Roll Call t Presents- COIJNC I LMEN RADA I R, CR I T ES, GREGORY, MCCARON AND MAYOR MOREHEAD Absent: FINANCE DIRECTOR DUNCAN AND CITY TREASURER PUGH Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ATTORNEY FLANDRICK, CITY ENGINEER FRENCH, PLANNING DIRECTOR CHIVETTA, BUILDING SUPERINTENDENT KALBFLEISCH, ACTING CHIEF OF POLICE ADAMS AND CITY CLERK 13ALKUS 00- Mayor Morehead announced that Finance Director Duncan and City Treasurer Pugh were attending a Treasurers and Finance Officers Seminar in Bakersfield. 00- COUNCILWOMAN GREGORY MOVED THAT THE MINUTES OF DECEMBER II, 1963, AND APRIL 7, 1965, BE APPROVED AND FURTHER READING BE WAIVED. COUNCILMAN CRITES SECONDED. The motion carried by the following vote: AYES: COUNCILMEN GREGORY, CRITES, ADAIR MCCARON AND MAYOR MOREHEAD NOES: NONE ABSENT: NONE 00- City Clerk Balkus presented the City Treasurer's Report as of March 31, 1965. As there were no objections,- Mayor Morehead ordered the report received and filed. 00- Mayor Morehead stated that during the month of April each year, whether it was an election year or not, It had been the policy of the Council, since he had been a member, to reorganize in April. Mayor Morehead turned the meeting over to City Clerk Balkus who announced that at this time all of the Council members were on an equal basis, to nominate and elect, and that voting could be accomplished by roll call or secret ballot. Voting was handled by secret ballot. City Clerk Balkus distributed ballots for the election of Mayor and the results proved that ivory D. Crites was elected Mayor by a vote of 3-2. Councilman Morehead received two votes. COUNCILMAN MOREHEAD MOVED THAT THE RECORDS SHOW THAT IVORY D. CRITES WAS ELECTED MAYOR BY A UNANIMOUS VOTE. COUNCILMAN MCCARON SECONDED. There were no objections, the mot ion, carried and was so ordered by CI ty Clerk Balkus. APRIL 21, 1965 7x30 P.M. Morehead was elected Mayor pro tem by a vote o'f 3-2. Councilwoman Gregory received two votes. Councilman Morehead thanked the Council for electing him Mayor pro tem and for their united support during the past year. He stated it had been a privilege and,'pleasure to serve as Mayor; that without enumerating many things that the City had accomplished in the last twelve 12) months, It went without saying; that he had received the full support of the Council and each member of the staff. He extended his thanks to everyone. Newly elected Mayor Crites statled he hoped that he could live up to what was expected of him. Councilman McCaron stated the Council had enjoyed working with Councilman Morehead during the past year and following a policy of rotation he felt this was the appropriate time to make the change; that it had been a very successful year under Councilman Morehead and he had done a very wonderful job. Councilman Adair commented that Councilman Morehead had done an outstanding job. Newly elected Mayor Crites stated he had been very pleased to work with the entire Council; that Councilman Morehead had been very helpful to him;.tha.t being elected Mayor was quite an honor. 00- City Clerk Balkus presented a letter from Hazel Wiley dated April 5, 1965, regarding the City's interest in an abandoned well at 3137 Vineland. Chief Administrative Officer Nordby stated the City had acquired the property In question as tax delinquent pro- perty from the County; that the City owned one 1/4 interest and, two 1/10 Interests; that Mrs. Wiley owned the surrounding property and desired to purchase the City's interest. He recommended that the three parcels be sold to Mrs. Wiley for $100.00 which would cover the cost of the City's acquisition and that the City Clerk be instructed to handle the escrow. COUNCILMAN MOREHEAD MOVED THAT THE THREE 3) PARCELS BE SOLD TO MRS. WILEY FOR $100.00 WHICH WOULD COVER THE COST OF THE CITY'S ACQUISITION AND THAT THE CITY CLERK BE INSTRUCTED TO HANDLE THE ESCROW. COUNCILMAN ADAIR SECONDED. Discussion followed as to whether or not the well was capped and filled wherein City Engineer French brought out that the report to him indicated that the well was capped. City Attorney Fiandrick stated it could be a condition of the sale that the well be capped if It was not now copped and filled if that was appropriate; that there were City Ordin.ances governing this as well as. the Kathy Fiscus Law. Hornbrook Street. COUNCILMAN MOREHEAD MOVED THAT THE AGREEMENT BE AUTHORIZED PURSUANT TO SECTION 9305 OF THE BALDWIN PARK MUNICIPAL