REGULAR MEETING OF THE BALDWIN PARK CITY COUNCIL NOVEMBER 3, 1965

In accordance with Section 2703 of the Municipal Code the
City Council met in open meeting at 7:00 p.m. in the
Conference Room for an informal session with the staff to
be informed on regular agenda items.
The City Council of the City of Baldwin Park met in
regular session at the above place at 7:30 p.m.

City Attorney Flandrick stated the Council had before them AGREEMENT
copies of a proposed agreement between the City of Baldwin LOCKMAN AND SAGUCH(,
Park and Lockman and Saguchi, Civil Engineers, with reference CIVIL ENGINEERS,
to the work to be done in connection with the Municipal
Lighting District; that this agreement was based ypon the MUNICIPAL LIGHTING
proposal submitted and approved by the Council at the last
meeting.

legislative session; that there was no change in substance;
that the purpose was to amend it so as to permit easier
recording of parcel maps which in effect are lot split
maps; that before there had been difficulties with it, now
there was express authority in the Map Act that required
or permits lot splits to be recorded and that was the
purpose of these changes.

City At Flandrick stated this resolution was a result
of the Council's action taken at'the last meeting wherein

City Clerk Balkus presented a claim against the City CLAIM AGAINST CITY

Chief Administrative Officer Nordby reviewed his report on
the availability of funds for a Christmas tree stating this
was a report which the Council had requested that he
prepare at the last regular meeting; that he had given
the Council in writing some of his thoughts; that funds
were available.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL AUTHORIZE
THE PAYMENT FOR THE TREE. COUNCILMAN ADAIR SECONDED.
Councilwoman Gregory stated that another item had been
brought before the Council by the Traffic Committee at
the last meeting concerning an additional crossing
guard; that there had been some thought that perhaps the
City could not afford that and she asked about this
matter.

Chief Administrative Officer Nordby stated the cost of an CROSSING GUARD
additional crossing guard was estimated to be approximately EXPENDITURE TO
$1,500.00; that he did report that any expenditure for an COME FROM POLICE
additional crossing guard should come from the Police DEPT. BUDGET
Department budget; that there were sufficient funds or would
be sufficient funds during the course of the year to pay for
an additional crossing guard from the Police budget, but in
the other Departments there was a savings too which would
take care of the matter under discussion.

Chief Administrative Officer Nordby reviewed his report
on the bid opening held on October 18, 1965, for the
supplying of one I) 1966 one-half ton pickup truck,
stating the low bidder did not submit a 10% deposit
with his bid; that the second low bidder was a Chevrolet
and third GMC; that there was $93.00 difference in the
two bids; that the fourth bidder came in $.12 over the
third bidder; that the recommendation was that the City
Council authorize the purchase of a GMC for the purposes
stated in the report.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL AWARD THE
BID TO THE THIRD BIDDER AS RECOMMENDED TO REYNOLD'S BUICK
FOR A GMC TRUCK FOR THE TOTAL AMOUNT OF $1,877.20).

Chief Administrative Officer Nordby reviewed his report
requesting for resolutions to set hearing dates to deter-
mine whether or not there are public nuisances at the
addresses indicated. He stated that he had shown the
Council pictures of these premises earlier and the
Council had reports in the Agenda folders from the first
notice to the final request for resolution; that the
City Attorney had reviewed these documents and had
indicated that they were complete.
City Attorney Flandrick read Resolution No. 65-172 by title
as follows:

TIME AND PLACE FOR A HEARING TO
DETERMINE WHETHER CERTAIN BUILDINGS
AND STRUCTURES CONSTITUTE PUBLIC
NUISANCES"
He stated this included all three premises that had been
outlined; that the proposed hearing would be on December 1,
1965, at 8:00 p.m. and at that time there would be staff
evidence presented to indicate the status of these build-
ings and thereafter the staff would request the Council's
determination as to whether the same constitutes a nuisance
that if they did the staff would follow through in accordance
with the provisions of the Code for abatement.
Chief Administrative Officer Nordby stated, for the benefit
of the audience, that the staff intended to bring before the
Council a number of cases similar to these; that the Council
could expect eventually to have hearings at every meeting
concerning public nuisances.

