In accordance with Section 2703 of the Municipal Code the City Council met at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items. The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Mayor Morehead led the salute to the flag. Discussion followed concerning parliamentary procedure and RE ORD. 398 the February 3, 1965 minutes with regard to Ordinance No. TRUCK ROUTES 398, wherein City Attorney Flandrick stated the minutes reflected the action that was taken; that if the Council wished they could reconsider the ordinance and have first reading again this evening. COUNCILWOMAN GREGORY MOVED THAT THE RESOLUTION BE ACKNONLEDGED AND FILED. COUNCILMAN ADAIR SECONDED. There were no objections, the motion carried and was so ordered by Mayor Morehead. 00- City Clerk Balkus presented a'resolution'from the City of Rosemead in support of the proposal to conduct a World's Fair in the City of Los Angeles. Discussion followed. COUNCILMAN MCCARON MOVED THAT IT BE RECEIVED AND FILED. COUNCILWOMAN GREGORY SECONDED. There were no objections, the motion carried and was so.ordered by Mayor Morehead. 00- City Clerk Balkus presented a claim against the City submitted by Mrs. Florence E. Early, 3933 La Rica, Apart- ment 1, Baldwin Park. COUNCILWOMAN GREGORY MOVED THAT THE CLAIM BE DENIED AND REFERRED TO THE INSURANCE CARRIER. COUNCILMAN MCCARON SECONDED. There were no objections, the motion carried and was so ordered by Mayor Morehead. 00- City Clerk Balkus presented a resolution from the City of Alhambra requesting state officials concerned with re- apportionment of State Senate to maintain territorial integrity of incorporated cities by placing entire territory of each city within one Senatorial District. In answer to a question by Councilman McCaron, Chief Administrative Officer Nordby stated that the comments from other cities seemed to be to combine two assembly districts for one senatorial district; that, in his opinion, the suggestion by the City of Alhambra should be included in a recommendation that one City not be divided into two senatorial districts. Further discussion followed. COUNCILWOMAN GREGORY MOVED THAT FURTHER READING OF ORDINANCE NO. 400 BE WAIVED. COUNCILMAN CRITES SECONDED. The motion carried by the following vote: AYES: COUNCILMEN ADAIR, MCCARON, CRITES, GREGORY AND MAYOR MOREHEAD NOES: NONE ABSENT: NONE 00- City Attorney Flandrick reviewed his memorandum dated February 3, 1965 regarding the 1965 Legislative Program and stated periodically he would be making reports to the Council; that if the Council wished to take any action either in support or opposition to any of the bills he suggested that this be done by letter signed by the Mayor or Mayor pro tem. 00- City Attorney Flandrick stated in connection with a condemnation action filed July 1964 to acquire three parcels for public sewer and storm drain purposes that by inadvertence the resolution adopted at that time did not include the phrase storm drain facilities"; that a resolution had been prepared to correct that clerical omission. Vella Construction Co,., Inc. and asked if the Council wished to defer this until the warrant resolution. As there were no objections,-Mayor Morehead stated this matter would be handled with the warrant resolution Resolution No. 65-28). 00- City Clerk Balkus read Resolution No. 65-29 by title as follows: RESOLUTION NO. 65-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDW I N PARK AMENDING RESOLUTION NO. 64-150" City Attorney Flandrick stated there was an additional amendment suggested that Finance Director Duncan and City Clerk Balkus had called to his attention,that presently the salary resolution provided for extra compensation or overtime for the Minute Clerk who was taking minutes at the City Council and Planning Commission meetings; that it was suggested that the City Council also permit the payment of overtime for the Minute Clerk at any of the Boards and Commissions; that the City now had City Council, Planning Commission, Board of Zoning Adjustments and shortly there would be a Personnel Board; that it was suggested that Section 2, Item 3 read 3. The Minute Clerk taking minutes at any regular, special or executive meeting of the City Council and all other Boards and Commissions of said City shall be paid his or her prescribed rate of pay for such overtime while required to attend and perform such duties." AND USE CF EXISTING RES. HOME ON PROPERTY I N R- I ZONE AT 371 I AND 3717 FOSTER AVE., RUBY HENDRICKS I I TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY MAYOR MOREHEAD. Mr. Marshall Hadley, Attorney, 14304 East Ramona Boulevard, Baldwin Park, representing Mrs. Ruby Hendricks, applicant, stated