REGULAR MEETING OF THE BALDNIN PARK CITY COUNCIL JUNE 2, 1965
CITY HALL COUNCIL CHAMBER) 14403 East Pacific Avenue 7:30 P.M.
In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.
Councilman Adair led the salute to the flag. FLAG SALUTE

COUNCILWOMAN GREGORY MOVED THAT THE MINUTES OF MAY 11, 1965, MINUTES OF MAY Ii,

Mr. Alex Vega, 3247 Ivar, Rosemead, stated, along with his ALEX VEGA,
brother Henry Vega, he represented System Construction Company;3247 Ivar, Rosemead
that they were in the business of sewer connections and had
been in the area for some twenty years; that they felt there REPR. SYSTEM CONSTRUk
existed in the City of Baldwin Park a sort of a monopoly by TION COMPANY
one certain company; that they felt this company should not
be issued permits to do sewer connections if none of the RE SBNER CONNECTION4
other contractors were; that the representatives of the 64-A-I)
other company have one big advantage; that they approach
the people and tell them that they were the only ones that
could connect'; that there had been instances where he had
bid $20.00 to $25.00 less and yet the work was being given
to the other contractor because they were using this advantage;
that he felt this situation should be stopped and the laws and
ordinances should be applicable to the other company as well
as to System Construction Company.

Mr. Henry Vega stated that unfair competition was all
they claimed.
Mayor Crites stated that the sewer district was being
constructed under the 1911 Act and belonged to the sewer
contractor until the City accepted it and therefore the
sewer constrictor had complete jurisdiction over it.
Mr. Vega stated he did not wish to argue legalities. He
asked if the 1911 Act allowed the sewer contractor to have
the privilege of connecting before all of the other contractors.
City Attorney Flandrick stated that the district was not
completed yet; that the lines were still under the jurisdic-
tion of the contractor; that if other contractors went in
and did damage to the line the prime contractor would deny
responsibility and the City would be then confronted with
a law suit; that It had been indicated through the
Engineering Department that only emergency hookups would
be permitted by Artukovich or anyone else; that to date
the Engineer had advised him that there had been forty-
nine 49) permits out of some five thousand 5,000)
parcels for house connections; that what Artukovich did
in terms of contacting the people he had no idea; that
that was his right as it was yours": that as'he had indicated
to Mr. Vega in a telephone conversation last week a meeting
had been attempted to be set up for June Ist to make sure
Mr. Artukovich understood this and that whether or not a
hookup was an emergency was'to be determined by the City
Engineer; that Mr. Artukovich could not make the June 1st
meeting and it had been set over to June 4th;
that it would be made clear to Mr. Artukovich and if
Council action was necessary to enforce this that it*was in-
tended to bring it back to the Council and have the Council
so direct him; that the problem was at the moment that the
lines did not belong to the City, they belonged to Artukovich
and were his responsibility; that if they should collapse
or be broken he would repair them; that the agreement between
Artukovich and the City Engineer's Office was that there
would be no hookups except in emergency Circumstances.
Mr. Alex Vega stated their position was to appeal to the
Council to rectify a situation which they thought was unfair;
that they wanted to be on record as having been before
the City Council.
City Attorney Flandrick stated that the Council would be
advised as to the results, if any, of the meeting.
Mayor Crites stated that when the lines were accepted by
the City you" would have the same equal privilege as any
other contractor.

Mr. Joe L. Cale, Big W" Trading Post, 15108 East Arrow
Highway, Baldwin Park, stated they were putting up nothing
more than a small canopy to put some of their furniture
under; that they had complied with all of the City regula-
tions thus far; that they understand they needed blacktop
and were complying with that according to the City Code;
that Mr. Kaibfleisch had been out; that he was here to ask
that curbs and gutters be waived until a later date that
they might go ahead and have more financial capital to
work with.

