In accordance with Section 2703 of the Municipal Code the
City Council met at 7:00 p.m. in the Conference Room for
an informal session with the staff to be informed on
regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

Chief Administrative Officer Nordby stated there was no
written policy on this type of refund however it had been
administrative practice to retain an amount for processing;
that there should be a written policy adopted on this;
that this was not an error on the part of the City; that
he recommended that a refund of $98.55 $109.50 less 10%
administrative costs) be made to Associated Coin Amusement
Co., Inc.

the Chief Administrative Officer and the City Attorney to
work on a written policy for business license refunds and
a fee schedule for City documents and publications which
the City reproduced for the public, and bring'it back to
the Council when the report was ready.

City Attorney Flandrick stated that Mr. Kalbfleisch
suggested two amendments to the resolution as follows: AMENDMENTS
Section 2, subparagraph f) to read That the applicant SECTION 2 f)
shall reconstruct the existing curbs, gutters-and side-
walks in and along the Foster Street frontage,;' and curbs
and gutters in and along the Foster Circle frontage to
conform to the revised design"; and Section 2, subparagraph SECTION 2 g)
g) to read That the applicant shall install the paving
hookup required in the cul-de-sac and Foster Circle area".
Councilman McCaron pointed out that in the testimony given
the applicant had stated this was not a rest home or a
convalescent home.
City Attorney Flandrick suggested the following revisions
to the resolution: Section subparagraph a) the second SECTION I a)
to the last line to read operate a rest home for elderly
persons on the hereinabove": Section 2, subparagraph d). SECTION 2 d)
to read facilities are being" in the sixth line down;
Section 2, subparagraph i) amend the last line to read SECTION 2 i)
of an occupancy certificate for said facilities; and";
and Section 2, subparagraph j) the last line to read for SECTION 2 j)
the facility.".

At the request of Councilwoman Gregory, City Attorney
Flandrick explained at the last regular meeting the
Council had considered the question of should the speed
limit on Baldwin Park Boulevard from Merced Avenue to
the San Bernardino Freeway be increased from 25 m.p.h.
to 35 m.p.h.; that this ordinance, if adopted, would
accomplish this; that this ordinance merely restated
Section 3380 as it now existed with the only change
being with reference to subparagraph I.

COUNCILWOMAN GREGORY MOVED TO AMEND FINANCE NO. 402
AS INTRODUCED BY STRIKING SUBPARAGRAPHS 2, 3, AND 4
FROM THE PROPOSED CHANGE IN SECTION 3380 AS SET FORTH
IN ORDINANCE NO. 402.
Councilwoman Gregory stated she would like to have Los
Angeles Street from the west City limits to Maine 35
m.p.h. and from Maine to Alderson 25 m.p.h. to coincide
with the Irwindale City limits; that Olive Street was a
thirty 30) foot street and there were three 3) schools
on this street; that Walnut Street School was from'Center
to Walnut, Landis School and a new school about to be
built on Olive; that Olive was now posted 35 m.p.h. and
it was impossible to drive this speed; that this was a
school area and she would like to see it all of Olive)
back to 25 m.p.h.; that she would like to see Vineland
Avenue a 25 m.p.h. zone until it was improved.
Mayor Morehead stated he was of the opinion that it should
be heft as is; that the Chief Administrative Officer and
the City Engineer had both agreed that the school zones
should and would) be posted 25 m.p.h.; that these school
zones were automatically 25 m.p.h. regardless of whether
they were posted or not.
The motion died for lack of a second.

City Clerk Balkus presented a claim submitted by Martin
H. Rohr, 3336 Big Dalton Avenue, Baldwin Park, regarding
a sewer lateral, 61-A-1.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL DENY THE
CLAIM AND REFER IT TO THE INSURANCE CARRIER. COUNCILMAN
ADA i R SECONDED.
City Attorney Flandrick explained that both he and the
City Engineer had made attempts to obtain the approval
of Falcon Construction Company but had been unsuccessful
to date; that he had suggested to Mr. Rohr that he file
a claim against Falcon Construction Company; that the
reason for referring it to the City's insurance carrier
was the fact that there appeared to be possible negligence
on the part of the City.

asked what would happen now.

