In accordance with Section 2703 of the Municipal Code the
City Council met at 7:00 p.m. in the Conference Room for
an informal session with the staff to be informed on
regular agenda items;
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.
Mayor Morehead led the salute to the flag. FLAG SALUTE
The invocation was given by Reverend Travis of the INVOCATION
Neighborhood Church.

Mayor Morehead introduced Mr. Bob Larson, Scoutmaster of
Troop 666 and for members of the Troop who were working
for merit badges on Citizenship in the Community.

City Clerk Balkus stated that Mr. Al Lemm and Mr. Marshall
Brown had indicated they would not appear to speak this
evening; that they had submitted a written communication,
which she read in full, indicating that the Un-American
Activities Committee of American Legion Post No. 241 wanted
to be on record as Legionnaires against any of the Nazi
Party's movements toward this City.
Mayor Morehead stated that the City Attorney had advised
+hat there was no legal action that could be taken to
exr1u4c this orgo-nization from the City but that he could
certainly go on reco,,i as opposing this typo-4 ergan.i zZa-
t i on and he was certain the o+t,ar mcu++~ers of the Council
felt the same way. There were no objections.

The Council reviewed the map on the wall regarding this
matter.
City Engineer French reviewed his report dated January
29, 1965, which stated that the areas that were proposed
to be de-annexed by the City of Baldwin Park consisted of
property owned by the Los Angeles County Flood Control
District and portions of Rivergrade Road and Live Oak
Avenue; that the streets involved were streets that
basically served Irwindale to a greater extent than
Baldwin Park; that the realignment of the boundary in
this area would provide both cities with better delineation
of jurisdiction to the advantage of maintenance and police
functions; that the proposed de-annexation of Olive Street
by Irwindale would allow Baldwin Park to control a street
that presently served the City but was under the juris-
diction of Irwindale; that this street was of little or
no benefit to Irwindale and therefore received little
attention; and that he recommended that the City proceed
as outlined in Irwindale's request.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL CONCUR
WITH THE RECOMMENDATION AND HAVE THE NECESSARY STEPS
TAKEN TO WORK OUT THE BOUNDARY ADJUSTMENTS AND THAT
THE CITY ENGINEER, CITY ATTORNEY AND STAFF UNDERTAKE

City Engineer French stated this section of Badillo Street
was presently one hundred fifty 150) feet wide which was
an excessive width; that the area in blue indicated the
property in excess of what the County plans indicated
would be necessary for the construction of Badillo as
an eighty-four 84) foot section, curb to curb, with a
one hundred 100) foot right-of-way; that any building or
construction that took place would have to observe
Badillo as a one hundred fifty 150) foot street; that
that would be asking the people to go across forty 40)
foot of parkway to get to the street; that, in his
opinion, the request was reasonable and he recommended
that the staff be instructed to prepare the final
maps for the vacation subject to retaining easements
for any utilities that exist within this area to be
vacated; that sewers were in part of this area.

City Attorney Flandrick stated that proposed Ordinance No.
397 relating to Fireworks Permits had been prepared at the
direction of the City Council. He pointed out a correc-
tion that the'Chief Administrative Officer wished
considered as follows: Section 3154 o" to read that the
fireworks stand shalt be removed on the fib, day of July.
Also the following additions and corrections were pointed
out: In Section 3153 the amount of the fee should be
$200.00; In Section 3154 p) the amount should read $200.00;
and in Section 3156 the last sentence should read City of
Baldwin Park.

City Attorney Flandrick stated at the first Council
Meeting in January the'Council had directed him to forward a
letter to i\r. Ivor Lyons indicating to him that if he
would agree to relinquish any and all claims against the
City arising out of the first two sewer districts of which
he was the Engineer of Work that the City in turn would
dismiss the present law suit pending against Mr. Lyons
in the approximate amount of $11,000.00; that Mr.. Lyons
had submitted a claim, if the Council recalled, in the
amount of approximately 115,000.00; that Mr. Lyons by a
letter dated January 23, 1965, copies of which the
Council had, indicated acceptance of the proposal as
made.

City Clerk Backus administered the Oath to those in the
audience desiring to be heard during the meeting.
City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for
the continuation of a public hearing on CP-43 an appeal
from denial of the Planning Commission, an application for
a Conditional Use Permit to allow the expansion of build-
ing and use of an existing rest home on property located in
the R-1 Zone single family residential zone) at 3711 and
3717 Foster Avenue, Ruby Hendricks.
City Clerk balkus stated that the proper publication,
mailings and postings had been accomplished prior to the
public hearing on January 6, 1965.