City Attorney Flandrick stated the Council had in their
Agenda folders a report from Building Superintendent
Kalbfleisch setting forth in the report the provisions of
Section 8106 of the Baldwin Park Municipal Code which
provides the-circumstances under which the Council may
waive the requirement of curbs, gutters and sidewalks.
COUNCILMAN MOREHEAD MOVED THAT THE REQUEST OF JOE L. CALE MOTION MADE AND
NOT BE GRANTED. COUNCILMAN ADAIR SECONDED. The motion CARRIED THAT REQUEST
carried by the following vote: BE DENIED
AYES: COUNCILMEN MOREHEAD, ADAIR, GREGORY,
AND MAYOR CRITES

Mr. Cale asked if he could be advised if this would mean
that all of his other building and money that he had invested
would come to a stand still; that he would not be issued
a building permit to go ahead with this.
City Attorney Flandrick stated that a permit could be issued
but it would be issued conditionally that these improvements
be constructed prior to the issuance of a Certificate of
Occupancy or a cash deposit accepted.
Mr. Cale stated he was attempting to make and present a
nicer looking corner; that he personally could not see
why the curbs and gutters could not be extended for at
least a few months to let them get capital gains on the
improvements.
Mayor Crites stated he understood the request was to waive
the requirements not for an extension of time. He asked
how much time could be extended.
City Attorney Flandrick stated the requirement was a condi-
tion of issuance of a building permit.

Mr. James Q. Gibson, 13268 Francisquito, Baldwin Park, JAMES Q. GIBSON,
cited an experience he had had at the Francisquito rail- 13268 Francisquito,
road crossing on May 29th. He stated that more than one B.Pk.
year ago this matter had been brought up before the City
Council; that there had been two very severe accidents at RE FRANCISQUITO
the crossing; that it had been decided that signals would RAILROAD CROSSING
be put in; that since then he had heard nothing more
about it until last night he saw in the paper that negotia-
tions had been opened with Pacific Electric Railroad for
the installation of a signal at that corner. He asked why
this had gone so long without anything being done about
it? He stated that the paper also stated these negotiations
had been opened by a recent request of the Public Utilities
Commission.
City Engineer French stated since he had been with the City
the City had entered into an agreement with Pacific Electric
for improvement of not only signals but gates on this inter-
section; that the City had agreed to pay approximately
$9,500.00 as the City's share; that the City had also made
application to the Public Utilities Commission for participa-
tion; that this application was now pending before the
Public Utilities Commission; hhat he had a letter in his
office from Pacific Electric that they could not get to
this intersection before September 1965; that the-City
had indication from them that the date could be moved up;
that the City had done as much as they could do; that
Pacific Electric would install the signals themselves.

Mr. Gibson stated he thought there was an abominable
situation existing on the City streets; that no matter
what direction one drives in Baldwin Park there were
holes that had not been attempted to be filled; that
there had been numerous claims against the City regarding
the street condition; that he did not think there was any
excuse for letting a sewer contractor get away with this
type of thing; that he was sure there must be something
in Artukovich's contract to force him to more promptly
fill up the holes.
Mr. Gibson asked what had happened to the public library?
He stated that the Baldwin Park Improvement Association
had put a lot of time and effort into assuring Baldwin
Park people that they would have a new library here and
asked for a report as to what had happened to it.

Deputy City Clark Langseth administered the Oath to those
in the audience desiring to be heard during the meeting.

Deputy City Clerk Langseth announced that the hour of 8:00
p.m. having arrived that it was time and place fixed for a
public hearing on Z-266, an application submitted by Lee
Wheeler, Agent for Eastern Development Corporation for a
change of zone from Zone R-I single family residential
zone) to Zone C-2 general commercial zone), or more
restrictive use on the property located at 12710 Ramona
Boulevard on the southeast corner of Ramona Boulevard and
Syracuse Avenue.
Deputy City Clerk Langseth stated that proper publication,
postings and mailings had been accomplished.
Planning Director Chivetta presented a resume of the case
and stated that the Planning Commission had adopted Resolu-
tion No. PC 65-14 recommending approval of the reclassi-
fication from R-I to C-2. He pointed out the area map
on the wall.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mr. Lee Wheeler, Agent for Eastern Development Corporation,
846 West Foothill Boulevard, Upland, stated he wanted to
point out a map he had presented to the Planning Commission
showing part of their justification for the rezoning of the
property, the major one being the construction of the San
Gabriel River Freeway.
As there was no one else in the audience desiring to speak
in behalf of or in opposition to Z-266, Mayor Crites de-
clared the public hearing closed.