City Attorney Flandrick explained that the claim would
be referred to the City's insurance carrier and they
would make a determination.
Mr. Rohr stated his dealing was'.with the City, not the
City's insurance carrier or Falcon Construction Company.
City Attorney Flandrick stated Mr. Rohr'could file suit
in Small Claims Court against Falcon Construction Company
and, if he'deemed it appropriate,' against the City of
Baldwin Park.
Note: See discussion and Council instruction later in
meeting.

Chief Administrative Officer Nordby reviewed his report
regarding the proposal to modify and improve the public
address system in the Council Chamber which recommended
that Mobile Radio, Inc. be directed to proceed with the
work, as outlined in his report, at a cost of $848.53.
Discussion followed that each official would have a
lavalier-type microphone and one would be at the map
area on the wall behind the Council; the possibility of
moving the speakers so that the Council could hear from
the speakers.
Chief Administrative Officer Nordby stated that, in his
opinion, the lavalier microphones would provide suffi-
cient volume. At this point the cavalier-type microphone
at the Planning Director's place was tested and the Council
agreed that these should provide sufficient volume.

Chief Administrative Officer Nordby reviewed his report
regarding compensation paid to employees injured on duty
stating at this time he did not have a final recommenda-
tion and suggested that the staff have additional time
to go over this and possibly get comments from the Council.
Discussion followed wherein Chief Administrative Officer
Nordby stated that a change in the Personnel Rules and
Regulations would be required and also the City Attorney
had stated there were a few legal problems involved;
that he could come u.p with procedure for this at the next
meeting.
City Attorney Flandrick stated if the Council wished they
could set this matter for public hearing at the first
meeting in April, April 7, 1965, then the Council could,
at the next meeting, consider the Chief Administrative
Officer's report and the matter would have already been
set for public hearing.
COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL INSTRUCT
THE CHIEF ADMINISTRATIVE OFFICER TO PREPARE A NECESSARY
REPORT RECOMMENDING SUCH CHANGES IN THE PERSONNEL RULES
AS ARE APPROPRIATE IN CONNECTION WITH WORKMEN'S COMPENSA-
TION, CLAIMS AND INJURIES AND TO SET THE MATTER FOR HEARING
ON APRIL 7, 1965. COUNCILMAN ADAIR SECONDED. The motion

Chief Administrative Officer Nordby reviewed his report
which suggested that the Council consider a resolution
calling for a new population estimate by the State Depart-

Mr. G.' A. Rennison, 35261 Barnes, Baldwin Park, stated he MR. G. A. RENNISON,
was present in regard to his fence; that his fence to the 35261 Barnes, B.Pk.
rear of 3510 and 3526k Barnes Avenue on Westcott) had
been completely demolished; that he had been to everyone
he could go to; that Mr. Kalbfleisch had seen it, as a
matter of fact he had pictures of it; that his chain link
fence was down to where there was only one wire holding it
up; that his property had washed into the street; that
the fence had been undermined; that he could not find the
person responsible for the damage.
In answer to a question by Mayor Morehead, Building
Superintendent Kalbfleisch stated he believed the mistake
was made by the subdivider; that he had transmitted this
Information'to Mr. Rennison.
Mayor Morehead stated it had to be established who did
the damage; that unless the City did the
damage it would be between Mr. Rennison and whoever did
the damage.
Mr. Rennison stated the City gave the approval to put in
the street and the City had approved it.
There was further discussion wherein Mr. Rennison stated
he had gone to his limit; that he had papers made out and
was going to throw an injunction against the property in
the back; that it would include the City of Baldwin Park,
the building contractor, the City Engineer and all of
them; that there had to be a retaining wall to protect
his property otherwise the street could not be put in,
the paving contractor could not put it in, nobody could
put it in; that someone was going to have to be responsible
for his fence.
Mayor Morehead suggested that Mr. Rennison contact Mr.
Levin and Mr. Rennison stated he would if he could find him.
Discussion followed regarding the street.
Mr. Rennison stated the street was to be a•fourteeil 14)
foot street; that the cut had been made three and one-half
31) feet down behind this property.
Councilman McCaron asked if there was a requirement in
the ordinance to require a retaining wall when the cut
was in excess of twelve 12) inches.
City Attorney Flandrick stated not in the subdivision
regulations; that as he recalled there was reference to
a retaining wall in the Grading Ordinance but he would
have to check this out as to the exact provisions.
Councilman McCaron stated this should be checked out and
a study made on this particular point.
City Attorney Flandrick stated if the Council desired he
would check this out and the Council would be advised in
writing of the findings and a copy of the findings would
be sent to Mr. Rennison.
City Engineer French stated the Improvements had not
been accepted; the street had not been accepted by the
City; that the City had never authorized anybody to go
on anybody elses land; that the contractor had been in
complaining that they had been protecting this fence.
Mr. Rennison stated his fence was three 3) inches inside
of his property line; that from where the curb was now,
if a fourteen 14) foot street was put in, this would take
them inside his property line; that a thirteen 13) foot
street would not come inside his property line; that if