Mr. Marshall Hadley, 14304 East Ramona Boulevard, Attorney
for Mrs. Ruby Hendricks, requested a continuance to the
next regular meeting as he had not had a chance to study
the matter that had been gone over by the Planning•Commis-
sion last evening.
As there were no objections from the Council, Mayor More-
head stated that this public hearing would be held over to
the next regular meeting.

City Clerk Balkus announced that it was the time and place
fixed for the public hearing on a Short Form 1911 Act
for the construction of curbs and gutters on the north
side of Ohio Street between Sierra Madre Avenue and
Landis Avenue.
City Clerk Balkus stated that proper publication and
postings had been accomplished.'
City Engineer French explained that the crown of the street
would have to be cut down approximately eight inches.
TESTIMONY I N OPPOSITION TO THE PROPOSED CONSTRUCTION WAS
CALLED FOR BY MAYOR MOREHEAD.
Mr. Ralph Smith, 14219 East Ohio Street, Baldwin Park,
stated he owned one hundred ten 110) feet of the
frontage involved; that he was not against curb and
gutter at that section; that he had taken it up with
Mr. Young when he was here as to putting in curb and
gutter and lowering the street; and that Mr. Young at
that time informed him that with the coming of the sewers
that they planned on lowering Ohio Street and it would
be feasible at that time to put in curbs and gutters.
Mr. Smith read in full and explained his letter addressed
to the Council dated February 3, 1965. Attached to the
letter was a petition requesting that the center of the
street be lowered to conform to the standards for street
construction marked Exhibit B".and a drawing of the
cross sections marked Exhibit A".
City Engineer French explained that in his proposal he
stated that the street had to be cut down; that he had made
some quick calculations and he did not agree with Mr.'
Smith's standards in the Exhibit presented; that they did
not meet what the City required in subdivision and street
standards; that they were about half way between both of
them; that he did propose to cut the street down to an
eight inch crown which was about two inches greater than
the normal crown; that the centerline of the street, on
Mr. Smith's proposal, as proposed was one inch above the
gutter plate; that he did not believe there were any
streets in Baldwin Park one inch above the gutter plate;
that in the City's proposal the center of the street would
be about six inches above the gutter plate.
Mr. Smith stated the standards shown on his drawing
were taken frcm Baldwin Park standards.
Discussion followed that the street was torn up at theA
present time for sewer construction.
Mayor Morehead asked normally was it procedure to put
in the street prior to curbs and gutters.

Mr. Smith stated he.was willing to put up a bond that.
the curbs and gutters would be put in after the street
was put in,.'
City Engineer French stated if it was known when Mr.
Smith was going to do his work the City could schedule
their work with Mr. Smith's; that the City was willing
vmrk with him; that there was sixty days to schedule.
the work.
Mr. Smith asked if Mr. French would give him a letter
to that effect.
City Engineer French said he would.
There was indication from City Engineer French that
Paragraph 3 of Mr. Smith's letter would be complied with.
Mr. Smith brought out that Mr. Pavlovtch at 14233 E. Ohio
Street had a driveway apron installed at the City's
expense as directed by the City.Council on July I, 1964.
City Engineer French stated this was a egress problem;
that this involved reconstruction and was never intended
to be put in at City standards; that it was a replacement
of an asphalt drive; that the City standard required on
a building permit for driveway aprons, was concrete; that
the City was not accepting this as a final job; that when
sidewalks went in this would have to be replaced with
concrete.
in answer to a question by Mayor Morehead, City Engineer
French stated that there was twelve 12) feet from the
curb face to the property line; that the work done at
Mr. Pavlovich's address was on City property.
Mr. Smith stated the description of the amount of curb
and gutter for the property on the corner of Sierra
Madre and Ohio was designated as forty-seven 47) feet
more or less; that this property was only thirty-five 35)
feet with a-fourteen 14) foot curb in there already for the
storm drain.
City Engineer French stated there wasa problem on the
corner; that there was a dedication requirement; that
only what was necessary would be put in and that was
all the property owner would be responsible for.
In answer to a question by Mr. Smith, City Engineer
French stated that normally the property owner was
responsible for the curb return, but he did not
believe the curb return could be constructed because
the property had not been dedicated for street.
In answer to a question by Mr. Smith, City Engineer
French stated that the City,had_not been constructing curb
and gutter; that they had been going out to private
contractors and the price hed varied from $2.00 to $2.50
per foot; that the City at the present time did not have
an open end contract.
City Engineer French stated that the City would work with
the property owners.
As there was no one else in the audience desiring to PUBLIC HEARING
speak either in behalf of or in opposition to the DECLAREQ CLOSED
proposed construction, Mayor Morehead declared the
public hearing closed.