this matter had been before the Council before and testimony had been taken and not wishing to repeat anything atready said they wanted to be here and available to answer questions or go over the matter with the Council; that Mrs. Hendricks and her contractor, Mr. Westover, were here; that they had read and considered the conditions that the Planning Commission had presented to the Council; that by and large all of them were acceptable; that certain matters should be clarified; that this was not a convales- cent home, it was a guest home for the aged; that the references in the conditions should be to a guest home for the aged; that such an operation in the R+l zone was much less trouble to neighboring areas than an apartment unit where children were running and screaming in the streets; that the elderly people would be of no particular problem to anyone; that most of them were inside a great portion of the day; that there were not a lot of cars coming in and out; that the State and County agencies preferred that these elderly people reside in a guest home in a residential area instead of commercial or manufacturing areas; that that was why this particular home of Mrs. Hendricks had been such a success; that she, as the Council knew, had had this operation for quite some time and at present the application was only to enlarge it; that concerning Condition No. 2, to construct a view obscuring block wall, this was satisfactory; however, the ref:ea'ence to side yard, he believed, should not'be in this pdrt cular item because the side yards were to have chain inked fence which was covered in-the very next item; that concerning Item No. 4, he did not recall there being any mention before of being a requirement of two inside park- ing spaces at this unit, however this was not a particular problem, since, he believed, there was an existing garage; that concerning Item No. 13, this might create an addi- tional problem of having to go back to the Planning Commission for approval of the building permit; that he believed precise plans had already been submitted and were in the files of the Planning Director; that there were enough copies of the plans submitted so that they could be at each of the Council members places this evening; that concerning the last item, Mrs. Hendrick*s permit limits the number to fifteen. 2 February 17, 1965^3 Page 5 TESTIMONY I N BEHALF MARSHALL HADLEY, ATTY 14304 E. Discussion followed concerning the wording of the application wherein Planning Director Kalbfleisch stated that on the applica- tion the proposed use was listed as rest home"; that the nature of the business vies listed as care for the aged". City Attorney Flandrick stated if the Council deemed it appropriate to grant this permit the resolution of approval woytd designate and describe it as a guest home for the aged. In response to Mayor Morehead, Mr. Hadley had Mrs. Hendricks bring forward the grant deed to Lot 12 which was recorded July 25, 1963 and showed Harold R. and Ruby A. Hendricks as owners and the 1964 Tax Bill on the property to the east addressed to Ronald M. and Kathleen R. Hendricks. He pointed out the plot plan on the wall stating that the engineer had redesigned this cul-de-sac cutting it down to a 25 foot radius on the Hendrick's property only; that there would be a 45 foot radius on the properties to the south; that there would be 7 parking spaces and there was a two car garage. He pointed out the existing building and the proposed build- ing; and stated there would be a sixteen foot paved drive. Mr. Westover, 8867 East Mission Drive, Rosemead, Corlin Construction Corporation, Covina, stated he had prepared a precise plan; that he did that with the exact plan which he took from the City Engineer's office showing the contour of the proposed street change; and for the purpose of comparison at the specific request of the Planning Conmission to be sure that there was no encroachment of the building within the proposed setback line; that he found when he laid out the building against the exact proposed street contour that there was an encroach- ment into the setback line so he made a change on the building; that the width of the driveway was eighteen 18) feet between the buildings; that they proposed to pave sixteen 16) feet. City Attorney Flandrick pointed out that Planning Director Kalbfleisch had marked in red on the plot plan the proposed fencing requirement and the height. Mayor Morehead stated that the Planning Commission had reviewed and restudied this case and they had still recommended denial of CP-43; that the conditions the Council had before them were conditions the Planning Commission recommended in the event