In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.
Councilwoman Gregory led the salute to the flag. FLAG SALUTE

City Attorney Flandrick stated he had given each member of
the Council a folder that had explanatory memoranda
concerning a number of condemnation cases and their
disposition and a brief memorandum on the current disposi-
tion on the attack on the Baldwin Park Zoning Ordinance
by Mrs. Eugenia Igna that resulted in a Judgment of
Dismissal.

City Attorney Flandrick stated he was presenting a resolu-
tion at the request of the City Engineer concerning the
formalization of City policy regarding offers of dedica-
tion. He stated the Council had copies of the resolu-
tion and an explanatory note from the City Engineer; that
the resolution as proposed was broken down into 3 parts;
that the first part was local streets; that the former
policy was that the offers would not be accepted unless
improvements had been constructed or the property owner
had agreed to construct at' his expense; that as far as
improvements were concerned the City would still use its
best efforts to obtain such improvements by zone variance,
issuance of Building Permit under Section 8104 of the
Code that requires construction of these improvements, by
Short Form 1911 Act or sbine other-Special Assessment District,
all of which would be at the expense of the property
owner; that this did not commit the City to a program of
building these improvements unless it was so desired;
that the second part related to future streets; that the
problem in this connection concerned the Board of Zoning
Adjustments as from time to time they were confronted with
a lot split or zone variance, as the case might be, in-
volving a proposed future street that might be shown on
the Master Plan or on a study made by the Planning Depart-
ment at some prior time; that this would be a directive
to the Planning Commission and Board of Zoning Adjustments
that when they were confronted with such a problem the
street as such would be accepted for dedication in con-
formity with a block study which was really a miniature
Master Plan prepared by the Planning Director, and
checked by Engineering and Building, and approved by the
Planning Commission and City Council; that the third aspect
of the resolution would relate to dedication on any street
included on the Select System, primarily the major streets;
that the division was made as to the type of dedication and
the improvements and so forth in terms of unimproved
property and improved property.

Chief Administrative Officer Nordby reported regarding
the letter he had received from the County Librarian,
Mr. Geller, dated July 21, 1965, stating that the land
acquisition for the library site had been recently
concluded; that the schedule for planning was to be
during the current fiscal year, 1965-66; that the County
planned to proceed with the design during this year and
they had the funds to do so; that the following year,
1966-67, the library would be actually constructed; that
the building would have 15,000 square feet; that Mr.
Geller had set up a meeting with his assistant and the
City staff for the near future to work out some of the details
of schedule in proceeding with this project; that the build-
ing would be financed from accrued funds and not on an
extended period of time; that the cost of design and
engineering would be financed from the current budget.

Regular Meeting of the Baldwin Park City Council
City Engineer French reviewed his report concerning the
request for the circulation of a 1911 Act Improvement
District petition for the improvement of Jerry Avenue
south of Ohio Street and Monterey Avenue north of Rocken-
bach Street. He stated the plan of the area to be
covered was in the Council folders; that if the Council
concurred with the circulation of the petition no action
was necessary.
There were no objections.

with the circulation of the petition.

At the request of the Council, City Engineer French read in
full the Traffic Committee Meeting Report of July 28, 1965,
which recommended that a fifteen 15) minute parking zone
not be created in the vicinity of 4724 North Maine and that
crosswalks be painted on all four legs of the intersection
of MacDevitt Street and Paddy Lane.
As there were no objections, Mayor Crites ordered that
the Council concur with the report and that it be filed.

City Engineer French reviewed his report concerning Final
Tract Map No. 23672. He stated that the tract was located
on Dart Street just east of Robinette Avenue and consisted
of seven lots; that the Subdivision Bond, Agreement and
Final Tract Map had been received and were on file in the
City Clerks Office. He recommended that the Council give
final approval to the subdivision and authorize the necessary
officials to sign the tract map by approval of Resolution

City Engineer French reviewed his report on the Award
of bid for the Ramona Boulevard Gas Tax Project No. 7
stating that the bids were opened on July 30, 1965, at
1:30 p.m.; that there were nine bids received; that the
the low bid was $39,602.55 compared to the Engineer's
Estimate of $56,047.88; that the bid was 70.6% of the
Engineer's Estimate. He recommended award to the low
bidder which was Payne-Wheatley and Co., Inc., 153 North
10th Avenue, Upland, California, in the amount of
$39,602.55 and that the Mayor and City Clerk be authorized
to sign the contract to this effect.

