suspension by a Department Head
had a right of appeal-to the City Council; that subsequent
to the adoption of these Rules the Council had introduced
an Ordinance, No. 392,which if adopted would have the effect
of creating a Personnel Board ano one of the duties of that
Board would be to hear appeals of disciplinary matters;

Planning Director Kalbfleisch presented a resume of the RESUME
case and stated that the Planning Commission had adopted
Resolution No. PC 64-138 recommending approval of the
request on December 23, 1964.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHALF
MAYOR MOREHEAD.
Mr.`Walter Middleton, 3692 Greyburn Road, Pasadena, owner, WALTER MIDDLETON
stated he was planning to dispose of the property to Harker 3692 Greyburn Rd.,
Development before and since there was talk about the truck Pasadena
routes on Baldwin Park Boulevard and Frandisgiiito; that in his
opinion it would be especially good if it were rezoned
because it made it almost impossible to develop the property
as R-1) with commercial zoning on the other three corners.
In answer to a question by Councilman McCaron, Mr. Middleton
stated it was proposed to develop both parcels as a unit.
Mr.-,Cha.nLeVeve, 10600 Katella, Anaheim, with Harker CHAN LEVEVE,
Development Company, stated anything he would say would 10600 Katella,
be redundant; that he would be, very happy to answer any Anaheim, Harker
questions the Council might have about their plans for Development Co.
development.
In answer to a question by Councilman McCaron, Mr. LeVeve stated they
were buying both Lots I and 2; that Mr. Middleton owned
one of the lots and Mr. Lerg owned the other lot; that
they were now in escrow and the escrow would close just
as soon as the zoning was completed.
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to Z-260, Mayor

Planning Director Kalbfleisch presented Lot Split No. 639,

North'Maine Avenue, Henry C. Reichert. He stated that
this case was recommended for approval.
City Clerk Balkus stated that a ten day waiver notice.had
been filed.
Discussion followed wherein Planning Director Kalbfleisch
stated the Planning Commission was presently studying
possible revisions in the Code to allow the possibility
of developing an R-i PD Plan Development) zone; that
there would be a minimum of 5,000 square feet for each
unit; that the Planning Commission would have the right
to request landscaping, the type of frontage and so forth.

City Engineer French stated that the item regarding the
claim of Vella Construction Company on Line 8A, Sewer Dis-
trict 62-A-I, had been continued from the last Council
Meeting; that he had a letter from Mr. Ivor Lyons regard-
ing this matter, which he read in full; that the City Clerk
and himself had reviewed the minutes and had found nothing
that would tend to clarify this matter any further than
Mr. Lyons' letter.
City Attorney Flandrick explained that the problem arose
in conjunction with a hearing which the Council held on
September 2, 1964, in the nature of a change order; that
the proposal at that time read as follows Section I b)
4) Line 8A. Extra cost, breakout and replace conc. sur-
face 41 cyd. $37.25. Approximate cost $1,527.25."; that
the contention of Vella Construction Company was that it
should have read breakout and remove; that the minutes in-
dicated that the Council approved the change order as
requested.
In answer to a question by Councilman McCaron, City Engineer
French stated this charge was the same charge that the City
had paid on other occasions for breakout and remove.
Mr. James Simms of Ivor Lyons and Associates stated there
was concrete broken out of this particular surface struc-
ture, which was a storm drain structure; that he believed
a portion of the resolution was missing; however, in the
same resolution in the very following item there was also
an error there in the language and fortunately they had
caught that the night that they read the resolution; that
the figure of $37.25 was the figure that was used in a
previous resolution of removal of concrete on Garvey and
elsewhere in District 2; that Mr. Vella neglected at the
time or somehow they neglected to see that the cost for
reinstatement of concrete was included in this particular
item; that this was in reference to that portion of sur-
face drainage structure in the easement east of Francis-
quito between Francisquito and Athol; that it was previously
a concrete V structure; that the whole thing was broken'
out and replaced.
In reponse to Councilman McCaron's comments, Mr. Simms
stated this was a ten 10) foot easement; that within this
easement there was a surface drainage structure; that Item

