CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue In accordance with Section 2703 of the Municipal Code the City Council met in open meeting at 7:00 p.m. in the Conference Room for an informal session with the staff to be informed on regular agenda items. The City Council of the City of Baldwin Park met in regular session at the above place at 7:30 p.m. Councilman forehead led the salute to the flag. There were no objections, the motion carried and was so ordered by Mayor Crites. 00- COUNCILMAN MOREHEAD MOVED THAT THE CITY TREASURER'S REPORT AS OF APRIL 30, 1965, BE RECEIVED AND FILED. COUNCILWOMAN GREGORY SECONDED. There were no objections, the motion carried and was so ordered by Mayor Crites. 00- Judge Fred Raab, Citrus Municipal Court, stated that plans bad beefi prepared, in their final form, for an addition to the court house;-that they wanted to-get the next phase of the court expansion program in the County's budget. He showed two charts, the second one showing the population increase in the district beginning back in 1953 and the projected increase in population, the first one showing the increase of the case load at Citrus Municipal Court. He stated that more room was needed before it could be obtained no matter how fast the proceedings were; that whatever the City of Baldwin Park, either the Councilmen and others individually or by group action, might see fit to do to give the project a boost would be appreciated by the judges and others who had been working on the project. In answer to questions by the Council, Judge Raab stated plans had been prepared for two phases; that the next phase would include not only three additional courtrooms but also expand the Clerk's Office to its ultimate size including the library and storage facilities; that there would be nine 9) courts rooms ultimately; that at present there were four 4) judges with three courtrooms and the converted jury room as the fourth courtroom. City Attorney Flandrick stated he had drafted out a resolu- tion that could be considered now or under New Business. Councilwoman Gregory suggested that this be brought up under New Business. Councilman McCaron withdrew the motion. As there were no`objections, Mayor Crites stated the resolution would be considered under New Business. City Clerk Balkus announced that the hour of 8:00 p.m. having arrived that it was the time and place fixed for a public hearing on Short Form 1911 Act on Center Street between Valle Vista Avenue and Palm Avenue. City Clerk'Balkus stated that proper publication, postings and mailings had been accomplished. City Attorney Flandrick stated this matter had been initiated several months ago by the City Council to cause the construction of curbs and gutters in and along certain areas of Center Avenue; that the hearing, although it was a single hearing, encompassed four separate areas: first area located on the easterly side of Center Avenue between Valle Vista and Kinlock Street and this particular area since the preparation of these maps and the staff reports had been completely curbed and guttered so therefore no consideration needed to be given to this area; that the second area was between Kinlock northerly to Palm Avenue on the'west side of Center Street; that the other two areas-in volved were again on Center Street on the west side! between Valle Vista and Adour Place and northerly.,of Adour Place between Adour Place and-.Palm Avenue being the fourth area. City Engineer French stated this was basically a street that was almost complete with the exception of a small amount of curb and gutter; that this affected six 6) property owners out of the four block area; that the solid dark lines on the maps before the Council indicated the curb and gutter necessary to be constructed to finish the street; that the area in red was an area that would have to have temporary construction so that when the other half of Adour Lane was completed it would not be necessary to remove existing curb, gutter and paving. City Clerk Balkus read a written protest from Mr. E. H. Benson, 4063 North Center Street, Baldwin Park. Mr. E. H. Benson, 4063 North Center Street, Baldwin Park, stated he had received a call from his attorney stating that the attorney had been negotiating with the City. City Attorney Flandrick stated for the record that Your remarks are under oath, is that.correct?" Mr. Benson stated That is correct". City Clerk Balkus again administered the oath. Mr. Mike Avilla, 4237 North Center Street, Baldwin Park, stated he was not protesting the construction; that the City Engineer stated this would complete Center Street; that he lived on the other side of Palm and it did not have gutters. He asked why they did not continue on up to Los Angeles Street. Mayor Crites stated this would be another matter; that this should be discussed with the City Engineer; that it could be accomplished under the same type of Act being considered this evening; that he was sure that the City Engineer and City Attorney would be able to help him in drawing up the proper papers and explaining the method of going about it. As there was no one in the audience desiring to speak in behalf of or in opposition to this Short Form 1911 Act, Mayor Crites declared the public hearing closed. City Attorney Flandrick stated in order to obtain juris- diction to order the work he suggested that the Council consider Resolution No. 65-88 as amended, the amendment being in the first full paragraph striking all of the language indicating the description of the area except the language On the east side of Center Street between Palm Avenue and Kinlock Street". Councilman McCaron asked if the curbs now set would allow for the full width of paving for a sixty 60) foot street. City Engineer French stated on the general dedicated sixty 60) foot street there was a forty 40) foot curb to curb section; that