City Engineer French stated there was a problem In the
setting of the bid date for the concrete work on Pacific
between Vineland and Depot and on Center Street; that the
bid date had been set for August 3, 1965, and because of
a publication problem this date had been moved up to
August 13, 1965. He requested conourrence of the Council.

City Clerk Balkus stated the next item was a request for
clarification of Z-270; that Ordinance No. 420 was intro-
duced on July 1, 1965 and refers to Planning Commission
Resolution No. P.C. 65-21 which stated in Section 3 that
the Planning Commission recommends approval and that
the proposed reclassification shall not become effective
until such time as the westerly side of Elton Street
abutting the applicant's property had been widened five
5) feet and the curb, gutter and sidewalk relocated.
She stated that the Baldwin Park Municipal Code, Section
8104 a) 2) stated curbs and gutters only shall be
required in M-I and M-2 zones" and asked if it was the
Council's intent to include sidewalks.

REQUIREMENT
City Attorney Flandrick stated if a Building Permit were
obtained on this property curbs and gutters but not side-
walks would be required; that the Planning Commission and
the Council perhaps by inadvertence included in their
comments that they would not give second reading to the
ordinance and approve the zone change until curbs, gutters
and sidewalks were constructed.
City Engineer French stated there were no sidewalks in
the area now; that normally in an M zone, unless there was
a residential use abutting the zone or a strong residential
use in the area, sidewalks were not usually required.
He stated, in his opinion, sidewalks were not necessary
with an industrial use.

having arrived that it was the time and place fixed for
the continuation of a public hearing on Z-271, an appeal
from denial of the Planning Commission, an application
submitted by Leonard Rifkin, M.D. requesting a zone change

fixed for a public hearing on Z-102, an application
initiated by the Baldwin Park City Council for a change
of zone from Zone R-I single family residential zone) to
Zone R-3 heavy multiple family residential zone) or more
restrictive use upon a parcel of land located at 14248 and
14254 Clark Street.
City Clerk Balkus stated that proper publication, postings
and mailings had been accomplished.
Planning Director Chivetta presented a resume of the case
and stated that the Planning Commission had adopted Resolu-
tion No. PC 65-25 on July 6, 1965, recommending approval of
the request and that the proposed reclassification not
become effective until such time as the applicant has
dedicated that area five 5) feet in depth by eighty-eight
88) feet in width fronting on Clark Street for future
widening of said street, and that area sixty 60) feet by
eighty-eight 88) feet for future Shadylawn Place; and that
the applicant has installed all Improvements therein
including curbs, gutters, sidewalks, street paving and
street trees to City specifications for both areas. He
stated an agreement and easement deed had been sent to
the applicant, Mr. Britt, by the City Engineer and Mr. Britt
had agreed to sign the agreement and the dedication.
TESTIMONY IN BEHALF OF THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mr. Donald Britt, 158 South Bandy, West Covina, thanked the
Council for reinstituting this matter and stated he be-
lieved in this particular area and its proximity to the
downtown area of Baldwin Park that it was very validly to be
considered as R-3 property; that he was willing to
dedicate the street and the five 5) foot on Clark; that
he believed it would be an improvement to the community
and he trusted that the shopping center would go along
as scheduled.
Mr. Britt stated he was also happy to hear the information
about the library.
TESTIMONY IN OPPOSITION TO THE REQUEST WAS CALLED FOR BY
MAYOR CRITES.
Mrs. Faye Hickey, 14322 Gage Street, Baldwin Park, stated
this City did not need more apartments; that she did not
think it would help the shopping center.

Building Superintendent Kalbfleisch stated he recommended
that the City Council adopt the 1965 Uniform Wiring Code;
that this was proposed to be adopted verbatim with the
exception that the Electrical Safety Engineer was to be
designated as the Building Official. He recommended that
the 1962 National Electrical Code exist as it was at the
present time. He recommended that the City Council adopt
the 1964UUniform Plumbing Code stating that the amend-
ments were to be as existed prior to this time. He
recommended that the City Council adopt the 1964 Uniform
Heating and Comfort Cooling Code verbatim with the excep-
tion that the Administrative Authority was to be designated
as the Building Official. He recommended that the City
Council adopt the 1964 Uniform Building Code with the
amendments as proposed by Ordinance No. 417; that the major
amendments were in Chapters 2 and 3 pertaining mostly to
administration of the Code; that the major changes in the
1964 Uniform Building Code were in Chapter 33.
