In accordance with Section 2703 of the Municipal Code the City Council met at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items; The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Mayor Morehead led the salute to the flag. FLAG SALUTE The invocation was given by Reverend Travis of the INVOCATION Neighborhood Church. Mayor Morehead stated that the City Attorney had advised +hat there was no legal action that could be taken to exr1u4c this orgo-nization from the City but that he could certainly go on reco,,i as opposing this typo-4 ergan.i zZa- t i on and he was certain the o+t,ar mcu++~ers of the Council felt the same way. There were no objections. There was NO ACTION NECESSARY. 00- City Clerk Balkus presented a letter from the City of Irwindale dated January 25, 1965, regarding the city boundary lines between Baldwin Park and Irwindale. City Engineer French reviewed his report dated January 29, 1965, which stated that the areas that were proposed to be de-annexed by the City of Baldwin Park consisted of property owned by the Los Angeles County Flood Control District and portions of Rivergrade Road and Live Oak Avenue; that the streets involved were streets that basically served Irwindale to a greater extent than Baldwin Park; that the realignment of the boundary in this area would provide both cities with better delineation of jurisdiction to the advantage of maintenance and police functions; that the proposed de-annexation of Olive Street by Irwindale would allow Baldwin Park to control a street that presently served the City but was under the juris- diction of Irwindale; that this street was of little or no benefit to Irwindale and therefore received little attention; and that he recommended that the City proceed as outlined in Irwindale's request. COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL CONCUR WITH THE RECOMMENDATION AND HAVE THE NECESSARY STEPS TAKEN TO WORK OUT THE BOUNDARY ADJUSTMENTS AND THAT THE CITY ENGINEER, CITY ATTORNEY AND STAFF UNDERTAKE THIS MATTER. Bonelli dated January 25, 1965, regarding the principle to the divulging of names of juveniles identified with major cirmes of violence and brutality. COUNCILI'IOMAN GREGORY MOVED THAT THE CITY COUNCIL SUPPORT MR. BONELLI'S RESOLUTION BY A LIKE RESOLUTION AND INSTRUCT THE CITY ATTORNEY TO PREPARE SUCH A RESOLUTION. COUNCIL- MAN ADAIR SECONDED. AND MAYOR MOREHEAD NOES: NONE ABSENT: COUNCILMAN MCCARON 00- City Attorney Flandrick stated that proposed Ordinance No. 397 relating to Fireworks Permits had been prepared at the direction of the City Council. He pointed out a correc- tion that the'Chief Administrative Officer wished considered as follows: Section 3154 o" to read that the fireworks stand shalt be removed on the fib, day of July. Also the following additions and corrections were pointed out: In Section 3153 the amount of the fee should be $200.00; In Section 3154 p) the amount should read $200.00; and in Section 3156 the last sentence should read City of Baldwin Park. Ivor Lyons indicating to him that if he would agree to relinquish any and all claims against the City arising out of the first two sewer districts of which he was the Engineer of Work that the City in turn would dismiss the present law suit pending against Mr. Lyons in the approximate amount of $11,000.00; that Mr.. Lyons had submitted a claim, if the Council recalled, in the amount of approximately 115,000.00; that Mr. Lyons by a letter dated January 23, 1965, copies of which the Council had, indicated acceptance of the proposal as made. City Clerk Balkus announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for the continuation of a public hearing on CP-43 an appeal from denial of the Planning Commission, an application for a Conditional Use Permit to allow the expansion of build- ing and use of an existing rest home on property located in the R-1 Zone single family residential zone) at 3711 and 3717 Foster Avenue, Ruby Hendricks. City Clerk balkus stated that the proper publication, mailings and postings had been accomplished prior to the public hearing on January 6, 1965. As there were no objections from the Council, Mayor More- head stated that this public hearing would be held over to the next regular meeting. 00- City Clerk Balkus announced that it was the time and place fixed for the public hearing on a Short Form 1911 Act for the construction of curbs and gutters on the north side of Ohio Street between Sierra Madre Avenue and Landis Avenue. City Clerk Balkus stated that proper publication and postings had been accomplished.' City Engineer French explained that the crown of the street would have to be cut down approximately eight inches. TESTIMONY I N OPPOSITION TO THE PROPOSED CONSTRUCTION WAS CALLED FOR BY MAYOR MOREHEAD. Mr. Ralph Smith, 14219 East Ohio Street, Baldwin Park, stated he owned one hundred ten 110) feet of the frontage involved; that he was not against curb and gutter at that section; that he had taken it up with Mr. Young when he was here as to putting in curb and gutter and lowering the street; and that Mr. Young at that time informed him that with the coming of the sewers that they planned on lowering Ohio Street and it would be feasible at that time to put in curbs and gutters. Mr. Smith read in full and explained his letter addressed to the Council dated February 3, 1965. Attached to the letter was a petition requesting that the center of the street be lowered to conform to the standards for street construction marked Exhibit B".and a drawing of the cross sections marked Exhibit A". City Engineer French explained that in his proposal he stated that the street had to be cut down; that he had made some quick calculations and he did not agree with Mr.' Smith's standards in the Exhibit presented; that they did not meet what the City required in subdivision and street standards; that they were about half way between both of them; that he did propose to cut the street down to an eight inch crown which was about two inches greater than the normal crown; that the centerline of the street, on Mr. Smith's proposal, as proposed was one inch above the gutter plate; that he did not believe there were any streets in Baldwin Park one