in this section of Center, the minimum dedication was fifty 50) feet allowing the City to get a forty 40) foot curb to curb section; that when sidewalks went in there would have to be additional dedication made; that there was not room for sidewalks at this time. The motion carried by the following vote: AYES: COUNCILMEN MOREHEAD, ADAIR, GREGORY, MCCARON-AND MAYOR CRITES NOES: NONE ABSENT: NONE City Attorney Flandrick stated it was his understanding that the City Council wished to take under submission the area on the west side of Center Street between Adour Place and Palm Avenue; that if that being the case since the curbs and gutters had been constructed between Valle Vista and Kinlock on the east side of Center that was as far as action was required at this time. As there were no objections, Mayor Crites ordered that the area on the west side of Center Street 4063 Center Street) between'Adour Place and Palm Avenue be taken under submission for action at the next Council meeting. 00- Mr. Dick Long, 3314 Baldwin Park Boulevard, Baldwin Park, stated his topic was the proposed budget. He read'a portion of the preamble of the proposed budget and stated continuing into the text the projected revenues indicated an approximate eight percent 8%) increase over the 1964-65 projection; that hopefully the tax- payer might anticipate a commensurate decrease in the tax rate; that apparently this was not to be; that a review of appropriations requested created some question which he hoped the Council would ponder with the thought of reflecting the attitudes and wishes of the citizens as stated in the preamble. Page 5 commensurate with the City's revenue and assessed valua- tion and if the City must have a plan was this one that the City could afford. He stated every effort,. had been expended to equalize personnel benefits and salaries of the City employees with that of other cities and asked should not the same zeal be shown for surveying the revenues and assessed valuation of other cities to equate these benefits and salaries as a percent of revenues and valuation; that if Baldwin Park must be compared with other cities let it start by comparing tax rates; that it would be fruitless to make enumerable surveys in order to keep up with other cities; that Baldwin Park's problems were unique as he was sure the Council was very much aware; that with all due respect for the moral of the City employees he believed that the moral of City taxpayers should have priority; that he respectfully offered these comments and urged the Council to transplant the attitudes of the citizens into this budget. 00- Mr. George J. Carr, merchant, 4110 North Maine, Baldwin Park, presented a plan which would increase the parking on Ramona Boulevard and change the crossing at Ramona and Maine. A colored plan was put on the wall at his request which proposed angle parking. He stated that there could still be three 3) lanes of traffic, and a safety lane which would provide space for the people to back out of the parking spaces. Mr. Bart Parker, President, Chamber of Commerce, stated it was proposed that on the north side of the tracks the traffic would be one way traffic going west and on the south side one way traffic going east; that there would be a left hand arrow for making turns north and south as well as east and west; that he thought this plan should be submitted to the City Engineer for study. Mayor Crites stated that the merchants were discussing some centralized parking district and a possible remodeling or face lifting on some of the downtown shopping areas and asked if this suggestion had any relationship to the parking district as such. Mr. Parker stated this could work hand in hand with the other plan. Further discussion followed. Regarding the parking along the railroad tracks, Mr. Bart Parker suggested that later on perhaps there could be two more entries and two more exits for better access. As there were no objections, Mayor Crites stated this would be referred to the Traffic and Safety Committee for study and report. 00- Mr. James Q. Gibson, 13268 East Francisquito, Baldwin Park, stated he was representing the Baldwin Park Improvement Association; that his subject was the Chamber of Commerce; that to be more specific the $16,000.00 that they were asking for in the 1965-66 budget; that they remembered that two or three years ago a request came from the Chamber of Commerce for $10,000.00; that last year it was $12,000.00; that both times there was a request made by the Council that a quarterly report would be made and the money given to the Chamber in quarterly amounts and it would be conti- gent upon the Council being satisfied with the quarterly reports; that last year he believed there was a motion passed by the Council to ask the Chamber for a detailed Continued) GEO. BIB] 39576-U01 1965-U02 05-U02 19-U02 CC-U02 MIN-U02 LI1-U03 FO9994-U03 FO116848-U03 DO116914-U03 C4-U03 MINUTES1-U03 5/1/2008-U04 ROBIN-U04 REGULAR-U05 SESSION-U05 CITY-U06 COUNCIL-U06 1965 05 19 CC MINHÄ—@¸—.