The City Council of the City of Baldwin Park met in adjourned regular session at the above place at 7:30 p.m. Mayor Crites led the salute to the flag. Roll Cali: Planning Commission Members Present: CAPRONI, GERALDI, KING AND THOMAS Planning Commission Members Absent: GILMER, KALLEMEYN AND SUTTERFILLD Board of Zoning Adjustments Members Present: DARGUS, CANNADY AND MCGOWAN Board of Zoning Adjustments Members Absent: MARKELL AND STAFFORD AT 7:32 P.M. COUNCILWOMAN GREGORY MOVED THAT THE CITY COUNCIL ADJOURN TO ROOM 100. COUNCILMAN MOREHEAD SECONDED. There were no objections, the motion carried and was so ordered by Mayor Crites. Absent: CITY ATTORNEY FLANDRICK, BUILDING SUPERINTENDENT KALB- FLEISCH, CHIEF OF POLICE ADAMS AND CITY TREASURER PUGH 00- i FLAG SALUTE Present: COUNCILMEN ADAIR, GREGORY, ROLL CALL MCCARON, MOREHEAD AND MAYOR CRITES Also Present: CHIEF ADMINISTRATIVE OFFICER NORDBY, CITY ENGINEER FRENCH, PLANNING DIRECTOR CHIVETTA, FINANCE DIRECTOR DUNCAN AND CITY CLERK BALiOJS ADJ. AT 7:32 P.M. TO ROOM 100 Mayor Crites called the meeting to order in Room 100. The MTG. CALLED TO ORDER Roil Call was again taken and was the same as indicated In IN ROOM 100 the above Roll Call. ROLL CALL 00- Chief Administrative Officer Nordby stated that the Council MUNICIPAL LIGHTING had adopted Resolution No. 65-165 on October 20, 1965, DISTRICT ordering the City Engineer to prepare an assessment diagram, plans and specifications for the Municipal Lighting Dis- ASSESSMENT DIAGRAM, trict; that the Engineering Department was limited in PLANS AND SPECIFICA- staff and it was the staff recommendation to the Council TIONS that the firm of W. J. Lockman, Civil Engineer, Monterey Park, be employed to supply the necessary reports and RES. THAT W. J. LOCK- engineering for the proposed lighting district; that time MAN, CIVIL ENGR. BE was of the essence; that Mr. Lockman had previously worked EMPLOYED TO SUPPLY on assessment districts with the firm of Martin and Flandrick, NEC. REPORTS AND Legal Counsel; that the attachments to the City Engineer's ENGR. FOR PROPOSED memorandum explained the terms; that a time limit was set LIGHTING DISTRICT and also a ceiling as for as cost. City Engineer French reviewed his report on the engineering and assessment spread for the proposed Street Lighting District pointing out that W. J. Lockman was aware that copies of the resolution ordering the work must be filed with the State Board of Equalization by January 1, 1966• and was prepared to meet this schedule. Discussion followed that the City of Baldwin Park would also have to enter into a contract with the Edison Company. COUNCILMAN MCCARON MOVED THAT THE CITY ENTER INTO AN AGREE- MOTION MADE AND AND AWARD THE CIVIL ENGINEER LOCKMAN MENT WITH W J CARRIED THAT CITY PREPARATION OF THE PLANS TO THE COMPANY BASED UPON HIS ENTER INTO AGREEMENT PROPOSAL. COUNCILMAN MOREHEAD SECONDED. WITH CIVIL W. J. LOCKMAN, ENGR., AND Chief Administrative Officer Nordby stated the agreement AWARD PREPARATION OF would be brought back to the Council for approval at the PLANS TO THE CO. next Council Meeting. The motion carried by the following vote: BASED UPON HIS PRO- POSAL AYES: COUNCILMEN MCCARON, MOREHEAD, ADAIR, GREGORY AND MAYOR CRITES NOES: NONE ABSENT: NONE 00- Mayor Crites stated the main purpose of the meeting was to get together informally with the Planning Commission and the Board of Zoning Adjustments to discuss planning for present and future improvements. Chief Administrative Officer Nordby distributed to all present a report dated October 26, 1965 entitled Capital Improvements, Planning and Progress Report". Planning Commissioner King stated the Planning Commission was a recommending body to the Council; that they could not make good recommendations unless they had the backing of the staff; that when the Planning Commission initiated projects they should from time to time be consulted on the projects; that the Planning Commission and staff should work hand in hand. He read the report dated January 12, 1965, from Chief Administrative Officer Nordby to the Planning Commission. He stated they also received reports dated March 12 March 9) and June 28, 1965. He stated that the Planning Commission had sent a letter to the staff on April 12 which indicated the procedure of items to be considered and suggested that the Department Heads most familiar with their own proposed program meet with the Planning Commission from time to time to clarify the items of most importance. He further stated that to his knowledge the Planning Commission had not received the communications they should have; that there was a need to be drawn closer together; that there should be more meetings; that he was willing and glad to spend whatever time was needed, however material from the staff was needed for the Planning Commission to make a good study and recommendation. Councilwoman Gregory stated there should have been another combined meeting in August. She asked if ordinances were automatically given to the Planning Commission and Board of Zoning Adjustments; that she did not think any seminar would help if they did not know the inside problems. City Clerk Balkus explained it was her responsibility to distribute the ordinances according to the distribution set forth in the ordinance; that copies were always available as requested; that the Planning Commission and Board of Zoning Adjustments received copies of the Council Agendas and Minutes. Planning Commissioner Geraldi stated he also thought there was a lack of communication. Planning Commissioner Caproni stated he thought lack of communication was the biggest problem; that the last three adjourned meetings of the Planning Commission were useless because the Planning Commission did not have any staff reports to review; that the Planning Commission was waiting for reports on five or six projects from the Planning Department. Planning Commissioner King stated from what he gathered the Street Lighting project was a very urgent matter; that if there had been time he would