Deputy City Clerk Langseth announced that it was the
time and place fixed for a public hearing on Z-269, an
appeal from denial of the Planning Commission, an applica-
tion submitted by John Elek, et al requesting a change
of zone from Zone R-I single family residential zone)
to Zone C-I neighborhood commercial zone) or more
restrictive use on the property located at 14969,
14973, 14991 East Pacific Avenue.
Deputy City Clerk Langseth announced that proper publica-
tion, postings and mailings had been accomplished.
Planning Director Chivetta presented a resume of the case
and stated that the Planning Commission had adopted Resolu-
tion No. PC 65-16 on May 4, 1965, denying the subject re-
quest; that there were many protests to the reclassification
not only from the abutting property owners but also from the
Planning Commission and City Council of the City of West
Covina expressing their desire that the reclassification
be denied for it would have serious effect on the R-I property
located in their City which was adjacent to the property to
be reclassified. He pointed out the area map on the wall.

TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY TESTIMONY IN BEHALF
MAYOR CRITES.

Mr. Irving Mitrany, 14432 Ragus Street, La Puente, stated IRVING MiTRANY,
some of the information given at the original hearing was 14432 Ragus St.,
slightly wrong; that the only complaint at the time of the La Puente
first notification of the zone change was from one person,
not numerous persons; that the person made the statement
that the traffic was fast there and the slowing down of
traffic would create a noise problem; that he had stated
the speed limit was 35 m.p.h.; that in checking he found
that right in front on the property it was posted 25 m.p.h.
thus anyone going 25 m.p.h. slowing down would not create
a noise problem; that the City of West Covina had not made
any decision at that time, they wanted to hear it, think it
over and come to some decision; that it had been stated this
was spot zoning; that a zone change was normally spot zoning;
that if he wanted C-I for the property it would be rather
ridiculous to go all the way to where it was commercial on
Puente and change all of the property to C-I when all of
the other properties would not be necessary; that a second
thought given by the opposition was that this was against the
General Plan; that the General Plan had been changed; that
what was good yesterday did not necessarily mean it was
good for today; that Baldwin Park was a progressive City
and it was growing; that he felt by putting in the drive-in
that it would be going along with progress; that some of the
neighbors were told by a certain party that a garage was
going in and that milk trucks would be going through the
back yard at 4:00 a.m. creating a terrible noise; that this
was not true; that there would be no cows; that this was a
mere milk store; that deliveries would be made about 9-11:00
a.m. just as was being done down the street; that there was
need for this and the people were for it; that they had
talked with many people; that he felt by the mere fact that
there were businesses constantly opening up in this area that
the general trend seems to be that the General Plan was chang-
ing and that it would eventually be a business street; that
unfortunately the City of West Covina had no businesses on
their section; that the street had been widened to sixty 60)
foot width; that he felt with the new information he had
added that he should be justified in having the property changed
to C-I so that he might have the opportunity to put in a
drive-in milk store to service the people; that there was a
need and a demand for it; that it was the coming thing; that
the building was there and nothing was going to be changed;
that the building was designed for a drive-in store; that
the driveways were already there; that the building had
been there for years empty and this was a loss of taxes
for the City of Baldwin Park; that he felt he should have
the right to have this zone change to C-I.
Ruth M. Housman, 597 Hanopy, Pomona, stated she owned RUTH M. HOUSMAN,
the property at 14969 Pacific Avenue; that it was a rented 597 Hanopy, Pomona
residence; that she had no intention of ever selling it
for commercial purposes; that she would like to see the
zone change.