City Attorney Plandrick pointed out that on one of the
two bids due to the fact tl~at one of the trade-in vehicles
had been involved in an accident the bidder was permitted
to reduce his trade-in value by 1/6; that the other bidder
was aware of the matter and had taken this into considera-
tion.
Chief Administrative Officer Nordby stated that the
appraiser had considered the vehicle which had been
involved in an accident a total loss; that the insurance
company was paying the City slightly over the trade-in
allowance quoted by Dave Schenk Dodge, Inc. and they
were allowing the City to remove the special equipment.
Discussion followed wherein it was brought out that the
warranty was good at any dealer; that the present police
cars were purchased'in October 1963 and delivered in
December 1963; that in the past police cars had been
kept approximately fifteen or sixteen months.
In answer to a question by Councilwoman Gregory, Acting
Chief of Police Adams stated that normally there were,
two men on each shift who would drive or were assigned to
one car; that as much as possible they assigned the same
men to the same cars; that in surrounding areas the Police
Departments cut their cars at 40,000 or 50,000 miles re-
gardless of the age of the cars.
Councilwoman Gregory suggested looking into the possibility RE POSSIBILITY CF
of having a City garage for maintenance of the cars. HAVING CITY GARAGE

Chief Administrative Officer Nordby stated, in his opinion,
from studies made, and in the City's past experience having
had their own garage previously, and considering the amount
of equipment the City had, it was far more costly to hire
a mechanic plus there would be a necessity for equipment,
a place to work, utilities and so forth; that the City
had some very good studies on this.
Councilwoman Gregory stated she would like to see some
of them.
Mayor Morehead instructed that Councilwoman Gregory COUNCIL INSTRUCTION
and other members of the Council, be furnished with COUNCIL TO BE FURNISH'

negotiated with Trinity Baptist Church through Mr.
Arthur Fields. He stated that the original parcel was
8500 square feet and was acquired for $13,500.00; that

currence of the Council he would proceed to arrange
conveyance.of the subject property to the Church for

ton.

quest of Vella Construction Company for $3,524.00, approved
by the City Council on January 20, 1965, in addition to an
amount that was approved in Resolution No. 64-180; that con-
sidering the testimony of the Engineer of Work and facts
that he had been able to delve into since then he had come
to the conclusion that this work was part of the original
sewer district; that he did not believe that the
$3,524.00 was due. Also that the $1,751.25 was not due
and since it had been paid that this should be taken out
of their retention; that he was asking that the Council
reconsider this matter.
City Attorney Flandrick stated he concurred in the
recommendation.

Councilwoman Gregory asked about Rivergrade, Badillo and
Puente stating they were not discussed at the public hearing.
City Attorney Flandrick stated these streets were now truck
routes in the existing ordinance; that the question was
did the Council wish them to remain or not.

City Attorney Flandrick stated because of Mrs. Gregory's

ORDINANCE NO. 398 FOR THE REASONS AS STATED BY THE CITY

6133 TO THE BALDWIN PARK MUNICIPAL CODE,
RELATING TO BUSINESS LICENSES"
COUNCILWOMAN GREGORY MOVED THAT ORDINANCE NO, 399 PASS

Councilwoman Gregory stated that in April or May 1964)
there were plans for the beautification of approximately
1836 feet along the right-of-way of Ramona Boulevard at
the westerly boundary of the City and asked if this had
to wait for the alignment of the street or when would it
be done.
City Engineer French stated this tied in with the
improvement of Ramona Boulevard; that the Ramona
Boulevard project had been approved by the State;
that they were waiting for the sewers to go in.
Councilwoman Gregory asked if there were funds for Ramona
Boulevard from Pacific to La Rica for curbs, trees,
lawn and automatic sprinklers.
City Engineer French stated there were some trees in;
that there was no money budgeted for further improvement
as Mrs. Gregory suggested; that this would have to come
out of the General Fund; that there would be curbs from
Gas Tax Funds.
Chief Administrative Officer Nordby stated he would be
very happy to make a report to the Council regarding
costs for these improvements.