that the Council approved this case. In answer to a question by Councilman McCaron, Mrs. Hendricks stated that if a patient became ill they would go to a hospital, convalescent home or nursing home depending on the doctor's recommendation. As there was no one-..else in the audience desiring to speak either in behalf of or in opposition to CP-43, Mayor Morehead declared the public hearing closed. COUNCILMAN MCCARON MOVED THAT THE CITY ATTORNEY BE IN- STRUCTED TO DRAW UP THE NECESSARY RESOLUTION APPROVING CP-43 AND PUTTING IN ALL CF THE CONDITIONS AS OUTLINED BY THE PLANNING COMMISSION WITH THE EXCEPTION OF THE SIX 6) FOOT WALL, FENCE BUT NOT REQUIRE A VIBN OB- SCURING WALL, ON THE CUL-DE-SAC SIDE OF THE PROPERTY INASMUCH AS IT WAS NOT A CONVALESCENT HOME, AND THAT IT BE STATED THE CCCUPANCY IS A GUEST HOME FOR THE AGED RATHER THAN A CONVALESCENT HOME. COUNCILMAN CRITES SECONDED, City Attorney Flandrick, for clarification, stated that Item No. I in the recommendation may now be deleted to- gether with Item No. 12 since the deeds and recorded information were presented establishing the fact of ownership; that Item No. 13 had been complied with by the submission of Exhibit A; that the fencing was to as marked on the Exhibit A by Planning Director Kalbfleisch; that Item No. 2 would be included in the resolution of approval; that Item No. 3 was to provide for the three foot fence within the front yard areas and along the cul-de-sac areas; that the additional condition would be that all construction conform to the plot plan. Park City Council AYES: COUNCILMEN MCCARON, CRITES AND ADAIR NOES: COUNC I LWOMEN e GREGORY AND MAYOR MOREHEAD ABSENT: NONE 00- City Clerk Balkus announced that it was the time and place fixed for a public hearing on AZC-II, an application ini- tiated by the Baldwin Park Planning Commission to initiate an Amendment to the Baldwin Park Zoning Code to require all automobile service stations to be subject to approval of a Conditional Use Permit in any and all zones, but excluding therefrom the R-l, R-2, R-3 and A-I Zones. City,,Clerk Balkus stated that proper publication had been accomplished. Planning Director Kalbfleisch presented a resume of the case and stated that the Planning Commission had adopted Resolution No. PC 65-2 recommending approval of the amend- ment to the Zoning Code, on January 19, 1965. As there was no one in the audience desiring to speak either in behalf of or in opposition to AZC-l1, Mayor Morehead declared the public hearing closed. Councilman McCaron asked for the reasoning behind this change. Planning Director Kalbfleisch stated that the Planning Commission had studied the development of service sta- tions within the C-2 zone as a permitted use; that the type of building aesthetically and the control on the building had not been of a desirable nature; that under a conditional use permit elevation, plot plans and so forth could be required before the development of the property. COUNCILWOMAN GREGORY MOVED THAT THE FINDINGS OF THE CITY COUNCIL CONCUR WITH THE FINDINGS OF THE PLANNING COMMISSION ON AZC-11. COUNCILMAN ADAIR SECONDED. He stated that inadvertently the report of the Director of Finance was not attached as the report stated. Councilwoman Gregory asked that this report be presented to the Council by the next regular meeting. 00- Chief Administrative Officer Nordby reviewed his report on the cost of increasing the City Newsletter circulation Discussion followed regarding the present distribution; that there was some duplication; that they were sent to approximately 1700 business license holders; that assess- ment rolls were used for addressing; that mailings were being made to property owners in the sewer district now under construction; that there was sufficient money to put out three more issues and mail 4500 more than the present distribution; that there are approximately 13,000 to 14,000 residential. units. Councilwoman Gregory stated she had always maintained if they were sent out quarterly that distribution could be made to everyone in the City; that probably very few of the persons who had business licenses in Baldwin Park lived. in Baldwin Park; that the Council represented the people that live in Baldwin Park; that. only approximately 2,000 people in Baldwin Park subscribed to the Tribune; that the Bulletin went out to the majority of the people and although it covered Baldwin Park activities it did not cover all of the news. Councilman Adair stated he thought the people of Baldwin Park.should have the newsletter and eliminate the mailing to the merchants. Councilman McCaron stated, in his opinion,' they should be mailed to everyone if at all possible and we have the facilities to do so and asked if there was any means of obtaining all of the addresses. Chief Administrative Officer Nordby stated it was to be proposed to purchase a used address--o-graph; that when the volume reached this point, in his opinion, it demanded too much time from the clerical help and the addressing system should be mechanized. Mayor Morehead stated he concurred with the other four members of the Council in that the newsletter should be printed less often and mailed to everyone. 