inch above the gutter plate; that in the City's proposal the center of the street would be about six inches above the gutter plate. Mr. Smith stated the standards shown on his drawing were taken frcm Baldwin Park standards. Discussion followed that the street was torn up at theA present time for sewer construction. City Engineer French stated if it was known when Mr. Smith was going to do his work the City could schedule their work with Mr. Smith's; that the City was willing vmrk with him; that there was sixty days to schedule. the work. Mr. Smith asked if Mr. French would give him a letter to that effect. City Engineer French said he would. There was indication from City Engineer French that Paragraph 3 of Mr. Smith's letter would be complied with. Mr. Smith brought out that Mr. Pavlovtch at 14233 E. Ohio Street had a driveway apron installed at the City's expense as directed by the City.Council on July I, 1964. City Engineer French stated this was a egress problem; that this involved reconstruction and was never intended to be put in at City standards; that it was a replacement of an asphalt drive; that the City standard required on a building permit for driveway aprons, was concrete; that the City was not accepting this as a final job; that when sidewalks went in this would have to be replaced with concrete. in answer to a question by Mayor Morehead, City Engineer French stated that there was twelve 12) feet from the curb face to the property line; that the work done at Mr. Pavlovich's address was on City property. Mr. Smith stated the description of the amount of curb and gutter for the property on the corner of Sierra Madre and Ohio was designated as forty-seven 47) feet more or less; that this property was only thirty-five 35) feet with a-fourteen 14) foot curb in there already for the storm drain. City Engineer French stated there wasa problem on the corner; that there was a dedication requirement; that only what was necessary would be put in and that was all the property owner would be responsible for. In answer to a question by Mr. Smith, City Engineer French stated that normally the property owner was responsible for the curb return, but he did not believe the curb return could be constructed because the property had not been dedicated for street. In answer to a question by Mr. Smith, City Engineer French stated that the City,had_not been constructing curb and gutter; that they had been going out to private contractors and the price hed varied from $2.00 to $2.50 per foot; that the City at the present time did not have an open end contract. City Engineer French stated that the City would work with the property owners. As there was no one else in the audience desiring to PUBLIC HEARING speak either in behalf of or in opposition to the DECLAREQ CLOSED proposed construction, Mayor Morehead declared the public hearing closed. Chief Administrative Officer Nordby stated that the appraiser had considered the vehicle which had been involved in an accident a total loss; that the insurance company was paying the City slightly over the trade-in allowance quoted by Dave Schenk Dodge, Inc. and they were allowing the City to remove the special equipment. Discussion followed wherein it was brought out that the warranty was good at any dealer; that the present police cars were purchased'in October 1963 and delivered in December 1963; that in the past police cars had been kept approximately fifteen or sixteen months. In answer to a question by Councilwoman Gregory, Acting Chief of Police Adams stated that normally there were, two men on each shift who would drive or were assigned to one car; that as much as possible they assigned the same men to the same cars; that in surrounding areas the Police Departments cut their cars at 40,000 or 50,000 miles re- gardless of the age of the cars. Councilwoman Gregory suggested looking into the possibility RE POSSIBILITY CF of having a City garage for maintenance of the cars. City Engineer French stated this tied in with the improvement of Ramona Boulevard; that the Ramona Boulevard project had been approved by the State; that they were waiting for the sewers to go in. Councilwoman Gregory asked if there were funds for Ramona Boulevard from Pacific to La Rica for curbs, trees, lawn and automatic sprinklers. City Engineer French stated there were some trees in; that there was no money budgeted for further improvement as Mrs. Gregory suggested; that this would have to come out of the General Fund; that there would be curbs from Gas Tax Funds. Chief Administrative Officer Nordby stated he would be very happy to make a report to the Council regarding costs for these improvements. 00- Chief Administrative Officer Nordby commented that approximately one year ago Mrs. Johnson, representing the Baldwin Park Improvement Association, had donated approximately $130.00 to $140.00 for the purpose of purchasing shrubbery for the front of the auditorium; that Mr. French, at his request, did some design work on the improvement of the corner of Pacific and Rail- road; that this improvement project had to be modified before being submitted to the Council. Councilwoman Gregory stated that this money was for potted plants and the money being held was not purchasing these potted plants; that she did believe this was what the people wanted and action should be taken on this. Chief Administrative Officer Ncrdby stated that businesses were allowed the month of January as a grace period to acquire their business license after which there was an application of a 10% penalty; that in his opinion, it was normal to waive the requirement if the last day of the month falls on the weekend; that he felt the Code should be amended to make it permissible to grant the license on the day following the weekend or holiday without penalty when the last day of the month falls on a week- end or holiday. Mayor Morehead asked the City Attorney to frame an appropriate motion. COUNCILWOMAN GREGORY MOVED THAT THE SECTION OF THE CODE DEALING WITH THE THIRTY-ONE 31) DAYS PERIOD BE AMENDED TO PROVIDE THAT IF THE LAST DAY OF THAT PERIOD IS ON A HOLIDAY THAT THE TIME LIMIT WILL BE EXTENDED BY ONE DAY AND DO NOT FORFEIT THE PENALTY.