Chief Administrative Officer Nordby commented that
approximately one year ago Mrs. Johnson, representing
the Baldwin Park Improvement Association, had donated
approximately $130.00 to $140.00 for the purpose of
purchasing shrubbery for the front of the auditorium;
that Mr. French, at his request, did some design work
on the improvement of the corner of Pacific and Rail-
road; that this improvement project had to be modified
before being submitted to the Council.
Councilwoman Gregory stated that this money was for potted
plants and the money being held was not purchasing these
potted plants; that she did believe this was what the
people wanted and action should be taken on this.

Regu Jae Meeting of the BaI'dWi n Park City Council
Regarding Warrant No. 114 of proposed Resolution No. 65-19,
City Attorney Flandrick commented that all of the title
reports had not been received therefore the action'had
not been. filed to acquire the easements necessary in
Sewer District No. 64-A-I,
City Clerk Backus read Resolution No. 65-19 by title as
follows:

Discusssion followed regarding Warrant Nos. 5555, 5560, 5561,
5562 and 5570.
Councilwoman Gregory asked that it be considered to send
the newsletters out approximately every three months
instead of every month and make a mailing to cover all
of Baldwin Park approximately 13,000 residences).
Mayor Morehead instructed the Chief Administrative Officer
to furnish Council, sometime between now and the next
Council Meeting, with a report as to how much money was
left in the budget for the newsletter for the remainder
of the fiscal year, and how much it would cost for a,
mailing to cover all of Baldwin Park.
COUNCILMAN CRITES MOVED THAT RESOLUTION NO. 65-19 BE
APPROVED AND FURTHER READING BE WAIVED. COUNCILWOMAN
GREGORY SECONDED. The motion carried by the following

Chief Administrative Officer Nordby explained that the halls
had been repainted; that the rooms opposite the Council
Chamber were being repainted; that drapes had been ordered
for the Council Chamber and the rooms across the hall; that
the Mayor and Council would be using the conference room
for their mail and appointments, and he would be using
the other two rooms; that the new Planning Director would
use the present Chief Administrative Office.
Discussion followed and Chief Administrative Officer
Nordby assured Council that there were adequate funds
to cover the improvements.

Mayor Morehead asked the Chief Administrative Officer
if he had given any thought to the matter that certain
people had been charged a penalty when they paid for
their City Business License on Monday, February 1, 1965.
Chief Administrative Officer Ncrdby stated that businesses
were allowed the month of January as a grace period to
acquire their business license after which there was an
application of a 10% penalty; that in his opinion, it was
normal to waive the requirement if the last day of the
month falls on the weekend; that he felt the Code should
be amended to make it permissible to grant the license
on the day following the weekend or holiday without
penalty when the last day of the month falls on a week-
end or holiday.
Mayor Morehead asked the City Attorney to frame an
appropriate motion.
COUNCILWOMAN GREGORY MOVED THAT THE SECTION OF THE CODE
DEALING WITH THE THIRTY-ONE 31) DAYS PERIOD BE AMENDED
TO PROVIDE THAT IF THE LAST DAY OF THAT PERIOD IS ON A
HOLIDAY THAT THE TIME LIMIT WILL BE EXTENDED BY ONE
DAY AND DO NOT FORFEIT THE PENALTY. COUNCILMAN CRITES
SECONDED,
Discussion followed, as to whether or not this could be
made retroactive wherein the City Attorney stated in his
opinion he didn't think so.
Further discussion followed wherein City Attorney Flandrick
stated that the Council was amending the ordinance to con-
form to an administrative practice.
Councilman Crites withdrew his second.
Mayor Morehead declared the motion dead for lack of a
second.
COUNCILMAN ADAIR MOVED THAT THE SECTION OF THE CODE DEALING
WITH THE THIRTY-ONE 31) DAY GRACE PERIOD BE AMENDED TO
PERMIT AN EXTENSION OF THAT PERIOD OF TIME BY ONE DAY
IF THE LAST DAY OF THE PERIOD FALLS ON A HOLIDAY AND TO
PROVIDE IN THE ORDINANCE THAT THE AMENDMENT ITSELF IS IN
CONFORMITY WITH ADMINISTRATIVE PRACTICES OF THIS AND
OTHER AGENCIES AND THAT PENALTIES COLLECTED FOR THAT