00- Chief Administrative Officer Nordby stated he had prepared a report for the Council concerning the processing of the applicants for the position of Chief of Police; that he requested a brief personnel session following the meeting. Accept the ruling and allow the relinquishment to finalize, and 2. Protest in writing to the Highway Commission in accordance with Section 73 of the Streets and Highways Code. He stated,in his opinion,the State was proceeding in accordance with standard procedure; that he did feel that if the Council desired to protest the relinquishment, a proper protest could be presented; that if the Council did protest this would give the City more opportunity to negotiate with the State. Discussion followed regarding the cost of the protest wherein City Attorney Flandrick stated that probably the hearing would be in Sacramento. Councilwoman Gregory stated in view of the evidence presented by the City Engineer, in her opinion, the City should protest; that maintenance alone would be expensive. City Engineer French stated that next Tuesday he was having a meeting with the Parks and Recreation Depart- ment to work out what the cost of the landscaping would be. Discussion followed that there was a storm drain pro- ject under this bond issue that would alleviate the drainage situation; that the City would have the full responsibility of further improvement of Puente Avenue; that the frontage roads have not been relinquished; that the City had signed an agreement to accept the frontage roads quite a while back; that the frontage roads would be basically to the fence; that there was talk of widening the freeway; that there would still have to be an access road. City Engineer French stated the protest would be based on the drainage structures, drainage facilities, condi- tion of the streets and the extra maintenance of the Iandscaping. Mr. Flandrick read a portion of the letter from Mr. Robert Hale dated February 15, 1965, as follows: original letter in Mr. Flandrick's files) We respectfully request, on behalf of our client, that it be authorized to cash its final retention without a waiver of the above mentioned claim. No further or addi- tional claims will be presented and any waiver will be with prejudice'to any new claims not heretofore presented. The motion carried by the following vote: AYES: COUNCILMEN CRITES, GREGORY, ADAIR, MCCARON AND MAYOR MOREHEAD NOES NONE ABSENT: NONE 00- Chief Administrative Officer Nordby stated that the opening of the bids for the improvement of Los Angeles Street would be on February 24, 1965, at 1:30 p.m. in the Council Chamber of the City Hall. 00- In response to Mayor Morehead, Chief Administrative Officer Nordby stated he planned to go to Berkeley this weekend; that he did not know whether he would leave Friday or not. 00- Chief Administrative Officer Nordby stated that on March 10, 1965, in San Diego the United League Chamber of Commerce would be putting on an Aircade; that he recom- mended anyone who could take that Wednesday off to attend. 00- Chief Administrative Officer Nordby stated that there would be a public hearing before the Local Agency Formation Commission on February 24, 1965, involving the annexation of the Werner Tract Mutual Water Company to the Baldwin Park County Water District; that, in his opinion, there were two reasons why Werner Tract Mutual Water Company should be taken over by another entity namely, they were not giving good service and they were not a revenue produc- ing agency. Considerable discussion followed concerning the possibility of the City taking over the Water District or going into the water business; that Werner Tract Mutual Water Company was in trouble; that the lines were not adequate; that there would have to be a lot of money spent for rehabilita- tion; that if the people in the District had not been noti- fied of the hearing this would be good grounds to ask for a continuance. Mayor Morehead stated it was his understanding there was no interest in the City taking over the Werner Tract Mutual Water Company and asked I f..that was. ri ght Councilman McCaron stated the annexation'should be encouraged as much as possible.