Regular Meeting of the Baldwin Park Cty`Council
Chief Administrative Officer Nordby reviewed his report
concerning the request to suspend the cadet program in
lieu of increase in patrol personnel stating that it
seemed the Selective Service was pretty well wrecking the
cadet program for the time being; that attempts had been
made to get deferments without success by the Chief of
Police by submitting correspondence and making telephone
calls to the Selective Service Board in Pasadena; that
the recommendation was not to permanently suspend the
program, because they felt it was a good one, but to sus-
pend it temporarily; that the proposition before the Council
was exchanging the six 6) cadet positions for five 5)
basic patrolmen positions; that this could be accomplished
without any further increase in the City budget.
Councilwoman Gregory stated she would be very reluctant
to scrub" the cadet program; that she thought through
legislation the Council should do something to retain the
young men and do something towards bettering the position
of the policemen and probably the cadet program could be
the lever used; that, in her opinion, even giving up the
cadet program temporarily would be defeating a purpose;
that she would prefer that the cadet, program stay. She
stated certainly the City could not afford to pay a man
patrolman's wages and have him sitting at the dispatcher's
desk; that she would like to see some thought put in on
retaining the cadet program.
Councilman McCaron asked if the intent was not to recruit
any further patrolmen through the cadet program.
Chief Administrative Officer Nordby stated the idea was
not to recruit anyone who was in the priority draft age
between the ages of 18 and 21; that in the past the City
had found people up to 36 years old and even older with
backgrounds that have been acceptable who were not
subject to the draft and could probably serve very well
as patrolmen with a minimum amount of training; that
it was not recommended that the program be permanently
dispensed with.
Councilman McCaron asked if there was anything that would
prevent the Department from hiring patrolmen without having
to keep a full complement of cadets.
Chief Administrative Officer Nordby stated the staff would
have to receive an approval from the Council for a change
in the Table of Organization; that the Selective Service
Board had taken a firm stand on some of the men that did
not look very encouraging; that there was one deferral granted
for a year based upon the mental capabilities in the
examination but after a year the individual would be gone
for two years anyway.
COUNCILMAN MCCARON MOVED THAT THE CITY COUNCIL SUSPEND THE
CADET PROGRAM UNTIL SUCH TIME AS IT BECOMES NECESSARY TO
REACTIVATE IT.
Mayor Crites asked if it was the intention to cancel the
program out and the men who were in it or let them go as
long as the government would allow them to stay.
Chief Administrative Officer Nordby stated the ones who
were fortunate enough to be able to remain in the program
would not be cancelled. He suggested the Council could
modify the suggestion and permit the staff to put on two
patrolmen and attempt to fill possibly three of the cadet
positions. He stated the Chief of Police had some informa-
tion on the status of the present cadets.