and Pronto Market going in at the corner of Puente and
Pacific; that the two locations were only 1/2 mile apart;
that under the Master Plan the C-I zoning was developed
as a nieghborhood type development; that under the Master
Plan it would be limited to one ii) mile minimum C-I
zoning; that with the C-I use they could have any use
listed under the C-I zoning; that originally the stand was
used for an egg stand when the property was a chicken farm;
that he did not believe there was any intent under the
Master Plan to design this property for commercial use;
that under the Master Plan it was designated as low density
residential within this general area.
Mr. Joseph Coulombe, 4034 Buckingham Road, Los Angeles, JOSEPH COULOMBE,
stated he was the President of Pronto Market; that they 4034 Buckingham Rd.,
operated a chain of twelve 12) convenience markets in L. A.
Los Angeles and Orange Counties; that last November
they had executed a lease of the premises to be con-,
structed for them at the southeast corner of Pacific
and Puente; that in making this committment to pay about
$55,000.00 in rent over the next ten 00) years they had
relied naturally upon the existing zoning of the City;
that in a growing City like Baldwin Palk they realized
from time to time there would be realignments of zoning
under the Master Plan; that certainly they would not
normally expect a small parcel to be scot rezoned in the
middle of one of the nicest resi;.entia; districts in the
City; that he felt this rezoning would obviously be detri-
mental to their business since a'-)cut forty percent 40%)
of items they sold would also be so!a by a drive-in dairy;
that if this property had been zoned C-I last November they
might very well not have signed ti,e tease; that therefore
they respectfully requested that the zone change be denied.
IN REBUTTAL Mr. Irving Mitrany stated the property that
was to be for the Pronto Market was c go on the condi-
tion that the property Itself was C-i; that up to the time
that he had made his application no application by Pronto
Market or by anyone was masse to have that zoned C-I; that
he felt first come first served; that he made the first
application and felt that he should be heard and judged
first.
Planning Director Chivetta asked if he was referring to
the southeasterly or southwesterly corner of Puente and
Pacific and stated as Mr. Metrory could see it was C-i
and had been since he had been with the City.
Mr. Mitrany stated he was competition and he did not feel
that the City should be put in.the position to where they
must use their power to stop the competition.
Mr. Coulombe stated the two lots which had been purchased
by the developers of the shopping center were zoned C-I
at the time of the purchase of the lots; that there had
been no zone change involved to the best of their knowledge.

Regular Meeting of the Baldwin Park City Council
Deputy City Clerk Langseth announced that it,Was the time
and place fixed for a public hearing on ZV-116, an appeal
from the denial of the Board of Zoning Adjustments, an
application submitted by Ralph and Helen Smith requesting
a Zone Variance to vary with the Zoning Code, No. 357,
Division 1, Section 9551, Permitted Uses" ttte,R-I Zone,
to convert four 4) single family residences Ato duplex
units, on certain real property located at 4752, 4750 and
4748 Bresee Avenue.