Line 8A as itemized on the resolution apparently stated
only the first portion of the intention of this resolu-
tion which,,wos the breakout and removal of the concrete;.,
that, gf.:course, then the sewer line was placed in the
ground and„''tonfortunately the resolution died not state
that they shad to put that in concrete as well, of course,
which-would have to be completed; that Mr!'Vella did com-
plete this work at the cost of $3,524.00; that again he
was saying that this particular item`a$ it was in the
resolution was not complete in its description; that un-
fortunately this happened to bethe resolution where we
had another error in the very following item; that there
was an error in mathematics again where the figure of
$37.25 was involved where it should have been $30.00;
that they: did feel that this was a legitimate claim and
Mr. Vella was obligated to replace the concrete that he
did remove; that he did so in good faith and they felt the
claim was justified.
Councilman McCaron stated he wou l.0 like to see a recap of
all of the items pertaining to the claim including the list
of figures and the actual balance owing.
In answer to a question by Mayor Morehead, City Engineer
French stated that the concrete was broken out and re-
placed; the problem was that when the bill was presented
he approved it based upon that resolution; that when the
extra bill of $3,500.00 came in he would not approve this
because the resolution stated breakout and replace.
City Attorney Flandrick stated there was an omission in
the resolution; that actually in this particular line 8A
the change as requested was in two parts; first breakout
and removal and second the replacement of the concrete.
Mayor Morehead asked what type of authority Vella Construc-
tion received in regard to this change order.
City Engineer French stated the records did not disclose
just what Mr. Vella was authorized to do.
Mr. Simms stated that, of course, the intention was that
the concrete be broken, removed, the sewer line laid
according to plans and then, of course, a similar struc-
ture constructed; that this was exactly what happened;
that after the public hearing not questioning the fore-
mat of this particular public hearing they, of course,
as the Engineer of Work authorized the contractor to
proceed with the work.
Councilman McCaron asked if another public hearing was
necessary.,
City Attorney Flandrick stated no that what was being
requested was in effect that an error be corrected; that
if the billing seemed reasonable and it appeared that a
mistake was made that the Council authorize payment and
correction of the minutes of September 2, 1964, to indi-
cate breakout, removal and replacement.
In answer to a question by Councilman McCaro n, City
Engineer French stated he was not here when this was
broke up; that the job was constructed and completed in
accordance with the plans; that the concrete was taken
out and replaced; that the discussions leading up to this
matter and the authorization would have gone through Mr.
Lyons' office.
In answer to a question by Councilman McCaron, Mr. Simms
stated that the original reason for bringing this up at
the time of the public hearing was the fact that they had
utilized an aerial survey in order to depict the topographical

features on their construction drawings; that this survey,
by contract, was furnished to them by the City of Baldwin
Park; that at the time of getting involved in this con-
tract they were working from what were called draft sur-
vey notes" that were furnished to them by the aerial sur-
vey people; that at the time the line was designed it was
not clear that this was a concrete surface structure;
that in any case whether it was a concrete structure, an
asphaltic structure, or what have you, it still became the
obvious route for the sewer line; that on the plans it was
not called out as a concrete surface structure it was
called outas an easement; that there was no showing of a
surfacing on the survey material that was furnished them
by the City; that at times it was difficult from aerial
photography, when there was folliage involved and what
have you, to accurately determine what the surface material
was; there was a doubt in their mind what it was and it
came out at the time of construction that it was a concrete
surface structure; that they had given consideration to
perhaps rerouting the line for the sewer line so they
again brought it up to public hearing at this date request-
ing the additional cost of this concrete; that unfortunately
there was this little complication in the writing of the
resolution of intention.
Councilman McCaron asked the City Engineer if he was
satisfied with that point.
City Engineer French stated he was satisfied with that
point.
In response to comments by Mayor Morehead, Mr. Simms
stated this was better than a million dollar program and
regardless of how many times one looked at the drawings and
the material one had to work from the drawings and items
like this do come up; that he had not yet seen a job that
he had worked on and the experiences that he had had when
the job was over one million dollars where changes of this
nature did not come up.
Councilman Crites commented that it was not normal for a
job to be bid on something that was concrete covered on the
terms of dig it up and put the pipe in without replacing it.
He asked who made the goof?
Mr. Simms stated he did not know; that he had written the
resolution of intention there would be a different story,
however he did not write the resolution of intention.
City Attorney Flandrick stated You did in fact write this
description, Mr. Simms".
Mr. Simms stated he did not recall writing it, however, he
did believe Mr. Vella was entitled to payment on this
particular item.
Mayor Morehead asked the City Engineer to furnish the
Council with a recommendation as far as the physical work
being done and his opinion as to whether it was-legal and
just.
City Engineer French stated he had completed theinspection
of the job and made a recommendation to the Council that
the job was finished; that a Notice of Completion had been
filed; that he could not make a determination as to whether
or not this was a just cost or not because he did not know
what led up to it; that the work was done and completed in
a workmanlike manner.

Councilwoman Gregory asked about the City owned property
at Badillo and Central along the wash.
Chief Administrative Officer Nordby stated there was an
application for a lot split on the property; that to open
up this property the City would have to acquire roughly
one-half of the lot which was being split; that he had
talked with the applicant and had nothing to report at
this time but would report at the next Council Meeting.

AAayor Morehead stated he had received a letter from Warren
Dorn, Los Angeles County Board of Supervisors, regarding
indecent literature and directed the City Attorney to take
this letter and come up with an appropriate resolution
supporting the Supervisors thinking on AB 87 and AB 207.

Mayor Morehead announced that it was the time and place
fixed for a public hearing on protests or objections
against the assessment levied for the improvement of
Assessment District Chevalier 1964.
Charles R. Martin, Special Counsel, stated the street had
been completed according to the plans and specifications;
that the purpose of the hearing tonight was to confirm
or modify the recommendations of the City Engineer with
regard to the spread of the assessment, his allocation
of the charges that have been imposed or incurred in
connection with the street improvement; that this was a
street improvement participated in as a joint venture
between the interested property owners and the-City, the City
doing a portion of the work at an estimated $2,000.00
and the property owners doing the balance; that the final
cost as apportioned to the property owners was $9,468.67;
that that amount had been spread by the City Engineer
in various proportions among the property owners con-
cerned; that they should have received notice by mail,
posting and otherwise; that the hearing was ready to
be conducted at this time.
Mayor Morehead asked the City Clerk if she had the
following affidavits relative to this hearing: Affidavit
of Publication, Affidavit of Mailing and Affidavit of
Posting.
City Clerk Balkus stated she had the three affidavits.