Chief of Police Adams stated at the present time that out
of five 5) members of the cadet program four had received
their physical examinations and their intelligence tests;
that two of the men had rated sufficiently high to rate a
deferral; that of the remaining two it would appear that
within 30 to ninety days they would be inducted; that the
fifth man was twenty-two years old but yet fell within the
limits of the cadet program; that the cadet program was
within the ages of 18 and 23; that this man had been in
the service and would remain with the City unless called
back because of his reserve status. He stated he had
three officers that he might possibly lose who were married
but without a family; that he understood one had received
a letter to go in for his examination.
Councilman Morehead asked the motion maker to withdraw
his motion stating that the reason for this request was
that he had been in conference with Mr. Nordby and the
Chief of Police on this subject and he thought he had
researched this matter and that he had something real
sound that he would like the Council to hear; that his
thinking included a motion.
Councilman McCaron stated he would withdraw the motion MOTION WITHDRAWN
temporarily.
COUNCILMAN MOREHEAD MOVED THAT THE SUSPENSION OF THE CADET MOTION MADE AND
PROGRAM BE HELD FOR FURTHER STUDY AND RESEARCH, AND THAT SECONDED
THE MAYOR IF AVAILABLE OR MAYOR PRO TEM IF AVAILABLE
ATTEMPT TO GET AN APPOINTMENT WITH THE SELECTIVE SERVICE
BOARD IN PASADENA, OR ANY OTHER OFFICE IN THIS AREA THAT
HAS JURISDICTION IN THE SELECTIVE SERVICE SYSTEM, AND
BE ACCOMPANIED BY THE CHIEF OF POLICE OR THE CHIEF ADMINISTRA-
TIVE OFFICER AND MAKE A PERSONAL APPEAL TO THAT BOARD OR
BOARDS ON SUBJECT MATTER OF DEFERRMENT OF PUBLIC SAFETY
PERSONNEL OF ALL AGES. I THINK THIS ROUTE OF COMMUNICATION
WILL BE MORE EFFECTIVE THAN MAIL OR TELEPHONE CONTACTS.
AND THIS COUNCIL ADOPT A URGENCY RESOLUTION COVERING THIS
MATTER AND FORWARD VIA AIR MAIL TO THE SECRETARY OF DEFENSE
GENERAL HERSHEY THE CHIEF OF THE SELECTIVE SERVICE FOR THE
ARMED FORCES. I THINK THAT THIS ACTION IS QUITE NECESSARY,
AND I AM SURE IF THE ABOVE BOARDS OR OFFICE HOLDERS TAKE
ANY ACTION THIS WILL NOT ONLY BENEFIT OUT LOCAL PUBLIC
SAFETY DEPARTMENT BUT ALL PUBLIC SAFETY DEPARTMENTS THROUGHOUT
THESE UNITED STATE.S. I DEFINITELY THINK THIS SUBJECT SHOULD
BE BROUGHT TO THE ATTENTION OF THE ABOVE ADDRESSEES DUE TO
THE FACT OUR COUNTRY IS NOT IN A STATE OF NATIONAL EMERGENCY,
OR IN A STATE OF WAR. I ALSO THINK THAT ANY MEMBER OF ANY
PUBLIC SAFETY DEPARTMENT IS JUST AS IMPORTANT AND NEEDED
PROBABLY MORE IMPORTANT THAN THESE MEMBERS WOULD BE TO THE
ARMED FORCES IN ANY CAPACITY. THE SELECTION AND PHYSICAL
REQUIREMENTS OF MEMBERS OF ANY PUBLIC SAFETY DEPARTMENT,
IN MY OPINION, ARE MORE RIGID THAN THAT OF THE SELECTIVE
SERVICE. I AM SURE THAT 90% OR MORE OF THE PERSONNEL THAT
ARE REJECTED BY VARIOUS PUBLIC SAFETY DEPARTMENTS WOULD BE
SELECTED BY THE SELECTIVE SERVICE SYSTEM DUE TO THE
DIFFERENCE IN THE TWO AGENCIES PHYSICAL REQUIREMENTS. A COPY
OF SUBJECT RESOLUTION TO BE MAILED TO ALL LAW ENFORCING
AGENCIES IN THE LOS ANGELES COUNTY. COUNCILWOMAN GREGORY
SECONDED.
Councilman McCaron stated he thought that there should be
a little latitude left for the Department to work with;
that appealing to someone else to control what is necessary
for immediate action was not a proper course; that the
Department should be allowed to hire someone at the time
they need them; that in the past it had never proved to be
successful to have to depend upon deferments; that the reason
he had made the motion he made was to allow the Department
to have a little latitude and the motion did not mean that
they had to dispense with the present cadets on hand; that
it would allow the Chief to hire other personnel qualified
to handle the job.

Regular Meeting of the Baldwin Park City Council
Mayor Crites stated perhaps what was necessary would be a
combination of the two motions providing for the present
and the future.
Councilman McCaron commented that inasmuch as it was just
stated that the Department had to follow a specified pro-
gram in selecting any new recruits for their Department,
what other procedure is there?
City Attorney Flandrick stated none that he knew of; that
it would depend on how much time the Chief thought the
department had before there were no Cadets left.
Chief of Police Adams stated that it had been 30 days
since the men had been notified; that there would be 60
days left at the most.
City Attorney Flandrick suggested that perhaps if the second
motion were to carry the Council might at the same time
instruct the Chief of Police to commence a recruiting pro-
gram for patrolmen so that at the next Council meeting if
it appeared that there was no success the Council would at
least be in a position to proceed.
Councilman McCaron stated that if the Chief continued to
recruit men that were strictly available for the draft he
was never going to get anywhere.
Councilman Morehead reviewed his motion and then reread
it at the request of Mayor Crites.
COUNCILMAN MCCARON MOVED TO AMEND THE MOTION TO FURTHER
ADD TO IT THAT THE CADET PROGRAM BE SUSPENDED FOR THIRTY
DAYS.
Discussion fol-lowed wherein Councilman McCaron clarified
that he wanted to set a limit on the time in which informa-
tion should be obtained.
COUNCILMAN ADAIR SECONDED.
At the request of Councilman Morehead, Councilman McCaron
with the consent of the second, Councilman Adair, withdrew
the amendment to the main motion.
With the consent of the second COUNCILMAN MOREHEAD AMENDED
HIS MOTION AS MADE TO PROVIDE THAT ALL OF THIS SHALL BE
DONE WITHIN A THIRTY 30) DAY PERIOD.
The motion carried by the following vote:

postings and mailings had been accomplished. MAILINGS
City Attorney Flandrick explained that the purpose of the
hearing was to delete two parcels from Assessment District
64-A-t; that the two parcels were owned by the Los Angeles
Flood Control District; that they would not benefit in any-
way from the improvements in this District; that they could
not be hooked up to any portion of the system; that the
secondary purpose was to permit the recordation of the
assessment diagram as such so that the requirement of pre-
paring metes and bounds descriptions for all of the parcels
could be facilitated and eliminated; that this had now been
recorded; that it would now be appropriate to call for any
objections to the proposed modification of boundaries by ELIMINATING PARCELS
eliminating Parcels I and 2 owned by the Los Angeles Flood I AND 2 LA CO FLOOD

City Engineer French stated that it was a dedicated
alley.
Councilwoman Gregory asked if Live Oak would remain without
curbs and gutters.
City Engineer French stated it was Baldwin Park County Water
District property, and as a part of adopting the Select
System the City entered into an agreement with the City
of Irwindale whereby thay gave the credit or the improvement
of Live Oak to the City of Irwindale for their control in that
the traveled roadway of Live Oak was in the City of Irwindale
on both sides of the street; that they would be dedicating the
parkway and City would not, at this time, suggest that the
dedication be worked out on Live Oak without an arrange-
ment being made with Irwindale for these improvements.

Water District would be required to obtain a permit for
any structure and any electrical installation.

City Engineer French reviewed his report concerning Lot REPORT BY CITY ENGR.
Split No. 693 stating that this lot split was filed with the RE L.S. NO. 693
Engineering Department and processed through the Engineering
and Planning Departments in accordance with the lot split
ordinance; that there was no problem with the street plans,
dedication was one of the requirements; that the applicant
felt that the improvement requirements were excessive in
that a complete improvement of Feather Avenue was required
as it would. extend to Garvey; that this was in the area
of Garvey, Feather and Corak Street by the school at the
intersection of Vineland and Foster; that the applicant
would be willing to dedicate Feather Avenue and a drainage
easement to solve a drainage problem at the end of Feather
Avenue and the additional widening on Francisquito Avenue;
that he would also be willing to release the City of an
obligation of the improvement of Francisquito Avenue that
the City had entered into for the widening if the City
would improve Feather Avenue; that Feather Avenue in all
fairness probably was not a great benefit to this applicant;
that he had C" zoning complete to Garvey Avenue all
along; that he recommended that the City accept this offer
and take the dedications subject to the above conditions.
Councilman McCaron asked what would happen to the small tip
at Garvey and Feather that would be severed from the other
property.
City Engineer French stated it would remain in the title
of the applicant.
City Attorney Flandrick stated that he wondered if some
disposition should not be made on the tip; that it was not
a buildable lot; that there would be problems from both
the City's and the applicant's standpoint.
City Engineer French stated the only practical use would
be to put it with the address of 3060 No. Feather which
was developed; that it be dedicated as part of the street
if they were willing and then the City would be responsible
for maintenance.
Mr. Ernie Kiddell, 920 West Pine Street, West Covina, ERNIE KIDDELL,
stated he represented Mr. Branson who was the owner 920 W. Pine St.,
of the property; that the portion of land left over W. Cov.
had been discussed; that Mr. Branson would like to re-
tain ownership of it; that maybe it would be wiser to
turn the road where they could utilize that sliver of
land and give Mr. Branson back a portion of land taken
from him for the dedication to the City.
City Engineer French stated the City could put a small
radius on the street and turn it; that the only problem
was when this was done land still would be left over.
Mayor Crites asked if there would be objections to having RE DESIGN OF FEATHER