have assumed this would have gone to the Planning Commission for study and recommendation; that he heard now that relocations were going to be referred to the Planning Commission; that he thought this matter should have been referred to the Planning Commission before it went to the Council. Planning Commissioner Caproni stated the Planning Commission was waiting on reports regarding highrise and underground utilities, costs, etc.; that it wss$ disconcerting to find you had overlooked things, when you are not aware of, them. Mayor Crites stated that one of the Public Utility Commission members at the League of California Cities Meeting in San Francisco had discussed underground utilities. Planning Commissioner King stated that there had been a lecture on this subject at one of the East San Gabriel Valley Planning Committee meetings; that from the information he had obtained it would cost approximately $150.00 for a normal size lot. Planning Director Chivetta stated the City was notified about one week ago concerning the hearing held by the Public Utilities Commission in Sacramento on this subject; that this would be brought before the Planning Commission for them to determine what they wished to recommend con- cerning this matter. Further discussion followed that the Planning Commission needed reports from the staff; that there was a lack of communication; that the staff was willing to meet with the Planning Commission; that the City Departments were understaffed. Councilwoman Gregory stated the Planning Commission was needed to plan the City even if there was adequate staff; that she did not approve of the urban renewal in the form It was being presented; that If this Planning Commission and Council did not plan the City another Planning Commission and Council would; that she did not think Baldwin Park would stay as it was. Planning Commissioner King stated he thought the public should be aware of the strides the City was making; that the staff should report to the Planning Commission on their thinking; that the Planning Commission should weigh the facts and judge for themselves; that study should be made and then the recommendation of the Planning Commission taken to the Council. Mayor Crites stated it should be stated that the City Government had made a lot of progress; that the Council had generally concurred with the recommendations made by the Planning Commission; that the Council had not concurred a time or two but sometimes had received informa- tion which had not been presented to the Planning Commission. Councilman Adair commented that, in his opinion, the Newsletter benefited the City; that the citizens were being made aware of the happenings and accomplishments; that every effort should be made to get the citizens of Baldwin Park to trade at home. Discussion followed regarding revenue; enforcement of ordinances that now existed; that there was only one Enforcement Officer; that a property owner was required by Code to put in curb, gutter and sidewalk if he put in in excess of $1,000. worth of Improvements on his property; that a Certificate of Occupancy was not given until the improvements were made. Councilman McCaron commented that a program was needed to educate the people as to the necessity of curbs, gutters and sidewalks and then the improvements put in all over the City. He asked how long It would take the Planning Commission to study the different items if they were handled one by one. Planning Commissioner Caproni stated he would say It would take three months to study each item after the staff report was submitted to the Planning Commission. Councilman McCaron stated that a procedure should be SUGGESTED JOINT MTG. set up for transmitting information to all three bodies; EVERY NLNETY 9Of that there should be a joint meeting every ninety 90) DAYS days; that there should be a report from the Board of Zoning Adjustments in general terms as to what they have allowed in the way of land usage; that the Planning Commission could report on what they were doing in the way of planning and any items they have that they want to put forth; that there should be a regular agenda for the meeting. Planning Commissioner Geraldi asked why someone on the staff possibly Mr. Chivetta, could not give the Planning Commission an hours schooling on certain items as they come up or any items they might need in the future. Councilman McCaron stated a general outline first as to just what planning was" would help. Mrs. Dargus stated there was a City ordinance prohibiting signs encroaching on the sidewalks; that the Board of Zoning Adjustments resolution had prohibited this; that the service station at Baldwin Park and Francisquito had their coca cola signs encroaching and also other signs; that on Francisquito near the freeway the Texaco station had been putting their signs out on the sidewalk. Discussion followed regarding the enforcement problem on this type of regulation; that outside display of goods for sale were prohibited in the Zoning Ordinance. City Engineer French stated there was a Code section pro- hibiting the encroachment of signs in the public right- of-way. Mr. Cannady commented that without adequate enforcement any enforcement might be considered discriminating. Discussion followed regarding the placement of light and telephone poles wherein It was brought out by City Engineer French that these companies preferred to serve from the rear wherever possible. Further discussion followed about holding the second reading of an ordinance for a zone change. There was extensive discussion about enforcement problems wherein Chief Administrative Officer Nordby stated that his staff had been informed to notify the department concerned in any violation they might be confronted with; for instance if it was a building violation the Building Department should be notified. Finance Director Duncan stated for budgeting purposes it would be appreciated if a determination could be made as to the items and the precedence of the items for the next fiscal year.