CODE. COUNCILMAN ADAIR SECONDED. The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, ADAIR, GREGORY, MCCARON AND MAYOR CRITES NOES: NONE ABSENT: NONE 00- City Clerk Backus presented a letter from John M. Attyah, President, Baldwin Park Bowl, dated April 14, 1965, regarding restricted dancing to juke box music. City Attorney Flandrick commented that if this were granted it would require an amendment to the Code; that the Acting Chief of Police through the Chief, Administrative Officer had recommended denial of the request and against any change In the Code as such; that the feeling was if it was permitted In this location it would therefore be permitted in many other locations which would lead to serious police problems. COUNCILMAN MOREHEAD MOVED THAT THE REQUEST BE DENIED AND CONCUR WITH THE RECOMMENDATION OF THE CHIEF OF POLICE. COUNCILMAN ADAIR SECONDED. The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, ADAIR, GREGORY, MCCARON AND MAYOR CRITES NOES: NONE ABSENT: NONE 00- Referring back to Item No. 2 under Written Communications Councilman McCaron asked why this letter was presented. City Attorney Flandrick explained that the Municipal Code presently required when a lot was proposed for division that either the applicant must dedicate so that there was sufficient street frontage and construct street improvements including curbs, gutters and sidewalks and so forth or, by an agreement, agree to do so; that the City Engineer under the present Code was not authorized to sign these agreements so therefore the Council was asked to authorize the execution of the agreements. Councilman McCaron stated then this was not binding upon the City to approve the lot split in the event that i t d i d not meet tare. Bevel opmen t of tha area. City Attorney Flandrick stated that was correct; that the Planning Director and the City Engineer had indicated, however, if the dedication was made and the street was constructed it would in fact conform to the street pattern and would meet all requirements of the Zoning Ordinance. City AttorneyFlandrick stated that a public hearing was conducted bu,t no decision was ever made; that the Planning Commt'ssion had made a recommendation in 1961 to the Council but as Indicated in the memorandum there was no final action by the City, Council; that due to the passage of time, approximately four years, i t was the staffs recommendation that the CAty Council direct the Planning Commission to initiate-the consideration of the zone change to zone R-3 and thereafter make whatever recommendation to the City Council that was appropriate. COUNCILWOMAN GREGORY MOVED THAT Z-102 BE REFERRED TO THE PLANNING COMMISSION FOR WHATEVER CONSIDERATION WOULD BE NECESSARY. COUNCILMAN MOREHEAD SECONDED. The motion barried by the following vote: AYES: COUNCILMEN MOREHEAD, ADAIR, GREGORY, MCCARON AND MAYOR CRITES NOES: NONE ABSENT: NONE 00- Chief Administrative Officer Nordby reviewed his report concerning the General Services Agreement with the Cdunty of Los Angeles stating that the agreement was first entered into in 1956; that it was renewed in 1960 for a five year period which expires in May; and that he recommended that the City notify the Board of Supervisors of its desire to renew the agreement for a five year period. COUNCILMAN ADAIR MOVED THAT THE CITY NOTIFY THE BOARD OF SUPERVISORS OF ITS DESIRE TO RENEW THE GENERAL SERVICES AGREEMENT FOR A FIVE-YEAR PERIOD. COUNCILMAN MOREHEAD SECONDED. In answer to questions by Councilwoman Gregory, City Attorney Flandrick stated that weed abatement was not included under this agreement; that the termination clause of this agreement-was such that either party could terminate the agreement as of the first day of July of any year upon notice in writing not less than two calendar months prior to the date of termination. RE COVIMERCJAL LOT CLEANING Continued) BIB] 39576-U01 1965-U02 04-U02 21-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116848-U03 DO116910-U03 C4-U03 MINUTES1-U03 5/1/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1965 04 21 CC MINHÄ—@¸—.ªÍ«April 21, 1965 Page 7 City Attorney Flandrick stated that a draft of an ordinance had been placed In the Councils Agenda folders to assist the Council In determining whether this was an advisable type of program to institute; that the Council should be aware that as far as this ordinance was concerned that there were existing provisions under the State Law permitting the weed abatement as such to be conducted either through the consolidated fire district or directly by the city; that there would be certain other sections that should be amended to conform to this type of ordinance if the Council desired to adopt it. In answer to a question by Councilman McCaron, City Attorney Flandrick stated, in his opinion, any time the Council would attempt to abate by a summary pro- ceeding or an administrative proceeding any type of a nuisance such as a burnt out building or structures that were substandard and so forth there must be, to satisfy due process of taw, a public hearing at which time the owner or any person who was interested might appear before the Council and testify on the question as to whether this particular thing was, in fact, a public nuisance. COUNCILMAN MCCARON MOVED THAT A DATE BE SET FOR A HEARING ON THIS ORDINANCE. COUNCILMAN MOREHEAD SECONDED. The motion carried by the following vote: AYES: COUNCILMEN MCCARON, MOREHEAD, ADAIR, GREGORY AND MAYOR CRITES NOES: NONE ABSENT: NONE City Attorney Flandrick brought out that a public hearing was not required on the ordinance; that public hearings would have to be set under the ordinance to determine whether a particular structure was a nuisance. Mayor Crites instructed that a final draft of the ordinance be prepared and presented to the Council. COUNCILMAN MCCARON MOVED THAT THE PREVIOUS MOTION BE RESCINDED. COUNCILMAN MOREHEAD SECONDED. City Attorney Flandrick explained that the proposed change related to compensation for employees injured in the line of duty. Plan; that the City was now faced openly with the need as evidenced by Officer Frank Travis who was struck down and nearly killed by an intoxicated driver; that this potential danger was not unique to the police department;.that none of the employees were immune to injury as the result of their duties'; that in an attempt to support the need of this program, he directed the Council's attention to tangible equipment such as autos and trucks; that these items cost upwards of $1800.00 and were insured with little or no interrogation; that in the case of a man and depending upon his job, the City invests as much as 25 to $30,000 dollars in his training, to a point of maximum efficiency, yet there was no insurance to protect this valuable asset, except Workmen's Compensation; that I.O.D. or injury on duty had been a source of concern for some time; that as it now stood, If an employee was injured in the course of his duties he had no coverage beyond his sick leave and State Compensation; that other cities'have I.O.D. plans incorporated into their State Retirement systems, covering a period of up to one year; that this C,i;ty has no such retirement program;, that he did understand, however, that there was, the posibilityof a State Retirement plan for the City, but It was also understood that this plan, the I.O.D. portion,, covered only public safety employees; that it was felt by the employees that a plan such as was being presented tonight was needed now to fill the void until the-retirrement program was adopted; that if he--was*•correct, only public safety employees would be covered under the retirement plan, and the I.0.D. program would be needed to support the other employees; that the cost of such•a plan, could in the case of extreme injury, wherein a man was off for a full year, be approximately $7,000.00 in salaries; that part of this would be recovered through Workmen's Compensation. He further stated, in closing, that-adoption of an I.O.D. program would give the employee confidence in the City and would greatly reduce the attrition rate and as a consequence the City would no longer be-losing valuable assets to another City because of lack of protection. City Attorney Flandrick stated for many years the Labor Code has had a provision in it that any City or County which had State Retirement as such as a system, any police officer who was injured in the tine of duty was entitled to one year's pay; that in 1963 this was extended to fire personnel that there was s'blIi'presently pending`ta cover all personnel of a city or county in this same respect; that there was pre- cedent for this type of action and it certainly was a proper action in the sense of being legal. Mayor Crites asked If the offended property owner had been satisfied. City Engineer French stated the property owner was happy the fast time he had been in contact with him.
