REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL AUGUST 18, 1965

In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. In the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in regular
session at the above place at 7:30 p.m.
Councilman McCaron led the salute to the flag.

Chief Administrative Officer Nordby reviewed his report
on future expenditures from unapp-opriated find balance.
He stated no action was necessary at this time and that
he might add one or two items to this report far the
Council's consideration at the next meeting.

Chief Administrative Officer Nordby stated that on Thursday
August 26, 1965, at 8:00 p.m. there would be a public
meeting in the Civic Auditorium on the subject of Rapid
Transit. He stated that Mayor Harry Faull of Pomona,
who was the Chairman of the Rapid Transit District Board,
maid be the a pecker.

City Engineer French reviewed his report regarding the
completion of Los Angeles Street Gas Tax Project No. 9
and recommended that the City Council accept the construc-
tion and order the City Engineer to file a Notice of
Completion.

THE CONSTRUCTION AND ORDER THE CITY ENGINEER TO FILE A

City Engineer French reviewed his report regarding the
request for the circulation of a 1911 Act petition for
the improvement of Shadylawn Place from its existing
terminus to the point where it abuts the shopping center
on Maine Avenue. He stated no action was necessary if
the Council was in accord with the circulation of the
petition.

City Engineer French reviewed his report on the street
pattern in the vicinity of Van Wig Avenue and Millbury
Avenue, Lot Split No. 680. He stated he was requesting
the consent of the Council to continue processing the
lot split and initiation of the necessary action to
amend the General Plan to eliminate the proposed
Falconer Street between Millbury and Van Wig and
Van Wig and Puente. He stated that Title Reports should
be obtained to ascertain title and a report made to
the Planning Commission for the initiation of the
amendment.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL INSTRUCT
THE STAFF TO GO AHEAD AND PROCESS LOT SPLIT NO. 680 AND
TO INITIATE THE NECESSARY PROCEEDINGS TO VACATE A SMALL
SECTION OF FALCONER STREET, OBTAIN TITLE REPORTS TO AS-
CERTA I N TITLE AND TO MAKE A REPORT TO THE PLANNING COMMIS-
SION FOR THE INITIATION OF THE AMENDMENT. COUNCILMAN
ADA I R SECONDED.
Mayor pro tem Gregory asked if it was necessary to process
the lot split before the Council obtained a report from
the Planning Commission; that the Planning Commission was
responsible for the changes by public hearing; that the
Council might be doing something in conflict with what the
Planning Commission might want to do.
City Engineer French stated this was true but the Council
based upon the recommendation of the Planning Commission
had already violated the Community Design; that he did
not believe anything was being done out of line; that he
felt it was somewhat unfair to delay the applicant of the
lot split when he could have put in the improvements and
dedicated the streets and had the lot split approved;
that they did fit every alignment that previously had been
layed out for the area; that he felt it would be unjust
hardship to the applicant of the lot split by making him
wait while all of the vacation proceedings went through.

Engineer French stated that Lot Split No. 531 was
recommended by the Planning Commission to the City Council
and the City Council approved It.

City Engineer French reviewed his report on the award of
bid for the construction of curb, gutter, sidewalk and
drive approach on Pacific Avenue between Vineland Avenue
and Depot' Avenue and construction of curb and gutters
on Center Street between Valley Vista Avenue and Palm
Avenue. He stated that on August 13, 1965, at 1100 p.m.
five bids were received and opened and that it was
recommended that the award be made to Aztec Construction
Company, 449 West Gladstone Avenue, Azusa, California,
in the amount of $5,860.36.
COUNCILMAN MOREHEAD MOVED THAT THE CITY COUNCIL AWARD
THE BID TO THE FIRM OF AZTEC CONSTRUCTION COMPANY, 449
WEST GLADSTONE AVENUE, AZUSA, CALIFORNIA, IN THE AMOUNT
OF $5,860.36. COUNCILMAN ADAIR SECONDED. The motion
carried by the following vote:

City Clerk Balkus.presented a revised Tentative Tract
Map for Tract No. 23692 stating that Mr. Brooks was in
the audience.
City Attorney Flandrick stated as he understood it this
map had been corrected in accordance with the conditions
of approval approved by the City Council on July 21, 1965;
that this was merely a matter of advising the Council
that the conditions so imposed had been complied with.
City Engineer French stated this was correct.
City Attorney Flandrick stated this was merely a matter
of note and file unless the Council had any questions.
Mr. Brooks stated he had nothing to say unless the Council
had any questions; that they had complied with the Planning
Commission and Council and provided the sixty 60) foot
entrance street.

Councilman McCaron commented regarding the letter from The
Metropolitan Water District stating, in his opinion, the
Council should adopt a resolution favoring passage of The
Lower Colorado River Basin Project Act.

City Attorney Flandrick stated he believed there was a
hearing on this Bill within the next several days and
suggested, due to the time, that Chief Administrative
Officer Nordby send a night letter or telegram.
As there were no objections, Mayor pro tem Gregory
directed that a resolution be drafted.