that this would be for the improvement of curbs, gutters

Councilwoman Gregory stated that Planning Director Chivetta RE OVAL RACETRACK
had appeared before the Irwindale Planning Commission and APPLICATION IN
spoke for the Council on behalf of the City regarding the IRWINDALE
oval racetrack; that on November 4, 1965, there was to be
another meeting regarding this matter. She stated that
most of the Council would be tied up with other'elettere and
asked if Mr. Chivetta could again appear in the Council's
behalf if there was an opportunity.
Planning Director Chivetta stated he would try to attend,
however, there was an adjourned meeting of the Planning
Commission that same date.
Discussion followed wherein Planning Director Chivette stated the
public hearing was closed and the matter was taken under
submission at the last meeting.
As there were no objections, Mayor Crites asked City Clerk CITY CLERK BALKUS

Chief Administrative Officer Nordby stated not too long C.A.O. NORDSY
ago an article appeared in two newspapers regarding the RE ARTICLE IN
tax rate in the City of Baldwin Park; that the list NEWSPAPER RE TAX
that appeared indicated the average tax rate as $11.44; RATE IN B.PK.
that this was the first mistake, that this was not the
average tax rate; that the next statement immediately
following was that Baldwin Park was the only community
with a tax rate of over $11.00 per hundred; that this
was mistake Number 2; that there were other communities
in the County of Los Angeles that had tax rates over $(1.00;
that there were unincorporated areas that were not
mentioned that have tax rates of up to $15.00 and $16.00
per hundred; that the reason he brought this out was that
articles of this kind bring a bad reflection on our
community; that it made people apprehensive of purchasing
property or going into business in this City and he thought
some action should be taken to correct this; that he had
written an article that would appear in the next Newsletter
pointing these errors out; that in the City of Baldwin Park
there were forty-three tax code areas; that the average
tax rate of all forty-three tax code areas was $10.89 per
hundred; that whether this was good or bad it pointed out
that Baldwin Park did get some poor publicity; that anyone
writing on taxes should go to an expert or be an expert on taxes.

2(Z09 Regular Meeting of the Baldwin Park City Council
Mr. Gus Nesseth, 4935 North Center Street, Baldwin Park,
recited an incident in which he had received a deed back
on a piece of property on Rockway Drive after the owners
had received their tax bill; that the house was sold for
$18,500.00 and the tax bill was $468.00; that he had
received other calls along this same line and would probably
be receiving other deeds back; that this was a disgusting
situation for a builder who was trying to do the right
thing in Baldwin Park; that a little closer study of the
entire program as far as the City of Baldwin Park was
concerned, the future planning and the entire realm of
reason should be looked into because it was not a very
good situation when the tax rate was this high; that he
realized there were problems all the way down the line; that
when you look into the entire situation as far as average
income of the City of Baldwin Park he thought there should
be a second look.
Chief Administrative Officer Nordby stated he thought the
tax situation had broader applications than Baldwin Park;
that if Mr. Nesseth was not making the application in
general he would not say anything more but if Mr. Nesseth
would stop in his office he would enlighten him on the
tax situation throughout the County.
Mr. Nesseth stated he was quite enlightened on it and could
make quite a dissertation on it if he had to but he
appreciated Mr. Nordby's offer.

City Engineer French reviewed his report regarding the
vacation of a future street in conjunction with Tract
No. 23692 stating that this Tract had received tentative
approval of the City Council; that Lot Split 8 approved
in 1956, required the dedication for future street purposes
an area eighty-five 85) feet long and fifty 50) foot
wide which was to be Stichman Avenue in the future; that
since that time a developer had put together all of the
property within this area and acquired some property from
the Flood Control District and this piece of property did
not fit the future development; that approximately fifteen
15) feet of this area would be outside of the street as
proposed; that it was recommended that the City Council
set a hearing date of December I, 1965, for the vacation
of this section of street outside of the alignment of
Stichman shown on Tract No. 23692.
City Attorney Flandrick stated there was an amendment
to proposed Resolution No. 65-171 in the description of
the property; that in essence the amendment excepted all
of the area included within the property, as described,
that is to be located within the street as shown on the
Tract Map.

COUNCILMAN MOREHEAD MOVED THAT RESOLUTION NO. 65-171 BE
APPROVED AS AMENDED AND THAT FURTHER READING BE WAIVED.
COUNCILWOMAN GREGORY SECONDED. The motion carried by
the following vote:
