In accordance with Section 2703 of the Municipal-Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff
to be informed on regular agenda items.
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.

Hannah regarding penalties on unpaid license fees.

Mr. Wallis C. Hannah, 841 South Hollenbeck, West Covina
stated he thought the taxation was taxation without
representation. He asked what additional services were
given for the taxes and stated that the people who owned
property in this area were already taxed for curbs, gutt)r'si
sidewalks and sewers; that this was tax upon top of tax in
his opinion; that because the surrounding cities had tnis
tax for rental units he supposed Baldwin Park should too.
He reviewed the taxes on his property and stated he was
not the only one concerned about this taxation without
representation; that he thought it was high time as a
group of citizenry and a group of intelligentsia that
we" look into this thing called taxes, taxes, taxes".

Mayor Crites stated the interest charge or tax as Mr.
Hannah called it was not an interest charge but a pen-`
alty for failure to pay license fees; that it was
customary and it was the practice of most of the cities
In this area to license as a business any kind of busi-
ness that operates within the city limits. He further
stated that the City tax rate was $.61 per $100.00 of
assessed valuation and that was currently based on a
twenty percent 201.) assessment ratio.
Mr. Hannah stated he wanted to know what services they
got from the City; that he had called on various occasions
for street sweeping and had received very little response;
that he would say one thing that the City did have a good
Police Department.
Chief Administrative Officer Nordby stated that,as an
example, If the $.61 tax rate was applied to the total
roughly 40 million assessed valuation It would pay for less
than one-half of the Police Department; that he would be
happy to discuss the problem with Mr. Hannah at any time
he would care to come into the office.

RESOLUTION NO. 65-115
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ESTABLISHING
CERTAIN VEHICULAR TRAFFIC RESTRICTIONS"
City Attorney Flandrick stated it was his understanding
that the Council wished to amend this resolution as pro-
posed to limit the parking on the two areas described in
Section 1 to a period of twenty 20) minutes conforming
with Section 3369 of the Baldwin Park Municipal Code;
that if this was correct Section I would be amended to
read: That the following areas are hereby designated
as twenty 20) minute parking areas pursuant to Section
3369 of the Baldwin Park Municipal Code." Section 2,
line 3 reading signs" should read signs and or curb
markings".

the effect of reducing the speed limit to fifteen miles
per hour on the north side of Ramona Boulevard between

Mr. John Attyah, President, Baldwin Park Bowl, stated they
wanted a variance and a permit and a dancing license so
that they could have dancing at the bowl with a juke bowl
that the ordinance prohibits this In Baldwin Park;that
their thoughts were that perhaps they might be different
In that this was a family recreation center and they had
a number of activities; that it was his understanding
the reason that dancing was not permitted with sound
system records was because it created an additional
problem for the Police Department; that anything they
might have to suggest if this was going to be the case
even remotely then they were not interested because their
operation was more than just dancing, dining, billiard
room or bowling; that it was to their interest not to
create anything that even remotely had to do with more
problems. He passed to the Council a list of why a dance
permit should be Issued permitting dancing with the Seeburg
Sound System juke box). He further stated that he was
fairly sure theirs was the only bowling center in Baldwin
Park and looking ahead five or ten years he would guess at
most there would be one more, if that; that they were
unique in this Instance.

Councilwoman Gregory asked if he had talked with the Chief
of Police regarding this wherein Mr. Attyah stated yes.

Chief of Police Adams stated he had had quite a lengthq~
conversation with Mr. Attyah and he had explained to Mr.
Attyah the numerous problems that had presented them-
selves In the past.
City Attorney Flandrick suggested that Mr. Attyah submit
this to the Chief, Mr. Nordby and himself; that he had
some comments on the existing ordinance and how it would
have to be changed to accomplish what was desired; that
he thought a complete staff report would be appropriate.
As there were no objections, Mayor Crites stated this would
be passed on to the persons just named for a study and
report back to the Council.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for a
public hearing on Z-271, an appeal from denial of the
Planning Commission, an application submitted by Leonard
Rifkin, M.D. requesting a Zone Change from Zone R-I
single family residential zone) to Zone C-1 neighborhood
commercial zone) or more restrictive use on the property
located at IL1L.i8 Cavette Place.
City Clerk Balkus stated that proper publication, postings
and mailings had been accomplished and that the applicant
requested a continuance of the hearing.

Chief Administrative Officer Nordby reviewed his report RE PUBLIC NUISANCE
regarding the Public Nuisance Ordinance. ORDINANCE
City Attorney Flandrick stated that he and Mr. Nordby had
met with several of the judges from Citrus Municipal
Court to review this ordinance; that there were some minor
administrative changes to be made and if acceptable to
the Council the staff would submit the ordinance for TO BE SUBMITTED FOR
introduction at the next regular meeting. INTRODUCTION AT NEXT

Chief Administrative Officer Nordby reviewed his report CHAMBER OF COMMERCE
regarding the Chamber of Commerce Agreement for 1965-66 AGREEMENT'
stating that there were minor changes one of which was
the total amount of the contract and in lieu of the
separate report on activities Mr. Cannady had discussed
with him using the minutes from the meetings in lieu of
this report as the activities were outlined in the
minutes.
Councilman McCaron, regarding Section 3, suggested that the
financial statement be received after the expiration of the
agreement in order to get the full year's report.