èÍ«2371 Regular Meeting of the Baldwin Park City Council type of audited report showing exactly and specifically what the City's money was used for; that so far, to his knowledge, this had not been forthcoming from the Chamber of Commerce; that he did hope when the report was submitted that it would be carefully studied by this group in con- sidering the grant for this next year's budget; that in a grant of this type it was their belief that the money should be used not for ordinary routine expenses but should be used for some type of promotional program, advertising and so forth, with the intention of trying to attract additional business and industry into Baldwin Park thus alleviating the tax structure and, at the same time, be of general benefit to the average citizen, not just the downtown area; that they like to believe that the Chamber of Commerce was working toward this end, however, they had not come up, in their opinion, with any concrete evidence of this for a number of years; that so that there would be no possible reflection on the present Manager of the Chamber of Commerce he wanted to state that he had heard nothing but good about Mr. Cannady and he had heard a lot of that; that he wanted the Chamber of Commerce to know that the Baldwin Park Improvement Association was not opposed to the City subsidizing them but were opposed to the money being used for ordinary routine expenses and nothing being realized out of this promotionally for the City. May 19, 1965 Page 6 Mayor Crites stated that the audit of the books and the report was not due until after the end of the fiscal year. Mr. Bart Parker stated he appreciated the remarks he made; BART PARKER that as a taxpayer he would be the first one to complain if he felt the money of the Chamber of Commerce was used lightly; that he felt the Chamber of Commerce was an arm of the City of Baldwin Park; that a detailed report was submitted each month to the City; that the report not as yet due would be submitted as per the contract; that at the present time the Chamber of Commerce had over two hundred 200) members. He invited Mr. Gibson or anyone else who would like to come to the Membership Dinner, to be held Saturday, May 22, 1965, at the Masonic Lodge. Mr. Dick Long stated that the proof of the pudding was DICK LONG in the eating; that the Chamber's activities should be measured in accordance with its objectives, specifically how much new commerce and industrial development had been derived from the Chamber's activities; that he would like to know their affiliation with the National Chamber of Commerce, their position on the stand that the National Chamber of Commerce had taken which had been contrary to the economic and social goals of the vast majority of the people in this City; that by subsidizing the Chamber of Commerce the National Chamber of Commerce was being sub- sidized; that he thought this group had been very political; that he thought the whole concept of the City's subsidy of the Chamber of Commerce should be seriously questioned; that he thought that statistical standards should be set up; that new industry and building up the assessed valuation was the concern. 00- Mr. Ralph Camp, 14842 Anada Street, Baldwin Park, stated he RALPH CAMP, 14842 was asking the Council for a permit to park one of his Anada St., B.Pk. vehicles on the street overnight; that he had a two car garage but could only park one car in it with ease. City Attorney Flandrick stated the City did not have a provision in the Municipal Code permitting the elimination of the requirement in individual cases for overnight parking; that the granting of this request would require an ordinance change. Discussion followed regarding relocation of the garage and that this would require reconstruction of the garage; that the house had been built five 5) years ago; that the Code prohibited parking in the front, side, or rear ycrd setbacks. Councilman McCaron asked if it would be possible for Mr. Camp to appear before the Board of Zoning Adjust- ments with a request to install a parking pad. City Attorney Flandrick answered yes. 00- Councilwoman Gregory reported she had attended a meeting of the Cities of Los Angeles County Committee of Mayors; that Ruth Burnell was again voted into a full term of office for the Local Agency Formation Committee. 00- Councilwoman Gregory reported she had attended the Board of Directors Meeting of the League of California Cities; that two major revenue and taxation matters which would affect cities of this division were discussed; item one was consideration of the request of Los Angeles County for support on its program seeking legislative authority to increase sales tax by 2¢ both in the incorporated and unincorporated areas of the County; that the State Board of the League of California Cities took the position to oppose the proposal and because of the stand of the State Board the committee felt that the matter had been resolved on a State wide basis and no further action was taken on this matter; that the second item was the Southern California Rapid Transit District giving consideration that they have the power to Invoke on a one time basis only the Unruh provision of the Collier-Unruh Bill which provides for the levying of an additional automobile in lieu tax of 2 of 1% with the revenue principally going to finance rapid transit engineering and development; that in addition the Transit District's proposal includes a request that it be given the right to impose an additional 1% in lieu tax to assist in financing the construction of the rapid transit system; that the committee recommended to the Board of Directors that the League support the proposal; that a voice roll call was taken and the result was 20 Yeas-and 15 Noes. 00- Councilman McCaron reported he had attended the Upper San Gabriel Valley Water Association Meeting; that they were supporting legislation at the State level to allow this area to levy an assessment to the users of the water in this area in order to pay for supplemental water; that as it was now property owners were taxed for the water. 00- Mayor Crites commented that Sargeant Gilman, in a very competitive event of police marksman in the area, placed number 6 in a field of quite a few men. He stated this would add Puente Avenue south of Francisquito Avenue to the City's Select System of Streets; that presently it was a State Highway; that this would automatically put it on the City's Select System of Streets at such time as the State relinquishes•their right to Puente Avenue; that this would allow the City to expend Gas Tax money on this street and, more important, it would make all expenditures on this street eligible for matching credit.