they put a retaining wall in along side of the base to
keep his property from going and his fence from failing
he would gladly go along with them; that all he wanted was
to bring it to ground level; another thing, you" had a
Civil Engineer surveyor come out to measure three months
ago for drainage; that there was a four 4) foot drop
from his property to Barnes and this surveyor asked why
did they make them cut it down that low; that his chain
link fence was set in cement and it was undermined right
right along the cement; that this was done in October.
In answer to a question by Councilwoman Gregory, Mr.
Rennison stated he had had his property surveyed before
the fence was put in in 1956.
As there were no objections, Mayor Morehead instructed COUNCIL INSTRUCTION
that the City Attorney, City Engineer and Building Super-
intendent look into this tract and Mr. Rennison's damages
and see what they would advise'Mr. Rennison to do; that
a copy of their professional.opinion be furnished to the
Council with a copy to Mr. Rennison.

Councilman McCaron stated he would like to go back on the RE CLAIM ITEM NO.
Agenda'to Item No. 7 under City Clerk, Claim Martin 7 UNDER CITY CLERK
H. Rohr, 3336 Big Dalton Avenue. He stated if the claim, MARTIN H. ROHR
after being referred to the City's insurance carrier,
came out to the claimant's benefit he would say let it
die there but if it was not taken care of properly it
should be brought back for proper disposition; that if
this was the correct procedure referral to insurance
carrier) and it was recommended he would accept it
otherwise he would not agree with the rejection.
Councilwoman Greogry asked if the City Attorney was
advised by the insurance carrier on problems the
City had with c)aims.
City Attorney Flandrick stated if it proceeded to
the point that it was a lawsuit, yes.
City Clerk Balkus stated in the past the insurance
carrier would give the City a report only if it was re-
quested.
The Council instructed the City Attorney to ask for a COUNCIL INSTRUCTION
disposition of this case along with the transmittal
of the claim to the insurance carrier.
City Attorney Flandrick stated, for the Council's informa-
tion, that this claim arose out of Sewer District 61-A-1;
that there were others that were similar in nature;
that the Council could not make the payment of these
claims out of sewer district money as they were not
timely filed; that the claims, if paid, would have to
be paid out of the General Fund.

Regarding the application for Temporary Use Permit for APPLICATION FOR TEMP.
a Circus, Graham Brothers, which had been continued USE PERMIT FOR

Nordby stated the circus was based in this area; that CONT'D FROM 2-17-65)

circus; that it was recommended that the application
be approved.