Chief Administrative Officer Nordby reviewed his report
regarding Resolution No. 65-I13 which if adopted would
appoint the Chief Engineer of the Fire Protection District
as the City Fire Chief.
In answer to a question by Councilwoman Gregory, City
Attorney Flandrick stated the purpose of the request of
the County for this resolution was that the City had adopted
a Fire Code which states that the Fire Chief will do certain
things and the adoption of this resolution would justify
his actions in the City.
Chief Administrative Officer Nordby read a portion of Mr.
Golden's of the C),unty) letter dated June, 1965.
City Attorney Flandrick explained that this was an
administrative situation facing all contract cities.

pressure move If the cities back this prior to any recom-
mendation from the Fire Department as to whether or not
they would accept the responsibility.

City Engineer French stated no; that it called for curbs
on the south side of Ramona from Franclsquito to Syracuse
and curbs on the north side of Ramona from Prancisquito to
approximately six hundred 600) feet east of Barnes with
an asphalt curb or berm where street will be widened and
adjoin Irwindale.
Councilwoman Gregory stated she did not believe that It
should be an asphaltic berm; that it should be equal on
both sides. She asked why this berm was specified.

City Engineer French stated where Ramona Boulevard came
into the City of Irwindale, Baldwin Park was resrricted
on improving a street that would be under the jurlE,diction
of Irwindale; that rather than put in something that would be
concrete and would have to be torn out and then set back the
specifications called for an asphaltic curb which could
be taken out without destroying or disturbing the street
at such time as it would be widened; that there was not
the proper width of street through this area; that the
section from Syracyse to the bridge was where the
interchange with the Rivergrade Freeway wou!d be and
the final grades and widths had nor been officially
established by the State Division of Highways and any-
thing constructed there would have to be altered; that
the asphaltic berm was cheaper than concrete curb and
would provide the drainage and protection without a
complete section.
Councilwoman Gregory suggested putting the cement curbing
on the City property on the north side of Ramona Boulevard
instead of on tfe.Pacific Electr.ic right-of-way.
City Engineer French stated the property belonged to
Pacific Electric but it was in the City of Irwindale.
He stated that by putting in a permanent curb this was
in effect saying this was the ultimate width of the
street, but this was not the desired ultimate width;
that this was identical to the situation on Los Angeles
Street where Irwindale was on both sides and the widen-
Ing would fall under the jurisdiction of Irwindale.

City Engineer French reviewed his report on the survey and SURVEY AND INSPFC-
Inspection for Ramona Boulevard, Gas Tax Project No. 7, TION RAMONA BLV
stating that there was a recommendation in the Council's GAS TAX PROJECT
Agenda folders but since writing this recommendation the NO. 7
City had received information that the surveyors new con-
tract would carry an increase in salary as follows:
Three man survey crew $27.50 per hour; Inspection
$72.00 a day or $9.75 per hour for any fractional part INCREASE IN SALARY
of any day; Office work preparation of grade sheets, FOR SURVEYORS UNDER
etc.) $9.75 per hour. He stated the maximum contract NEW CONTRACT
price would be $4,500.00 for the service to be spread
over the ninety 90) days of construction if it took that
long. He recommended that the City engage the firm of
Walsh-Forkert-Hutchison Civil Engineers, Inc. to perform
this service stating they were a local firm, well staffed
and had provided this service for the City before very
efficiently and very well. He stated he would also like
an authorization for the Mayor and City Clerk to sign en-agree-
ment Incorporating this information.

City Engineer French reviewed his report on appraisals
for Maine Avenue and Baldwin Park Boulevard stating the
City had received almost all of the Title Reports at this
time and It was time to appoint appraisers to appraise
property necessary for the widening; that two appraisers
were needed as It was a gas tax project and the appraisers
would have to be approved. He stated It was recommended that
the staff be authorized to engage Verne Cok. 6f-V6rne. Cox
Company, Pomona, California, and Jerry Morriss of O'Brien,
Mawhenney and Long, Los Angeles, California, to provide
these services. He stated that both the City Attorney and
himself were very familiar with these appraisers; that
they were well qualified.