Counci Iman McCaron commented on the letter from the LETTER FROM P.E.
Pacific Electric Railway Company dated August 12, 1965,
stating he believed the Council's action of restricting P.E. TO BE NOTIFIED
parking on the right-of-way would indicate the Council RE COUNCIL ACTION
had taken action and that they should be notified of this. OF RESTRICTING PARK-
ING ON RIGHT-OF-WAY
Councilwoman Gregory stated she had noted that the work
buildings along Depot had been painted gray. She stated
a letter should be sent to Pacific Electric complimenting
them on their fix up, paint up.
Chief Administrative Officer Nordby stated there had been RE COMPLAINT ON
a reoccurrence of a complaint that was made last October NOISE AND SNITCUUNG
concerning the use of the spur Iine parallel to Depot Avenue; OF TRAINS ON SPUR
that he had written to Mr. Lewis reminding him of the LINE PARALLEL TO
action he took to satisfy the property owners. He stated DEPOT
this complaint concerned the noise and the switching of
trains between the hours of 12:00 a.m. and 3:30 a.m.

City Clerk Balkus announced that the hour of 8:00 p.m.
having arrived that it was the time and place fixed for a
public hearing on Z-272, an application submitted by
Lewis Winters for a change of zone from Zone R-3 heavy
multiple residential) zone to Zone C-P commercial-pro-
fessional) zone or more restrictive use upon a parcel
of land located at 3910-3912 Baldwin Park Boulevard.
City Clerk Balkus stated that proper publication, postings,
and mailings had been accomplished.
City Clerk Balkus administered the Oath to those in the
audience desiring to be heard during the meeting.

Regular Meeting of the Baldwin Park City Council
Planning Director Chivetta presented a resume of the case
and stated that the Planning Co mission had adopted Resolu-
tion No. PC 65-29 on July 28, 1965, recommending approval
of the subject request and that the proposed reclassifica-
tion not become effective until such time as the applicant
had dedicated that area twenty 20)'feet in depth by one
hundred fifty 150) feet in width fronting on Baldwin
Park Boulevard for future widening of said street, and that
area ten 10) feet in width by two hundred four 204) feet
in depth along Le Rica Avenue for future street widening
and that the applicant install all Improvements therein:
I.e., curbs, gutters, sidewalks, street paving and street
trees to City specifications for both areas. He stated
it was the recommendation of the staff that the Council
concur with the Planning Commission's resolution. He
pointed out an area map on the wall.
A gentleman stood stating he was the applicant and that
he had nothing to say at this particular time.
In answer to a question by Councilman McCaron, Planning
Director Chivetta stated that the applicant, or his
representative, was in full accord with the dedica-
tions along La Rica and Baldwin Park Boulevard.
As there was no one else in the audience desiring to
speak-in behalf of or in opposition to Z-272, Mayor pro
tem Gregory declared the public hearing closed.
City Clerk Belkus read Ordinance No. 425 by title as

to amending the Baldwin Park Zoning Code by adding Sections

manufacturing restrictive) Zone.

City Attorney Flandrick stated this matter was studied
by the Planning Commission at some length; that the Council
had received a draft of the ordinance at their last meeting
and again had a copy of the ordinance before them; that this
established a new zone, M-R manufacturing restrictive
zone. He stated there was a minor change to the ordinance,
that of listing the M-R zone in Section 9450, which was a
list of all zones in the zoning ordinance. He stated
that other than this change the ordinance was as recommended
by the Planning Commission; that the purpose of the ordinance
was to establish a type of zone which would constitute a buffer
zone between residential zones, and heavy
industrial zones as indicated in the introductory paragraph
and section of the ordinance; that the ordinance itself
established all of the regulations concerning this
particular zone and the question tonight was did the
Council wish to adopt this in its entirety, or amended,
or in part.

City Attorney Flandrick stated he would be on vacation
commencing next week; that Mr. Charles Martin would be
available for any consultations, telephone calls etc.
that might be necessary; that he or someone from their
office would be in attendance at the Planning Commission
and City Council meetings.

As Mr. Stolteben was still not present, City Attorney
Flandrick briefly outlined the problem in connection with
the letter from Cal-Coin Service Company dated August 9,
1965, regarding operating of coin-metered laundry equipment
in privately owned apartment buildings in Baldwin Park.
He stated there was a business license provision that states
if there was a vending machine in the business two busicas
licenses were not required one for store and one for vending
machine operator); that a fee for the machine was required
in the amount of $6.00 plus $.50 for each decal. He stated
that according to the City records this gentleman did not
come under this category.
Chief Administrative Officer Nordby stated the gentleman
claimed that his washing machines were only used by tenants
of the apartment building therefore the income from the
machines was limited; that the gentleman had stated when
he first' started in this business the arrangement was that
the apartment owner provide the facilities and receive 10%

of the gross revenue from the machine; that the vending
machine operators began bidding among themselves and as a
result the apartment owners take had risen to 40%; that
this was the reason the gentleman stated he was concerned
with the license fee of the City; that the City did provide
for a decal for each machine; however in his type of
operation he had machines in the various surrounding
communities in addition to Baldwin Park; that he was sold
a decal for maybe half a dozen machines in a particular
apartment complex; that when one went bad he would take
a machine from his repair shop and replace the one with
the decal and every time he replaced a machine he had to get
a new decal but the one that had the decal which was taken
out might wind up in another city; that the gentleman felt
the imposition of the City's license fee was excessive;
that he could give the Council a more detailed report at
the next meeting if it was so desired; that the Code did
provide an appeal to Council for relief.
As there were no objections, the matter was ordered filed MATTER ORDERED FILED
until such time as the party pursued the matter further.