Deputy City Clerk Langseth stated that proper publication,
postings and mailings had been accomplished.
Planning Director Chivetta presented a resume of the case
and stated that the Board of. Zoning Adjustments had
adopted a resolution of denial, BZA 65-31, on May 12, 1965,
for the reason that the applicant failed to show reasonable
hardship for the granting of the same. He pointed out an
area map on the wall.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mr. Ralph Smith, 14219 East Ohio, Baldwin Park, stated
he would only be converting three residences; that he
had a financial interest on the second trust deed on the
property which was not at the time of construction; that
after Mr. Berthel converted the residences he took the
property back in lieu of foreclosure; that the houses were
over built for the area; that they were on 5,000 square
foot lots and 1,400 square feet per house; that the
houses were so arranged and so constructed that by blanking
out two doors in the houses they were converted to duplexes;
that he had nothing to do with the property at the time of
conversion nor did he know that they had been converted in
violation of the ordinances of the City; that the houses
were so situated on the lots so that they were difficult
to rent; that the center house had no yard space. He
passed out plot plans showing the existing blacktop. He
stated that it worked a hardship from the standpoint that
the rent he had been able to get for the two houses rented
did not cover the payments on the first trust deed or the
taxes and insurance. He outlined his financial obligations
stating he came before the Council to try to plead his'case
to show he did have a financial problem and that being able
to convert the units into duplexes would enlarge the income
of the properties and overcome the pay out; that the area
was in the vicinity-of the schools and also in the vicinity
of a future industrial development; that there was no play
area for children by the houses and since the houses were
three 3) bedroom and family room they had to rented to
persons with children; that as one bedroom duplexes he
would rent only to persons with only one child under school
age).
As there was no one else in the audience desiring to speak
either in behalf of or in opposition to ZV-116, Mayor
Crites declared the public hearing closed.

Mr. Ralph Smith asked if it would be'possible to have a
study made by the Planning Commission for rezoning of
the area.
Councilman Morehead stated he did not see a need for a
study:;,that it was stipulated as R-1 by the Master Plan.
Mr. Smith pointed out that there were a number of rentals
in the area.

Councilman Morehead reported that a week ago last Wednesday COUNCILMAN MOREHEAD
he had attended the Regional Library Meeting in West Covina; RE REGIONAL LIBRARY
that W. Geller, County Librarian, had stated. the properly for G.
the library in Baldwin Park was not out of escrow; that
it was expected to be out of escrow shortly and at that
time he would meet with Mr. Nordby and the City and the
planning would start from there.
Chief Administrative Officer Nordby stated he had not heard
any new developments as far as the acquisition of the property
was concerned; that regarding the construction the City was
a third party; that the County acquired the land and con-
structed the library; that they were faced with the problem
of expanding at the present location and committing them-
selves to five years rent; that this was trying to be over-
come by relocating the facility so as not to be involved
with the inadequate quarters; that during the last two
months studies had been made with the objective of making
certain recommendations to the Board of Supervisors; that
the studies consisted of first of all meeting with the City
Manager and Finance Director of La Puente to study their
system of financing a civic center; that subsequent he had
met several times with the firm of William J. Moran, a con-
sulting firm which handled totally the construction of public
facilities; that he felt if the City took an aggressive
position it would accelerate the construction of the library
by at least two years; that he had met with George Dickerson
and Leon Norman, financing consultant, concerning the William
J. Moran plan; that this particular plan was used in the
building of the same type of facility in Duarte; that at
this time there was not firm enough Information to release.

Councilwoman Gregory reported that the East San Gabriel
Valley Planning Committee held their last meeting of the
year on May 27, 1965; that Mayor pro tem Harvey Krieger
of West Covina was elected Chairman; that Mayor pro
tem Pat Noranda of Irwindole was elected Vice Chairman
for the coming year.

Mayor Crites reported that he had attended the Sanitation
District 15 meeting last week; that it"had been reported
that the Board of Directors of the districts of Southern
California planned to obtain another dump site for solid
fill materials that would last another one hundred 100)
years; and that the County operated facilities in this
general area had at least a twenty 20) to fifty 50) years.

wise might be due from February 1965 and dismissing this
count in the complaint filed by them against the City.

Councilwoman Gregory asked if the joint session could be
set up between the Board of Zoning Adjustments, Planning
Commission and City Council.
Mayor Crites stated he had appeared before the Planning
Commission and they were in favor of such a meeting;
that he had not appeared before the Board of Zoning
Adjustments.
Councilwoman Gregory suggested that the date be set
tentatively for June 30, 1965.
Mayor Crites stated this would be handled as an adjourned
meeting of the City Council; that an invitation would be
extended to them to attend and a report would be made
back to the City Council as soon as possible.

to forward them to the City's insurance carrier for
processing as well as to Mr. Artukovich with a letter
recommending that he take appropriate action.