City Engineer French reported on the bids received for
the Los Angeles Street Improvement from the Westerly City
Limits to Maine Avenue, Project Number 9. He stated that
the apparent low bidder, F. W. Richter Contractors, 80
East Montec i to Avenue, Sierra ftdre, California, had bid.
a total of $120,139.95, which was 77.8% of the Engineer's
estimate and the high bid was 100.5% of the Engineer's
estimate. He stated he would bring this item on the
next Agenda for recommendation of the award.
As there were no objections, Mayor Morehead stated this
matter would be held over toa'the next regular meeting.

City Engineer French reviewed his report regarding the
cost of landscaping on Ramona Boulevard between Pacific
Avenue and Harlan Avenue stating that the area involved
was in excess of 63,000 square feet and that the approxi-
mate cost would be $50,000.00.
Discusssion followed that there should be some way for
flood waters to get on the street and be taken care of.
Councilwoman Gregory stated she had requested costs from
La Rica to Pacific; that she thought this would be the
beginning of a beautification program; that she was under
the impression for about this much money the City could
hire three men and give them this particular job of
beautification; that Ramona Boulevard would be curbed
and guttered as it was widened and a beautification pro-
gram could be started.
Discussion followed regarding possibility of putting in
a line to water the existing trees.
Councilwoman Gregory suggested that the Council ask the
City Engineer to renegotiate the lease with Pacific
Electric Railway Company and see what he comes up with
and then go from there perhaps on the original plan from
La Rica to Pacific to include a watering system, auto-
matic sprinklers, maintenance man hours, lawn, bushes,
shrubs and so forth. She stated that the Parks and
Recreation Department were considering a building in
the park; that from Sierra Madre to Robin on Ramona
Boulevard on the north side she believed, should be
parking.area and beautification on the south side; that
the City had already started a beautification at the
bridge but this was not in effect because of the lack
of sewers in that area; that she thought both ends could
be worked toward the center and she thought Ramona Boule-
vard from La Rica to Pacific on the south side should
be landscaped.
Discussion followed regarding the drainage problems; that
there was a natural culvert along the right-of-way; that
it could be landscaped so that the Water could be taken
through the landscaping or the landscaping could be out
side.

In answer to a question by Councilman Crites, City Engineer
French stated the beautification lease extended approxi-
mately 60 to 100 feet west of Harlan; that it went to just
east of Pacific to where the existing parking lot ended;
that it was forty-five 45),feet on one side and fifty-
five 55) or sixty-five 65) feet on the other side; that
this lease could be cancelled by thirty 30) days written
notice by either party,and the City was liable to remove
any improvements put on the property as demanded by the,
railroad.
In answer to a question by Councilwoman Gregory about the
beautification along the right-of-way In Irwindale, City
Engineer French stated that the improvement that was to
go in on the railroad side of Ramona Boulevard required
grading and slope easements; that this was brought forth
because of the slope easements; this easement as he re-
called was 1800 by 20 with fifteen 15) feet for beautifica-
tion and five 5) feet for slope.
Councilwoman Gregory suggested that the Council instruct
the City Engineer to renegotiate with the railway company
for a more protective beautification-lease.
Discussion followed that it should be a 90 year lease,
with exclusive rights, both sides of the P.E. track westerly
from Pacific, parking to be continued from where it now
existed on the north side of the tracks on down to Sierra
Madre,
City Engineer French stated as he understood he was to go
to the Pacific Electric Railway Company and negotiate to
lease the property from Pacific to Harlan as an exclusive
lease for the purpose of beautification with no cancella-
tion clause.
As there were no objections to this instruction by the
Council, Mayor Morehead so ordered.

City Engineer French reviewed his report regarding the
pedestrian crossing at the intersection of Foster Avenue
and the Pacific Electric Railway tracks and stated the
cost was approximately $250.00 and he had a proposed
walkway agreement with Pacific Electric Railway Company
which had to be approved by the Council if the Council
desired to proceed with the construction of the crossing.
COUNCILMAN ADAIR MOVED THAT THE CiTY COUNCIL CONCUR WITH
THE CITY ENGINEER'S RECOMMENDATION AND THAT THE AGREEMENT

news media; that the newspapers themselves restrict what
would be published.