City Engineer French reviewed his report regarding the
Short Form 1911 Act on the south side of Pacific Avenue
between Ahern Drive and Holly Avenue stating the plans
were almost completed for the widening of this street;
that in approximately forty 40) days a Short Form
contract would be brought to the City Council for approval
to obtain bids for the widening of this section of street
and would like this incorporated with this project.
City Attorney Flandrick stated the date in Section 3 of
Resolution No. 65-114 should be set for August 4, 1965.
In answer to a question by Councilman McCaron, City
Engineer French stated this would be sixty-two 62) feet
of street curb to curb; that there was one block where
he had written letters to all of the property owners
requesting that they come in on a voluntary basis;
that the Improvement could not be forced on that one
block but it would be paved out; that because of the
location of the structures the sidewalks would have
to go adjacent to the curbs; that there was existing
sidewalks on the north side which would have to be
replaced.

lots if the street was not straightened out.
City Engineer French stated the parcel at 13632 Palm
was a little deceptive in that there was b W tine exist-
ing but there was a structure built over it, and the street
was aligned to miss the structure; that actually 13632, 1
13636, 136L2 was developed as one piece.
Regular Meeting of the Baldwin Park City Council
City Engineer French reviewed his report regarding a re-
quest for a petition for initiation of 1911 Act Improve-
ment District stating this was a request from Mr. Ha: rls,
1.356 Durfee, El Monte, to circuiate a 1911 Act petition
to development of an interior street to serve the black
bounded by Ramona, Center, Palm a,nd Walnut. He stated
there was a map In the Councills Agenda Folders indica-
ting the street to be involved; that the crosshatched
area Indicated the property i hat would have to be acquired;
that the area not crosshatched was street that had been
dedicated in the past; that there was one correction; that
the property on the north end of the map, 4.164 had been
dedicated to facilitate the curve of the street; that the
map showed dedication in a straight line. He stated no
action was necessary if there were no objections.
City Attorney Flandrick stated the boundary line would have
to be altered to exclude in its entirety or include in its
entirety.
Councilman McCaron asked If the outlining of the street
was satisfactory to the Engineering Department.
City Engineer French stated yes, it was their recommenda-
tion.

City Attorney Flandrick pointed out a clerical error
on Page 2, Section 9303, the fifth line in the first
full paragraph from the bottom of the page the figure
140 feet" should be 60 feet".
With the approval of the second, Councilman Morehead
added to his motion AS AMENDED".
In answer to a question by Councilman McCaron regarding
9300 b) regarding the monuments set", City Attorney
Flandrick explained that a rough draft of the map would
be submitted and reviewed and thereafter when the plan
was approved the applicant would go to the expense of
preparing the map.

Councilwoman Gregory stated that among the bills mentioned
at a recent League of California Cities meeting was AB 1615,
the Cigarette Tax Bill. She stated it was brought out that
this bill had passed the legislators and was now in the
hands of the Governor; that this was a local option bill
and could bring revenue to the City; that she believed
that action should be taken this evening in Introducing
an ordinance that would Impose the $.02 cigarette tax to
be effective January 1, 1966; that this act might seem
premature but it would be a protective measure prior to
County action; that an approximate amount of revenue to
be brought to the City would be $88,000.00.
COUNCILWOMAN GREGORY MOVED THAT ACTION BE TAKEN THIS EVENING
IN INTRODUCING AN ORDINANCE THAT WOULD IMPOSE THE $.02 CIG-
ARETTE TAX TO BE EFFECTIVE JANUARY 1, 1966; THAT THE CHIEF
ADMINISTRATIVE OFFICER BE DIRECTED TO FORWARD A LETTER TO
THE GOVERNOR INDICATING THAT THE COUNCIL WISHED THIS BILL
TO BE SIGNED IF IT HAD NOT ALREADY BEEN SIGNED. COUNCILMAN

Planning Director Chivetta presented a resume of Resolu-
tion No. PC 65-23 setting forth an Interpretation
classifying Day Nurseries" as an allowable use in the R-l,
R-2, R-3, C-I and C-2 Zones, subject to a Conditional Use
Permit.
Councilwoman Gregory stated she was wondering If Day
Nurseries should not be excluded from the R I Zone to make
this a workable resolution; that Child Care was per-
mitted in the R-I Zone and was working out fairly well be-
cause it was six 6) children or less; that Day Nurseries
would be anywhere from eleven 11) children to fifty 50)
children; that to allow anything this commercial in an
R-1 Zone would be Infringing on the rights of the property
owners.
Discussion followed.
Planning Director Chivetta stated the policies and pro-
cedures of the State Requirements for Day Nurseries was
quite complex; that the Planning Commission was quite
concerned with a permitted use in an R-I Zone but felt
with a Conditional Use Permit and the State regulations
this could be controlled so as not to become obnoxious
or & nuisance to the adjacent property owners.
City Attorney Flandrick stated that, as the Council was
aware, one of the requirements for the issuance of a
Conditional Use Permit was that the Board finds that
there was no interference with the use and enjoyment of
adjacent properties.
Councilman McCaron commented that it might not be
necessary to subject the Board of Zoning Adjustments to
the requests if they became a problem; that they might
be just as bad in R-2 and R-3; that there might be cer-
tain other stipulations that should be made concerning
distances from residences.
Planning Director Chivetta stated a more dense zone and
a buffer of people did not permit this type of use as
being nonobjectionable to the area.
Further discussion followed.
COUNCILMAN MCCARON MOVED THAT THIS BE REFERRED BACK TO
THE PLANNING COMMISSION AND ASK THEM TO PRESENT A FEW MORE
FACTS ON THE R ZONE USAGE WITH THE DAY NURSERIES ADJACENT
TO R PROPERTIES.
Discussion followed that a Conditional Use Permit would
control each application.
The motion died for lack of a second.