Chief Administrative Officer Nordby stated that the Retire-
ment Study report prepared by Coates, Herfurth and England
had been received on Friday, February 26, 1965; that it was
the intention to include this in the budget when it was
submitted to the Council. He commented regarding the
feasibility of a private insurance company proposal
stating that he understood that West Covina was now under
a private insurance company and was dissatisfied and
was attempting to withdraw.
Councilwoman Gregory asked that Council receive a copy of
the Retirement Study report prior to the budget sessions.
Councilman McCaron stated if it were possible to have any-
thing for comparison the Council should have the information,
such as the reason why West Covina was dissatisfied and what
private insurance companies had to offer.

Chief Administrative Officer Nordby stated that the Baldwin
Park Employees Association had elected one member to the
Personnel Board and'&e'fore'the end of the week should have
elected their second member.
Council discussion followed wherein Mayor Morehead stated
that the Council would consider their selection of two
members to the Personnel Board at the next regular meeting.

Chief Administrative Officer Nordby again commented that
there was to be an Aircade in San Diego on March 10, 1965,
put on by the National Chamber of-Commerce; that registra-
tion, round trip railroad fare and luncheon was $15.00;
that the reservations should go in by noon on March 4, 1965.

Chief Administrative Officer Nordby stated he had one.
item that might need Council action; that the City was
one officer short in the Police Department; that this
vacancy: could be filled very shortly from the certified
eligible. list; that the injury of Officer Travis had
created another temporary.vacancy; that he believed the
Personnel Rules and Regulations authorized the Chief,
Administrative Officer to authorize an,appointment on a
temporary basis; that applicants were being processed
for the Chief of Police; that at this time there were
three men who would be attending the Police Academy
making a total of six vacancies in the Department at
this time; that be believed there should be an eppoint*
ment made until the end of the fiscal year on a temporary
basis to fill' the temporary position created by Officer
Travis' injury; that this would be going one over the
Table of Organization approved by the Council; that
there was no problem as far as funds were concerned
and he wanted the approval of the Council to increase
the Table of Organization until the end of the fiscal
year.
Mayor Morehead stated, in his opinion, that Officer Travis'
position should be temporarily filled.
Discussion followed wherein City Attorney Flandrick stated
the Chief Administrative Officer now had the authority
to'nnake the temporary appointment; that Mr. Nordby was
requesting the Council to amend the'Table of Organization
for the rest of this fiscal' year to increase the Police
Department by one patrolman.
Chief Administrative Officer Nordby stated the temporary
appointment would terminate at the end of the fiscal year,
however the Police Department was requesting additional
personnel and the chances were that this could become a
permanent appointment.

Councilman McCaron stated that Lot Split No. 644 brought RE INTERIOR LOTS
up an old problem regarding dedication for future streets;
that, in his opinion on Interior lot splits a provision ACQUISITION OF

future street whereby the cost of acquiring the opening STREET
to the future street would be borne by each of the interior

Councilwoman Gregory brought out that the City did budget
for land acquisition; but it was not enough to buy a piece
of property that stood in the way of a street; that she
had discussed this with the new Planning Director and asked
him to look into this and possibly make a recommendation
to the Council regarding some solution.
City Attorney Flandrick stated that the City Engineer and PROPOSED CHANGES
he had been talking with the Chief Administrative Officer IN LOT SPLIT ORD.
concerning proposed changes in the Lot Split Ordinance TO BE PRESENTED TO
to be presented to Council; and that this could be included COUNCIL
if the Council wished.
In answer to a question by Mayor Morehead, City Attorney
Flandrick suggested that the fee could be increased for
the filing of the map and allocate internally a portion
of the fee for this particular purpose or it could be set
up through the Planning Commission or through the Planning
Department by a series of block studies showing the interior
streets and that a provision be made in the ordinance that
there would be a charge in the amount of x":, dollars per
lot for a lot split application that came in n~ the area
included in that block study.
